HomeMy WebLinkAbout1960 11-28 CCM Regular Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota November 28 1960 The Village Council met in regular session and was called to order by Mayor William Super at 7 :30 P.M. Roll Call: Mayor William Super, Carl Carlson, Clifford Wellman and Russ Jones were present. Trustee Wayne Gageby was absent. Motion by Carl Carlson and seconded by Clifford Wellman to approve the Minutes of the Regular meeting of November 14, 1960, as recorded. Motion carried. Motion by Clifford Wellman and seconded by Russ Jones to approve the Minutes of the Special meeting of November 21, 1960, as corrected. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Street Improvement No. 1960 -60, continued from the meeting of September 26, 1960. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereon in the official newspaper, the last publication being on September 8, 1960, which affidavit was examined and found satisfactory and ordered placed on file. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION DECLARING HEARING UNFAVORABLE FOR THE CONSTRUCTION OF STREET IMPROVEMENT No. 196o -60 WHEREAS, the Village Administrator has recommended that the heaving be declared unfavorable until such time as a method of assessment has been determined, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: That the hearing on Street Improvement Project No. 1960 -60 be declared unfavorable. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof William Super, Russ Jones, Carl Carlson and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption RESOLUTION OF CANCELLATION FROM HENNEPIN COUNTY TAX ROLLS - UNPAID SPECIAL ASSESSMENTS AG03NST PROPERTY OWNED BY THE UNIVERSITY OF MINNESOTA BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: WHEREAS the Village of Brooklyn Center entered into an agreement with the University of Minnesota on the 28th day of June, 1960, a copy of which is -1- included in Council Minutes of October 24 1960, to cancel the unpaid Special Assessments fom the Hennepin County tax rolls and provide for separate accounting of the deferred assessments by the Village on released and unreleased property now owned by the University of Minnesota or by the University of Minnesota and Earle Brown. Member Russ Jones introduced the following resolution and moved its adoption RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Horbal Construction Company has satisfactorily completed the following improvements in accordance with said contract; Sanitary Sewer Laterals and Lift Station, Project Nos. 1960 -15 and 1960 -39• NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved on the recommendation of the Village Engineer. 2. The value of work performed exceeded the original contract amount by $626.14 because of under- estimating of pipe quantities on proposal form. 3. The Village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement projects being $73,433.66. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Russ Jones and Clifford Wellman; and the following voted against the same; None; whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Nodland Construction Company has satisfactorily completed the following improvement in accordance with said contract; Sanitary Sewer Interceptor and Lift Station, Project No. 1959 -19A. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved on the recommendation of the Village Engineer. 2. The value of work performed was less than the original contract amount by $1,047.90 because of over estimating pipe depths and pay cuts on proposal form. 3. The Village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $131,178,85. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following -3- voted in favor thereof: William Super, Russ Jones, Carl Carlson and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION REINSTATING CERTAIN SPECIAL ASSESSMENTS ON PARCEL 5700, AUDITOR'S SUBDIVISION 310 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: WHEREAS the Village Council of the Village of Brooklyn did on October 24, 1960, adopt a resolution entitled "Resolution of Cancellation from Hennepin County Tax Rolls Unpaid Special Assessments Against Property Owned by the University of Minnesota or by the University of Minnesota and Earle Brown ", which removed from the tax rolls an assessment on Parcel 5700 of Plat 89105 in the amount of $2252.88 plus the second half installment payable in 1960 in the amount of $326.42, and WHEREAS this property was in the process of being transferred to School District 286 and has now been transferred to School District 286, and WHEREAS School District 286 has agreed to assume the special assessments, NOW, THEREFORE, BE IT RESOLVED that the County Auditor of Hennepin County be instructed to reinstate to the tax rolls an assessment of $2252.88 under Levy No. 2133, Parcel 5700, Plat 89105, The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof William Super, Clifford Wellman, Carl Carlson and Russ Jones, and the following voted against the same; None; whereupon said resolution was declared duly passed add adopted. Motion by Carl Carlson and seconded by Clifford Wellman to refund the cash escrow money for Soderholm Addition, on the recommendation of the Village Administrator, since all the work has been completed. Motion carried. Motion by Russ Jones and seconded by Carl Carlson to release the bond for Northbrook Manor 4th Addition in the amount of $18,363 upon the filing of a new bond in the amount of $500 to cover boulevard sodding and tree planting on 9 lots on the recommendation of the Village Administrator. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson to agrove the Justice Report of Raymond E. Benson for part of August, September and October, 1960. Motion carried, Motion by Carl Carlson and seconded by Russ Jones to approve the following applications for licenses: Plumbers License — Robert S. Wallen, 8201 17th Avenue South Cesspool Cleaners License - Broadway Cesspool Service, 5821 Camden Avenue. Motion by Russ Jones and seconded by Carl Carlson to purchase a TB35W Wausaw trip plow from Public Works Equipment Company for $515 plus the trade -in of a Ross one - way rigid plow. Motion carried. -4- Motion by Clifford Wellman and seconded by Carl Carlson to uphold the recommendation of the Planning Commission to deny the request of Earle Helwig to move a house from 6632 Osseo Road to 6801 Ewing Avenue. Motion carried. Motion by Russ Jones and seconded by Carl Carlson to retain the services of Diva Penttila to audit the following Village funds for the calendar year 1960: General Fund Park Bond Fund Poor Fund Park Bond Redemption Fund' Certificates of Indebtedness Fund Special Assessment Funds State Loan Fund P.E.R.A. Agency Fund Investment Trust Fund Fire Relief Association Agency Public Utilities Fund Fund Liquor Fund General Bonded Indebtedness Park General Fund Fund General Fixed Asset Fund and the books and records of the Fire Department Relief Association, Russ Jones, Clifford Wellman and Carl Carlson 'voted in favor thereof, and William Super voted against the same. Motion carried. The bills set forth on the schedule attached to these Minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of November 28, 1960" were audited and ordered paid. Motion by Russ Jones and seconded by Carl Carlson to adjourn.
