The Village Council met in regular session and was called to order by
Mayor William N. Super at 7 :30 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson and Russ
Jones were present. Councilman Wayne Gageby was absent.
Motion by Carl Carlson and seconded by Clifford Wellman that the minutes of the
regular meeting of the Vill1ge Council on March 22, 1960 be approved as,recorded
with the following corrections: (1) The effective date of road limits should
be March 28, 196o.instead of April 28, 1960. (2) The date of opening bids for
gravel and oil supplies should be April 11, 1960 instead of April 25, 196 0 -
Motion carried.
The Village Administrator reported the results of bids opened on Sanitary
Sewer Project No. 1960 -5, and recommended that the bids be tabled until the
next meeting.
Motion by Russ Jones and seconded by Carl Carlson to table the bids for
Sanitary; 7 0 — e Project No. 1960 -5 until the next council meeting. Motion

Member''Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING BID
WHEREAS, the Village Administrator and Purchasing Agent have
reported that on March 21, 1960 at 2 :00 P.M. they opened and
tabulated bids received for the furnishing of two altitude
valves and that said bids were as follows:
Dayco Inc. $2,110.00
Michel Sales Co. 2,376.00
Municipal Supply Co. 1944.00
NOW„ THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that the low bid of
Municipal Supply Company in the amount of $1,944.00 is deemed
to be the best bid submitted by a responsible bidder for
village purposes and that said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman
and Russ Jones; and the following voted against the same: None, whereupon
said resolution was declared duly passed and adopted.
Member Russ Jones introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID
WHEREAS, the Village Administrator and Purchasing Agent have
reported that on April 11, 1960 at 2 :00 P.M. they opened and
tabulated bids received for one 1960 Police Car and that said
bids were as follows
Broadway Automotive, Inc. $1359.10 with trade -in'
King Dodge Company 1419.00 with trade -in
NOW,, THEREFORE., BE IT RESOLVED by the Village Council of

bid of Braodway Automotive Inc. in the amount of $1,359.10
is deemed to be the best bid submitted by a responsible
bidder for village purposes and said bid is hereby acce *d.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman and
Russ Jones; and the following voted against the same: None whereupon said
resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and moved its
adoption:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, that the low bid of
Anderson Aggregate for the furnishing of stabilized gravel
and fine aggregate for seal coat is the lowest and best bid
submitted by a responsible bidder for village purposes and
said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, and
Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member Russ Jones introduced the following resolution and moved its
adoption:

Richards Oil Company is deemed to be the lowest and best bid
submitted by a responsible bidder for village purposes and
that said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman and
Russ Jones; and the following voted against the same. None; whereupon said
resolution was declared duly passed and adopted.
Member Wayne Gageby arrived at this point of the meeting.-
Motion by Russ Jones and seconded by Carl Carlson to table the bids
received on Sanitary Sewer Project No. 1960 -6 and Storm Sewer Project No.
1960 -7 until the next meeting. Motion carried,

1960 -20, 1968 -21, 1960-23, 1960 -26, 1960 -28 and 1960 -30.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the

member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne
Gageby and Russ Jones, and the following voted against the same; None;
whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Carl Carlson to uphold
recommendation of the planning commission as recorded in their minutes of
March 21 and April 7, 1960 and approve the preliminary plat of Elsen's
City View 3rd Addition, Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby to refer to the
Village Administrator and the Village Attorney the recommendation of the
planning commission that the zoning ordinance be amended to provide that
outdoor ball parks and skating rinks etc., be allowed by Special permits in
R -1 zone. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman to uphold
the recommendation of the planning commission that the petition for a
variance submitted by E, C. Peterson for a reduction on the zoning ordinance`
requirements for multiple dwellings on his property, which is east of Logan
Avenue North and North of 58th Avenue North be denied because it is too far
below the requirements of the ordinance. Motion carried.
Motion by Wayne Gageby and seconded by Russ Jones that the village
council uphold the recommendation of the planning commission and approve the
preliminary plat of East Palmer Lake Addition as proposed by Hipp Construction
Company. This plat is located West of Logan Avenue North between 69th Avenue
North and 73rd Avenue North, and East of the Palmer Lake Basin. The Planning
Commission also recommends that the village participate in one -half of
construction cost of sanitary sewer lateral (not to include house services)
and the street surfacing only on Oliver Ave ue or ? r the North line of

Lot 1, Block 11, up to Penn Avenue Nort��flr`m "O ve'r Aue North to 73rd
Avenue North, all within Hipp's East Palmer Lake Addition. This participation
and the cost as listed above would be in exchange for the village obtaining
a deed for all of that operty within Hipp's East Palmer Lake Addition lying
Uloe� Ees'b- of Block 1, and Ql of Oliver Avenue and Penn Avenue North. Motion
carried.
Motion by Russ Jones and seconded by Wayne Gageby to uphold
recommendation of the planning commission that the petition for a special
use permit for the construction of a multiple dwelling as submitted by Madsen
Floral Company for their property located between 55th Avenue North and 56th
Avenue North between Camden and Bryant Avenues North be approved with the
following stipulations; on the east side of the property the setback shall
be 10' and the driveway from either 56th Avenue North or 55th Avenue North
to serve this property,,,shall be on the West side of the property, and that.:
approval will be granted upon the submission of acceptable drawings in
performance of those presented and on file with the secretary, Motion carried.

Motion by Russ Jones and seconded by Carl Carlson to uphold the
recommendation of the planning commission that the request for a special
use permit as submitted by Mr. Frank Waite for the construction of a
multiple dwelling unit on the Southeast corner of the intersection of
Quail Avenue North and 63rd Avenue North be denied. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby to uphold the
recommendation of the planning commission that the request for a special
use permit as submitted by the Northwestern Bell Telephone Company to
construct an exchange building between Dupont Avenue North and Emerson.
Avenue North, South of an abutting 65th Avenue North be ,granted, subject to
and providing for the necessary 30' of right -of -way for both Emerson Avenue
North and Dupont Avenue North, and 33' of right -of -way for 65th Avenue North
within their plat, and also that there be provided a minim= of 25 feet green
strip adjacent to any abutting residential property, Motion carried,.
Motion by Carl Carlson and seconded by Russ Jones to uphold
recommendation of the planning commission that the buffer strip be omitted as
requested by Colonial Bldrs. Inc. for their property at the southeast corner
of the intersection of Humboldt Avenue North and 55th Avenue North. This
will permit the omission of a buffer strip along the back part of the lots
adjacent to the existing alley. Motion carried.
Motion by Russ Jones and seconded by Carl Carlson to uphold recommendation
of the planning commission to deny the variance request submitted by Homedale
131drs. and Mr. Ames for reduction in lot area requirements in multiple dwelling
for the property listed as part of Lot 4, Block 5, Wangstad's Brooklyn Terrace
Addition. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman to receive
petitions for sanitary sewer on Aldrich Avenue from 59th Avenue to 61st
Avenue and on Colfax Avenue from 61st Avenue to L:Oac Drive, and Lilac Drive
from 183' North of Colfax Avenue to 150' East of Colfax Avenue, Motion
carried.
Motion by Carl Carlson and seconded by Wayne Gageby to axthorize the
increase of cash regster cash in the village clerk's office from $25.00 to
$100.00, Motion carried.
Motion by Wayne Gageby to commit the Village of Brooklyn Center to
make the following improvements in accordance with the resolution heretofore
identified as Improvement Commitments for VA Loan purposes. Said resolution
sbalihave inserted in it the following:
Property to be improved: Garden City 7th Addition
Estimated Cost: $11,966,60
Date of completion: 12 months
Improvements to be made: Street surfacing, installation of street
signs, trees and boulevard sod and sodding drainage swales in
Garden City 7th Addition,
Builder: Winston Brothers Company
The foregoing motion was duly seconded by Clifford Wellman, and upon vote
being taken thereon the following voted in favor thereof William N. Super,
Carl Carlson, Wayne Gageby, Clifford Wellman and Russ Jones; and the
following voted against the same: None; whereupon said resolution was declared
duly passed and adopted.
Member Clifford Wellman introduced the following resolution and moved
its adoption:

AN ORDINANCE RELATING TO THE APPOINTMENT
OF SPECIAL POLICE OFFICERS IN THE VILLAGE
OF BROOKLYN CENTER AND AMEMING CHAPTER 23
OF THE VILLAGE ORDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS:
Section 1. Chapter 23 of the village ordinances is hereby amended
by adding the following new sections:
Section 23 -701 Appointment of Special Police Officers.
Whenever in the judgment of the Village Council of the Village of
Brooklyn Center it shall be necessary or desirable to increase the
police force of the village temporarily, the Village Council is
empowered to appoint "special police officers ". The appointment
shall designate the time for which the services are to be rendered
and the place. The person appointed shall accept such appointment
in writing and shall take an oath of office to be filed with the
clerk. Any such appointment may be revoked with or without cause
and without notice by the Village Council at any time.
Section 23 -702 AUTHORITY OF SPECIAL POLICE OFFICERS. Persons
appointed special police officers have authority to serve process and
make arrests and do all acts authorized by law to preserve the public
peace and order that other policemen in the village have and their
duties and obligations in that regard shall be the same. It shall
be unlawful for any such person to wear at any public gathering,
or upon any public street or highway, or in any public place whether
on or off duty a uniform or cap of the same color or appearance as
that used by the regular police officers of the Village of Brooklyn
Center,
Section 23 -703 SPECIAL POLICE OFFICER BAD "(EAND GUN. A special
police o fif ic appointed pursuant to this ordinance may wear a special
police officer badge or emblem during the time and in the areas for which
the appointment is made, said badge to be furnished by the Village of
Brooklyn Center upon payment of the sum of $10.00, $5.00 of which shall
be returned to the person upon the termination of such appointment.
No special police officer shall wear a gun or be otherwise armed
unless such authority is included in the appointment, and such gun may
be worn only during the time and in the areas for which the appointment
is made. It shall be unlawful for any special police officer to wear
or exhibit his badge or to wear a gun except as provided herein.
Section 23 -701+ AUTHORITY RESTRICTION. It shall be unlawful for
any person commissioned as a special police officer to exercise any

police authority or act as a policeman except in the place or places
designated in his appointment and for such period as his appointment
shall be in force.
Section 23 -705 BOND REQUIRED. Evevy person appointed as a
special police officer shall file with the village clerk a corporate
surety bond in an amount of $1000.00 upon a form prescribed by the
village at the time of filing his oath of office and written acceptance
of his appointment. Such bond shall be conditioned upon the faithful
discharge of the duties of the office of special police officer and
upon compliance with all applicable laws and ordinances.
Section 23 -706 REQUIREMMS OF IDENTIFICATION. All applicants
for appointment as special police officers shall submit to all
reasonable regulations and requirements of the Village of Brooklyn
Center Police Department as the same shall relate to identification,
photographing and fingerprinting.
Section 23 -707 TERMINATION OF APPOINTMENT. Whenever the purpose
for the appointment as a special police officer ceases to exist, the
holder of such appointment shall within ten (10) days surrender his
badge to the Police Department of the village,
Section 23 -708. INSURANCE. Whenever a special police officer is,
appointed at the request of another to assist in patrolling or a 'orcir%
the law on the premises of the other's place of business, the person
requesting that such appointment be made shall file an appropriate
letter with the village agreeing to save the village harmless from any
`and all; liability which may accrue to it by reason of any acts or
omissions of the person appointed, and the village may require
evi., of insurance or in lieu thereof evidence of financial ability
to- adequately protect the village. This section shall not be construed
to impose any liability upon the village arising out of the appointment
of any special police officer.
Section 23 -709 PENALTY. Any person convicted for the violation of
any of the provisions of Sections 23 -701 through 23 -708 may be punished
by not more than 90 days imprisonment or a fine of not more than $1000

Section 1, Chapter 19 the Village Ordinances is amended by
adding new sections 19 -203, 19-204, 19 -205, 19 -208, 19 -210, and 19 - 211 and
renumbering the former sections as follows: Former section 19 -203 to 19 -206,
former section 19 -204 to 19 -207, former section 19 -205 to 19 -209, and former
section 19 -206 to 19- 212,and the new sections shall read as follows
Section 19 -203. FIGHTING AND BRAWLING. Every person who engages in
,brawling or fighting shall be guilty of disorderly conduct and upon
conviction thereof shall be liable to the same fine or imprisonment
provided for in Section 19 -201 of the village ordinances.
Section 19 -204 ASSAULT. Every person who shall commit s
assau or an assault and battery, not amounting to a felony,
conviction therefor shall be liable to the same fine or impris
provided in Section 19 -201 of the village ordinances.

r Section 19 -205. PETTY LARCENY. Every person who commits a larceny
as def _n� ed`inSections 622.01 through 622.04 of the Minnesota Statutes
which larceny is not punishable as a felony under state law upon
convic#on therefor shall be liable to the same fine or imprisonment
provided for in Section 19 -201 of the village ordinances.
Section 19 -208 CONTRIBUTING TO DELINQUENCY OF MINOR. Any person
who by act, word or omission encourages, causes or contributes to the
neglect or delinquency of a child, and such act, word or omission is not
by provisions of state law declared to be a felony, upon conviction
therefor shall be liable to the same fine or imprisonment provided in
Section 19 -201 of the village ordinances.
Section 19 -210 PUBLIC BATHING HOURS. Section 616.14 o f the
Minnesota Statutes is hereby adopted by reference and shall have the same
force and effect as though set out at length herein, and persons convicted
of a violation thereof shall be liable to the same fine or imprisonment
provided for in Section 19 -201 of the village ordinances.
Section 19 -211, MALICIOUS DESTRUCTION OF PROPERTY, Every person
who wilful y in ures, damages, or destroys the property whether real or
personal of another without their consent upon conviction therefor shall
be liable to the same fine or imprisonment provided in Section 19 -201 of

OF THE VILLAGE ORDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS:
Section 1. Chapter 11 of the Village Ordinances is amended by
adding thereto the following new sections:

Section 11 -301 MINORS - LIQUOR. Section 340.731 of the Minnesota
Statutes is hereby adopted by reference and shallhlve the same force
and effect as though set out at length herein,

Section 11 -302 MINORS -BEER. Section 340.03 of the Minnesota
Statutes is hereby adopted by reference and shall have the same force
and effect as though set out at length herein.
Se ction 11 -303 LIQUOR ON SCHOOL GROUNDS. No person shall
introduce upon, or have in his possession upon, or in, any school grounds,
or any schoolhouse or school building, any spiritous or malt liquors,
except for experiments in laboratories.
Sectio 11 -304, PENALTY. Any person convicted of violating
Sections 11 -301, 1 -302, or 11 -303 may be punished by not more than 90
days imprisonment or a fine of not more than $100.
Section 2. This ordinance shall take effect from and after its
legal publication.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the follOLng
voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby,
Clifford Wellman and Russ Jones; and the following voted against the same:
None; whereupon said ordinance was declared duly passed and adopted.

Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION
WHEREAS, the Village of Brooklyn Center has been presented
with a petition requesting detachment of certain property
now in the corporate limits of Brooklyn Center and,

WHEREAS, such petition has been signed by all of the owners
of such property, and
WHEREAS, the land to be annexed abuts the Village of Crystal
boundary and is separated by Twin Lakes fvom the Village of
Brooklyn Center proper and does not abut other Brooklyn Center
land, and
WHEREAS, it does appear to be in the best interests of the
Village of Brooklyn Center to detach such land,
NOW,, THEREFORE, BE IT =MY RESOLVED that the Brooklyn Center
Village Council hereby petitions the Municipal Commission to
proceed with such annexation to the Village of Crystal in
accordance with Chapter 686 of 1959 Session Laws and to
authorize the Village of Brooklyn Center to adopt an
Ordinance detaching from the corporate limits of the Village
of Brooklyn Center, the property described as Lots 1, 2 and 3..
Block 1, Twin Lake Park, 2nd Addition and Lots 5, 6, 7, 8,
5910 60, 61„ 62, 9 and 10, Aud. Sub. No. 328.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman and upon vote being taken thereon the following
voted in favor thereof: Carl Carlson, Clifford Wellman, Wayne Gageby,
William N. Super and Russ Jones; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION AUTHORIZING CORRECTION OF
RESOLUTION DIRECTING THE COMMENCEMENT
OF CONDEMNATION PROCEEDINGS
WHEREAS, the Village Council by resolution duly adopted on the 24th
day of February, 1960 determined that it was necessary and in the public
interest that certain parcels of land be acquired for public use as more
fully set forth therein, and
W RUMS, it appears that it is in the public interest that the
following corrections be made in said resolution as to Parcels Nos. 24, 25
26, 27 28, 29, 30, 31, 44, 45 and 46, and that a parcel be added to be
known as Parcel No, 66,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center as follows:
1. The part of the resolution of the Village Council adopted
February 24, 1960 referring to the taking of certain parcels of land is hereby
