Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
April 18, 1960
The Village Council met in special session and was called to order
by Mayor Super at 7;45 P,M.
Roll Call: William N. Super, Carl Carlson, Wayne Gageby, Clifford
Wellman and Russ Jones were present.
Motion by Carl Carlson and seconded by Russ Jones tht the bid of
Peter Lametti Construction Company for Sanitary Sewer Project No. 19b0-5,
and Sanitary Sewer Project No. 1960 -6, and Storm Sewer Project No. 1960 -7
be opened and tabulated with other bids for the before mentioned project even
though the bid was received two minutes after the closing time for bids.
Members Carl Carlson, Clifford Wellman, Wayne Gageby and Russ Jones voting yes;
and Mayor Super voting no. Motion carded.
Member Clifford Wellman introduced the Following resolution and moved
its adoption;
RESOLUTION ACCEPTING BID
AND APPROVING CONTRACT FORM
WHEREAS, the Village Administrator and the Village Engineer have
reported that on April 11, at 2 :00 P.M. they opened and tabulated
the bids received for Sanitary Sewer Project No. 1960 -6 and Storm
Sewer Project No. 1960 -7 and that said bids were as follows:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center as follows:
The bid of Peter Lemetti Construction Company in the
amount of $129,973.11 for Project 1960 -6 and $197,457.75
for Project 1960 -7 totaling $327,430.86, for the furnishing
of all work, labor and material in connection with the above
named projects according to the plans and specifications
therefor now on file in the office of the village clerk, is
deemed to be the lowest and best bid submitted for said work
by a responsible bidder and said bid is hereby accepted.

The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson and upon vote being taken thereon the following voted in
favor thereof: Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones;
and the following voted against the same; William N. Super; whereupon said
resolution was declared duly passed and adopted.
Motion by Russ Jones and seconded by Wayne Gageby that the Village
Council accept an Indemnity Agreement from Peter Lametti Construction Company,
which agreed to indemnify the Village of Brooklyn Center from any and all
judgments obtained by other bidders on the same project that may be incurred
as the result of the village's determining to accept the low bid of Peter
Lametti Const. Company which was received on April ll, 1960. Said agreement
was accepted subject to revision by the Village Attorney and the legal counsel
for Peter Lametti Construction Company. Motion carried,
Motion by Carl Carlson and seconded by Russ Jones to authorize the
retainer of Douglas Barr for further studies regarding the proposed deepening
of Shingle Creek, in accordance with his proposal dated April 6, 1960.
Motion carried.
Trustee Clifford Wellman left the meeting at this point.

Motion by Wayne Gageby and seconded by Carl Carlson that the Vil3%e
Council approve the claims of Anoka County in the amount of $864.41 connected
with relief cases of Robert Gorham and Virgil Segalstrom. Motion carried.
Motion by Wayne Gageby and seconded by Russ Jones to approve the
final plat of Northport Park. Motion carried.
Motion by Wayne Gageby and seconded by Russ Jones to proceed with
the condemnation of an easement for the construction of sanitary sewer lateral
across parcel B, of Registered Land Survey No. 370, and Lot 1, Block 3,
Sunrise Manor Addition. Motion carried.
Motion by Russ Jones and seconded by Carl Carlson that the Village
of Brooklyn Center require that contractors shall post a performance bond
guaranteeing that they will pay their share of the cost of the construction of
sanitary sewer and water mains upon the completion of the construction of the
project. Motion carried.
Motion by Wayne Gageby and seconded y uss Jones to adjourn. Motion
carried.
