HomeMy WebLinkAbout1960 04-25 CCM Regular Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota April 25i 1960 The Village Council met in regular session and was called to order by Mayor William N. Super at 7:45 P.M. Roll Call: William N. Super, Carl Carlson, Clifford Wellman and Russ Jones were present. Trustee Wayne Gageby was absent. Motion by Clifford Wellman and seconded by Russ Jones to approve the minutes of the Regular meeting of April 11, 1960 as recorded. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator and the Village Engineer have reported that on April 11, 1960 at 2 :00 P.M. they opened and tabulated bids received for sanitary sewer project No. 1960 -5, and that said bids were as follows: Nodland Const. Co. $56,559.90 Peter Lametti Const, 48,649.57 Lametti & Sons 53,271.85 Phelps -Drake Inc. 49,732.56 Walter Hiller & Sons 38,592.40 Walbon Excavating 60,943.75 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Walter Hiller & Sons, Inc. in the amount of $38,592.40 as to the furnishing of all work, labor and material in connection with sanitary sewer project 1960 -5 according to the plans and specifications therefor now on file in the office of the village clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted., The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption•. RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator and the Village Engineer have reported that on April 25, 1960 at 2:00 P.M. they opened and tabulated the bids received for Water Improvement No. 1960 -1B and that said bids were as follows: Keys Well Drilling Company $21,985.00 Tri -State Well Company 25,309.00 Bergerson- Caswell Inc. 33,,225• Layne- Minnesota Inc. 34,860.00 NOW,, THMWORE,, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: -1- That the bid of Keys Well Drilling Company in the amount of $21,985.00 for the drilling of a well and the furnishing of all work, labor and material in connection with the drilling of a well in accordance with the plans and specifications therefor now on file in the office of the village clerk, is deemed to be the lowest and best bid submitted by a responsible bidder for said work and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones and upon vote being taken thmeon the following voted in favor thereof: Carl Carlson, Clifford Wellman, William N. Super and Russ Jones; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WEEREAS, the Village Administrator and the Village Engineer have reported that on April 25, 1960 at 2 :00 P.M. they opened and tabulated bids received for the furnishing of a Deep Well Turbine Pump as a part of Water Improvement Project 1960 -1B, and that said bids were as follows: Meade Well Company $4,863.40 Fadden Pump Co. 4,945,00 Fairbanks & Morse 4,940.00 Layne - Minnesota, Inc. 4,768.72 Bergerson- Caswell Inc. 5,790.00 NOW, THEREBORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows; That the bid of Layne- Minnesota, Inc. in the amount of $4,768.72 for the furnishing of a Deep Well Turbine Pump in accordance to the Plans and Specifications therefor now on file in the office of the Village Clerk, is deemed to be the lowest and best bid submitted for said pump by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Clifford Wellman, William N. Super, Russ Jones, and the Hollowing voted against the same: none; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Russ Jones that the Village Council adopt the assessment policy for new installation of water mains that all of the abutting property shall be assessed at the time of the construction and that the assessment will be $490.00 per lot and the assessment does not include street resurfacing, and petition forms shall note that all parcels of land abutting a water improvement will be assessed for the improvement and the street surfacing is not included in the estimated assessment. Motion carried. -2- Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER impROVEKm N0. 1960 -29 AND PROVIDING FOR REIMBURSMW OF UNASSESBED COST OF WATER IMPROVEMENT NO. 1956 -19 and 1960 -1 WHEREAS, it is proposed that there be constructed improvements consisting of the following: Construction of water supply system including wells, tanks, feeder mains, laterals, service connections and appurtenances to provide water service along the following described streets; STREET FROM TO Chowen Ave.No. 65th Ave.No. a point approximately 200 ft. north of 66th Ave. No. 66th Ave. No. Chowen Ave.No. Beard Ave, No, WHEREAS,. the Village Engineer has made a preliminary report advising that said proposed improvements are feasible and that it can be constructed at an estimated cost of $7,840.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended, 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 9th day of May, 1960 at'8.00 O'clock P.M. and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3, The area proposed to be assessed for said improvement is as follows ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREETS, 4. This proposed improvement shall be designated Water Improvement No. 1960 -29. BE IT FURTHER RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that it is hereby determined that the properties which will be served by Water Improvement No. 1960 -29 when said improvement is completed, will also be benefited by Water Improvement No, 1956 -19 and 1960 -1, which propert, was not initially assessed for Water Improvement No. 1956 -19 and 1960 -1 and that as to expenditures made for Water Improvement No. 1956-19 and 1960 -i from g p general ad valorem tax levies or other sources and funds in addition to special assessments heretofore made for said improvement the Village shall be reimbursed therefor by adding $1,960.00 to the assessments to be levied for Water Improvement No. 1960 -29 and the Village Clerk shall cause notice tatsuch adds, tional amounts are proposed to be assessed to be included in the notice of hearing in the making of said Water Improvement No. 1960 -29. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof; Carl Carlson, Clifford Wellman, William Super and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -3- Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER IMPRoy SENT No. 1960 -34 WHEREAS, it is proposed that there be constructed improvements consisting of the following: Construction of water supply system including wells, tanks, feeder mains, laterals, service connections and appurtenances to provide water service along the following described streets: On Osseo Road (T.H. 152) from 69th Ave.No. to a point 1150 feet south of 69th Ave. North. WHEREAS, The Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $10,661975 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 9th day of May, 19W at 8 :00 O'clock P.M, and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREETS. 4. This proposed improvement shall be designated Water Improvement No. 1960 -34. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Clifford Wellman, William Super and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PRoposm WATER IwROVEMENT N0. 1960 -37 WHEREAS, it is proposed that there be constructed improvements consisting of the following: Construction of water supply system including wells, tanks, feeder mains, laterals, service connections and appurtenances to provide water service along the following described street; on 63rd Ave. No. from Orchard Ave. No. to Lee Ave. No. WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $6 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: -4- 1. The council proposes to proceed under authority granted by Chapter 398 Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 9th day of Nay, 1960 at 8 :00 O'clock P.M. and the clerk shall publish notice of the time and place of bearing by two weeks' publication in the official newspaper of the Village. 3• The area proposed to be assessed for said improvement is as follows: ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMM Sf MS: 4. This proposed improvement shall be designated Water Improvement No. 1960 -37. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Clifford Wellman, William Super, Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1960 -35. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 21, 1960, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROV.E',Nm1UT No. 1960 -35 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby that the following improvement shall be constructed: CONSTRUCTION OF SANITARY SEWER ON ALDRICH AVENUE NORTH FROM 59th AVENUE NORTH TO 61ST A VENUE NORTH. 2. The plans and specifications for said improvement s.l be prepared by Graydon Boeck, Village Engii.neer. The motion for adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman and Russ Jones; and the following voted against the same: None, whereupon seid resolution was declared duly passed and adopted. No. 1960 -38 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of-the Village of Brooklyn. Center, Minnesota, as follows; 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby that the following improvement_ shall be constructed, CONSTRUCTION OF SANITARY SEWER ON: STREET FROK TO Major Avenue North 63rd Avenue North South Terminus Noble Avenue North 63rd Avenue North South Terminus 63rd Avenue North Noble Avenue North A Point 100 ft. East of 'Ma jors, 2: The plans and specifications for said improvement shall be prepared by Graydon Boeck, Village Engineer 34 Builder Claus Johnson and Sons to post a bo of cash escrow to guarantee the payment of the assessments on Lots 5, 6, and 7, Block 4� and Lots 9 and 10.. Block 3 in Fair meadows Addition upon the completion of the construction of the sanitary sewer laterals. 4. Builder Borgstrom Construction Co. to post bond or cash escrow to guarantee the payment of the assessments on the lots in the proposed subdivision of Parcels 2000 and 4000 of Section 344 5. Assessments on the property of Martin Panayotoff described as Parcel 4530, Section 33, shall be for 20 year term. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Clifford Wellman, William Super and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson to uphold recommendation of the planning commission and approve the petition for a special use permit for the construction of a multiple dwelling as submitted by F. W. Ames to be located on his property listed as Part of Lot 4, Block 5, Wangstad's Brooklyn Terrace Addition, which is located directly South of Mr. Ames's residence located at 6045 Osseo Road. The special permit is approved" with the following stipulations: The area of the lot to be used for a multiple dwelling shall conform with all regulation of the village ordinances and specifically that there be 138' of frontage on Osseo Road with an average depth of approximately 217' which will provide the necessary area to construct the eleven (11) unit multiple dwelling according to the plans on file with the secretary. The permit will be granted upon submission of final acceptable drawings in conformance with those presented and presently on file. Motion carried. -6- Motion by Carl Carlson and seconded by Russ Jones to uphold the recommendation of the planning commission and grant a special use permit for the construction of a multiple dwelling as petitioned for by Mr. Fred Ledin P g P for his property listed as Lots 1 and 2, Block 1, Ledin's Addition, with the following stipulations: the entrance and access to the parking lot for this multiple dwelling shall be from 59th Avenue North and that all units within the multiple dwelling shall be single bedroom units and that approval will be granted upon submission of plans to'be approved by the village council. Motion carried. Motion by Russ Jones and seconded by Carl Carlson to uphold the recommendation of the Planning Commission that the request for a variance as submitted by Jack Kahn for the E. C. Peterson Property to reduce the green strip abutting Highway 100 from 15 feet to 5 feet, this property is described as Parcel 7930 of Lot 57, Aud itor's Subdivision 21$. Motion carried. Motion by Carl Carlson and seconded by Russ Jones to uphold the recommendation of the Planning Commission that the Planning Commission Secretary contact the District Engineer of the Minnesota Highway Department and request the construction of a service drive on the southeast side of Trunk Highway 100 from Logan Avenue North to 59th Avenue North and the possibility of cutting off the entrance of 59th Avenue North onto Trunk Highway 100 as a secondary request. Motion carried. The approval to divide by metes and bounds is granted on the following stipulation: That the petitioner when subdividing his property, will dedicate the westerly and southerly 30 feet of the above named lot for street purposes and deliver a deed for the same to the Village of Brooklyn Center, and that the lot divided from the northeast corner of the property be according to the regulations of the Platting Ordinances. The council proposes to proceed under authority granted by Chapter 398., Laws of Minnesota, 19531, as amended. -8- 2, A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 9th day of May, 1960, at 8:00 O'clock PM* and the clerk shall publish notice of time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $31,100.00, NOW, THER'F BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1 953, as amended. 2. The plans and specifications for the following improvement prepared by the Village Engineer are hereby approved and ordered . filed with the Clerk: Construction of one (1) Deep Well and the furnishing of one (1) Deep Well Turbine Pump. 2. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than 10 days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the clerk in the amount of not less than five percent (5$) of the bid. 3• The bid date is set for May 9th, 1960 at 11:00 O'clock A.M. 4.
