,,Minutes of the Proceedings of the 'pillage "`Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council w��wA � •i r �r-rr May 23, 1960 The Village Council met in regular session and was called to order by Mayor William No Super at 7:55 P -M- Roll Call: Mayor Super, Carl Carlson, Russ Jones and Wayne Gageby were present. Trustee Clifford Wellman was absent. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator and the Village Engineer have reported that on May 23, 1960 at 11:00 A.M. they opened and tabulated the bids received for Sanitary Sewer Improvement Nos- 1959 -53, 1960 -8, 9, 16, 17, 18, 19, 20, 21, 23 and 30 and that said bids were as follows: Peter Lametti Const. Co. $126,966.09 Northern Contractors 143,165.6o Barbarossa & Sons 169,12500 Lametti & Sons 174,1+0.20 Nodland Construction 236,196.50 NOW THRRWORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: That the bid of Peter Lametti Construction Company in the amount of $126,966.09 for the furnishing of all work, labor and material in connection with the con - struction of sanitary sewer laterals in accordance with the plans and specifications therefor'now on file i3a the office of the Village Clerk, is deemed to be the lowest and best bid submitted by a responsible bidder for said work and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. I Motion by Russ Jones and seconded by Carl Carlson upon the recommendation of the Village Engineer that the bids for Project 1960 - an d i 1960 -39, and Projects 1960 -26, 27, 28, 32 40, 33 be tabled until the next meeting. Motion carried. i Motion by Russ Jones and seconded by Wayne Gageby that the low bid of Viking Steel in the amount of $6,296.35 for the furnishing of corrugated metal pipe according to the specifications bid upon on May 23, 1960 be accepted. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Water Improvement No, 1960 -29. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publicathn thereof in the official newspaper, the last publication being on May 5, 1960, which affidavit was examined and found eatisfactXy and ordered placed on file. -1- The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners not appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION DISAPPROVING CONSTRUCTION OF WATER IMPROVEMENT NO_ 1&-29 , — BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is not necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement be constructed. Construction of water supply system including wells PP Y Y g � tanks, feeder mains, laterals, service connectioxn and appurtenances to provide water service along the following described streets: Street From To Chowen Ave.No. 65th Ave-No. A point approximately 200 ft. north of 66th Ave. No. 66th Ave. No. Chowen Ave.No. Beard Ave.No. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1960 -48. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 5, 1960, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owner appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption; RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER impRovEm NT NO. i960 -48 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby that the following improvement shall be constructed. CONS1'R WION OF A STORM SEWER SYSTEM TO SERVE THE AREA BOUNDED BY 73rd AVENUE ON THE NORTH, pALMER LAKE BASIN AND. maNaz DREEK ON THE WEST, 69th AVENUE NORTH ON THE SOUTH AND A LINE PARALLEL TO ARID 150' EAST OFWGAN AVENUE NORTH ON THE FAST. -2- 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Company. Tho motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones. and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None;Vaereupon aid resolution was declared duly passed and adopted. Motion by Wayne Gageby and seconded by Carl Carlson to uphold the recommendation of the planning commission to deny the petition of Pearson Bros. A to rezone the Southwest corner of 65th and Osseo Road (the north 150' of the Bast 150' of Lot 2, Block 10, Northgate Addition) from R -1 to B -le Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby to uphold the recommendation of the planning commission and deny the request for a special permit to construct a service station on the North 150' of the East 150' of Lot 2, Block 10, Northgate Addition. Lotion carried. Motion by Russ Jones and seconded by Carl Carlson to uphold the recommendation of the planning commission and approve the petition of Pearson Bros. for a special use permit to construct 3 multiple dwellings on .t Lot 2, Block 10, Northgate Addition as shown on the plat filed with the planning commission but subject to the approval by the village council of construction plans. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the village council approve the deputizing of a special polioo etficer for Shopper City subject to the village ordinances. Motion carried. »4- Motion by Wayne Gageby and seconded by Russ Jones to instruct the Assistant Village Administrator to secure a public address system for the council chambers on a trial basis. Motion tarried. Motion by Russ Jones and seconded by Wayne Gageby that the village hold open house for the fire station at 63rd and Osseo Road and the village hall on June 14, 1960. Motion carried. Notion by Carl Carlson and seconded by Wayne Gageby to instruct the Village Engineer to prepare information for a public hearing on resurfacing streets on those streets torn up for sanitary sewer below Highway -#100. The date of the public hearing to be set later. Motion carried4 Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ABATING TX W S WHERMS, the Village of Brooklyn Center has received tract L, Registered Land Survey No. 546 for street purposes and that said tract should have been tax exempt since 1957: BE IT HEREBY RESOLVED that the Village Council of the Village of Brooklyn Center, Minnesota hereby requests that the County Auditor of Hennepin County, Minnesda cancel all delinquent taxes and penalties on the above described tract. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby,aad upon vote being taken thereon the following voted in favor thereof: William N. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center,, Minneade, Peter Lametti Const• Co, have satisfactorily completed the following improvement in accordance with said contract: Sanitary sewer Smprovement Project 1959 -24 on Eft Ave. No. from Ewing to France,, on France from 67th Ave. No. to 68th Ave. No., along North line of Ek=ise Manor. From France Ave. No, to a point 264 feet west of Halifax Ave. No. and on Grimes Ave. No. and Halifax Ave. No. from 67th Ave. No. to the north line of Suariee Manor Addition. WEEMS, the Village Engineer has inspected and approved the project and thereby recommends its acceptance; NOW, THEREFORE., BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed (exceeded) the original contract amount by $365.42 because extension of 164 feet of 8 VCP and one additional manhole and 2 services. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $9,173.11. WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $11,294.73. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING Old PROPOSED SANITARY SEWER IMP NO. 190-21 WHEREAS, it is proposed that there be constructed as imprevement consisting of the following: CONSTRUCTION OF SANITARY SEWER LATERAL ON LYNDAL= AVENUE NORTH FROM 59th Ave. 110. to 61st Ave. No. WHEREAS, the Village Engineer boa fade a preliminary report advising that said proposed improvemeot is feasible and that it can be constructed at an estimated cost of $11,616.97# NOW, THEREFORE, BE IT RESOLVER by the Village Council of the Village of Brooklyn Center, Minnesota, as follevsi 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 13th day of June.. 1960, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Bid date is set for June 13, 1960 at 1100 e'eleak A.M. 4. The Village Administrator and Village Eaginoor shall be authorized to open and tabulate the bids. No dr ver of a motor vehi cle shall 3ri OM motor ve a upon or across the private property of another, including automobile service stations, at a corner formed by the intersection of two streets unless requested or authorized to do so by the owner thereof. Entering upon the property of an automobile service station for the purpose of purchasing gas, oil or for other purposes normally incident to the operation of an automobile service station shall be presumed to be authorized by the owner thereof. Section 27 -106. PENALTY. Any person convicted of violating any of the provrs on of Sections 27 -101 through 27 -105 may be punished by not more than 90 days imprisonment or a fine of not more than $100. Section 2. Sections 27 -202 of the village ordinances is hereby amended to read as follows: Section 27 -202, PARKING RESTRICTED, No person in charge of any vehicle shall park k or permit such cle to stand upon any highway, street or alley in the Village of Brooklyn Center for more than four consecutive hours between the hours of 12 :00 o'clock midnight and 6 :00 o'clock A.M. nor for more than six consecutive hours at any time. Section 27 -203. RiwwAL OF ILLEGALLY PARKED VEHICLES, Any vehicle parked in violation of the ordinances of the Village or in violation of state law may be removed by towing at the direction of the Village Police to a suitable place for storage until claimed by the owner or his agent, and the owner or other person responsible for such parking of the vehicle shall be liable for the reasonable cost of such towing and storage upon conviction for such illegal parking. Section 27 -204. PENALTY.
