HomeMy WebLinkAbout1960 06-13 CCM Regular Session r + Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota June 13, 1960 The Village Council met in regular session and was called to order by Mayor Super at 7;30 P.M, Roll Call: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones were present. Trustee Clifford Wellman was absent. Motion by Wayne Gageby and seconded by Carl Carlson to approve the minutes of the regular meeting on May 9, 1960, and May 23, 1960, and the minutes of the special meeting of May 16, 1960, as recorded. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND -APPROVING CONTRACT FORM WHEREAS, the Village Administrator and the Village Engineer have reported that on June 13, 1960 at 11 :00 A.M. they opened and tabulated bids received for sanitary sewer and water project No. 1960 -37, 38, 46, 47, and that said bids were as follows: Petrowske and Ross $58,219.25 Barbarossa and Sons 61,987.72 NOW, TWWORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Petrowske and Ross in the amount of $58,219.25 as to the furnishing of all work labor and material in connection with sanitary sewer and water project No. 1960 -37, 38, 46, 47 according to the plans and specifications therefor now on file in the office of the village clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. BE IT FURTHER RESOLVED that Bergstrom Construction Co. and Claus Johnson & Sons shall be required to pay cash for that part of the cost charged to the W2 of the SWu of the Swi of Sec. 34 T119 R21, and Lots 5, 6, & T o Blk 4 and Lots 9 & 10, B1k 3, FAU M ADOWS 2ND ADD., and that the cost charged to EJ of the SE of SEu of See. 33, T119, R21 shall be assessed for a period of 20 years. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby, and Russ Jones; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION TABLING JiIDS WHEREAS, the Village Administrator and the Village Engineer have reported that on June 13, 1960 at 11 :00 A.M, they opened and tabulated bids received for Sanitary Sewer Improvement Projects Nos. 1960 -24, 35, 44 and 45 and that said bids were as follows: 1960 -24 1960-35 1960 -44 19+6 -45 Petrowske and Ross $12,561.00 $10,605.50 $ 4,819.00 $15,885.00 Peter Lametti Const. 12,265.42 7,658.85 4 1 060.29 19,294.68 Barbarosse and Sons 12,366,50 11,863.50 4,S50.50 16,333.00 - 1 - WHEREAS, it was deemed advisable to table the bids received for Sanitary Sewer Improvement Projects Nos. 1960 -24, 35, 44 and 45 until the people on 53rd Avenue have been advised of the cost of Project No. 1960 -44, NOW.. THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bids received for Sanitary Sewer Improvement Projects Nos. 1960 -24, 35, 44 and 45 be tabled until the people on 53rd Avenue have been advised of the cost of Project No. 1960 -44, The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOWTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator and Assistant Administrator have reported that on June 13, 1960, at 11 :00 A.M., they opened and tabu- lated bids received for the furnishing of a 1960 model police car and that said bids were as follows: BIDDER PRICE DELIVERY Broadway Automotive $1,572.00 30 - 35 days NOW, THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota, that the low bid of Broadway Automotive for the furnishing of a 1960 police car in accordance with the specifications is deemed to be the best bid submitted by a responsible bidder for village purposes and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, William N. Super, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The mayor announced that the meeting was open for the consideration Of proposed Sanitary Sewer Improvement No. 1960 -41. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on June 9, 1960, which affi- davit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERIlf3 CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1950 -41 AND ORmim PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed. 2 - CONSTRUCTION OF A SANITARY SEWER LATERAL ON Bryant Avenue North from 61st Avenue North to North Lilac Drive. 2. The plans and specifications for said improvement shall be prepared by Village Engineer. The motion for the adoption of the foregoing resolution was duly swconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby, and Russ Jones, and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed. CONSTRUCTION OF A SANITARY SEWER LATERAL ON Aldrich Avenue North from 61st Avenue North to 62nd Avenue North. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby and Russ Jones, and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVID33G FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVENOT NO. 1960 -11 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: 3 _ Construction of a proposed sanitary sewer lateral on Bryant Avenue North from 53rd Avenue North to the N.S.P. Easement (Approx. 300' North of 57th Ave.) and on 55th Avenue North from Bryant Avenue North to a point 450' East of Bryant Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $30,478.38. NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hsll in the village on Monday, the 27th day of June, 1964, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All parcels of property abutting on the above -named streets where the project is to be constructed. 4. This proposed improvement shall be designated Sanitary Serer Improvement No. 1960 -11. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby and Russ Jonesp and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1960 -51. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed. CONSTRUCTION OF SANITARY SEWER LATERAL ON Lyndale Avenue North from 59th Avenue North to 61st Avenue North. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. 4 _ The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby and Russ Jones, and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Motion by Russ Jones and seconded by Carl Carlson to authorize the taking of bids for bituminous patching material on July ll, 1960, at 11:00 A. M. Motion carried. Member Wayne Gageby introduced the following ordinance and moved its adoption: AN ORDINANCE RELATn G TO CERTAIN PUBLIC AND QUASI - PUBLIC USES OF LAND AND AMENDING SECTIONS 35 -701 AND 35 -703 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CEMR ORDAIRS: 1. Section 35 -701, paragraph f, of the village ordinances is hereby amended to read as follows; "Section 35-701. SINGLE FAMILY RESIDENCE DISTRICT (R -1) PERMITTED USES f Public uses upon property owned by the Village of Brooklyn Center or other units of government." 2. Section 35 .703 of the village ordinances is hereby amended by adding thereto the following: "Section 35 =703 SINGLE FAMILY RESIDENCE DISTRICT (R -1) SPECIAL USES �• Ball park not operated for profit." 3. This ordinance shall take effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Russ Jones and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Wayne Gageby and Russ Jones and the following voted against the same: None. whereupon said ordinance was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET SURFACING IMPROVEME 0 NO. 1960 -58. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Earle Brown School, 59th Avenue North and Humboldt on Thursday, the 7th Of July, 1960, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREETS WHERE THE PROJECT IS TO BE CONSTRUCTED. 4. This proposed improvement shall be designated Street Surfacing Improvement No. 1960 -58. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby and Russ Jones, and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. 6 - Motion b s y Russ Jones and seconded by Wayne Gageby to receive the petition for the installation of water mains on Chawen Avenue from 65th Avenue to 66th Avenue. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC EWING ON PROPOSED WATER IMPROVEMENT N0. 1960 -29 AND PROVIDING FOR REDEMEM1' OF UN- ASSESSED COST OF WATER IMPROVEMENT NO. 1956 -19 AND 1960 -1 WHEREAS, it is proposed that there be constructed improve- ments consisting of the following: Construction of water supply system including wells, tanks, feeder mains, laterals, service connections and appurtenances to provide water service along the following described streets: STREET FROM TO Chowen Avenue North 65th Avenue North a point approximately 200 ft. no. of 66th Ave. 66th Avenue North Chowen Avenue North Beard Avenue North WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvements are feasible and that it can be constructed at an esti- mated cost of $7,840.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows. 1. The council proposes to proceed under authority granted by Chapter 298, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 27th day of June, 1960 at 8:00 o'clock P.M. and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. This proposed improvement shall be designated Water Improvement No. 1960 -29. BE IT FURTHER RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that it is hereby determined that the properties which will be served by Water Improve - ment No. 1960 -29 when said improvement is completed, will also be benefited by Water Improvement No. 1956 -19 and 1960 -1, which property was not initially assessed for Water Improvement No. 1:956 -19 and 1960 -1 and that as to expen- ditures made for Water Improvement No. 1956 -19 and 1960 -1 from general ad valorem tax levies or other sources and funds in addition to special assessments heretofore made for said improvement the Village shall be reimbursed therefor 7 - by adding $1,960.00 to the assessments to be levied for Water Improvement No. 1960 -29 and the Village Clerk shall cause notice that such additional amounts are proposed to be assessed to be included in the notice of hearing in the making of said Water Improvement No. 1960 -29. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, William Super, Wayne Gageby and Russ Jones, and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Members Wayne Gageby and Russ Jones were appointed to a Personnel Committee to work with the Village Administrator on personnel problems.
