HomeMy WebLinkAbout1960 07-11 CCM Regular Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and the State of Minnesota July 11, 1960 The Village Council met in regular session and was called to order by Super at 7:30 p.m. Roll Call: William N. Super, Carl Carlson, Russ Jones, and Clifford Wellman were present. Member Wayne Gageby wan absent. Motion by Clifford Wellman and seconded by Russ Jones that the Minutes of the regular meetings of June 13, 1960, and June 27, 1960, and the Minutes of the special Board of Review meeting on June 28, 1960, be approved as recorded. Motion carried. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APFROVING CONU ACT FM WHEREAS, the Village Administrator, Assistant Administrator, and the Village Engineer have reported that an JUly 11, 1960, at 11:00 A.M. they opened and tabulated bids received for bituminous patching material and that said bids were as follows: Picked -Up Delivered Picket -up Unit Price Uhit Price Unit Price Bidder Ton Toil Ton Miles Total Barton Construction Co. McCrossan in the amount of $47:550.00 as to the furnishing, loading and delivery of plaint -aUed bituminous materials according to the forms and ispeeifications therefor on file in the office of the Villags Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder inasmuch as C. S. McCrossan is 2.7 miles from the Village Hall while Barton Construction Co. is 9.0 miles from the Village Hall, and said bid is hereby accepted. The motion for the adoption of the foregoing resolutions was duly seconded by Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Russ Jones, and Clifford Wellman; and the ,following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WH'E'REAS, the Village Administrator, Assistant Administrator and the Village Engineer have reported that on July 11, 1960, at 11:00 A.M. they opened and tabulated bids received for construction of Well Pump House No. 3, Project No. 1960 -1B (3), and that said bids were as follows: Karl Dedolph Const. Co. $14,832.00 D. W. Hersted Co., Inc. 14,377.00 Loeffel Coast. Co. 15,400.00 Rosengren Coast. Co. 13,580.00 NOW, THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota, that the low bid of Rosengren Const. Co. in the amount of $13,580.00 for construction of Well Pump House No. 3, Project No. 1960- 1B(3), including furnishing and supplying all necessary equipment and material for the construction and all necessary accessory equipment and appurtenances, according to the forms and specifications therefor on file in the office of the Village Clerk, is deemed to be the best bid submitted by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Russ Jones, and Clifford Wellman; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Letourneau Co. for furnishing and delivery of two increment starters for wells No. 3 & 4, Project No. 1960- 1B(3), is deemed to be the best bid submitted by a respon- sible bidder inasmuch as Letourneau promises a delivery date of August 1, -2- i 1960; and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Jones., a , and Clifford Wellman; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. NOW, THMMORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bids received for Sanitary Sewer improvement 1960 -4 and Storm Sewer Improvement 1960 -55 be tabled. The motion for the adoption of the foregoing resolution was duly seconded by Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Russ Jones, and Clifford Wellman; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following amendment to the Village Ordinances and moved its adoption: AN ORDINANCE AMENDING THE ZONING ORDINANCE BY ADDING TERRITORY TO TEE RESIDENTIAL BUSINESS DISTRICT (R -B) AND THE LOCAL BUSINESS DISTRICT (B-l) THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS: Section 1. Section 35 -713 is hereby amended by adding thereto the following: "Section 35 -713 RESIDENCE - BUSINESS DISTRICT (R -B) BOUNDARIES. . . . . . The north 100' of the east 180' of the north 300' of the south 312.53' of Lot 18, Aud. Sub. No. 25." Section 2. Section 35 -723 is hereby amended by adding thereto the following: " Section 35 -723 LOCAL BUSINESS DISTRICT (B -1) BOUNDARIES. The north 170' of the north 300' of the south 312.53' of Lot 18, Aud. Sub. No. 25, lying west of the easterly 180' of the north 300' of the south 312.53 of Lot 18, Aud. Sub. No. 25." -3- Section 3. This ordinance shall take effect from and after its legal. publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Russ Jones and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Russ Jones and Clifford Wellman and the following voted against the same: none; whereupon said ordinance was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson to uphold recommendation of the Planning Commission to ap*ove the request of Dallas Lawrence Lake Realty to divide part of Lot 5 of Aud Sub. #309 located at 72nd Avenue North and Lyndale, said property bounded on the East by Riverdale, on the South by 72nd Avenue, on the West by Lyndale Avenue and on the North by the North line of lot 5, provided that the plat be according to the platting ordinance, that a 50 foot road as shown be deeded to the Village and that a Registered Land Survey be filed. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold recommendation of the Planning Commission to approve Bergstrom's Lynside Manor 4th Addition provided that the property adjacent to South of are of cul de sac and South of bts 6 and 19 remain as outlets for future develop - ment by reason of inadequate soil bearing and that plat be submitted accord- ing to platting ordinance. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold recommendation of the Planning Commission to approve the request of J. J. Barnett to divide lot 35 Lyndale Acres into two lots each 74 feet by 165,45 feet. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson to uphold recommendation of the Planning Commission to grant a variance to Busse Erik- son to divide the property at 5640 Humboldt Avenue North, South 1/2 of the North 115 feet of the West 1/4 of the Northwest 1/4 of the Southwest 1/4, Section 1 Township 118, Range 21, into four lots, each lot 68.15 x 133 feet Provided that a Registered Land Survey be filed and separate survey certifi- cates be submitted: Motion carried. Motion by Clifford Wellman to uphold recommendation of the Planning Commission that two special sign permits be granted to Shopper's City (1) Bryant and Highway 100, approximately 6 x 12 feet, (2) France and Highway 100, approximately 8 x 15 feet, 18 feet above grade, to be used as directional signs for a period of one year from July 7,1960. Motion lost for lack of a second. Motion by Carl Carlson and seconded by Russ Jones that the above recommendation of the Planning Commission be taken under advisement. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Attorney be instructed to prepare an ordinance governing ice cream and Popsicle-vending vehicles. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1960 -59. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the Official newspaper, the last publication being on July 7, 1960, which affi- davit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Water Main construction on Sailor Lane from 55th Avenue North to 53d Place North. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William Super, Russ Jones, Carl Carlson, Clifford Wellman, and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Russ Jones to authorize the Mayor and Clerk to execute a bid of $1.00 for the frame house and sherds on the Arthur J. Steffenson property at 6058 West River Road. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of July 11, 1960" were audited and ordered paid. Motion by Russ Jones and seconded by Carl Carlson to adjourn. Motion carried.
