HomeMy WebLinkAbout1960 07-25 CCM Regular Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and the State of Minnesota July 25, 1960 The Village Council met in regular session and was called to order by Mayor William Super at 7..:30 p.m. Roll Call: Mayor William Super, Clifford Wellman, ,Russ Jones, and Wayne Gageby were present. Trustee Carl Carlson was absent. Motion by Clifford Wellman and seconded by Russ Jones that the Minutes of the regular meeting of July 11, 1960, and the Minutes of the Special Meetings of July 7 and July 18, 1960, be approved as recorded. Motion carried. Motion by Clifford Wellman and seconded by Wayne Gageby that the request of Father Ohlinger of St. Alphonsus Catholic Church for permission to hang a banner across Osseo Road at 69th Avenue North, for a period of not more than 10 days during August 1960, be granted. Motion carried. Motion by Wayne Gageby and seconded by Clifford Wellman to grant the request of Father Ohlinger of St. Alphonsus Catholic Church for a temporary license for Bingo for a period of three days (August 19, 20 and'21, 1960). The license for Bingo is to conform with the ordinances of the Village. Motion by Russ Jones and seconded by Wayne Gageby to reject all bids on Storm. Sewer Improvement No. 1960 -48, Sanitary Sewer Improvement No. 1960 -49, and Water Main Improvement No. 1960 -50. Motion carried. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION RESCINDING ADOPTION OF ORDINANCE RELATING TO R -B AND B -1 DISTRICTS ADOPTED JULY ll 1960 WHEREAS, the Village Council on July 11, 1960 adaybed an ordinance entitled AN ORDINANCE AMENDING THE ZONING ORDINANCE BY ADDING TERRITORY TO THE RESIDENTIAL- BUSINESS DISTRICT (R -B) AND THE LOCAL BUSINESS DISTRICT (B -1) ; and WHEREAS, said ordinance has not yet been published; and WHEREAS, the Planning Commission has recommended certain changes thereto and the Council concurs in such changes, NOW, THEREFORE, BE IT RESOLVED by the Village Council as follows: 1. The action of the Village Council of the Village of Brooklyn Center of July ll, 1960, adopting the ordinance above recited is hereby rescinded and no publication shall be made thereof. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby and upon vote being taken thereon the following voted in favor thereof: William Super, Russ Jones, Wayne Gageby and Clifford Wellman, and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following ordinance apd moved its adoption: AN ORDINANCE RELATING TO USES PERMITTED IN AN R -B DISTRICT AND AMENDING SECTION 35-710 OF THE ZONING ORDINANCES OF THE VILLAGE OF BROOKLYN CENTER THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAIN: Section 1. Section 35 -710 of the village ordinances is amended by adding to said section a new subdivision "h" to read as follows: " Section 35 -710 RESIDENCE- BUSINESS DISTRICT (R-B) PERMITITD USES6 h. The compounding, dispensing, or sale (at retail) of drugs, prescription items, patent or proprietary medicines, sick room supplies, prosthetic devices or items relating to any of the foregoing when conducted in a building occupied primarily by physicians or dentists. Section 2. This ordinance shall take effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by Member Clifford Wellman and upon vote being taken thereon the following voted in favor thereof: William Super, Wayne Gageby, Russ Jones and Clifford Wellman and the following voted against the same: none; whereupon said ordinance was declared duly passed and adopted. Member Russ Jones introduced the following ordinance and moved its adoption: AN ORDINANCE ADDING CERTAIN PROPERTY TO THE RESIDENTIAL- BUSINESS DISTRICT AND AMENDING SECTION 35 -713 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CEO ORDAIN: Section 1. Section 35 -713 is hereby amei}ded by adding thereto the following: " Section 35 -713 RESIDENCE- BUSINESS DISTRICT (R -B) BOUNDARIES. the north 100 feet of the east 180 feet and all that part of the north 170 feet lying west of the east 180 feet of that part of Lot 18, Auditor's Subdivision No. 25, Hennepin County, Minnesota, lying south of the south line of Lawnridge Addition. Section 2. This ordinance shall take effect from and after its legal publication. - The motion for the adoption of the foregoing ordinance was duly seconded by Member Clifford Wellman and upon vote being taken thereon the following voted in favor thereof: William Super, Wayne Gageby, Russ Jones and Clifford Wellman and the following voted against the same: none; whereupon said ordinance was declared duly passed and adopted. Mr. Fredrickson, a representative of the purchaser of the property involved in this ordinance, has agreed to submit a letter to the Village regarding street surfacing on Beard Avenue, fencing on the north line of the property from Beard Avenue to Osseo Road, and dedicating land for street purposes on Beard Avenue. Motion by Clifford Wellman and seconded by Russ Jones to approve the follow - ing applications for licenses: I -2- Gasoline Filling Station License Bud & Fran's Texaco Station 4861 Osseo Road Johnson Standard Service 6044 Osseo Road Heating License Oil Burner Service Co., Inc. 315 W. Lake St. Plumber's License R. A. Wiley Well Co., Inc. Osseo, Minna Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET SURFACING IMPROVEMENT N0. 1960 -62 WiEMEAS, it is proposed that there be constructed an improvement con- sisting of the following: CONSTRUCTION OF STREET SURFACING ON 54th AVENUE NORTH FROM FRANCE TO SAILOR LANE AND ON SAILOR LANE FROM 55th AVENUE NORTH TO 53rd PLACE. WHMEAS,,the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $3436.50. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proeeed under authority granted by Chapter 398, Laws of Minnesota, 1953; as amended. 2 A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 8th day, of August, 1960; at 8:00 o'clock P.I., and the clerk shall pubiioh notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREET WEERE THE PROJECT IS TO BE CONSTRUCTED. 4. This proposed improvement shall be designated Street Surfacing Improvement No. 1960 -62. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Russ Jones, William Super, Clifford Wellman and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION AMENDING EMMW DOMAIN PROCEEDINGS AS AUTHORIZED ON FEBRUARY 24, 1960 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota: 1. The engineers have recommended to the Village Council that the takings set forth in the Resolution of February 24, 1960 as amended by the Resolutions of April 3.1, 1960 and May 9, 1960 authorizing and instructing -3- the Village Attorney to undertake condemnation proceedings should be revised as hereinafter set forth. 2. Same as Same as Parcel 1 Tract C of R Land Parcel l Survey 124 (for underground utilities) The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William Super, Clifford Wellman, Russ Jones, Wayne Gageby and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. -4- Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IM oVMNT No. WHEREAS, it is proposed that there be constructed an improvement con - sisting of the following; CONSTRUCTION OF A PROPOSED SANITARY SEWER LATERAL ON BRYANT AVENUE NORTH FROM 53rd Avenue North TO THE N.S.P. EASEMENT (Approximately 300' North of 57th Avenue North) and ON 55th Avenue North from BRYANT AVENUE NORTH TO A POINT 450' EAST OF BRYANT AVENUE NORTH. WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $30,478.38. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Dews of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Monday, the 8th day of August, 1960, at 8 :00 O'clock P.M., and the clerk -shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREETS WHERE THE PROJECT IS TO BE CONSTRUCTED. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1960 -11. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Russ Jones, William Super, Clifford Wellman and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following ordinance and moved its adoption: AN ORDINANCE ADDING CERTAIN REQUnumnTS TO THE PLATTING ORDINANCE AND AMENDING SECTION 15 -108 OF THE VII.LAGE CRDMMCES THE VILLAGE COUNCIL OF TSE VILLAGE a? moon CENTER ORDAIN: Section 1. Section 15 -108 of the village ordinances, paragraph (a) thereof, is hereby amended to read as follows: " Section 15 -108 REQUIRED IMPROVEMENTS. . . . . . (a) Monuments. Monuments shall be placed at all block corners, angle points, points of curves in streets and at intermediate points as shown on the final plat, location and size as determined by the Village Engineer. There shall be at least three concrete monuments installed per block. If the block is longer than 800 feet, there shall be four monuments. They shall be installed on the west and south sides of the street at the exterior corners and the remaining monuments equally dividing the distance between. Other monuments shall -5- be steel or cast iron, as approved by the Hennepin County Surveyor and shall be set at each corner or angle on the out - side boundary of all lots. Pipes or steel rods shall be placed at the corners of each lot and at each intersection of street centerlines. All Ut Si, state, county, or other official benchmarks, monuments or triangulation stations in or adjacent to the property shall be preserved in precise position4" Section 2. Section 15 -108 of the village ordinances is hereby amended by adding to paragraph (d) a new paragraph which shall be paragraph 9 to read as follows: " Section 15 -108 RSQUnW IMOVEMMM. . . : . A (d) 9. Boulevard Sod. Boulevard sod shall be installed from the street gutter line to the property line adjacent to all streets. This shall include any side yard boulevards." Section 3. This ordinance shall take effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by Member Russ Jones and upon vote being taken thereon the following voted in favor thereof: William Super, Wayne Gageby, Rasa Jones and Clifford Wellman and the following voted against the same: none; whereupon said ordinance was declared duly passed and adopted. Motion by Russ Jones, seconded by Wayne Gageby to accept the Justice Report for the month of May. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION CRDERING ADVERTISEMENT FOR WA!= MEMS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: I. Bid date is set for Thursday, August 18, 1960 at 11:00 o'clock A.M. The motion for the adoption of the foregoing resolution was duly seconded by Member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Wayne Gageby, Russ Jones and Clifford Wellman; and the following voted against the same: none; whereupon said resolution was declared duly passed and adopted. The proposed ordinance concerning vending vehicles was discussed and returned to the village attorney for further revision. Motion by Russ Jones and seconded by Wayne Gageby to adjourn. Motion carried. f After a short recess, the meeting was reopened by Mayor William Super to discuss the salary adjustments recommended by the Personnel Committee in a V 1DdffiOrandum dated July 8, 1960. Members present were William Super, Clifford Wellman, Russ Jones, and Wayne Gageby. Carl Carlson was absent. Motion by Clifford Wellman, seconded by Wayne Gageby that salary adjustments be made according to the recommendations of the Personnel Committee in the memo dated.
