Council of the Village of Brooklyn Center
in the County of Hennepin and the State of
Minnesota
August 8, 1960
The Village Council met in regular session and was called to order
by Mayor William Super at 7:35 P. M.
Roll call: Mayor William Super, Clifford Wellman, Russ Jones,
Wayne Gageby and Carl Carlson were present.
Motion by Wayne Gageby and seconded by Clifford We llman that the
Minutes of the regular meeting of July 25, 1960, be approved as
recorded. Motion carried.
The Mayor announced that the meeting was open for the considera-
tion of proposed Sanitary Sewer Improvement No. 1960 -11.

The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weekst publication thereof
in the official newspaper, the last publication being on August 4,
1960, which affidavit was examined and found satisfactory and
ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvements. After
hearing and considering all objections, and the property owners
appearing in favor of said improvement, Member Wayne Gageby intro -
duced the following resolution and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF
SANITARY SEWER IMPROVEM W NO. 1960 -11
and ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
BE IT RESOLVED, by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and
for the best interests of the Village and the owners
of property specially benefited thereby that the
following improvement shall be constructed.
Construction of a sanitary sewer lateral on Bryant
Avenue North from 53rd Avenue to the Northern States
Power Basement (Approximately 300' North of 57th
Avenue North) and on 55th Avenue North from Bryant
Avenue North to a point 1 50' east of Bryant Avenue
North.
2. The plans and specifications for said improve-
ment shall be prepared by Graydon R. Boeck, The
Village Engineer.
The motion for the adoption of the foregoing resolution
was duly seconded by member Carl Carlson, and upon vote being
taken thereon, the following voted in favor thereof: William
Super, Russ Jones, Clifford Wellman, Wayne Gageby and Carl
Carlson, and the following voted against the same: None..
whereupon said resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOUJTION TABLING BIDS
WHEREAS, the Assistant Village Administrator and the
Village Engineer have reported that on August 4, 1960 at
11 :00 A.M. they opened and tabulated bids received for
Sanitary Sewer and Water Main Project Nos. 1960 -10, 31,
12, 14, 22, 29, 41 42 51, 57 and 59 and that said bids
were as follows:

WHEREAS, it was deemed advisable to table the bids received
for Sanitary Sewer and Water Main Project Nos. 1960 -10, 11,
12, 14, 22 290 41, 42, 51, 57 and 59.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center, Minnesota, that the bids received
for Sanitary Sewer and Water Main Project Nos. 1960 -10, 11 12
14 22, 29, 41, 42, 511, 57 and 59 be tabled.
The motion for the adoption of the foregoing resolution
was duly seconded by Member Wayne Gageby, and upon vote being taken
thereon the following voted in favor thereof: Carl Carlson,
William Super, Russ Jones, Clifford Wellman) and Wayne Gageby;
and the following voted against the same: none; whereupon said
resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following ordinance
and moved its adoption:
AN ORDINANCE LICENSING AND REGULATING
CERTAIN VENDING OPERATIONS ON PUBLIC
STREETS AND AMENDING CHAPTER 23 OF THE
VILLAGE ORDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS:
Section 1. New Sections 23 -801, 23 -802, 23-803, 23-804
and 23-805 are hereby added to the village ordinances and shall
read as follows:
" Section 23 -801 LICENSE REQUIREMENTS. No owner or
operator of any vehicle which is used for the purpose of dispensing
or vending confections or other goods directly from such vehicle
shall carry on such dispensing or vending unless licensed as pro-
vided in this ordinance. This ordinance shall not apply to persons
using vehicles for the delivery of goods or services directly to
homes or establishments where the goods are taken by the operator
of the vehicle onto private property for delivery, nor shall it
apply to the operations of any political subdivision or unit of
government. A vehicle for purposes of this ordinance shall mean
any mobile unit being used on the public streets for the purpose
of vending or dispensing as aforesaid.
" Section 23802 APPLICATION FOR.LICENSE. Application
for a license shall be made to the village clerk and shall des-
cribe the vehicle or vehicles from which said vending operations

will be carried on and shall give the names of the persons inter-
ested in said business. It shall describe the types of confections
or other goods which will be sold from said vehicle. The applicant
P shall also set forth the names of the insurers providing liability
coverage on the vehicle or vehicles and the amount of coverage
carried. The application shall be accompanied by the annual fee
which shall be $75.00 per vehicle. Licenses shall run from May l
to April 30 of the following year. If an application for a license
is denied, the fee shall be refunded to the applicant.
" Section 23 -803 HOURS AND ROUTES. No person licensed
hereunder shall carry on the vending operations except between the
hours of 1 :00 P.M. to 4 :30 P.M. and 6:30 P.M. to 9:30 P.M. More
than ten (10) days before commencement of his operations the licensee
shall file with the Chief of Police a proposed route or routes over
which the vehicles will travel each day within the Village. The
licensee shall follow such route while operating within the Village.
Proposed ahanges shall be filed with the Chief of Police at least
10 days in advance of making such changes. If the Chief of Police
shall disapprove of such proposed routes, the licensee may appeal
the ruling of the Chief of Police to the Village Council for deter -
mination. Only such routes shall be approved as will minimize the
hazard to persons who may be customers of such vehicle and which
will minimize traffic difficulties which may arise out of such
operations.
" Section 23 -804 SAFETY REQUIPENW. Every licensee shall
maintain liability insurance in the amount of at least $50,000 for
single injuries and $100,000 for each accident together with at
least $5000 property insurance. Vehicles must be parked at the
curb while engaging in vending operations and vending shall be
done only at the curb side of the vehicle. Each vehicle must be
equipped with flashing lights on both the front and rear of the
vehicle clearly visible to oncoming cars in full daylight. Every
vehicle while carrying on a vending operation shall be attended
by at least two persons, one of whom shall have the following
specific duties: For the full period during which such vehicle
is stopped for vending, or which is stopped in such a manner or
at such place as to reasonably cause others to believe that it
is proposing to engage in vending operations, said person shall
stand alongside said vehicle in such a manne as to be able to
observe traffic coming from all directions and also the crossing
of the street by minors in the immediate vicinity of said vehicle.
Such person shall give adequate warning to both vehicles and minors
so as to avoid accident or injury to said minors. He shall, if
necessary, carry such signalling or warning devices as will enable
him to give adequate warnings.
" Section 23 -805 VIOLATIONS. Any person violating any
provisions of this ordinance may upon conviction thereof be fined
not to exceed $100 or to not more than 90 days imprisonment. Any
licensee who violates any provision of this ordinance or who
drives or operates his vehicle in a careless and negligent fashion
may in addition to the foregoing penalties have his license revoked
after a hearing before the Village Council upon reasonable notice."
Section 2. This ordinance shall take effect from and
after its legal publication.
Passed by the Village Council of the Village of Brooklyn
Center this day of August, 1960.

The motion for the adoption of the foregoing ordinance was duly
seconded by Member Wayne Gageby and upon vote being taken thereon
the following voted in favor thereof: William Super, Wayne Gageby,
Russ Jones, Carl Carlson, and Clifford Wellman and the following
voted against the same: none; whereupon said ordinance was declared
duly passed and adopted.
Motion by Carl Carlson and seconded by Wayne Gageby to negotiate
easements on three parcels of land between Bryant and Colfax on
65th Avenue North for the construction of storm and sanitary sewers.
Total amount of the three easements not to exceed $1500 plus replace-
ment of improvements. Motion carried.
Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION DIRECTIM CONDEMMTI0K
OF CERTAIN STS IN LAND
WHEREAS, the Village Engineer has advised the Village
Council that certain interests in land are required for
municipal purposes, including permanent and temporary
easements for the construction of sewers and the acquisi-
tion of certain streets, and it appearing that the acqui-
sition of such interests in land is necessary and desirable
and in the public interest, and that the taking will be
most fairly and equitably accomplished through proceedings
in eminent domain., and the Village has been unable to procure
such interests by negotiation.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
Brooklyn Center, Minnesota as follows:
1. The Village Attorney is instructed and directed
to file the necessary petitions to acquire the interests
in land as hereinafter set forth for the purposes set
forth herein, and he shall prosecute such action to a'
successful conclusion or until it is abandoned, dismissed,
or terminated by the Court.

The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby,
Carl Carlson and Russ Jones; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Carl Carlson to accept the
Justice Report for the month of July. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby to approve the following

Motion by Clifford Wellman and seconded by Carl Carlson that the resigna-
tion of Graydon Boeck as Village Engineer be accepted. Motion carried.
Motion by Clifford Wellman and seconded by Russ Jones to authorize the
Village Administrator to advertise for a Village Engineer. Motion carried.
The bills set forth on the schedule attached to these minutes and made a
part hereof entitled "The Bills Audited and Ordered Paid at the Meeting
of August 8, 1960," were au3 ited and ordered paid.
