The Village Council met in regular session and was called to order
by Mayor William Super at 7:30 P. M.
Roll Call: Mayor William Super, Clifford Wellman, Russ Jones,
Wayne Gageby, and Carl Carlson were present.
Motion by Carl Carlson and seconded by Russ Jones that the Minutes
of the Regular meeting of August &, 1960, and the Special meetings
Of August 11 and August 15, 1960, be approved as recorded, with a
notation on page 4 of the Minutes of August 8, 1960, relative to
a 30 -foot condemnation instead of a 40 -foot condemnation. Motion
carried.
Member Russ Jones introduced the following resolution and moved
its adoption:
RESOUITION ACCEPTING BID
AND APPROVING CONTRACT FORM
WHEREAS,, the Village Administrator and the Village
Engineer have reported that on August 4, 1960 at
11:00 A. M. they opened and tabulated bids received
for sanitary sewer and water main project Nos.
1960 -10, 11, 12, 14, 22, 2 9, 41 , 42 , 510 57 and
59, and that said bids were as follows:

Council of the Village of Brooklyn Center that the
bid of Barbarossa & Sons in the amount of $131,971.50
as to the furnishing of all work, labor and material
in connection with sanitary sewer and water main
improvement project Nos. 1960 -10, 11, 12, 14, 22, 29,
41, 42, 51, 57 81nd 59 according to the plans and
specifications therefor now on file in the office
of the Village Clerk is deemed to be the lowest
and best bid submitted for said work by a respon-
sible bidder, and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly
P+ co aded by member Wayne Gageby, and upon vote being taken thereon
the following voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby, Russ Jones and Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
The mayor announced that the meeting was open for the considera-
tion of proposed Street Surfacing Improvement No. 1960 -62.
F The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks' publication thereof
in the official newspaper, the last publication being on August 18,
1960, which affidavit was examined and found satisfactory and
ordered placed on file.
The mayor then called upon all property owaaers present to present
arguments eitba r for or against the proposed improvements. After
hearing and considering all objections, and the property owners
appearing in favor of said improvement, Member Carl Carlson
introduced the following resolution and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF
STREET SURFACING IMPROVEMENT N0. 1960 -62
AND ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as
follows:
1. It is hereby determined that it is necessary
and for the best interests of the Village and
the owners of property specially benefited thereby
that the following improvement shall be constructed:
Construction of street surfacing on 54th Avenue
North from France to Sailor Lane and on Sailor
Lane from 55th Avenue North to 53rd Place.
2. The plans and specifications for said improve-
ment shall be prepared by Graydon R. Boeck, Village
Engineer.
The motion for the adoption of the foregoing resolution was duly
seconded by member Wayne Gageby, and upon vote being taken thereon.,
the following voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby, Russ Jones,
and the following voted against the same: Clifford Wellman,
whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Clifford Wellman to return
the bids for water meters to the suppliers unopened inasmuch as
all the meters authorised under the last contract have not been
purchased to date. Motion carried.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING
ON PROPOSED STREET SURFACING DWROVEMENT N0. 1960 -60
WHEREAS, it is proposed that there be constructed
an improvement consisting of the following:
Construction of street surfacing on June Avenue
North from 69th Ave. No. to 70th Ave. No. and
On 70th Ave. No. from June Ave. No. to Halifax
Ave. No.

WHEREAS, the Village Engineer has made a preliminary
report advising that said proposed improvement is
feasible and that it can be constructed at an
6 estimated cost of $1,837.00.
NOW, THEREFORE, BE IT RESOLVED, by the Village
Council of the Village of Brooklyn Center, Minnesota,
as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953, as
amended.
2. A public hearing on the proposed improvement
shall be held at the Village Hall in the Village on
Monday, the 26th day of September, 1960 at 8:00
o'clock P. M., and the clerk shall publish notice
of the time and place of hearing by two weeks'
publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improve-
ment is as follows:
ALL PARCELS OF PRCIPERTY ABUTTING ON THE ABOVE NAMED
STREETS WHERE THE PROJECT IS TO BE CONSTRUCTED.
4. This proposed improvement shall be designated
Street Surfacing Improvement No.- 1960 -60.
The motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson, and upon vote being taken thereon,
the following voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby, Russ Jones and Clifford Wellman
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
Member Russ Jones introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING} FOR PUBLIC HEARING ON
PROPOSED WATER IMPROVEmErT N0. 1960 -63 AND PROVIDING
FOR REIMBURSEMENT OF UNASSESSED COST OF WATER
impwyEMENT N0. 1956 -19 AND 1960 -i
WHEREAS, it is proposed that there be constructed
improvement consisting of the following:
Construction of water supply system including wells,
tanks, feeder mains, laterals, service connections
and appurtenances to provide water service along
the following described streets:
On June Avenue North from 69th Ave. No. to 70th
Ave. No., and
On 70th Avenue North from June Ave. No. to
Indiana Ave. No.
WHEREAS, the Village Engineer has made a preliminary
report advising that said proposed improvement is
feasible and that it can be constructed at an
estimated cost of $7,161.50.

NOW, THEREFORE, BE IT RESOLVED, by the Village
Council of the Village of Brooklyn Center,
Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953.,
as amended.
2. A public hearing on the proposed improvement
shall be held at the Village Hall in the Village
on Monday, the 26th day of September, 1960 at
8:00 P.M. and the Clerk shall publish notice of
the time and place of hearing by two weeks' publica-
tion in the official newspaper of the village.
3. The area proposed to be assessed for said improve-
ment is as follows:

4. This proposed improvement shall be designated
Water improvement No. 1960-63 -
BE IT MTHER RESOLVED, by the Village Council of
the Village of Brooklyn Center, Minnesota, that
it is hereby determined that the properties which
will be served by Water Improvement No. 1960 -63
when said improvement is completed, will also be
benefited by Water Improvement 1956 -19 and 1960 -1,
which property was not initially assessed for
Water Improvement No. 1956 -19 and 1960 -1 and that
as to expenditures made for Water Improvement No.
1956 -19 and 1960 -1 from general ad valorem tax
levies or other sources and funds in addition, to
special assessments heretofore made for said
improvement the Village shall be reimbursed therefor
by adding $500.00 to the assessments to be levied
for Water Improvement No. 1960 -63 and the Village
Clerk shall cause notice that such additional
amounts will be assessed to be included in the notice
of hearing in the making of said Water Improvement
No. 1960 -63.
The motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson, and upon vote being taken thereon,
the fallowing voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby, Russ Jones and Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved
its adoption:

ON PROPOSED SANITARY SEWER IMPROVEM W NO. 1960 -64
WHEREAS, it is proposed that there be constructed
an improvement consisting of the followings
CONSTRUCTION OF SANITARY SEWER LATERALS:
On Drew Avenue North from 50th Ave. No. to 53rd Ave. No.
On 53rd Avenue North from Ewing Ave. No. to Northport Drive
On Northport Drive from 53rd Avenue No- to 53rd Place.

WHEREAS, the tillage Engineer has mad I e a preliminary
report advi0ing that said proposed improvement is
feasible and that it can tie constructed at an esti-
mated cost. $29,584.85.

1. The council proposes to proceed coder authority
granted by Chapter 398, Laws of Minnesota, 1053, as
amended.
2. A public hearing on the proposed improvement
shall be held at the Village Hall, in the Village
on Monday, the 26th day of September, 1960, at
8:00 o'elock P.M., and the clerk shall publish
notice of the time and place of hearing by two
weeks' publication in the official newspaper of
the Village.
3. The area proposed to be assessed for said improve-
ment is as follows:
ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED
STREETS WHERE THE PROJECT IS TO BE CONSTRUCTED
4. This proposed improvement shall be designated
Sanitary Sewer Improvement No. 1960 -64.
The motion for the adoption of the foregoing resolution was duly f

and the following voted against the same: None

Member Carl Carlson introduced the following resolution and moved
its adoption:

PROPOSED STORM SEWER IWROVEWM PROJECT N0. 1960 -55
WHEREAS, it is proposed that there be constructed
an improvement consisting of the following:
Construction of a storm sewer on 65th Ave. North
from Bryant Ave. North to Humboldt Ave. No. to
serve the area within the following boundaries:
Beginning at the intersection of Bryant Ave. No.
and 65th Ave. No.; thence west alo n 65 th Ave. No.

178* to the back lot line of Hohenstein's Addition,
thence south along the back lot line of Hohenstein's
Addition to the north line of Frank Burch's 4th
Addition, thence west along the north line of Frank
Burch's 4th Addition to the back lot line of Lot 1,

along the back lot line a distance of 149.25 feet
to the intersection of the north line of Frank Burch's

WHEREAS, the Village Engineer has made a preliminary
report advising that said proposed improvement is
feasible and that it can be constructed at an esti-
mated cost of $114,500.00.
NOW, THEREFORE, BE IT RESOLVED, by the Village Council
of the Village of Brooklyn Center, Minnesota, as
follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953,
as amended.
2. A public hearing on the proposed improvement
shall be held at the Village Hall in the Village
on Monday, the 12th day of September, 1960 at 8:00
o'clock P.M., and the clerk shall publish notice
of the time and place of hearing by two weeks'
publication in the official newspaper of the village.
3. The area proposed to be assessed for said improve -
ment is as follows:
ALL LOTS AND PARCELS LYING WITHIN THE ABOVE DESCRIBED
PROPERTY TO BE SERVED, AND WHERE THE PROJECT IS TO
BE CONSTRUCTED.
4. This proposed improvement shall be designated
Storm Sewer Improvement No. 1960 -S5.
5. This hearing shall be held to correct the omission
of certain property from the above - described area as
originally set forth in notices published in the
official newspaper prior to the hearing previously
held on June 27, 1960 for the same improvement.
The motion for the adoption of the foregoing resolution was duly
seconded by member Wayne Gageby, and upon vote being taken thereon,
the following voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby, Russ Jones, Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.

Motion by Wayne Gageby and seconded by Russ Jones that the Village
Council accept the final plat of Hipp's East Palmer Lake Addition,
subject to the platting ordinance and bond, and subject to checking
against preliminary plat by the Village Engineer. Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby that the final
plat of Elsen's City View 3rd Addition be accepted subject to
platting ordinance and bond. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that
$96.16 be refunded to Prudential Insurance Co. since, through
clerical error, Prudential Insurance Co. paid one year's special
assessments twice on Lot 3, Block 2, Garden City 5th Addition.
Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman to approve
a negotiated contract with Peter Lametti Construction Co. for a
water main extension to connect Well No. a to the Village water
system. The low negotiated contract is for $1,864.50. Motion
carried.
Motion by Wayne Gageby and seconded by Carl Carlson to approve
the following applications for licenses:

Vending Truck License Elmer E. Rockett
Vol 65th Avenue North
Well Drilling License E. H. Renner & Sons, Inc.

Motion carried.
The application for an off -sale 3.2 beer license for B & B Cafe was
not approved.
Motion by Clifford Wellman and seconded by Russ Jones to instruct
our Chief of Police to investigate the feasibility of issuing
off -sale beer licenses to restaurants and other related businesses.
Motion carried.
Member Wayne Gageby introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID

WHEREAS, the Village Administrator and the Village
Engineer have reported that on August 11, 1960 at
11:00 A.M., they opened and tabulated bids received
for Bituminous Street Surfacing Project No. 1960 -58,
and that said bids were as follows:

NOW, THEREFORE, BE IT RESOLVED, by the Village Council
of the Village of Brooklyn Center that the bid of
Barton Construction Co. in the amount of $78,509-
as to the furnishing of all work, labor and material
in connection with Bituminous Street Surfacing Im-
provement Project No. 1960 -58 according to the plans
and specifications therefor, now on file in the office
of the Village Clerk is deemed to be the lowest and
best bid submitted for said work by a responsible
bidder, and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson, and upon vote being taken thereon,
the following voted in favor thereof: William Super, Carl Carlson,
Wayne Gageby and Russ Jones.,
and the following voted against the same: Clifford Wellman,
whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Clifford Wellman to release
Donnay's street bond for Donnay's Brooklyn Gardens 4th Addition and
Registered Land Survey 755 in the amount of $20,900. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman to release
Donnay's street bond for Donnay's Brooklyn Gardens 5th Addition in
the amount of $32,000. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman on the
recommendation of the Village Administrator to release all remaining
street bonds for Garden City Additions subject to the condition
that a bond in the amount of $3,200 be posted to guarantee completion
Of sodding on various vacant lots and street surfacing on Beard
Avenue south of Lawrence Road. Motion carried.
Motion by Carl Carlson and seconded by Russ Jones to favor a point
agreement for engineering studies with Robbinsdale and Crystal
relative to Twin Lake water level. Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson to instruct
the Village Attorney to draft an ordinance relative to requiring
connection to sanitary sewer laterals within one year when sewer
is available. Motion carried.
It was the concensus of opinion of the Council members to take no
appeal from the awards made by the Commissioners of Condemnation
for the sanitary sewer interceptor from 61st Avenue to 70th Avenue
and along 70th Avenue from the Mississippi River to Logan Avenue.
Member Russ Jones introduced the following resolution and moved
its adoption:
RESOLUTION AMENDING TAKIM
IN EMINENT DOM IN PROCEEDINGS
ALOxG 65TH AVENUE NORTH
BE IT RESOLVED, by the Village Council of the Village
of Brooklyn Center as follows:

1. It is recited that the Village Engineer has
recommended that the taking along 65th Avenue
for street purposes heretofore authorized insofar
as said taking affects a part of Lot 3, Mendenhall's
Outlots, be reduced from a 40 foot strip to 30 feet.
2. The taking as to said property for street pur-
poses is therefore amended so that the property to
be taken for such purposes shall be described as
follows:
The South 30 feet of the following described property:
The South 2 acres of Lot 3, Mendenhall's Outlots,
Hennepin County, being more particularly described
as that part of Lot 45, Auditor's Subdivision No.
310, Hennepin County, Minnesota, included within
the south 2 acres of Lot 3, Mendenhall's Outlots,
Hennepin County, Minnesota.
The motion for the adoption of the foregoing resolution was duly
seconded by member Wayne Gageby, and upon vote being taken thereon,
the following voted in favor thereof: William Super, Wayne Gageby,
Russ Jones, Carl Carlson and Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Carl Carlson to authorize
the Village Administrator to prepare specifications and advertise
for bids for a billing machine to be paid for out of public
utilities funds to be used by the Public Utilities Department.
Bids are to be opened on September 8, 1960, at 11 :00 A. M. Motion
carried.
Motion by Russ Jones and seconded by Carl Carlson to reject the
position taken by the State of Minnesota Department of Highways in
EL letter dated July 22, 1960, (copy of which is attached) relative
to approval of preliminary plans for Interstate Highway No. 94
in Brooklyn Center and to instruct the Village Engineer to send a
letter to the Highway Department to the effect that we still hold
to the position taken at the council meeting of June 6, 1960, as
set forth in a letter to the Highway Department from the Village
Administrator, dated June 8, 1960. Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson to approve the
investing of Fire Department Relief Association funds.. Motion
carried.
Member Carl Carlson iutroduct,the fallowing resolution and moved
its adoption:
RESOLMION PROVIDING FOR THE ISSUANCE AND SALE
OF $200 IMPROVEMENT BONDS
WHEREAS, the Village Council has heretofore entered
into contracts for the construction of Water limprove-
ments 1956 -19, parts 1, 2 and 3, pursuant to the
provisions of Chapter 398, Laws of Minnesota 1953
as amended, and

WHEREAS, the total cost of said improvement has
heretofore been determined to be in the sun of
$52$,000, a portion of which has been financed by
' the issuance of bonds, and
WHEREAS, there has been heretofore created Improve -
ment No. 1956 -B Fund out of which has been paid the
cost of said ovements and into which is being
ng
paid the proceeds of the special assessments and
taxes heretofore levied for said improvement, and
WHEREAS, it presently appears advisable to the
Village Council to issue improvement bonds to
finance the balance of the cost of said improvement
to replace temporary financing heretofore utilized
by the Village to pay the costs thereof,
NOW, THEREFORE, BE IT RESOLVED, by the Village
Council of the Village of Brooklyn Center as follows:
I. It is hereby determined to finance a portion of
the cost of Water Improvement No. 1956 -19, parts 1,
2 and 3, by the issuance of improvement bonds.
2. In anticipation of the collection of the special
assessments and taxes heretofore levied and payable
into Improvement No. 1956 -B Fund, the Village shall
forthwith issue and sell $200,000 Improvement bonds.
The full faith and credit of the Village shall be
pledged for the payment of the principal and interest
oa the bonds when the monies on hand in Improvement
No. 1956 -B Fund are insufficient for the purpose.
3. The improvement bonds shall be 200 in number and
numbered 1 to 200, both inclusive, in the denomina-
tion of $1,000 each, shall bear date October 1, 1960,
shall bear interest payable July 1, 1961 and semi-
annually thereafter on January 1 and July 1 in each
Year. Said bonds shall mature serially on January 1
In the years and amounts as follows: $50,000 in each
of the years January 1, 1963 thru 1966, both inclusive.
Said bonds shall be issued without option of prior
payment. The full faith and credit of the Village
shall be pledged to payment of said bonds.
4. The offer of Kalman & Company of Minneapolis,
Minnesota to purchase said bonds at per plus accrued
interest with said bonds to bear the following rates
of interest:
3.4% on aXl bonds maturing January 1, 1963 through
1966, both inclusive plus separate and additional
interest coupons on all bonds at the annual rate
Of 1% from January 1, 1961 to January 1, 1963, is
hereby accepted.
5. Both principal and interest shall be payable at
the Main Office of the Northwestern National Bank of
Minneapolis.. Minnesota, and the Village shall pay
the reasonable charges of said bank for its services
as paying agent.

6. The bonds and interest coupons to be thereto
attached shall be in substantially the following
form:

KNOW ALL MEN BY THESE PRESENTS, That the Village of
Brooklyn Center, Hennepin County, Minnesota, acknowledges
itself to be indebted and for value received hereby prom-
ises to pay to bearer out of Improvement No. 1956 -B Fund
the sum of ONE THOUSAW DOLLARS on the lot day of January,
19 , and to pay interest thereon at the rate of three
and forty hundredths percent (3.40%) per annum together
with additional interest at the rate of one percent (1 %)
per annum for the period from Jan l l 61 to January 1

1963 represented by separate coupons, all interest payable
July 1, 1961 and semiannually thereafter on the lst day
of January and the lot day of July in each year in accor-
dance with and upon presentation and surrender of the
attached interest coupons as they severally become due.
Both principal of and interest on this bond are payable
at the main office of the Northwestern National Bank of
Minneapolis, Minneapolis, Minnesota, in any coin or
currency of the United States of America which at the
date of payment Is legal tender for public and private
debts.
This bond is one of an issue of bonds in the total
principal amount of $200,000, all of like date and tenor
except as to maturity, all issued pursuant to and in f ll.

bond have been done, have happened and have been performed

date of its actual issuame and delivery does not exceed

due on its Improvement Bond dated October 1, 1960, lvo.

The Village has agreed to furnish the approving legal
opinion of Messrs. Howard, Peterson, LeFevere, Lefler and
Haertzen to the purchasers and such opinion is hereby re-
quested. The clerk is authorized and directed to cause a
COPY of such opinion to be printed on each of such bonds
and to certify on each bond to the fact that such opinion
is on file in his office prior to the delivery of such
bonds, which certificate shall be in substantially the
following form:
We hereby certify that we have examined certified
copies of proceedings taken preliminary to and in
the issuance by Village of Brooklyn Center, Hennepin
County, Minnesota, of its Improvement Bonds of 1960
In the total principal amount of Two Hundred Thousand
Dollars ($200,000), dated October 1, 1960, said bonds
being 200 in number and numbered 1 to 200, both
inclusive, and in the denomination of One Thousand
Dollars ($1,000) each, all bearing interest at the
rate of three and forty hundredths percent (3.40%)
per annum, together with additional interest on all
bonds for the period from January 1, 1961 to
January 1, 1963 at the rate of one percent (1.00%)
per annum represented by separate coupons, all
interest payable July 1, 1961, and semiannually
thereafter on the lot day of January and the 1st
day of July in each year and which bonds mature
serially on January let in the years and amounts as
follows:

Fifty Thousand Dollars ($5o,000) in 1963 to 1966
both inclusive, without option of prior payment,
both principal and interest payable at the North-
western National Bank of Minneapolis in the City
P of Minneapolis, Minnesota; and in our opinion such
proceedings show lawful authority for the said issue
under the laws of the State of Minnesota now in
force.
We further certify that we have examined one of the
bonds (No. 1) prepared and executed for said issue
and find the same to be in due form of law and prop-
erly executed, and in our opinion said bonds are
valid and binding general obligations of the Village,
Payable primarily from special assessments hereto-
fore or hereafter levied for various improvements of
said Village, but the full faith and credit of the
Village is pledged for their payment, and the Council
has obligated itself to levy ad valorem taxes in
event of any deficiency in the fund, which may be
levied upon all taxable property in the Village with -
out limitation as to rate or amount.

I, the undersigned, Clerk of the Village of Brooklyn
Center, Minnesota, hereby certify that the above is a full,
true and correct copy of the legal opinion of Messrs. Howard,
Peterson, LeFevere, Lefler and Haertzen of Minneapolis,
Minnesota, which was delivered to me prior to the delivery
of this bond and is on file in my office.

7. The Clerk is directed to cause said bonds to
be prepared and the Clerk and Mayor are authorized
and directed to execute the same and affix the
Village seal thereto and to cause the interest
coupons to be executed and authenticated by the
printed facsimile signatures of said officers.
8. The bonds issued hereunder shall be payable
from Improvement No. 1956.E Fund. If any payment
of principal or interest on said bonds shall become
due when there is not sufficient money in said fund
to pay the same, the Treasurer shall pay such prin-
cipal or interest from the general fund of the
Village and such fund shall be reimbursed for such
advances out of proceeds of assessments for said
improvement when collected.
9. The estimated collection of special assessments
together with ad valorem tax levies hereby authorized
and certified to the County Auditor and other reve-
nues pledged for the payment of said bonds will
Produce at least five percent (5 %) in excess of the
amount needed to asset, when due, the principal and
interest payments on the bonds. The Clerk shall
deliver a certified copy of this resolution to the
County Auditor of Hennepin County and obtain his
certificate as required by Section 475.63, Minnesota
Statutes.

10. The said bonds, when fully executed, shall be
delivered by the Treasurer to the lu rcbaser thereof
upon receipt of the purchase price, and the said
purchaser shall not be o?aligated to see to the proper
application thereof.
11. The Clerk and Treasurer are authorized and
directed to prepare and furnish to the purchaser
and to the attorneys approving said issue certified
copies of all proceedings and records relating to the
issuance of said bonds and to the right, power and
authority of the Village and its officers to issue
the same and said certified copies and certificates
shall be deemed the representations of the Village
as to all matters stated therein.
The motion for the adoption of the foregoing resolution was duly
seconded by member Clifford Wellman, and upon vote being taken there-
on, the following voted in favor thereof: William Super, Wayne
Gageby, Russ Jones, Carl Carlson and Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.

Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING WORK
CONMCTED BY VILLAGE
WHEREAS, pursuant to a written contract signed with
the Village of Brooklyn Center, Minnesota, Peter
Lametti Construction Company has satisfactorily
completed the following improvement in accordance
with said contract:
Sanitary Sewer Improvement Project No. 1959 -19B
(Interceptor on Northern States Power Easement
from Lyndale Ave. No. to Logan Ave. No.)
NOW, THEREFORE, BE IT RESOLVED, by the Village
Council of the Village of Brooklyn Center:
1. The work completed under said contract is
hereby accepted and approved, upon recommendation
of the Village Engineer.
2. The value of work performed (exceeded - is less
than) the original, contract amount by $4,662.33
because of Engineering coats incurred after comple-
tion date and minor replacement costs retained.

3. The Village Officials are hereby directed to
issue proper order for final payment on said con-
tract, taking the contractor's receipt in full.
The total amount paid for said improvement project
being $130,271.71.
The motion for the adoption of the foregoing resolution was duly
seconded by member Clifford Wellman, and upon vote being taken
thereon, the following voted in favor thereof: William Super,
Carl Carlson, Russ Jones, Wayne Gageby and Clifford Wellman,
and the following voted against the same: None
whereupon said resolution was duly passed and adopted.
The bills set forth on the schedule attached to these Minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at
