Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota September 12, 1960 The Village Council met in regular session and was called to order by Mayor William Super at 7 :30 P.M. Roll Call: Mayor William Super, Clifford Wellman, Russ Jones, Wayne Gageby, and Carl Carlson were present. Motion by Carl Carlson and seconded by Russ Jones that the Minutes of the Regular meeting of August 22, 1960, and the Special meeting of September 6, 1960, be approved as recorded. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson to accept the low bid of Burroughs Corporation for a P404 -11 Sensimatic Billing Machine in the amount of $3,854.80. The other bid, rceived from National Cash Register Co. was in the amount of $3,902.55 for a Model 32 -1A Accounting Machine. An alternate bid from National Cash Register Co. in the amount of $3,266.78 was for a Model 42 -11 billing machine, which did not meet our specifications. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby to uphold the recom- mendation of the Planning Commission to divide Lot 20, Aud. Sub #216, Into a 62.6 foot lot and a 87.4 foot lot, due to an error by the surveyor in tak- ing center line of Bass Lake Road as property line, provided survey certi- ficates be submitted accordingly. Those voting in favor thereof: Carl Carlson, William Super, Russ Jones, Wayne Gageby; and the following voted against the same: Clifford Wellman; whereupon said motion was carried. Motion by Wayne Gageby and seconded by Carl Carlson to uphold the recommenda- tion of the Planning Commission to approve the Digatano Addition as sub - mitted. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold the re- commendation of the Planning Commission to grant a Special Use Permit to Henry Woyke, to move a house with an apartment on second floor to 6706 Grimes Avenue because the State Highway Department has acquired the property which is now located at 6646 Osseo Road for the freeway, provided that proper exits conform to the building ordinance; plumbing and sanitary facilities conform to the plumbing ordinance; and electrical wiring and appliances be according to the electrical code. A variance from the minimum lot size required for duplex is also granted. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1960 -S5. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on September 8, 1960, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present argu- ments either for or against the proposed improvement. After hearing and considering all objections, and the propgrty owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption; RESOLUTION ORDERING CONS'T'RUCTION OF STORM SEWER TMPRGVEMENT N0. 196o -55 AND ORDERING TREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows; 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed. Storm Sewer Interceptor on 65th Avenue North from Bryant Avenue North to Humboldt Avenue North. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Company. 3. This hearing was held to correct the omission of certain property from the originally described area as was set forth in notices published in the official newspaper prior to the hearing on June 27, 1960, for the same improvement. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being thereon the following g voted in favor thereof: William Super, Russ Jones, Wayne Gageby, Carl Carlson, Clifford Wellman, and the following voted against the same: none; whereupon said resolution was declared Quly passed and adopted. Motion by Carl Carlson and seconded by Clifford Wellman that the Village enter into a contract, as amended, with Community Planning & Design Associates, Inc., St. Paul, for planning an industrial park. Motion carried. Motion by Wayne Gageby and seconded by Russ Jones to approve, on the recom- mendation of the Village Administrator, the release of all previous street bonds for Garden City Development Company and accept from Winston Bros. Co. $700,00, to be held in escrow in the Investment Trust Fund for future street surfacing on Beard Avenue south of Lawrence Road, and the posting of a $2000 bond to complete sodding requirements in all their plats. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson to release the street bond on Northbrook Manor 4th Addition, on the recommendation of the Village Administrator, in lieu of the posting of a reduced bond to guarantee the completion of sodding and installation of boulevard trees; the amount of the reduced bond to be determined by the Engineering Department of the Village. Motion carried. Motion by Russ Jones and seconded by Carl Carlson to receive the petitions for construction of sanitary sewer in the Lakebreeze Addition and the area below Highway 100 near Cook's Paint, 4800 N. Lilac Drive. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby to receive the petitions for street surfacing on 73d Avenue North from Lyndale Avenue to Newton Avenue. Motion carried. Motion by Russ Jones and seconded by Wayne Gageby to authorize the Purchas- ing Agent to prepare specifications and advertise for bids for a low -boy trailer; bids to be opened on October 7, 1960 at 11:00 A.M., and to purchase a salt spreader and radio to be used by the Street Department. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to accept the Auditor's Report, dated December 31, 1959, from Zimmerman & Moen, Certified Public Accountants, 24 South 6th Street, Minneapolis. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING CANCELLATION AND TRANSFER OF FUND BALANCES WHEREAS, the Village Auditor has recommended the cancellation of certain uncollectible accounts and the transfer of certain funds to correctly _o represent the status of the various fund balances of the village accounts, and WHEREAS, the Village Council has examined the memorandum submitted by the Auditor in support of these suggested cancellations and transfers, and WHEREAS, it appears that said memorandum should be made a part of the minutes as substantiation for the proposed action by the Village Council, NOW, THEREFORE, BE IT RESOLVED BY THE Village Council of the Village of Brooklyn Center as follows: 1. The memorandum entitled "Village of Brooklyn Center, December 31, 1959 - Notes on Resolution To Be Drafted In August 1960 by Village Attorney" is hereby adopted by reference and the original of said memorandum shall be attached to these minutes and made a part hereof. 2. The accounts set forth on page 1 of said memorandum to be charged off, namely the amount of $20.00 in the General Fund, $22.80 in the Poor Fun in Li Fund, 1�+ . �+6 in the d the amount of 1 6. 0 e Public Utilities Fun $ 3 $9 5 q uor Store #1 Fund are hereby cancelled and discharged, the said accounts either being uncollectible or collectible only at a cost which would exceed the anticipated collections. 3. The following special assessment funds shall be closed as of December 31, 1959 and the balances therein transferred to the principal and interest redemption fund: 1955 A 1956 B 1957 A and B 4. With respect to Bond Fund 1958 -B, the amount of appropriation to said bond fund is hereby amended to be the sum of $413,922.04. Said fund is hereby closed and the balance therein remaining shall be transferred to the principal and interest redemption fund for said bonds. 5. There is hereby approved the transfer of $30,130.53 from the 1957 AB Fund to the 1956 B Fund based upon the information set forth on page 3 of said memorandum. 6. The 1960 budget appropriations are hereby reduced in the sum of $3,178 to reflect the transactions set forth on page 4 of said memorandum. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman and upon vote being taken thereon the following votes, in favor thereof: William Super, Russ Jones, Wayne Gageby, Carl Carlson, Clifford Wellman, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted. Motion by Russ Jones and seconded by Wayne Gageby to receive petitions for opening of the street, grading and surfacing of the street and the construc- tion of sanitary sewer along the Mississippi River across lots 7, 8, 9, 10, 11, 12 and 1 Aud. Motion by Wayne Gageby and seconded by Carl Carlson to approve the applica- tion of B & B Cafe, 3701 50th Avenue North, for a non - intoxicating malt liquor license. Those voting in favor thereof: Carl Carlson, William Super, Russ Jones, Wayne Gageby; and the following voted against the same: Clifford Wellman; whereupon said motion was carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING MUNICIPAL STATE AID HIGHWAYS WHEREAS, it appears to the Village Council of the Village of Brooklyn Center that the streets hereinafter described should be designated Municipal State Aid Streets under the provisions of Minnesota Laws of 1959, Chapter 500: NOW, THMWCRE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the streets described as follows, to -wit: NO. BE IT FURTHER RESOLVED, that the Village Clerk is hereby authorized and directed to forward two certified copies of this Resolution to the Commissioner of Highways for his consideration, and that upon his approval of the designation of said streets or portion thereof, that same be cons tructed, improved and maintained as Municipal State Aid Streets of the Village of Brooklyn Center, to be numbered and known as Municipal State Aid Streets as indicated above. The motion for the adoption of the foregoing resolution was duly seconded by Russ Jones and upon vote being taken thereon the following voted in favor thereof: William Super, Russ Jones, Wayne Gageby, Carl Carlson, Clifford Wellman, and the following voted against the same: none, whereupon said resolution was declared duly passed and adopted.. Motion by Carl Carlson and seconded by Clifford Wellman to accept the final plat of Busse - Erickson Addition subject to platting ordinance and bond. Motion carried. -k- Member Wayne Gageby introduced the following amendment to the Village Ordinances and moved its adoption: AN rSDIMME RELATING TO SANITARY SEWER CONNECTIONS IN THE VILLAGE OF BROOKLYN CENTER AND AMENDING CHAPTER 7 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS: Section 1. Section 7 -306 of the village ordinances concerning VIOLATIONS AND PENALTIES is hereby renumbered as Section 7 -308. Section 2. There is hereby adopted a new Section 7 -306 and a new Section 7 -307 of the village ordinances which shall read as follows: Section 7 -306 PLUMBING CONNECTION REQUIRED. Every building, dwelling or other structure in which plumbing exists or is to be installed shall be connected with the Village sanitary sewer system whenever such system is provided in the street upon which such building, dwelling or other structure fronts or is adjacent thereto within the period prescribed in Section 7 -307. Section 7 -307. TIME LIMITATION. Such connection shall be made and thereafter continued within one year after the effective date of this ordinance, or if no sewer system is presently available, then such connection shall be made within one year after such sanitary sewer system is provided. Section 3. This ordinance shall take effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Russ Jones, Clifford Wellman and Wayne Gageby and the following voted against the same: none; whereupon said ordinance was declared duly passed and adopted. Motion by Wayne Gageby and seconded by Clifford Wellman to hold a hearing on Special Assessments at the Village Hall on October 6, 1960, at 8 :00 P.M. Motion carried. The inequity was caused by the following sequence of events; Initially, certain projects were authorized) constructed and assessed to the �enefitted property owners under the 1956 B Fund, but they were financed by the issuance of bonds under the 1957 AB Fund, To correct this ,situation the financing costs (principal and interest on bands payable) were paid to the 1957 AB Fund out of the 1956 B Fund„ Subsequently, however, the costs of the projects authorized under 1956 B Fund along with inter - related projects authorized under the 1957 AB- Fund were erroneously assessed under the same levy number. Because of this error, assessment receipts can be properly allocated to the two funds only after a complete detailed analysis is made of assessments received under one levy number.
