Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
September 26, 1960
The Village Council met in regular session and was called to order
by Mayor William Super at 8 :15 P.M.
Roll Call: Mayor William Super, Clifford Wellman, Russ Jones,
Wayne Gageby and Carl Carlson were present.
Motion by Wayne Gageby and seconded by Carl Carlson to approve the
minutes of the Regular meeting of September 12, 1960. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby to receive the
petition of the Willow Lane PTA concerning School Crossings at 69th and
Quail and 71st and Osseo Road and to request Traffic Signal surveys by the
Department of Highways. Motion carried.
Motion by Clifford Wellman and seconded by Wayne Gageby to authorize
the use of police officers to direct traffic at the school crossing at 71st
and Osseo Road and 65th and Osseo Road until the matter of the feasibility
of school crossing signals has been determined. Motion carried.
Motion by Russ Jones and seconded by Carl Carlson to receive the
request from the Garden City PTA regarding school signals at 65th and
Osseo Road. Motion carried.
Member Russ Jones introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HvARING ON
PROPOSED SANITARY SEWER IMPROVEMENT N0. 1960-66
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of sanitary sewer laterals and lift station
to serve the following described property:
The area bounded on the south by the Village Limits, on
the west by Twin Lake, on the east by the Village Limits
and on the north by the Soo Line Railroad tracks.
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it
can be constructed at an estimated cost of $160,800.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
I. The Council proposes to proceed under authority granted
by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 10th day of
October, 1960, at 8 :00 O'clock P.M., and the clerk shall publish
notice of the time and place of hearing by two weeks' publication
in the official newspaper of the village.
3. The area proposed to be assessed is as follows:
ALL PARCELS OF PROPERTY WITHIN THE ABOVE DESCRIBED AREA
AND BENEFITTED THEREBY.
` 4. This proposed improvement shall be designated Sanitary
Sewer Improvement Project No. 1960 -66.
5• Plans, specifications and estimates to be prepared by
Minder Engineering Co.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon, the following
voted in favor thereof: William Super, Russ Jones, Clifford Wellman,
Carl Carlson and Wayne Gageby, and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for the consideration
of proposed Sanitary Sewer Improvement No. 1960 -64.
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks' publication thereof in the
official newspaper, the last publication being on September 8, 1960, which
affidavit was examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member Wayne Gageby introduced the following resolution and
moved its adoption:

The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Wayne Gageby, Russ Jones, William Super
and Clifford Wellman; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.

NO. 1956 -19 and 1960 -i AND ORDERING
PREPARATION OF PLANS AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially
benefitted thereby that the following improvements shall be
constructed:
Construction of Water Main on June Ave. No. from 69th to
70th Avenues North, and on 70th Avenue North from June
Ave. No. to Indiana Ave. No.
2. The plans and specifications for said improvement shall be
prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Wayne Gageby, Russ Jones, William Super
and Clifford Wellman; and the following voted against the same: None;
whereupon said resolution was declared duly passed and.adopted.
- Motion by Russ Jones and seconded by Wayne Gageby to continue the
hearing on Improvement No. 1960 -60 to November 28, 1960. Motion carried.
Motion by Clifford Wellman and seconded by Russ Jones to uphold
the recommendations of the Planning Commission to grant a variance to
Fred Hey, 3527 York Avenue North, to build a two - story, single - family,
colonial -style dwelling at 6122 Camden Avenue North, Lot 12, Block 1,
Sonnenberg's Addition, which has a first floor square foot area of 770
square feet, instead of the 1,020 square feet required in the village
ordinance because the proposed dwelling will conform with the houses in the
immediate area. Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby to appoint
Robert Brose as a Special Police Officer to work at Shoppers' City, as
requested by Shoppers' City. Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson that it be
recorded in the Minutes of the Village Council that the Village of
Brooklyn Certer recognizes its responsibility to maintain the river bank
along the Mississippi River at the residence of Guy Bobendrier where it may
have been disturbed by sewer construction, and if there is damage to the
bank during the spring flood stage that the Village of Brooklyn Center will
make the necessary repairs to the river bank. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Audit Report as submitted by Zimmerman and Moen be published. Motion carried.
Member Carl Carlson introduced the following ordinance and moved
its adoption:
AN ORDINANCE REGULATING THE DESIGN, SPECIFICATIONS AND
INSTALLATION OF ELECTRIC WIRES APPARATUS AND PLANTS,
ADOPTING THE MINNEAPOLIS ORDINANCE BY REFERENCE,
REPEALING SECTION 3 -807 AND AMENDING SECTION 3 -807.2
OF THE VILLAGE ORDINANCES

The Village Council of the Village of Brooklyn Center ordains:
Section 1. Section 3 -807 of the Village ordinances is hereby
repealed, and Section 3807.2 of the Village ordinances is hereby amended
to read as follows:
Section 3 -807.2 CONSTRUCTION REQUIREMENTS. Electric wiring
apparatus, plants and installation shall be in strict conformity
with the provisions of this ordinance, the statutes of the State of
Minnesota and the rules and regulations issued by the Railroad
and Warehouse Commission of Minnesota under authority of the state
statutes, and in conformity with the 1960 Electrical Ordinance of
the City of Minneapolis as published and promulgated in pamphlet
form insofar as the same relates to the construction requirements
which are set forth therein, three copies of which shall be kept on
file in the Village Office, Department of Building.
Section 2. This ordinance shall be in full force upon legal
publication thereof.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Wayne Gageby, and upon vote being taken thereon, the following
voted in favor thereof: William Super, Clifford Wellman, Russ Jones,
Wayne Gageby and Carl Carlson, and the following voted against the same:
None; whereupon said ordinance was declared duly passed and adopted.
Member Carl Carlson introduced the following ordinance and moved
its adoption:
AN ORDINANCE REGULATING PERMIT FEES FOR ELECTRICAL WIRING.,
INSTALLATION OF ELECTRICAL WORK OR ELECTRICAL DEVICES,
ADOPTING THE MINNEAPOLIS FEE SCHEDULE BY REFERENCE
AND AMENDING SECTION 3 -818 OF THE VILLAGE ORDINANCES
The Village Council of the Village of Brooklyn Center ordains:
Section 1. Section 3 -818 of the Village Ordinances of the
Village of Brooklyn Center is hereby amended to read as follows:
Section 3 -818. ELECTRICAL FEES. The fee for permits for
the installaton of any electrical work, wiring, or device
shall conform to the electrical fee schedule as contained
in the pamphlet entitled ELECTRICAL ORDINANCE- CITY OF
MINNEAPOLIS- 1960 Edition, which pamphlet contains the
ordinance adopted by the City of Minneapolis, and which
is hereby adopted by reference. Three copies of said
ordinance shall be kept on file in the Village office,
Department of Buildings.
Section 2. This ordinance shall be in full force upon legal
publication hereof.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Wayne Gageby, and upon vote being taken thereon, the following
voted in favor thereof: William Super, Clifford Wellman, Russ Jones,
Wayne Gageby and Carl Carlson; and the f9llowing voted against the same:
None; whereupon said ordinance was declared duly passed and adopted.

Member Carl Carlson introduced the following ordinance and moved
its adoption:
AN ORDINANCE RELATING TO FEES FOR THE INSTALLATION OF
GAS FITTINGS AND GAS BURNING DEVICES AND THE INSTALLATION
OF HEATING, VENTILATING AND AIR CONDITIONING UNITS, AND
AMENDING SECTIONS 3 -820 AND 3-821 OF THE VILLAGE ORDINANCES
The Village Council of the Village of Brooklyn Center ordains:
Section 1. Sections 3 -820 and 821 of the Village Ordinances are
hereby amended to read as follows:
Section 3 -820 GAS FITTING FEES. The following fees shall be charged
for installation of gas piping, fixtures or devices:
a. Gas piping
For any permit for installing gas piping, providing for not to
exceed five gas fixtures or gas devices, $1.50 and for the piping
for each additional fixture provided for, $.25 shall be added to
such permit fee.
Where such permit is issued for both gas piping and plumbing, the
fee shall be equal to the combined fees for each of said classes
of work or installation.
b. Gas Stoves, Ranges, Etc.
For any permit for installing gas stoves, ranges, hot plates, steam
tables, dental devices, refrigerators, retorts, bake ovens, room
heaters, barbecue grilles, hair dryers or other.similar gas burning
devices, having an input not to exceed 200,000 BTU, the fee charged
shall be $1.10 for each such device included in such permit; for
inputs over 200,000 BTU but not to exceed 400,000 BTU, $4.00; for
inputs exceeding 400,000 BTU, the fee shall be as provided in this
section for gas burners for use in connection with a heating system,
which fee shall be in addition to the fee charged, as above provided,
for the installation of any gas piping for said devices and for any
other gas fitting work, if any, included in said permit.
c. Gas Water Heaters
For any permit for installing gas water heaters, the fee charged
shall be $2.00 for each such device included in such permit, which
fee shall be in addition to the fee charged, as above provided, for
the installation of any gas piping for said devices and for any other
gas fitting work, if any, included in said permit.
d. Central Systems, Gas or Oil one percent of the total estimated cost
of the installation up to $30,000 and one -half of one percent
over $30,000 plus $1.50 piping fee. ($14.50 minimum)
Additions and Alterations one percent of the total estimated cost
of the installation up to $30,000 and one -half of one
percent over $30,000. ($5.00 minimum)
Replacemen one percent of the total estimated cost of the installation
($6.50 minimum).
Ventilation: one percent of the total estimated cast of the installation
up to $30,000 and one -half of one percent over $30,000.
($5.00 minimum)
Gas and Oil: conversion burners, unit heaters, wall heaters, space
heaters, etc.
1. up to 500,000 BTU gas or 3 GPH oil input, $6.50 each appliance.
2. having an input exceeding 500,000 BTU gas or 3 GPH oil, one
percent of the total estimated cost of the installation plus
$1.50 piping fee.

3. installation or replacement of a minor appliance, $3.00 for
each appliance.
Conversion from L.P. to Natural Gas: $2.00 for each heating appliance plus
1.00 for each minor appliance.
Process Equipment Same as Central Systems.
Oil Tanks Buried tanks $4.00, exposed tank only $2.00.
ELECTRIC HEATING First 50,000 BTU output $5.00 -- each additional 10,000
BTU $2.00. Additions and alterations to electric heating systemc
shall be same as above.
section 3 -821 HEATING, VENTILATING AND AIR CONDITIONING FEES.
a. Definitions and Explanations
Central Heating For the purpose of this Ordinance, a central
system shall be assumed to mean a self - contained appliance for supplying
hot water, steam or warm air, for heating, by transfer of the heat of
combustion through approved ducts, pipes, etc., designed to heat
spaces remote from or adjacent to the appliance location. A central
system may include heating, ventilating or air conditioning or
any combination thereof.
Duct Furnace A furnace normally installed in distribution
ducts of air conditioning systems to supply warm air for heating.
This definition shall apply only to an appliance which depends for
air circulation on a blower not furnished as part of the furnace and
for the purpose of this Ordinance shall be considered a central
system.
Minor Appliance A minor appliance as referred to in this
Ordinance shall mean an appliance other than space heating, i.e., water
heater, gas range, dryer, etc.
Estimated Cost For the purpose of this Ordinance, all fees
based on one percent of the job shall be assumed to mean one percent
of the estimated cost as indicated on the permit application.
One percent as referred to above shall mean one percent of the
sum of all materials, equipment, labor, profit, and installation costs
necessary for the complete installation of the system involved.
(This, in most cases, may be assumed to be the bid price of the job.)
In the event of any materials, equipment, labor, etc., being
furnished by any owner, tenant, lessee, or other party involved, the
cost of such material, equipment, labor, etc., shall be added to the
estimated cost for fee purposes.
Should any question arise concerning estimated cost, due to the
nature of the circumstances involved, the estimated cost shall in all
cases be subject to the approval of the Building Department.
Divided Responsibility Where an installation, addition or
alteration of any heating system involves more than one contractor,
i.e., one contractor installing the duct work or radiation and
another doing the gas piping, the contractor installing the principal
portion of the system shall be responsible for the principal fee and
the other contractor shall be responsible for the piping permit and
fee.
Permits and fees as outlined above shall in all cases be
subject to the approval of the Building Department.
Multiple Central Systems: For the purpose of this ordinance,
any residence, building, occupancy, etc., having installed more than

one central furnace or boiler, each such furnace or boiler not
inter- connected with another shall be considered a separate system.
Multiple furnaces and /or boilers connected to a common system
of piping and /or duct work shall be considered one system.
b. Fees
Central Systems For the installation of any steam, hot water,
warm air, ventilating or air conditioning central system where the cost
of the proposed work does not exceed One Thousand Three Hundred Dollars
($1300.00), the permit fee shall be $13.00 plus $1.50 piping fee.
For the installation of any steam, hot water, warm air, ventila-
ting or air conditioning central system where the cost of the proposed
work exceeds One Thousand Three Hundred Dollars ($1300.00), the permit
fee shall be one percent of the estimated cost for the first Thirty
Thousand Dollars ($30,000.00) and one -half of one percent thereafter
Plus $1.50 piping fee.
Additions and Alterations For additions, alterations, or
repairs to any central system where the cost of the proposed work does
not exceed Five Hundred Dollars ($500.00), the permit fee shall be
$5.00.
For additions, alterations, or repairs to any central system where
the cost of the proposed work exceeds Five Hundred Dollars ($500.00),
the permit fee shall be one percent of the estimated cost of the job
for the first Thirty Thousand Dollars ($30,000.00) and one -half of one
percent thereafter.
Replacements: For the replacement of any furnace or boiler
in connection with an existing system where the cost of the proposed
work does not exceed Five Hundred Dollars ($500.00), the permit fee
shall be $5.00 plus $1.50 piping fee.
For the replacement of any furnace or boiler in connection with
an existing system where the cost of the proposed work exceeds
Five Hundred Dollars ($500.00), the permit fee shall be one percent of
the estimated cost plus $1.50 piping fee.
Ventilation and Exhaust Systems: For the installation of any
ventilating and/or exhaust system where the cost of the proposed work
does not exceed Five Hundred Dollars ($500.00), the permit fee
shall be $5.00.
For the installation of any ventilating and /or exhaust system when
the cost of the proposed work exceeds Five Hundred Dollars ($500.00),
the permit fee shall be one percent of the estimated cost of the job
for the first Thirty Thousand Dollars ($30,000.00), and one -half of
one percent thereafter.
For the purpose of this ordinance, where "small type" exhaust
fans (100 thru 500 cfm) are installed in dwelling construction, the
system shall be interpreted to mean the entire building. In the case
of commercial and industrial construction, each occupancy shall
constitute a separate system.
Gas and Oil Permits For the installation or replacement of any
conversion burner, unit heater, floor furnace, wall heater, space
heater, etc., having an input not to exceed 500,000 BTU gas or 3
gallons per hour oil, the permit fee shall be $5.00 for installation
of each unit

500 for each opening thereafter.
For the installation or replacement of any conversion burner,
unit heater, floor furnace, wall heater, space heater, etc., having
an input exceeding 500,000 BTU gas or 3 gallons per hour oil, the
permit fee shall be one percent of the estimated cost plus $1.50

piping fee not to exceed five units and 50¢ for each additional
unit.
For the installation or replacement of any range, stove, griddle,
hot plate, dryer, fryer, etc., the permit shall be $3.00 for each
appliance which shall, include the piping fee.
Conversion from L.P. to Natural Gas: For the conversion of
any system from liquified petroleum bottle gas) to natural gas,
the permit fee shall be $2.00 for each space heating appliance and
$1.00 for each minor appliance which shall include the piping fee.
Process Equipment For the installation of any steam, hot
water, or warm air system fired with gas or oil and used in connection
with.a process application or any additions, alterations, repairs, or
replacements thereto, the permit fee shall be based on those as
outlined for central systems. In the case of process systems, for
the purpose of figuring estimated cost, the Building Department may
waive the cost of the equipment used in the particular process
involved, i.e.,,vats, pressers, ovens, etc. The estimated cost
shall always include furnaces, boilers, burners, piping, ductwork,
etc.
Oil Tanks: For the installation of a fuel oil storage tank or
tanks, for use connection with an oil burner installation, where
such tanks are buried or otherwise enclosed, the permit fee shall be
$1+.00.
For the installation of a fuel oil storage tank or tanks only
for use in connection with an oil burner, not underground or
otherwise enclosed, the permit fee shall be $2.004
Stokers and Powdered Fuel Burners For the installation of any
stoker and/or powdered fuel burner, the permit fee shall be one
percent of the estimated cost of the job.
Electric Heating For any permit for the installation,
alterations, addition, or repairs of any electric heating system
the permit fee shall be $5.00 for the first 50,000 BTU output
capacity and $2.00 for each additional 10,000 BTU output capacity
or fraction thereof.
Electric heating systems of the central type i.e., boilers,
fan systems, etc. the permit fee shall be based on the schedule for
central systems.
The above fee shall be in addition to those provided in the
electrical ordinance.
Section 2. This ordinance shall be in full force upon legal
publication hereof.

by member Wayne Gageby, and upon vote being taken thereon, the
following voted in favor thereof: William Super, Clifford Wellman,
Russ Jones, Wayne Gageby and Carl Carlson; and the following voted
against the same: None; whereupon said ordinance was declared duly
passed and adopted.
Motion by Wayne Gageby and seconded by Russ Jones to instruct the
Village Attorney to request an Attorney General's opinion as to whether
or not an ordinance regarding the passing of bad checks is properly a
matter of a village ordinance and also as to whether or not the State of
Minnesota is responsible for the cost of the maintenance of persons
confined for bad check convictions if the conviction is made under the
State statute. Motion carried.

Motion by Russ Jones and seconded by Carl Carlson to accept the
Justice Report for the Month of August. Motion carried.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR WATER IMPROVEMENT N0. 1960 -1B (4) AND
DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improvement
prepared by the Village Engineer are hereby approved and ordered
filed with the Clerk:
Construction of 8 -inch pipe connection for Well No. 4.
2. The Clerk shall advertise for bids for such improvement by
publication at least once in the official newspaper and in the
Construction Bulltin, the date of first publication not less than
10 days prior to the date for receipt of bids. Said notice shall
state that no bids will be considered unless sealed and filed
accompanied by a cash deposit, bid bond, cashier's check or
certified check payable to the clerk in the amount of not less
than five percent (5 %) of the bid.
3. The bid date is set for October 24, 1960, at 11 :00 O'clock A.M.
4. The Village Administrator and the Village Engineer shall be
authorized to open and tabulate the bids.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Wayne Gageby, Russ Jones, William Super
and Clifford Wellman; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Russ Jones and seconded by Carl Carlson that the
following application be approved:
Plumber's License - Rudy Plumbing Co., 4934 Thomas Ave. N.
Motion carried.
Mayor Super left the meeting at this point.
The Council discussed the Recreation and Park Board budgets.
The bills set forth on the schedule attached to these Minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the
Meeting of September 26, 1960" were audited and ordered paid.
