Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota, including all accounts audited
by said Council
August 25, 1959
The Village Council met in
regular session and was called to order

Y � � y, substituting for Mayor Super, at $ :00 P.M.
Roll Call Wayne Gageby, Russ Jones, Clifford Wellman, and Carl
Carlson were present. Mayor William N. Super was absent.
Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION ESTABLISHING METHOD OF
ASSESSMENT FOR SANITARY SEWER LATERAL
WHEREAS, the village council has considered benefits received
from the construction of sanitary ry sewer laterals, and the
Village
Engineer g has
g made his recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. Assessments for the construction of Sanitary Sewer Laterals
in areas which are platted or divided generally on the grid
plan shall be computed as follows:
(a) A front foot rate shall be computed for the cost
of the lateral line and manholes and a charge for the
stub connection shall be established.
(b) Each plot or parcel shall be assessed according
to its front footage plus a charge for the number of
stub connections provided.
(c) A lot shall not be assessed on more than one side.
(d) The Village Engineer shall use his discretion in
determining front footage on odd shaped lots.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and
Clifford Wellman, and the following voted against the same: None;
whereupon said resolution was duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION APPROVING INVESTMENTS
BY FIRE DEPARTMENT RELIEF ASSOCIATION
WEEMS., the Village Council has considered the advisability
of investments proposed by the Fire Department Relief
Association,
NOW THEREFORE, BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center as follows:
1. That the Village of Brooklyn Center will re- purchase
from the Fire Department Relief Association
Village of Brooklyn Center certificates of indebtedness
at par plus accrued interest, the amount thereof
being $2$,000 plus accrued interest of $147.$5.

2. The Fire Department Relief Association is hereby
authorized to purchase $15,000 Village of
Brooklyn Center Park Bonds dated July 1, 1959 and
approximately $25,000 'in government certificates.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and
Clifford Wellman, and the following voted against the same: None; whereupon
said resolution was duly passed and adopted.
Motion by Carl Carlson and seconded by Clifford Wellman that the
Mayor and Clerk be authorized to execute a contract with the Minneapolis Gas
Company to furnish gas service at the new Fire Station and Liquor Store at
63rd and Osseo Road. Motion carried.
Motion by muss Jones qnd seconded by Carl Carlson that the Village
Council approve the appointment of Ed Peterson as deputy treasurer, which
has been made by Vic Ehrenberg, treasurer. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Village Council release the street escrow money for Northview Heights
Addition, in the amount of $840 upon the recommendation of the Village
Engineer. Motion carried.
Motion by Russ Jones and seconded by Clifford Wellman that the
Village Council receive petitions for Sanitary Sewer Laterals on Irving
Avenue from Northern States Power Easement to 59th Avenue; James Avenue from
Northern States Power Easement to 59th Avenue; and Humboldt Avenue from
Northern States Power Easement to 55th Avenue. Motion carried.
Member Russ Jones introduced the following resolution and moved
its adoption:

RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED STREET SURFACING INPROVM40T NO. 1959 -30
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Street surfacing on 65th Avenue and 66th Avenue from
Osseo Road to back lot line between Drew Avenue and
Chowen Avenue; and on Ewing Avenue and Drew Avenue
from 65th Avenue to the North line of Brooklane Addition
and France Avenue from Osseo Road to the North line of
Brooklane Addition.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $14,580.85,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
' 1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the village on Tuesday, the 15th day of September,
1959, at 8:00 o'clock P.M., and the clerk shall publish notice of the
time and place of hearing by two weeks' publication in the official
newspaper of the village.

34 The area proposed to be assessed for said improvement is as
follows:
All lots and parcels abutting thereon.
4. This proposed improvement shall be designated Street Surfacing
Improvement No. 1959 -30.

The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and
Clifford Weilma, and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED SANITARY SEWER IWROVEMENTS NO. 1959 -48, 42, 5Q
WHEREAS, it is proposed that there be constructed improvements
consisting of the following:
Sanitary Sewer Improvement No. 1959-48:
Sanitary Sewer lateral on Irving Avenue North from '
Northern States Power Easement to 59th Avenue
the estimated cost of which is $7,105.17
Sanitary Sewer Improvement No. 1959 -49:
Sanitary Sewer lateral on James Avenue North from Northern
States Power Easement to 59th Avenue
the estimated cost of which is $6,205.52
Sanitary Sewer Improvement No. 1959 -50:
Sanitary Sewer lateral on Humboldt Avenue from Northern
States Power Easement to 55th Avenue North
the estimated cost of which is $12,981.39
WHEREAS, the village engineer has made a preliminary report advising
that the proposed improvements are feasible and that they can be
constructed at the estimated cost set forth after each improvement above,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted

2. A public hearing on the proposed improvements shall be held
at the Village Hall in the village on Tuesday, the 15th

member Carl Carlson and upon vote being taken thereon the following voted in
favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and Clifford Wellman,
and the following voted against the same: None; whereupon said resolution bas
declared duly passed and adol3ted.

Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR STREET IMPROVEMENT N0, 1959 -30 AND
DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following
improvement, prepared by Village Engineer, is hereby
approved and ordered filed with the Clerk:
Street surfacing on 65th Avenue and 66th Ave. from
Osseo Road to back lot line between Drew Avenue and
Chowen Avenue; and on Ewing Avenue and Drew Avenue
from 65th Avenue to the North line of Brooklane Addition
and France Avenue from Osseo Road to the North line of
Brooklane Addition.
2. The Clerk shall advertise for bids for such improve-
.
ment by publication at least once in the official newspaper
and in the Construction Bulletin, the date of first publication
not less than 10 days prior to the date for receipt of
bids. Said notice shall state that no bids will be considered
unless sealed and filed and accompanied by a cash deposit, bid
bond, cashier's check or certified check payable to the Clerk
in the amount of not less than five percent of the bid.
3. Bid date is set for September 15, 1959 at 2 :00 o'clock
P.M.
4. The Village Administrator and Village Engineer shall
be authorized to open and tabulate the bids.
The motion for the adoption of the foregoing resolution was duly seconded
by member Russ Jones, and upon vote being taken thereon the following voted
in favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and Clifford
Wellman; and the following voted agains the same None; whereupon said
resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING WORK
0MR4CTED BY DEVELOPER)
WHEREAS, Wm. Bobendrier a developer has contracted with
Phelps -Drake Co. Inc. to construct the following improvements:
Construction of Sanitary Sewer mains and Water Mains
on Halifax Avenue from 69th Avenue to 70th Avenue
Project No. 1959 -28
WHEREAS, Phelps -Drake Co. Inc, have satisfactorily completed the
above improvements,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. Upon recommendation of the Village Engineer, the work completed
is hereby accepted and approved.
2. The value of the work performed is as follows
Sanitary Sewer Mains $3,289.13
Water Mains ,195.76

The motion for the adoption of the foregoing resolution was duly sed6nded by
Russ Jones, and upon vote being taken thereon the following voted in flvor
thereof: Wayne dby, Russ Jones, Carl Carlson and Clifford Wellman; and
the following voted against the same: None; whereupon said resolution was
duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING WORK
(CONTRACTED BY DEVELOPER)
WHEREAS, William Bobendrier & Hipps Construction Co., developers have
contracted with Phelps -Drake Co. Inc, to construct the following
improvements:
Sanitary Sewer Main and Water Main on Grimes Avenue
from 69th Avenue to 71st Avenue
Project No. 1959-27
WHEREAS, Phelps -Drake Co. Inc., have satisfactorily completed the
above improvements,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. Upon recommendation of the Village Engineer, the work
completed is hereby accepted and approved.
2„ The value of the work performed is as follows:
Sanitary Sewer Mains $6,058.10
Water Mains $7,8i4.72
The motion for the adoption of the foregoing resolution was duly seconded
by Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: Wayne Gageby, Russ Jones, Carl Carlson and Clifford
Wellman; and the following voted against the same: None; whereupon said
resolution was duly passed and adopted.
Motion by Carl Carlson and seconded by Clifford Wellman that the
Mayor and Clerk be authorized to execute a deed for the sale of park
property pursuant to a purchase agreement entered into between the Park
Board and William F. and Lillian M. Ahlberg, the legal description of which
is;
The South 84 feet of the West 125 feet of the
East 360 feet of Tract C, Registered Land Survey
Number 40, lying West of Tract A, Registered
Land Survey Number 619.
Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that
Public Utilities Department be authorized to purchase a Hydrant Meter in
the amount of $225 plus freight. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Village pay the claim of Spetz & Berg Inc., in the amount of $250, and that
the Village Attorney be authorized to contact Peter Lametti for
reimbursement of this cost. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman to deny
the following claims:
Hoglund Plumbing Co. in the amount of $40.00
G. J. Collorodoro in the amount of $22.50

The foregoing claims are for plumbing bills due to plugged sewer service,
The Village of Brooklyn Center denies responsibility for conditions beyond
their control. Motion carried.
The bills set forth on the schedule attached to these minutes and
made a part hereof entitled "The Bills Audited and Paid' at the Meeting of
August 24, 1959" were audited and ordered paid.
Motion made by Russ Jones and seconded by Clifford Wellman to
adjourn. Motion carried.
