The Village Council met in an adjourned session from February 23,
1960, and was called to order by Mayor William N. Super at 7.05 F.M.
Roll Call: Mayor Super, Russ Jones, Wayne Gageby and Clifford Wel.L
were present, Carl Carlson was absent.
Member Wayne Gageby introduced the following amendment to
the Village Ordinances and moved its adoptions
AN ORDINANCE RELATING TO THE PLUMBING ORDINANCE
OF THE VILLAGE OF BROOKLYN CENTER AND AMENDING
SECTION 3 -503
The Village Council of the Village of Brooklyn Center,
Minnesota do ordain as follows:
1. Section 3 -503 of the ordinance of the Village
of Brooklyn Center is hereby amended to read as follows:
Section 3 -503. ADOPTION OF PLUMBING AND WATER ORDINANCE
OF TEE C OF MINNEAPOLIS. There is hereby adopted
and incorporated into this ordinance by reference
thereto, by marking three copies thereof as "official
copies" and filing them for reference and inspection
in the office of the Village Clerk, all of that certain
ordinance of the City of Minneapolis adopted by the
City Council of said City, entitled "An Ordinance
to regulate the construction, extension, alteration
and repairing of plumbing work and repealing certain
ordinance provisions" as amended and now in effect
and published in 1959 in pamphlet form entitled
"PLUMBING, WATER & GAS PIPING ORDINANCES" and con-
taining Sections 1 through 25 inclusive; provided,
however, that the following numbered sections of
said ordinance are not hereby adopted or incorporated
into this ordinance: Section 2; Paragraph 1, Pages 1
and 2 of the Plumbing Ordinance, and Appendix B,
pages 82 through 100, and provided further, that
wherever the term "City of Minneapolis" shall appear
in said ordinance it shall be construed to mean
"Village of Brooklyn Center "; wherever the term
"Department of Buildings" appears it shall be
construed to mean the "Department of Building
of the Village of Brooklyn Center ", and wherever
the term "Plumbing Inspector" is used it shall be
construed to mean the "Plumbing Inspector of the
Village of Brooklyn Center ", and the term "Minneapolis
Plumbing and Water Ordinance" as used therein shall
be construed to mean the "Village of Brooklyn Center
Plumbing and Water Ordinance."
2. This ordinance shall take effect from and after
its legal publication.
The motion for the adoption of the foregoing amendment to an Ordinance
was duly seconded by member Clifford Wellman, and upon vote being
taken thereon, the following voted in favor thereof: William N. Super,
Clifford Wellman, Russ Jones and Wayne Gageby; and the following
voted against the same: None; whereupon said Ordinance was declared

duly passed and 'adopted.
Member Clifford Wellman introduced the following amendment
to the Village Ordinances and moved its adoption.
AN ORDINANCE RELATING TO GAS PIPING
IN THE VILLAGE OF BROOKLYN CENTER AND
AMENDING SECTIONS 3 -811 THROUGH 3 -815
INCLUSIVE
The Village Council of the Village of Brooklyn Center,
Minnesota do ordain as follows:
1. Section 3 -811 through 3 -815 inclusive of the
ordinances of the Village of Brooklyn, Center are hereby
amended to read as follows:
Section 3-811. ADOPTING OF GAS PIPING ORDINANCE OF
THE CITY OF MINNEAPOLIS. There is hereby adopted
and incorporated into this ordinance by reference
thereto, by marking three copies thereof as "official
copies" and filing them for reference and inspection
in the office of the Village Clerk, all of that
certain ordinance of the City of Minneapolis adopted
by the City Council of said City, alteration and
repairing of gas piping work and repealing certain
ordinance provisions" as amended and now in effect
and published in 1959 in pamphlet form entitled
"PLUMBING, WATER AND GAS PIPING ORDINANCES" and
containing Sections 1 through 13 inclusive; pro -
vided, however, that the following numbered sections
of said ordinance are not hereby adopted or incor-
porated into this ordinance: Section 3, page 66 ;,
and provided, further, that wherever the term "City
of Minneapolis" shall appear in said ordinance it
shall be construed to mean "Village of Brooklyn
Center "; wherever the term "Department of Buildings"
appears it shall be construed to mean the "Department
of Building of the Village of Brooklyn Center" and
wherever the term "Plumbing Inspector" is used it
shall be construed to mean the "Plumbing Inspector
of the Village of Brooklyn Center'", and the term
"Minneapolis Gas Piping Ordinance" as used therein
.shall be construed to mean 'Village of Brooklyn
Center Gas Piping Ordinance."
Section 3 -812. PERMIT REQUIRED. No person, firm
or corporation shall hereafter install, alter,_ maintain
or repair any system for the use of illuminating or
fuel gas or installing, altering, repairing, or
servicing any gas burning device connected thereto
is or for any building or structure in the Village
of Brooklyn Center without first obtaining a permit
therefor.
Section 3 -813. PERMIT APPLICATION AND INSPECTION.
An applicant for a permit shall submit a plan of the
proposed installation, including a proposed layout,
which describes the containers, valves, piping,
fittings, safety devices and appliances to be installed.
The Plumbing Inspector shall be notified as soon as
the installation is completed, and as soon as practicable
thereafter the Plumbing Inspector shall conduct a
pressure test of the system. No system shall be
placed in use until the pressure test has been made
and the installation approved in writing by the Plumbing
Inspector.

Section 3 -814 LICENSING REQUIRED. No person, firm
or corporation shall engage in the business of in-
stalling, altering or repairing any system for the
use of illuminating or fuel gas or in the installation,
altering, or repairing of any gas burning device
connecter thereto without first having procured a
license therefor as herein provided, except that a
person, firm or corporation duly licensed as a plumber
by the Village of Brooklyn Center shall not require
any further license to engage in such work. Licenses
shall be issued only to individuals or contractors who
show a thorough understanding of the laws and regulations
governing the installation of illuminating,or fuel gas
systems and gas burning devices and who demonstrate
sufficient knowledge, skill and training to enable
them to carry on the work of installing, maintaining,
and altering illuminating or fuel gas systems and gas
burning devices. Any person, firm or corporation
holding a Class A gas fitters license from the City
of Minneapolis shall be deemed prima facie qualified
to obtain a_ license from the Village of Brooklyn
Center. A person, firm or corporation engaged in
the business of installing or repairing heating plants
who is duly licensed for such purposes by the Village
shall not require a license under this section to
install such heating systems involving the use of gas.
(a) The applicant shall pay a Twenty- five '1$25.00)
Dollar License fee and Fifteen ($15.00) Dollars for
renewal thereafter, and the license shall run from
May 1 to April 30 of the following year.
(b) Application for a license shall be made to
the Village Council and such license shall be granted
by a majority vote of the Council aeon proof of the
applicant's qualifications and upon the filing of a
bond in the amount of $1,000.00 conditioned upon
compliance with this ordinance.
(c) No license shall be issued unless and until
the applicant shall first file with the Village Clerk
a policy or policies of insurance insuring such applicant
against liability imposed by law on account of damage
to or destruction of property in the amount of $25,000,
and on account of injury to persons in the amount of
$50,000 for injuries to one person and in -the amount
of $100,000 for each accident. Any such policy shall
provide that it may not be cancelled by the insurer
except upon notice to the Village of Brooklyn Center.
In case of cancellation of such insurance such license
shall be suspended automatically until such insurance
has been replaced.
Section 3 -815. CORRECTION OF UNSAFE CONDITIONS. The
Plumbing Inspector and the Village Fire Marshall are
hereby empowered to cause any illuminating or fuel
gas system or any gas burning device connected thereto
to be shut off whenever they shall find that such
system or device does not comply with the requirements
of the Village ordinances or whenever the system for
any reason presents an immediate hazard to life or
property. They may attach a warning tag to such system
which states that such system is in violation of the
Village ordinances or constitute an immediate hazard.
It shall be unlawful for any person to cause such system
to be placed in use thereafter until it shall be approved
by the Plumbing Inspector in writing.

2. This ordinance shall take effect from and after
its legal publication.
The motion for the adoption of the foregoing amendment to an Ordinance
was duly seconded by member Wayne Gageby, and upon vote being taken
thereon, the following voted in favor thereof: William N. Super,
Clifford Wellman, Russ Jones and Wayne Gageby; and the following
voted against the same None; whereupon said Ordinance was declared
duly passed and adopted.
Motion by Clifford Wellman and seconded by Russ Jones that we adopt
standard forms for use by licensees for Plumbing and sewer work for
Water Main Bonds and Sewer Bonds. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman that on and
after June 1, 1960, use of the Village Auditorium at 64+5 Lyndale
Avenue North have a charge of $5.00 per evening for janitorial services.
Youth groups are to get preference. The balance of the nights are to
be first come, first served. It will not be let out for Sunday meetings.
Arrangements for use of the Auditorium are to be made at the Village
Office at 7100 Osseo Road, Brooklyn Center 22, Minnesota. The Auditorium
at the new Village Hall at 7100 Osseo Road and the meeting room at the
new fire station shall not be let out for public use. Motion carried.
Resolution #1. RESOLUTION AUTHORIZING USE OF VOTING MACHINES BY
INDEPEI�DEl�T SCHOOL DISTRICT NO. 286.
Member Clifford Wellman introduced the following resolution
and moved its adoption:
RESOLUTION AUTHORIZING USE OF VOTING MACHINES
BY INDEPENDENT SCHOOL DISTRICT N0.286
WHEREAS, the School Board of Independent School District
No. 286 has been providing free storage for five voting
machines in the Earle Brown School at the request of the
Village of Brooklyn Center, and
WHEREAS, the School Board of said school district has
inquired concerning the use of said voting machines at
a Special Election, if one be held, in the month of
March, 1960,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center that in consideration of
the storage of five voting machines provided by Independent
School District No. 286, said district is hereby authorized
to use said voting machines at a Special Election, if called.,
without further charge to said school district, and the
personnel of the Village are directed to cooperate with
said school district in providing information about the
proper use of said machines.
The foregoing motion was duly seconded by member Rust Jones and upon
vote being taken thereon, the following voted in favor thereof: William
N. Superp Russ Jones, Wayne Gageby and Clifford Wellman;
and the following afi�tinst the same: None
whereupon said resolutionwas declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Clifford Wellman to authorize
the Mayor and Village Clerk to enter into an agreement between Mr. Earl
Brown and the Village of Brooklyn Center for the acceptance, maintenance
and housing of antique fire equipment. Motion carried.
Motion by Wayne Gageby and seconded by Russ Jones that we increase the
salaries of the liquor store managers, Truman Nelson and James Fischback

to $513.00 per month, retroactive to January 1, 1960. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that we receive the
following petitions for sanitary sewer:

Motion by Clifford Wellman and seconded by Wayne Gageby that the sod
bond for Northbrook Manor - 1st Addition in the amount of $935.85
be released,.upon recommendation of the Village Engineer. Motion
carried.
Motion by Russ Jones and seconded by Clifford Wellman that the sod
bond for Northbrook Manor - 3rd Addition in the amount of $2,1$4.00
be released, (in lieu of Cash Escrow of $375.00), upon recommendation
of the 'Village Engineer. Motion carried.
RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR: Sanitary Sewer
Improvement No. 1960 - 5 and Directing Advertisement for bids.
Member Wayne Gageby introduced the following resolution
and moved its adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR: SANITARY SEWER IMPROVEMENT NO. 1960 -5
AND DIRECTING ADVERTISEMENT FOR BIDS.
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. The plans and specifications for the following
improvement, prepared by Minder Engineering Co. are hereby
approved and ordered filed with the Clerk: Construction
of sanitary sewer main interceptor from 65th Ave. No. to
70th Ave. No., between Lyndale Ave. No. and the Mississippi
River.
'2. The clerk shall advertise for bids for such improve-
meat by publication at least once in the official newspaper
and in the Construction Bulletin, the date of first public -
ation not less than 3 weeks prior to the date for receipt
of bids. Said notice shall state that no bids will be
considered unless sealed and filed and accompanied by a
cash deposit, bid bond, cashier's check or certified check
payable to the Clerk in the amount of not less than five
percent of the bid.
3. Bid date is set for April 11, 1960 at 2:00 o'clock
P.M.
4. The Village Administrator and Village Engineer
shall be authorized to open and tabulate the bids

The Village Administrator requested approval to take bids for 2 - 12
inch double acting altitude valves for the water system, the estimated
cost of each valve without installation is $1,400.00.

Member Russ Jones introduced the following resolution and

prepared by the Village Engineer are hereby approved and
ordered filed with the Clerk:
2 12 inch Double Acting Altitude Valves.
2. The clerk shall advertise for bids for such improve-
ment by publication at least once in the official newspaper
and in the Construction Bulletin, the date of first publication
not less than 3 weeks prior to the date for receipt of bids.
Said notice shall state that no bids will be considered unless
sealed and filed and accompanied by a cash deposit, bid bond,
cashier's check or certified check payable to the Clerk in
the amount of not less than five percent of the bid.
3. Bid date is set for March 21, 1960 at 2:00 o'clock
P.M.
4. The Village Administrator and Village Engineer shall
r be authorized to open and tabulate the bids.

J ember Clifford Wellman introduced the following
resolution and moved its adoption:
RESOLUTION DIRECTING CONDEMNATION OF
CERTAIN IlrERESTS IN LAND
...
WHEREAS, THE Park Board by resolution duly adopted has determined
that certain land is required for park purposes and that it has been
unable to acquire such land by negotiation, and that it is necessary
and 'desirable and in the public interest that such land be acquired
and that the power of eminent domain be utilized in order to
procure such land, and it appearing that the acquisition of such
property is in the public interest, and
WHEREAS, the Village engineer has advised the Village Council
that certain interests in land are required for other municipal
purposes, including permanent and temporary easements for the
construction of sewers and the acquisition of certain streets, and
it appearing that the acquisition of such interests in land is
necessary and desirable and in the public interest, and that the
taking will be most fairly and equitably 8ccomplished through
proceedings in eminent domain,
NOW THEREFORE BE RESOLVED by the Village Council of Brooklyn Center
Minnesota as follows:
1. The Village Attorney is instructed and directed to file then
necessary petitions to acquire the interests in land as set forth
in Exhibit A which exhibit is attached hereto and made a part hereof
for the purposes set forth therein, and he shall prosecute such
action to a successful conclusion or until it is abandoned, dismissed,
or terminated by the court.
2. The Village Attorney and the Village officers shall do all
things necessary to be done in the commenceipent, prosecution and
successful termination of such action.
