The Village Council met in regular session and was called to
order by William N. Super, Mayor, at 8:05 P.M.
Roll Call. William N. Super, Clifford Wellman, Carl Carlson and
Wayne Gageby were present. Clerk Russ Jones was absent.
In the absence of the Clerk, Administrator A. J. Lee recorded the
minutes.
Motion by Carl Carlson and seconded by Wayne Gageby that the
meeting night for village council meetings be changed from Tuesday evening
to Monday evening, and the time for the meetings shall be 7:30 P.M-
Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman to appoint
As J. Lee deputy clerk during the absence of Clerk Russ Jones., Motion
carried.
The Mayor announced that this was the time and place for receipt
of bids for the purchase of $630,000 Improvement Bonds and $100,000 Park
Bonds is 'accordance with the resolution adopted February 9, 1960.
'the Clerk presented an affidavit showing publication of Notice of
Sale in Commercial West, a financial paper published in Minneapolis,
Minnesota,, which affidavit was examined and found satisfactory and ordered
placed on file, together with a satisfactory affidavit of publication in
the Brooklyn Center Press, the official village newspaper.
The Clerk then presented the sealed bids which had been received,
which were opened and examined and found to be as follows:

After due consideration of the bids for $630,000 Improvement Bonds, member
Carl Carlson introduced the following resolution and moved its adoption;
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that the bid of John Nuveen and Co., Inc.,
Shearson Hammill and Co., H. E. Wood and Co. and Pnnheimer Egan
Inc. to purchase $630,000 Improvement Bonds bearing interest rate of
3.75% on all bonds maturing on January 1, 1962 to 1965, inclusive;
4% on all bonds maturing January 1, 1966 to 1968 inclusive; 4.25% on
all bonds maturing January 1, 1969 to 1974 inclusive, and 4.50% on
all bonds maturing January 1, 1975 to 1981 inclusive, together with
an additional coupon of 1.50% on all bonds for the period of from
May 1, 1960 to July 1, 1961, and to pay therefor the sum of
$630,7.50.25: is hereby found, determined and declared to be the most
favorable bid and is hereby accepted. The Clerk is directed to
retain the check of said purchaser.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N Super, Clifford Wellman, Carl Carlson and
Wayne Gageby; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and
moved its adoption:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The Village shall forthwith issue its negotiable
improvement bonds in the principal amount of $630,000, dated
April 1, 1960, being 630 in number and numbered 1 to 630, both
inclusive, in the denomination of $1,000 each, bearing interest
at the rate of 3.75 percent per annum on all bonds maturing
January 1, 1962 to January 1, 1965s inclusive; x+,00 percent on all
,bonds maturing January 1, 1966 to January 1 1 1968, inclusive;
4,25 percent on all bonds maturing January 1., 1969 to January 1,
1974, inclusive; 4.50 percent on all bonds maturing January 1, 1975
to January 1, 1961, inclusive, plus additional interest at the
rate of 1.50 percent for the period from May 1, 1960 to July 1,
1961 to be represented by a separate coupon, said bonds maturing
serially in the years and amounts as follows:
$35,000 on January leach year 1962 to 1972, inclusive,
$30,,000 on January 1 each year 1973 to 1979, inclusive,
$20,000 on January 1, 1980 and
$15,000 on January 1, 1981,
with a prepayment option as follows:
All bonds maturing on January 1, 1972, and thereafter,
are subject to redemption in inverse numerical order on
January 1. 1966, or any interest payment date thereafter
upon payment as follows:
(1) if redeemed prior to January 1, 1971, at par plus
accrued interest plus a premium of $30.00 for each
bond redeemed;
(2) if redeemed on January 1 1971, or thereafter..
At par plus accrued interest plus a premium of $10.00
for each bond redeemed.
2. Both principal and interest shall be payable at the main
office of the American National Bank of Saint Paul, St. Paul,
Minnesota, and the Village shall pay the reasonable charges of
said bank for its services as paying agent.
3. The bonds and interest coupons to be thereto attached
shall be in substantially the following forms

KNOW ALL MEN BY THESE PRESENTS That the Village of Brooklyn
Center, Hennepin County, Minnesota, acknowledges itself to be
Indebted and for value received hereby promises to pay to bearer
out of Improvement No. 1959A and B Fund the sum of ONE THOUSAND
'DOLLARS on the lst clay of January, 19 , and to pay tuterest
thereon at the rate of percent ( %) per annum
together with additional interest at the rate of one and fifty
hundredths percent (1.500) per annum for the period from May 1
1960 to July 1, 1961 represented by separate coupons, all interest
payable July is 1961 and semiannually thereafter on the lst day
of January and the lst day of July in each year in accordance with
and upon presentation and surrender of the attached interest coupons
as they severally become due. Both principal of and interest on
this bond are payable at the main office of American National Bank
of Saint Paul, St, Paul, Minnesota, in any coin or currency of the
United States of America which at the date of payment is legal
tender for public and private debts.
All bonds of this issue maturing on January 1, 1972, and
thereafter, upon thirty (30) days prior notice by mail to the
bank where the bonds are payable and to the last known holder
are subject to redemption in inverse numerical order on January l,,
1966, or any interest payment date thereafter., upon payment at
par plus accrued interest plus a premium of $30.00 for each bond
redeemed if redeemed prior to January 1, 1971: and if redeemed on
January 1, 1971, or thereafter, at par plus accrued interest plus
a premium of $10.00 for each bond redeemed. Holders desiring to
receive such notice must register their names, addresses and
bond numbers with the Village Clerk.
This bond is one of an issue of bonds in the total principal
amount of $630,000, all of like date and tenor except as to
interest rates, maturity and redemption privilege, all issued
pursuant to and in full conformity with the Constitution and Laws of
the State of Minnesota, including Minnesota Statutes, Chapter 429,
as amended, for the purpose of defraying the expenses incurred and
to be incurred in special improvements of the Village, and is
payable primarily from special assessments to be levied against
property specially benefited thereby but constitutes a general
obligation of the Village, and to provide moneys for the prompt
and full payment of said principal and interest as the same become
due the full faith and credit of the Village is hereby irrevocably
Pledged and the Village will levy ad valorem taxes if required for
such purpose without limitation as to rate or amount.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of
Minnesota to be done, to happen, and to be performed precedent to
and in the issuance of this bond have been done, have happened and
have been performed in regular and due form, time and manner as
required by law; and that this bond together with all other indebt
edness of the Village outstanding on the date hereof and the date
of its actual issuance and delivery does not exceed any
constitutional or statutory limitation thereon.

out of Improvement No. 1959A and B Fund at the main office of
American National Bank of Saint Paul, St. Paul, Minnesota,

installment of interest then due on its Improvement Bond dated

4. The Clerk is directed to cause said bonds to be prepared
and the Clerk and Mayor are authorized and directed to execute the
same and affix the vill?ge seal thereto and to cause the interest
coupons to be executed and authenticated by the printed facsimile
signatures of said officers.
5. The bonds issued hereunder shall be payable from Improvement
No. 1959 A and B Fund. If any payment of principal or interest on
said bonds shall become due when there is not sufficient money in
said fund to pay the same, the Treasurer shall pay such principal
or interest from the general fund of the Village and such fund shall
be reimbursed for such advances out of proceeds of assessments fad
said improvement when collected.
$. The total cost of the improvements for which special asaess, -,
ments have already been calculated and spread upon the tax rollo
exceeds the amount of such assessments as set forth in the resolute:,
adopted February 9, 1960. In addition thereto, Water Improvement
No. 1960 -1 is being financed as follows; 30% from special assessments,
and 70% from a general tax levy, as set forth in the resolution
adopted February 9, 1960. For the purpose of providing money for the
portion of payment of principal and interest on the bonds not payable
from special assessments, there is hereby levied upon all of the taxable
property in the village a direct ad valorem tax in the years and
amounts as follows;

7. The estimated collection of special assessments together
with the foregoing ad valorem tax levy and other revenues pledged
for the payment of said bonds will produce at least five percent in
excess of the amount needed to meet, when due, the principal and
interest payments on the bonds. The Clerk shall deliver a certified
copy of this resolution to the County Auditor of Hennepin County and
obtain his certificate as required by Section 475.63, Minnesota
Statutes,
8. The said bonds, when fully executed,, shall be delivered.
by the Treasurer to the purchaser thereof upon receipt of the
purchase price, and the said purchaser shall not be obligated to
see to the proper applimtion thereof.
9. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys approving
said issue certified copies of all proceedings and records relating
to the issuance of said bonds and to the right, power and authority
of the Village and its officers to issue the same and said certified
copies and certificates shall be deemed the representations of the
Village as to all matters stated therein.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof; William N. Super, Clifford Wellman, Carl Carlson,
and Wayne Gageby; and the following voted agLnst the same: None; whereupon
said resolution was declared duly passed and adopted.
After due consideration of bids for $100,000.00 Park Bonds,
member Carl Carlson introduced the following resolution
BE IT RESOLVED by the Village Council of theVillage of
Brooklyn Center, Minnesota, that the bid of John Nuveen
and Co., Inc,, Shearson Hamill and Co., H, E. Wood and Co.
and Mannheimer Egan Inc, to purchase $100,000.00 Park Bonds,
bearing interest rate of 3.75% on all bonds maturing on
January 1, 1963 to 1965, inclusive; 4% on all bonds maturing
on January 1, 1966 to 1968 inclusive; 4.25% on all bonds
maturing January 1, 1969 to 1974 inclusive, and 4.50% on
all bonds maturing January 1, 1, to 1981 inclusive,
together with an additional coupon of 1.50% on all bonds
for the period of from May 1, 1960 to July 1, 1961, and to
pay therefor the sum of $100,000.00, is hereby found,
detsermined and declared to be the most favorable bid and is
hereby accepted. The Clerk is directed to retain the
check of said purchaser.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,
and Wayne Gageby; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The Village shall forthwith issue its negotiable park
bonds in the principal amount of $100,000, dated April 1, 1960,
being 100 in number and numbered 1 to 100, both inclusive, in
the denomination of $1,000 each, bearing interest at the rate
of 3.75; percent per annum on all bonds maturing January 1, 1963
to January 1, 1965, inclusive; 4.00 percent on all bonds maturing
January 1, 1966 to January 1, 1968, inclusive; 4.25 percent on all
bonds maturing January 1, 1969 to January 1, 1974, inclusive;
4.50 percent on all bonds maturing January 1, 1975 to January 1,
19611. inclusive; plus additional interest at the rate of 1050
percent for the period from May 1, 1960 to July 1, 1961 to be
represented by a separate coupon, said bonds maturing serially
in the years and amounts as follows, all without option of prior
payment:
$5,000 on January 1 each year 1963 to 1980, inclusive, and
$10,00 on January 1, 1981.
2. Both principal and interest shall be payable at the main
office of the American National Bank of Saint Paul, St, Paul,
Minnesota, and the Village shall pay the reasonable charges of

interest rates and maturity, all issued by the Village for the
purpose.of providing money to acquire and develop parkland and
recreational facilities, and is issued pursuant to authority
conferred by more than the regdsite majority vote of the
gualified.electors of the Village voting on the question of the
issue at an election duly and regularly called and held and
pursuant to and in'f ull conformity with the Constitution and Laws
of the State of Minnesota thereunto enabling,
IT IS HERESY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of
Minnesota to be done, to happen, and to be performed precedent to
and in the issuance of this bond have been done, have happened and
have been performed in regular and due form, time and manner as
required by law; that prior to the issuance hereof a direct
annual irrepealable ad valorem tax has been duly levied upon all
of the taxable property in the Village in the years and amounts
as required by law and additional taxes may be levied upon all of
said property, if required to pay principal or interest, without

all other indebtedness of the Village outstanding on the date

4. The Clerk is directed to cause said bonds to be prepared
and the Clerk and Mayor are authorized and directed to execute
the same and affix the village seal thereto and to cause the
interest coupons to be executed and authenticated by the printed
facsimile signatures of said officers.
5• There shall be paid out of the Park Bond Redemption Fund
the principal of and interest on said bonds and into which shall be
paid the proceeds of the taxes herein levied; provided, however,
that if any payment of principal or interest on said bonds shall
become due when there is not sufficient money in said fund to pay
the same, the Treasurer sha;, pay such principal or interest from
the general fund of the Village and such fund shall be reimbursed
for such advances out of the proceeds of taxes herein levied when
collected.
6. For the purpose of paying the principal of and interest
on said bonds, there is hereby levied upon all of the taxable
property in the Village a direct ad valorem tax which shall be
spread upon the tax rolls and collected with and as part of
other general taxes of the Village, and shall be paid into the
Park Bond Redemption Fund above provided., which tax is in the years
and amounts as follows:

7. The Clerk is hereby authorized and directed to deliver
a certified copy of this resolution to the County Auditor of
Hennepin County, together with such other information as the
County Auditor may require, and to obtain his certificate that
the issue has been entered upon his register and that a tax
has been levied as required by law.
8. The tax levy herein provided shall be irrepealable until
all of said bonds are paid, provided that the Clerk shall annually,
prior to October 10, certify to said County Auditor any amount
appropriated to the said Park Bond Redemption Fund to pay principal
and interest due during the ensuing year, and the County Auditor shall
thereupon reduce the levy collectible during such year by the amount
so certified.
9. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt-of the purchase
price, and the said purchaser shall not be obligated to see to the
proper application thereof.
10. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys approving said
issue, certified copies of all proceedings and records relating to the
issuance of said bonds and to the right, power and authority of the
Village and its officers to issue the same and said certified copies
and certificates shall be deemed the representations of the Village
as to all matters stated therein.

the low bid of Automatic Voting Machine Division, Rockwell Manufacturing
Company, Jamestown, New York in the amount of $9660.00 f.o.b., Brooklyn Center
as per their proposal form and contract.
Member Wayne Gageby introduced the following resolution and moved;.

RESOLUTION ACCEPTING BID
WHEREAS, the Village Administrator and purchasing agent have
reported that on March 7, 1960 at 2 :00 P.M. they opened and
tabulated bids received for a One Ton Truck and that said biddy
were as follows:

NOW, THEREFORE., BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that the low bid of
Osseo Motor Company for a One Ton Chevrolet Truck in the amount
of $2986.78 is deemed to be the best bid submitted
by a responsible bidder for village purposes and said bid is
hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Clifford
Wellman; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member`Wayne Gageby introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID
WHEREAS, the Village Administrator and the purchasing agent
have reported that on March 7, 1960, at 2 :00 P.M. they opened
and tabulated bids received for One five to eight ton Tandem
Steel Roller and that said bids were as follows:

NOW, THEREFORE BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that the low bid of the
Phillippi Equipment Company for a demonstrator model of a
Galion five to eight ton Tandem Steel Wheel. Roller in the
amount of $6475.00 is deemed to be the best bid submitted by a
responsible bidder for Village purposes and said bid is hereby
accepted.
The motion for the adoption of the foregoing resolution was duly seconOed
by member Carl Carlson and upon vote being taken thereon the following voted
in favor thereof William N. Super, Carl Carlson, Wayne Gageby and Clifford
Wellman, and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Wayne Gageby that
the recommendation of the Village Engineer and Village Administrator that
the consideration of bids for the crushing of street materials be tabled
until the next meeting. Motion carried..

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that the bid of
Muni -Quip Corp. in the amount of $1,140.00 for Radar Timing
Equipment is deemed to be a proper bid submitted by a
responsible bidder for Village purposes and said bid is hereby
accepted.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson and Wayne Gageby., and
the following voted against the same; Clifford Wellman; whereupon, said

Motion by Carl Carlson and seconded by Clifford Wellman to grant
a special use permit to John F. Rowland to construct s model garage to be
used as a sales office on that part of Lot 6, Guilford's Outlots, lying
Westerly of TH #100. Said special use permit in the R -1 district to be
terminated on April 1, 1962. A further condition of the special use permit is
that there shall be no outside storage of construction equipment or materials,
Members Carl Carlson., Wayne Gageby and Clifford Wellman voting for the
motion, and Mayor Super voting against the motion. Motion carried.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION SUPPORTING APPLICATION
FOR BROOKLYN CENTER STATE BANK
RESOLVING, that the Village Council of the Village of Brooklyn
Center being advised of the pending application of Dallas G.
Lawrence, Harold M, Fredrikson, and others before the Department
of Commerce for the State of Minnesota for the chartering of a
State Bank in Brooklyn Center to be known as Brooklyn Center Statue
Bank, hereby formally recognizes the need and usefulness for
banking services and facilities in the Village of Brooklyn Center
and hereby evidences its support of such application for a charter
to Brooklyn Center State Bank.
Further Resolve, that the Village Clerk is hereby authorized
to deliver a copy of this resolution, duly certified in the
customary manner to be true and correct, to the applicants
for Brooklyn Center State Bank for use in evidence at the hearing
on such application to be held on March 21, 1960 before
the Department of Commerce of the State of Minnesota.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted:

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Nodland Construction Company has
satisfactorily completed the following improvement in accordance
with said contract:
Sanitary Sewer Projects No. 1959 -31, 32, 33, 34 & 40
NOW THUMORE., BE IT RESOLVED by the Village Council of the Village
ofBrooklyn Center:
1. The work completed under said contract is hereby accepted
and approved,

2. The value of work performed is Tess than the original
amount by $4266.00 because the depths were less because of our
street department removing the street surfacing. Also the lengths
of the house services were shorter than the original estimate.
3. The Village officials are hereby directed to issue proper
order for final payment on said contract., taking the contractor's
receipt in full. The total amount paid for said improvement
project being $45,952.50.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the following

2. The value of work performed is less than the original
contract amount by $1,47$.00 because the depths were less because

WHEREAS, the accounting firm of Zimmerman & Moen is presently
making the annual audit of Village accounts,
BE IT HEREBY RESOLVED that the firm of Zimmerman & Moen is
hereby authorized to audit the accounts for the Fire Department
Relief Association and the cost thereof shall be expended
from the General Fund.

SPECIFICATIONS FOR WATER IMPROVEMENT
N0. 1960 -1 AND DIRECTING amrimENT
FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following
improvement, prepared by Village Engineer are hereby approved and
ordered filed with the Clerk:
Construction of One (1) Deep Well and
the furnishing of One (1) Deep Well Turbine Pump.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in the
Construction Bulletin, the date of first publication not less than
10 days prior to the date for receipt of bids. Said notice shall
state that no bids will be considered unless sealed and filed and
accompanied by a cash deposit, bid bond, cashier's check or certified
check payable to the Clerk in the amount of not less than five percent
of the bid
3. Bid date is set for April 25, 1960 at 2 :00 o'clock P.X,
4. The Village Administrator and Village Engineer shall be
authorized to open and tabulate the bids.

Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION RECOMMENDING A CHANGE
IN ASSESSED VALUE OF INDUSTRIAL
AND COMMERCIAL ZONED PROPERTY
WHEREAS, a Committee from the Planning Commission and the
Village Council and the Village Assessor have met and
considered the assessed value assigned to properties zoned
for industrial and commercial use, and have determined that
the Village Council should recommend to the Village Assessor
that such properties should be reappraised to reflect their
current market value,
BE IT HEREBY RESOLVED, that the Village Council hereby
recommends to the Village Assessor that he examine the
presently zoned industrial and commercial property and
appraise them at a value reflecting their current market
value.

member Wayne Gageby, and upon vote being taken thereon the following

its adoption:
RESOLUTION ESTABLISHING RATES TO BE
CHARGED FOR SANITARY SEWER RATES
WHEREAS, the Village Engineer and the Village Administrator
have considered the matter of fair and equitable sanitary sewer
service charges and recommend that the following policies and
rates be adopted in establishing individual sanitary sewer rates:
(1) Single family residence $4.50 p er quarter
(2) Two, three, and four family dwelling units
$4.50 per unit per quarter.
(3) Multiple family dwelling units in excess
of four units, commercial & Industrial
establishments shall have a sewer rate of
$4.50 times the number of fixture units
divided by 15. Fifteen being the number
of fixture units in the average single
family dwelling.
BE IT HEREBY RESOLVED, in accordance with Section 7 -303 of the
Village of Brooklyn Center ordinances that the foregoing rates
shall be effective beginning March 31, 1960.
Motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Wayne Gageby, Carl Carlson and
Clifford Wellman, and the following voted against the same: None; whereupon
said resolution was duly passed and adopted,
Motion by Clifford Wellman and seconded by Wayne Gageby to approve
Mayor Super's appointment of Mrs, Ralph Johnson to the Recreation Commission.
Mrs, Johnson's term shall expire December 31, 1960. Notion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman to receive
the petition for water mains on Chowen Avenue from 65th Avenue to 66th
A Motion carried.
Motion by Clifford Wellman dna seconded by Wayne Gageby to
authorize the Mayor and Clerk to execute the purchase agreement and mortgage on
Lot 50s Auditor's Subdivision #309, Hennepin County, Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson to approve the
Justice Report.
The bills set forth on the schedule attached to these minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the
Meeting of March 8, 1960" were audited and ordered paid.
