January 13, 1959
The Village Council met in regular session and was called to order. by
William N. Super, Mayor, at 8:10 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby
and Russ Jones were present.
The following newly elected officials were sworn into office: H. R. Jones,
Clerk, Clifford Wellman,_ Trustee, John Nordberg, Assessor, and John Wingard,
Justice of Peace,
Motion by Carl Carlson and secouded by Clifford Wellman that the Village
Council approve the minutes of the regular council, meeting of December 9, 1958,
regular council meeting of December 23, 1958 and the srecial meeting of December
30, 1958 Minutes were approved as recorded. Motion carried,
Motion )�y Wayne Gageby and seconded by Carl Carlson that the Village Council
uphold the .recommendation of the PlPn wing Commission, and al. a variance to the
Uzzell Construction Co. for a 15' setback on Lot 18, Block 6, G City lst
Addition as said addition was platted under the old ordinance allowing a 15'
setback. Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby that t-he Village Council,
uphold the recomrendation of the Planning Commission and allow Roy Busse to build
a dwelling on a 50' lot on Lot 5, Block 3, Humboldt Addition as said construction
and lot size conform to the existing neighborhood. Motion carried.,
Motion by Carl Carlson and seconded by Wayne Gage-by that the Village Council
uphold the recommendation of the Planning Commission that the Planning Commission
be represented as a sponsor of the forthcoming Planning Conference. Motion, carrier,,.
Motion by Russ Jores and seconded by Clifford Wellman that the Village
Council approve Mayor Super's appointment of Dallas Lawrence as Park Board member

for three year appointment. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman that the Village`
Council approve Mayor Super's appointment of the following Planning Commission
members for two year tees H. Z. Demeules, Harry Poate, Nicholas Warhol, &4d
Paul Dullen. Motion carried.
Motion by Carl Carlson and seconded by Russ Jones that the Village Council
approve the tlayor's appointment of the following officers:
Special health Officer Edwin C. Peterson - one year
Health Officer Dr. Robert I Shr.agg - one year
Village Attorney Larson., Loevixiger,Lizid..quist,Freeman
& 1?7 aser - one year
Relief Administrator Edwin C. Peterson - one year

Member Carl. Carlson Introduced tce following resolution:
RESOLU

BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. It has been requested by the Board of Directors of the
Suburban Gas Agency that the Village Council of V
Village of Brooklyn Center appoint an alternate board
member with full voting authority who could vote at all
Board and Committee meetings in the absence of the
regular board member.
2. A. J. Lee, Village Administrator, is hereby appointed as
alternate board member to the Suburban Gas Agency.
The motion for the 6doption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby
and Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Russ Jones that the Village Council
release the street bond of Claus H. Johnson & Sons, Inc., in the amount of
$7,500.00 which covered street surfacing in Fair Meadows Addition, upon the
recommendation of the Village Administrator. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman that the Village
Council, upon the recommendation of the Village Administrator, release the street
bond of Clayton C. Perron in the. amount of $1,200.00, which covered s rfacIng on
Girard Avenue North bets =een 63rd and 64th Avenues and a 1/2 street to cut in
between Fremont and Humboldt Avenue known as 63rd Avenue. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the Village
Council, upon the recommendation of the Village Administrator, release the
following bonds on Garden City 4th Addition:
$4,700,00 Bond for street surfacing sod, trees and signs.
$4,300.00 Bond for street surfacing, sod, trees and signs. ,
Motion carried.
Motion by Warne Gageby and seconded by Clifford Wellman that the Village
Council release tibe cash escrow of Ericon Corporation in the amount of $3 00.00 t o
guarantee the complation of fencing. Motion carried.

Member Wayne Gageby introduced the following ordinance and moved its
adoption:
AN ORDINANCE REGULATING THE PARKIN OF VEHICLES
ON STREETS WITHIN THE VILLAGE OF BROOKLYN CENTER
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS:
1. There are hereby added to the village ordinances two new
sections entitled 27_201 and 27_202 which shall read as follows:
Section 27 -201 PARKIN PROHIBITED. No person shall stop,
stand or park a vehicle, except when necessary to avoid
conflict with other traffic or in compliance with the
directions of a police officer or traffic control device,
on any street within the Village of Brooklyn Center where
any sign or direction prohibiting such parking has been
posted upon such street by authority of the village council,
nor shall any person park a vehicle upon any street contrary
to the provisions of any sign or direction posted thereon
by authority of the village council. All signs and directions
placed or maintained by the Brooklyn Center Police Department
shall be deemed to be pursuant to authority of the village
council unless the village council has expressly prohibited
the erection of such sign or direction. This section shall
be construed as supplementary to Section 27-101,
Section 27 -202 PENALTY. Any person violating Section 27 -201
shall be guilty of a misdemeanor, punishable by a fine not to
exceed One Hundred Dollars ($100.00) or by imprisonment in the
county jail for a period not to exceed ninety (90) days.
2. This ordinance shall take effect from and after its
publication.
The motion for the adoption of the foregoing ordinance was duly seconded by Carl
Carlson, and upon vote being taken thereon the following voted in favor thereof:
William N. Super, Carl Carlson, Wayne Gageby, Russ Jones, and Clifford Wellman;
and the following voted against the same: None; whereupon said rrdinance was
declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Carl Carlson that the Village approve
the building of a patching roller. Upon vote being taken the following voted in
favor Carl Carlson.. Clifford Wellman, Wayne Gageby, and Russ Jones; and the
following voted against the same: William N. Super. Motion carried.
Motion by Carl Carlson and seconded by RussJones that the Village deny the
petitions of Roland Erickson, Pioneer Realty, for sanitary sewer and water mains
in Greenlawn Addition. Motion carried.
The bills set forth on the schedule are attached to these minutes and node
a pex•t hereof entitled "The Bills Audited and Ordered Paid at the Meeting of
January 13, 1959" were audited and ordered paid.
