February 17, 1959
The Village Council met in special session and was called to order by
William N. Super, Mayor, at 8:15 P.M.
Roll Call: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones were
present and Clifford Wellman was absent. (Clifford Wellman arrived late as here -
inafter indicated).
Motion made by Carl. Carlson and seconded by Wayne Gageby that the Village
Council approve the minutes of the regular meeting of January 27, 1959• The
minutes were approved as recorded and corrected. The corrections were as follows:
January 27, 1959, minutes; page ft ,the ordinance section 1-116 FEMALE DOGS. It
shall be unlawful for any person, firm or corporation owning, keeping or harboring
any female dog or dogs to allow them to run at large within the Village while in
heat and the dog catcher or Village Police are hereby authorized and directed to
take up and impound such female dogs, wherever found, whether licensed or not, and
to release said dogs only when properly licensed and upon the order of the Village
Council; and the resolution on page #4 of the January 27, 1959 minutes identified
as Improvement Cownitments for VA Loan Purposes the builder should be Hipp Construo-
tion Co. instead of Donnay Construction Co. Motion carried.
Clifford Wellman arrived at the meeting at this point and took over -his duties
as Trustee.

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, that the low bid of N. P. Madsen as
to the furnishing of the general construction as per specifications
in the amount of $62,767.00, to be completed in 110 days; the low
bid of Hoglund Plumbing & Heating Co. for the installation of heating
and plumbing; and the law bid of Mergens Electrical~ Co. for the
electrical installation are deemed to be the best bids submitted by
responsible bidders for village purposes and said bids are hereby
accepted.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof! William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby
and Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and moved its
adoption:
RESOLUTION ORDERING ADVERTISEMENT
FOR BIDS FOR FIXTURES OF THE
LIQUOR STORE -FIRE STATION
1. The Village Clerk shall advertise for bids for fixtures of the
Liquor Store -Fire Station under the specifications prepared by Shifflet,
Backstrom, Hutchison and Dickey, Inc.
2. Bid date is set for March 10, 1959, at 2 o'clock p.m.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon #a taken thereon the following voted in
favor thereof: William N. Super, C Ord Wellman, Carl Carlson, and Wayne
Gageby; and the following voted against the same: None; whereupon said
resolution was duly passed and adopted.
Motion made by Russ Jones and seconded by Clifford Wellman that the 'Village
Council uphold the recommendation of the Planning Commission that a variance be
granted Mr. Robert Hanson to construct two one - family dwellings, provided,
however, that the dwellings on Lot 4 have a setback of 32 and the dwelling
on Lot 5, a setback of 35'. Conditions of variance also state that Mr. Robert
Hanson make the necessary arrangements with the Village Engineer to insure
improvements of Russell Avenue North, Penn Avenue North and the North 1/2 of
53rd Avenue North between Queen Avenue North and Russell Avenue North.
The aforementioned setbacks are necessary because of an error in the
setback of the existing dwelling on Lot 3. This will insure proper alignment on
the North with future dwellings in the event abutting property on the North is
platted B -1. Motion carried.
Member Russ Jones introduced the following resolution and moved its
adoption:

FOR SANITARY SEWER IMPROVEMENT NO. 1958 -48
AND DIRECTING ADVERTISPIMT TOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following
improvement, prepared by William E. Jensen, Engineer are
hereby approved and ordered filed with the clerk:
Sanitary sewer on Oliver Avenue North from 53rd
Avenue North to the North boundary line of
Hjelvik's 2nd Addition.

ment by publication at least once in the official newspaper

not less than ten days prior to the date for receipt of bids.
Said notice shall state that no bids will be considered unless

cashier's check or certified check payable to the Clerk in the
amount of not less than five percent of the bid.
3. Bid date is set for March 10, 1959 at 2 c' clock p.m.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted in

Pearson's Northport 3rd Addition; otherwise described
as those lots abutting Pearson Drive from 500' West of
Admiral Lane to Comanodore Drive and Commodore Drive
from Pearson Drive to Admiral Place.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in
the Construction Bulletin, the date of first publication not less
than ten days prior to the date for receipt of bids. Said notice

AND DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows;
1. The plans and specifications for the following improve-
ment, prepared by William E. Jensen, Engineer are hereby approved
and ordered filed with the clerk;
June Avenue North from approximately 180' South of 59 1- 2
Avenue North to 61st Avenue North and on Kyle Avenue North
from proposed 607th Avenue North to 61st Avenue North.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in the
Construction Bulletin, the date of first publication not less than
ten days prior to the date for receipt of bids. Said notice shall
state that no bids will be considered unless sealed and filed and
accompanied by a cash deposit, bid bond, cashier's check or
certified check payable to the Clerk in the amount of not less than

Motion by Russ Jones and seconded by Wayne Gageby that the Village Council
accept the Justice of Peace report submitted by John Wingard for the month of
January. Motion carried.
Motion made by Russ Jones and seconded by Carl Carlson that the Village
Council authorize the public works officials, engineers, Administrators, Mayor
and Councilmen to attend the courses at University of Minnesota Continuation
Center and pay the proper tuition fees. Motion carried,-
Motion made by Carl Carlson and seconded by Russ Jones that the Village
Council set the rate of interest for loaning funds to current construction
projects issues: The average interest rate of last bond issue in the previous
year and for the year of 1959 will be 3.82 %. Upon vote being taken the following
members voted in favor: William N. Super, Carl Carlson, and Russ Jones.
Clifford Wellman voted no, and Wayne Gageby abstained from voting. Motion
carried.
Member Carl Carlson introduced the following ordinance and moved its
adoption:
AN ORDINANCE CHANGING THE NAME OF MAY AVENUE
TO INDIANA AVENUE NORTH
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOWS:
1. A new section entitled 25 -408 is hereby added to the village
ordinances to read as follows:
Section 25 -408. MAY AVENUE - INDIANA AVENUE NORTH.
May Avenue lying between 69th Avenue North and 70th
Avenue North) is hereby renamed and shall hereafter
be known as Indiana Avenue North.
2. This ordinance shall take effect from and after its

WHEREAS, it is proposed that there be constructed an improvement
conalsting of the following:
Construction of sanitary sewer on Osseo Road from
58th Avenue North to 485 feet North of 58th Avenue North.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $5,000.00,
NOW, THEREFORE.. BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended*
2. A public hearing on the proposed improvement shall be held at the
Village Hall in the village on Tuesday, the tenth day of March., 1959'
at 8 :00 o'clock P.M., and the clerk shall publish notice of the time
and place of hearing by two weeks' publication in the official newspaper
of the village.
3. The area proposed to be assessed for said improvement is as
follows:
All lots and parcels of land abutting thereon.
4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1959-17.

member Wayne Gageby, and upon vote being taken thereon the following voted in
