March 10, 1959
The Village Council met in regular session and was called to order
by William N. Super, Mayor, at 8 :00 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson and
Russ Jones were present. Wayne Gageby arrived late as hereinafter indicated.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Village Council approve the minutes of the regular meeting of February 10,
1959 and the special Co uncil meeting of February 17, 1959. Minutes were
approved as recorded. Motion carried.
The mayor announced that the meeting was open for the consideration
of proposed Sanitary ewer I No. 19

The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks' publication thereof in the
official newspaper, the last publication being on March 5, 1959, which
affidavit was examined and found satisfactory ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member Carl Carlson introduced the following resolution and
moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF
SANITARY S& R IMPROVEMENT NO. 1959 -11
AND ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and
for the best interests of the village and the owners of
Property specially benefitted thereby that the following
improvement shall be constructed:
Sanitary sewer on Osseo Road from 58th Avenue North
to 485 feet North of 58th Avenue North,
2. The plans and specifications for said improvement shall
be prepared by William E. Jensen Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman
and Russ Jones; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Russ Jones and seconded by Carl Carlson that the Council
uphold the planning commission recommendation to the Village Council that it
is.not to the best interest of the Village to grant a variance from the
ordinance that requires a public access to a lot and that the petition of
Frank Cameron be denied. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
village council uphold recommendation of planning commission, that the
petition for variance of Mr.`Ostroum to build a house on lot 11, block 2,
Linden Shores on Twin Lake, which is 50' lot, be approved. Motion carried,
Motion by Russ Jones and seconded by Clifford Wellman that the
recommendation of the Planning Commission be upheld and a special use
permit be granted to Mrs. Ziph for the operation of a pre- school nursery
at 3906 52nd Avenue North, provided that a fence enclose the back yard
completely and that the special permit to operate, is not transferable.
William N. Super, Clifford Wellman and Russ Jones voted yesj and Carl Carlson
voted no. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that we uphold
recommendations of the Pianning Commission and deny the petition of Kenneth
Bergstrom for rezoning from R -1 to B -1, the North 350' of the West 524.$' of
the Southwest 1/4 of the Southwest 1/4 of Section 34.. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman that the
petition of E. C. Peterson for rezoning be referred back to the Planning
Commission for further consideration. Motion carried.
Member Wayne Gageby arrived at this point of the meeting.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BIDS
WHEREAS, the Village Administrator, Administrative Assistant, and
Architects have reported that on March 10, 1959, at 2 o'clock p.m•
they opened and tabulated the bids received for the furnishing of
store fixtures for liquor store and fire station building, and
that said bids were as follows:

NOW THKFjWCHE BE IT RESOLVE by the Village Council of the Village
of Brooklyn Center, Minnesota, that the low bid of Bergstedt & Nielsen
as to the furnishing of store fixtures for liquor store and fire
station as per specifications in the amount of $8930,00 is deemed
to be the best bid submitted by responsible bidders for village
purposes and is hereby accepted; provided, however, that the village
council reserves for a 30 day period its decision on the acceptance
of alternatesFE2 and 3, and that the acceptance of the entire bid is
contingent upon the mayor's approval of the shelving.
The motion for the adoption of the foregoing resolution was duly seconded by
member Russ Jones,ead upon vote being taken thereon the following voted in
favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne
Gageby and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Wayne Gageby that the
f brick to be used on the new fire station and liquor store should be Ochs
brick No. B654. Motion carried.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING BID AND APPROVIM CONTRACT FORM
WHEREAS, the Village Administrator and Assistant Village Administrator
have reported that on March 10, 1959, at 2 o'clock p.m., they opened
and tabulated the bids received for Sanitary Sewer Improvement
Nos. 1958 -48, 1959 -1, 1959 -22 1959 -3, 1959 -4, 1959 -7, 1959 -8, 1959 -11,
1959 -12 and 1959 -13, and that said bids were as follows:

The bid of Petroske & Ross in the amount of $49,512.70 as to the
furnishing of all work, labor and material in connection with
Sanitary Sewer Improvement Nos. 1958 -48, 1959 -1, 1959 -21 1959 -3,

1959 -4, 1959 - 7,'1959 -8, 1959-11, 1959 -12 and 1959 -11 according
to the plans and specifications therefor now on file in the office
of the Village Clerk, is deemed to be the lowest and best bid
submitted for said work by a responsible bidder, and said bid is
hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded
by member'Wayne Gageby and upon vote being taken thereon the following
voted in favor thereof: William N. Super; Clifford Wellman, Wayne Gageby,
Carl Carlson and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Russ Jones that we
authorize E C. Peterson as relief administrator to look into each and every
case on our relief roll. Motion carried.
Member Clifford Wellman introduced the following resolution and
moved its adoption:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the 'Village
of Brooklyn Center, as follows:
The base bid of Socony Mobil Oil Co., as to the furnishing of
gasoline and fuel as per specifications is deemed to be the best
bid submitted by a responsible bidder for village purposes, and said
bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Russ Jones, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson
and Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Motion by Russ Jones and seconded by Clifford Wellman to enter into a
lease agreement with the University of Minnesct for the period beginning
March 15, 1959 and ending March 15, 1960, and covering the property described
as follows:
That part of Lot 63, Auditor's Subdivision 218, bounded on
the Northwest by Highway 100, on the East by Humboldt
Avenue North and on the South by 59th Avenue North.
Motion carried.
Member Wayne Gageby introduced the following resolution and moved
its adoption:

RESOLUTION ESTABLISHING NEW RESIDENTIAL,
RATES FOR SANITARY SEWER. SmicE
BE IT RESOLVED BY the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The rate to be charged to residential users for
sanitary sewer service provided by the Village shall be $4.50
per unit per quarter.

The motion for the adoption of the foregoing resolution was duly seconded by

Member Russ Jones introduced the following resolution and moved
its adoption:
RESOLUTION ESTABLISHING NEW MINIMUM
MUNICIPAL WATER RATES
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The minimum rate to be charged for municipal water shall
be $4.00 per unit per quarter.
2. Said minimum rate shall be effective immediately and
shall be applied to all billings hereafter made.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby,
Carl Carlson and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Russ Jones introduced the following resolution and moved its
adoption:
A RESOLUTION PROPOSING THAT THE VILLAGE OF BROOKLYN CENTER
TAKE THE NECESSARY STEPS TO ACQUIRE CERTAIN TAX DELINQUENT
PROPERTY
WHEREAS, the Village Council of the Village of Brooklyn Center
has been advised that the following described lands are now
owned by the State of Minnesota as a result of tax delinquencies;
That part of Lot 36, Auditor's Subdivision No. 218,.
lying East of the East line of the plat of Ryden's
Secton Addition and North of the North line of Lot 37,
Auditor's Subdivision No. 218. and
WHERAS, The Village of Brooklyn Center needs said property for
public road and public utility purposes, and because 56th Avenue
North is.pre- sently constructed and being used by the public over
sad.property, and
WHEREAS, the''V lAge of Brooklyn Center desires conveyance of said
tax forfeited:'lsnds pursuant to the provisions of Section 282.01 of
the Minnesota, Statutes,
NOW, THEREFORE, BE IT RESOLVED that the Village of Brooklyn Center
apply for the conveyance of the above described tax forfeited lands

to be used by the said Village of Brooklyn Center in the event
that said application is granted for public road and public
utility purposes.
IT IS FURTHER RESOLVED that the Mayor and the Village Clerk axe
authorized and directed to execute any and all papers necessary
to complete said application.

Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ABATING ASSES SM RD
BE IT RESOLVED by the Village Council of the Village,of Brooklyn
Center that the following special assessment be abated because the
present owners occupied these properties prior to the platting
of Bergstrom's Lynside Manor:
Public Utilities Water 58, levy no. 2130, in the amount
of $490.00 per lot.
on Lot 19, Block 3 Bergstrom's Lynside Manor, 6300 Perry Ave. N.
and Lot 18, Block 3, Bergstrom's Lynside Manor, 4812 63rd Ave. N.
In the event the occupant hooks up to the water improvement the amount
of $190.00 will be assessed at that time.
The motion for the adoption of the foregoing resolution was duly seconded by
member'-Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby, and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PRCPOSED WATER IMPROVEMENT N0, 1959-20
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Water main on 65th Avenue North from Osseo Road
to Beard Avenue North.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $8,500.00,
NOW. THEREFORE., BE IT RESOLVED by the Village Council of the, Village
of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended,
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the village on Tuesday, the 14th day of
April, 1959, at 8 :00 o'clock P.M., and the clerk shall publish
notice of the time and place of hearing by two weeks' publication
in the official newspaper of the village.

3. The area proposed to be assessed for said improvement is
as follows:
Those lots and parcels abutting the South side of
65th Avenue North from Osseo Road to Beard Avenue North,

The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote beirig taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Russ Jones introduced the following ordinance and moved its
adoption:
AN ORDINANCE AMENDING CHAPTER 11 OF THE VILLAGE
ORDINANCES TO PERMIT THE ISSUANCE OF MORE THAN
ONE NON - INTOXICATING MALT LIQUOR LICENSE TO
ONE PERSON
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN:
1, Section 11 -107 of the Village ordinances is hereby amended
to read as follows:
" Section 11 -107 LICENSING REQUIREMENTS, All licenses
granted hereunder shall be issued subject to the following
conditions, and all other conditions of this ordinance, and
subject to all other ordinances of the Village applicable there-
to:
(a) No license shall be granted to any person under
twenty -one years of age.
(b) No license shall be granted to any person who has been
convicted of a felony, or of violating the national or state
liquor laws or local ordinance relating to manufacture or
transportation of intoxicating liquors.
(c) No such malt liquor shall be sold, served, or consumed at
or in any theater, picture show or any other place cf'public
gathering for the purpose of entertainment or amusement, or at,
in or upon any public highway or in any vehicle upon any public
highway, except that such malt liquor may be sold., served, or
consumed in any dance hall or in any building in which public
dancing is carried on or permitted only after first having
obtained written permission from the Village Council of the
Village of Brooklyn Center, State of Minnesota, to sell, serve
or consume such malt liquor in such dance halls or building
in which public dancing is carried on or permitted.
(d) No "on -sale" license shall be granted for sales in
connection with any business or club where such business or club
has not been in operation at that place for at least six months
immediately preceding such application,
(e) No license shall be granted for sale on any premises
where a licensee has been convicted of a violation of this
ordinance or where any license hereunder has been revoked for
- cause for at least one year after the said conviction or
revocation.

(f) No sale of any non - intoxicating malt liquor shall be
made to any person under guardianship, nor to any person under
twenty -one years of age.
(g) No gambling, nor any gambling device prohibited by law,
shall be permitted in any licensed premises.
(h) All licenses granted under this ordinance shall be
issued to the applicant only and shall be issued for the premises
described in the application. Such license shall not be
transferred to another place without the approval of the
licensing authority.
(i) No license shall be granted to any manufacturer of
non- intoxicating malt liquor nor to any one interested in the control.
of any such place, and no equipment or fixture in any licensed
place shall be owned in whole or in part by any such manufacturer.
(d) No "on-sale" license shall be granted within 600 feet of
any public school nor within 600 feet of any church..
(k) Licenses shall be granted only to persons who are citizens
of the United States and to persons of good moral character.
(1) No license shall be issued to any person who has a
twenty -five dollar federal occupational tax receipt unless su3h
person has a license to sell intoxicating liquor in accordance
with the provisions of Chapter 46, Extra Session Laws of 1933 -34,,
and acts amendatory thereof."
2. This ordinance shall be effective from and after its publication.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,
Wayne Gageby and Russ Jones; and the following voted against the same:
None; whereupon said ordinance was declared duly passed and adopted.
Member Carl Carlson introduced the fold owing ordinance and moved
its adoption
AN ORDINANCE AMENDING a AATER 7 OF THE
VILLAGE ORDINANCES TO PROHIBIT DUMPING
ON LAKES AND OTHER BODIES OF WATER
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN:
M 1. Section 7 -202 of the Village ordinances is hereby amended
to read as follows:
" Section 7 -202 DISPOSAL OF REFUSE RESTRICTED. It shall be
unlawful for any person, firm or corporation to throw,
scatter upon or deposit, or cause or permit to be thrown,
scattered upon or deposited, any rubbish, trash, refuse,
waste material, decaying or offensive matter, or like
substance, upon or in any street, public highway, lake,
stream or other body of water, whether frozen or not, or
upon or in any land or area not designated as a public dump
in the Village of Brooklyn Center; provided, however, that
any lawful occupant of land may place such matter on such land
for reasonable periods of time as long as the same
constitutes neither a fire hazard nor a public or private
nuisance."
2. This ordinance shall be effective from and after its
publication.

The motion for the adoption of the foregoing ordinance was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,
Wayne Gageby and Russ Jones; and the following voted against the same: None;
whereupon said ordinance was declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption;
RESOLUTION ESTABLISHING .LOAD LIMITS
BE IT RESOLVED by the Village of Brooklyn Center that the legal
load limit on the Village of Brooklyn Center streets shall be
4 ton per axle beginning March 15, 1959 and continuing until such
time as Hennepin County shall have removed load restrictions from
County roads.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: I William N. Super, Clifford Wellman, Carl Carlson, Mayne
Gageby, and Russ Jones; and the following voted against the same; None ;.
whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Carl Carlson that we extend
the approval of the proposed plat of Je R. Murphy for one year from this
date. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that the
following licenses be renewed and approved;

Motion carried.
Motion by Russ Jones and seconded by Carl Carlson that the following
new licenses be approved:

Well Drilling Clyde L. Esler Well Drill Co.
Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that we accept deed
for a strip of land on 47th Avenue North for street purposes from Edward D.
Sullivan and Elizabeth M. Sullivan. Motion carried.
Motion by Russ Jones and seconded by Clifford Wellman that the
Village Council accept the Justice of Peace report submitted by Raymond
