March 24, 1959 The Vills ge Council met in regular session and was called to order by William N. Super, Mayor, at 8 :00 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson; Wayne Gageby and Russ Jones were present. Motion by Russ Jones and seconded by Clifford Wellman that the Village Council approve the minutes of the regular meeting of February 24, 1959 as corrected in ink, and initialed by both the Clerk and the Mayor. Motion carried. Motion by Carl Catson and seconded by Wayne Gageby to reject the petitions for sanitary sewer on Halifax, Grimes, and France Avenue North, North of 67th Avenue North, for the present because of the lateness in filing. Motion carried. Motion by Wayne Gageby aid seconded by Carl Carlson to reject petition for sanitary sewer on Osseo Road South of 65th Avenue to 300' South of 63rd Avenue North and Halifax Drive from Osseo Road to Grimes Avenue, and France Avenue from 61st Avenue North to Halifax Drive for the present because of lateness in filing. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the applications for licenses of Weinman Plumbing Co., 570 West Broadway, and Ernie Perron Well Co., 639 9th St.N.E., be denied, Motion carried, At this point of the meeting Carl Carlson was excused for the balance of the meeting. Motion by Clifford Wellman and seconded by Wayne Gageby to grant the request made to the Village of Brooklyn Center for the use of No, 1 fire truck pumper at the State Fire School. The days to be used are the 27th, 28th and 30th of April, from 1 :00 to 3 :00 P.bt. Motion carried by four members present. Motion by Wayne Gageby and seconded by Russ Jones that the Village Council approve the application of 0. Je Daniels, 5720 Wayzata Blvd., for renewal of Well Drillers license, Motion carried by four members present. by Motion by Clifford Wellman a Gageby geby that the Village Council approve new licenses for the following: Cedergren Enterprises 5624 We Lake Street for Iumbers license Armstrong Cesspool Service 7100 County Road 30 for Scavenger license Motion carried by four members present. Member Wayne Gageby introduced the following resolution and moved its aption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSM SANITARY SEWER IMPRO VEM=r NO. 1959 -21 WHEREAS, it is proposed that there be constructed an improvement consisting of the following; A sanitary sewer lateral extending from the intersection of 70th Avenue North and June Avenue North to 71st Avenue North, and on 71st Avenue North from Kyle Avenue North to Halifax Avenue North, on Indiana Avenue from 71st Avenue to Woodbine Lane, on June Avenue North from 71st Avenue to Woodbine Lane, and Woodbine Lane North from <yle Avenue to Halifax Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $34,690.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 14th day of April, 1959, at 8 :00 o'clock P.M., and the clelk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels abutting thereon. 4* This proposed improvement shall be designated Sanitary Sewer Improvement No. 195921• The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof; William N. Super, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Russ Jones and seconded by Wayne Gageby that the Village Council approve the final plat of Donnay's Brook Lyn Gardens 4th Addition, subject to all requirements of the platting ordinance. Motion carried by four members present. Motion by Russ Jones and seconded by Clifford Wellman that we uphold recommendation of the Village Administrator, Mr. Lee, to appoint Don Nielsen as weed inspector. Motion carried by four members present. Motion by Russ Jones and seconded by Wayne Gageby that the Village Council approve the appointment by Village Treasurer of Eve Ripsin as deputy treasurer. Motion carried by four members present. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 19 Tka t $2,000.00 be transferred from 1955 A Improvement Fund principal and interest monies to 1954 C Improvement Fund principal and interest monies. 2. This transfer will in effect close out the deficit that now shows as of December 31, 1958, records of the 1954 C Improvement Fund. This deficit came about because assessment .2- rolls for projects #1954 -C -1, 1954 -C -2, 1954 -C -3 were identified only as oiling assessments and were levied in 1955 instead of 1954. Money returned from the county was identified under 1955 A oiling, a misallocation of funds. In addition 1955 A Improvement Fund paid for part of 1954 oiling projects, therefore the transfer of only $2000.00 sufficient to coven 1954 C Improvement Find deficit is being made. The balance shall remain in 1955 A Improvement to cover the costs expended by 1955 A Improvement Fund. The motion for the adoption of the foregoing resolution was duly seconded by Russ Jones and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption; RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows; 1. The Village Council hereby approves and ratifies expenditures from Improvement No. 1958 -B Fund in the total amount of $405,337-78- 2. On May 27, 1958, the Village Council determined that the total cost of the improvements to be paid for from Improvement No. 1958 -B Fund was $390,000.00. Said determination of costs did not include the cost of resurfacing of streets, which cost had previously been authorized for said improvement. The sum of $15,337.78 which has been expended therefor.over and above the said $390,000.00 is therefore ratified da approved, valid special assessments having been heretofore levied to cover said additional costs. The motion for the adoption of the foregoing resolution was duly seconded by Russ Jones and upon vote being taken thereon the following voted in favor thereof; William N. Super, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption; RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows; 1. This Council hereby declares its opposition to House File No. 971, the so- called "Compulsory Arbitration Bill ". 2. Said proposed Bill would not, in the opinion of the members of this Council, be in the public interest, would remove from duly elected public officials their proper duty and obligation to establish such wages and working conditions as are fair and just, and would unduly hamper the proper budget - making process by impeding the efforts of official governing bodies in their attempt to give due weight to all of the conflicting demands upon limited governmental revenues. - 3 - A The motion for the adoption of the foregoing resolution was duly seconded by Wayne Gageby and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted.
