The Village Council met in regular session and was called to
order by William N. Super, Mayor, at 8 :00 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson,
Wayne Gageby and Russ Jones were present.
Motion by Clifford Wellman and seconded by Russ Jones that the
Village Council approve the minutes of the regular meeting of March 10,
Special meeting of March 17, special meeting of March 19, and regular
meeting of March 24, 1959 Minutes were approved as recorded. Motion
carried.
The mayor announced that the meeting was open for the consideration
of proposed Water Main Improvement No, 1959 -20.
The Clerk produced an affidavit of publication of notice of
hearing on the proposed improvement showing two weeks' publication thereof
iii the official newspaper, the last publication being on April 9, 1959,
which affidavit was examined and found satisfactory and ordered placed
on file*
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all obdectione, and the property owners appearing in favor of
said improvement, member Wayne Gageby introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF
WATER MAIN IMPROVEMENT NO. 1959-2
AND ORDERING PREPARATION OF PLANS
AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and
for the best interests of the village and the owners of
property specially benefited thereby that the following
improvement shall be constructed:
Water main on 65th Avenue North from Osseo Road
to Beard Avenue North.
2. The plans and specifications for said improvement
shall be prepared by Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Wayne
Gageby, Carl Carlson and Russ Jones; and the following voted against the
same: None; whereupon said resolution was declared duly passed and
adopted.

BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and
for the best interests of the village and the owners of pro-
perty specially benefited thereby that the following
improvement shall be constructed:
Sanitary sewer lateral extending from the intersection of
70th Avenue North and June Avenue North to 71st Avenue
North, and on 71st Avenue North from Kyle Avenue North to
Halifax Avenue North, on Indiana Avenue from 71st Avenue to
Woodbine Lane, on June Avenue North from 71st Avenue to
Woodbine Lane, and Woodbine Lane North from Kyle Avenue to
Halifax Avenue North,
2. The plans and specifications for said improvement shall
be prepared by Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Wayne
Gageby, Carl Carlson, and Russ Jones; and the following voted against the
same: None; whereupon said resolution was declared duly passed and adopted.
Motion by Wayne Gageby and seconded by Carl Carlson that the
Village Council uphold recommendation of the planning commission that the
proposed plat of Elsen's City View 2nd Addition, be approved, subject to
the platting ordinance. Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby that the
Village Council uphold recommendation of the planning commission that the
Replat of Block 1, Elsen's City View Addition, be accepted as per plat
approved and filed with the Planning Commission. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that the Village
Council uphold recommendation of the planning commission that the proposed
plat of Blocks 1 and 2, Petro Additions be approved, subject to the
platting ordinance. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman that the
Village Council uphold recommendation of the planning commission that a
Variance to build an 8' extension on present garage be granted to
James We Curtis, 6420 Girard Avenue North, as per plans submitted and
approved this date. Said plan and signed statement of approval by
abutting property owner shall be filed with the Planning Commission'b
Motion carried,
Motion by Wayne Gageby and seconded by Carl Carlson that the
Village Council uphold recommendation of the planning commission that the
petition of Harlan Kemper to re -zone Lot 8, Block 1, Sunset Manor
for commercial purposes, be denied on the grounds that said proposal does
not conform to the existing zoning ordinances. Four members voting yes
Clifford Wellman voting no. Motion carried.
Motion by Wayne Gageby that the Village Council uphold
recommendation of the planning commission, that the petition of Walter
C Nielsen, to rezone the North 300' of the South 312.S3' of Lot 18,
Auditor's Subdivision #25, be denied on the grounds tht in &Tess to and
egress from the above mentioned property is not in the best interests of
the surrounding area nor the Village. Motion lost for lack of second..
Motion by Clifford Wellman and seconded by Carl Carlson that the
Village Council refer the petition for rezoning by Walter C. Nielsen back
to the planning commission for further study on traffic problems and
rezoning. Motion carried.
Motion by Russ Jones and seconded by Carl Carlson that the Village
Council uphold recommendation of the planning commission that a variance
be granted to Axel Anderson to construct a two -car garage on the property
at 3319 - Mumford Road, Lot 17, Block 3, Garden City 3rd Addition, with a
20' setback from Beard Avenue North instead of the required 25' setback,
as said variance would not be detrimental to existing surroundings.
Motion. carried.
Motion by Wayne Gageby and seconded by Carl Carlson that the
Village Council uphold recommendation of the planning commission,, that the
petition of Albin Peterson to re -zone a portion of Lot 21, Auditor's
Subdivision #25, be denied on the grounds that at the present time, the
planning commission does not deem it feasible to rezone commercially this
small portion of land. Motion carried.
Motion by Russ Jones and seconded by Clifford Wellman that the
Village Council uphold recommendation of the planning commission that a
variance be granted Mrs. Dorothy Warn authorizing the sale of the East
portion of Lot 10 in Subdivision #0 providing, however, that Mrs. Warn
deed to the Village that portion of said lot that will someday become a
public roadway; also, that Mrs. Warn provide an easement North of the
South lint0bf said property to insure ingress to and egress from the
proposed portion of said lot, to be conveyed, which would provide access
to the property proposed to be conveyed. The written instruments necessary
to comply with said conditions shall be approved by the Engineering
Department, Village Attorney and Village Council, prior to the conveyance
of said property, Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Planning Commission make a study of the possibility of rezoning property
along the full length of Osseo Road in the Village; also a study of #152
itself. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the
Village Council take action opposing the enlarging of Crystal Airport and
that we authorize the Village Attorney to attend the meeting of the
Metropolitan Airport Commission, April 16, 1959, to be held at 2+29
University Avenue, St. Paul, at 2:30 P.M. Motion carried,
Member Carl Carlson introduced the following resolution and moved
its adoption.
RESOLUTION APPROVING SPECIFICATIONS FOR STABILIZED
GRAVEL AND FINE AGGREGATE FOR SEAL COAT AND
BITUMINOUS MATERIAL AND DIRECTING ADVERTISHMENT
FOR BIDS,
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The specifications, prepared by A. J. Lee, Village
Administrator, are hereby approved and ordered filed with the
Clerk,
2. The Clerk shall advertise for bids for such materials
by publication at least once in the official newspaper, the
date of first publication not less than three weeks prior to
the date for receipt of bids, Said notice shall state that

no bids will be considered unless sealed and filed and accom-
panied by a cash deposit, bid bond, cashier's check or
certified check payable to the Clerk in an amount of not less .
than five percent of the bid.
3. Bid date is set for April 28, 1959 at 2 :00 P.M.
4. The Village administrator and assistant administrator
shall open and tabulate the same.
The motion for the adoption of the foregoing resolution was duly seconded
by :member Russ Jones, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne
Gageby, and Russ Jonas; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved
its adoption:

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improve-
ment, prepared by Village Engineer, are hereby approved and
ordered filed with the clerk:

2. Mr. Cbazin shall furnish the Village of Brooklyn
Center a performance bond guaranteeing cash payment upon the
t completion of the construction of the project for that portion
of 1959 -21 which lies in Northport Manor 4th Addition before
a contract therefor is entered into by the Village.
3• The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in
the Construction Bulletin, the date of first publication not less
than ten days prior to the date for receipt of bids. Said
notice shall state that no bids will be considered unless sealed
and filed and accompanied by a cash deposit, bid bond, cashier's
check or certified check payable to the Clerk in the amount of
not less than five percent of the bid.

from Beard Avenue North to Chowen Avenue North,
and on Chowen Avenue North from 62nd Avenue North
to approximately 159' North of 62nd Avenue North.

not less than ten days prior to the date for receipt of bids.

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improve-
ment, prepared by Village Engineer, are hereby approved and ordered
filed with the clerk:
Construction of Water Mains on Indiana Avenue Avenue North
from 71st Avenue North to Woodb a Lane and on June
Avenue North from 71st Avenue North to Woodbine Lane
and on 71st Avenue North from Halifax Avenue North to
Kyle Avenue North.,
2. The Clerk shall advertise for bids for such improve -
ment by publication at least once in the official newspaper
and in the Construction Bulletin, the date of first publication
not less than ten days prior to the date for receipt of bids.
Said notice shall state that no bids will be considered unless
sealed and filed and accompanied by a cash deposit, bid bond,
cashier's check or certified check payable to the Clerk in the
amount of not less than five percent of the bid.
3. Said bids shall be called for in conjunction with the
bids for Improvement No. 1959 -21 and Mr. Chazin shall furnish to
the Village of Brooklyn Center a satisfactory performance bond
to guarantee cash payment for this improvement upon completion
of the project, which performance bond shall be furnished prior
to the execution of the contract by the Village.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby,
Carl Carlson and Russ Jones; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Wayne Gageby that the
Village Council approve Mr. Hagel's attendance to the Minnesota Recreation
Association Convention at Faribault. The estimated expenses are $24.40.
Motion carried.
Motion by Russ Jones and seconded by Clifford Wellman that the
Village Council authorize the attendance at the League of Municipalities
Convention at International Falls by Village Officials. Motion carried.

Motion by Russ Jones and seconded by Carl Carlson that the
Village Council correct the minutes of February 17 so that the
following Resolution will read as follows
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR SANITARY SEWER IMPROVEMENT N0, 1959 -3 AND
DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, as follows:
1. The plans and specifications for the following
improvement, prepared by William E. Jensen, Engineer, are
hereby approved and ordered filed with the clerk:
Construction of sanitary sewer to serve Lots 1 through
14, Block 9; Lots 1 through 4, Block 8; all of Block 7;
Lots 12 and 13 and Lots 52 through 64, Block 6, all in
Pearson's Northport 3rd Addition, which is on Halifax
Place from the South intersection of Halifax Avenue
and Halifax Place to 130' South of the intersection of
61st Avenue North and Halifax Mace and on Halifax Avenue
from the South intersection of Halifax Avenue and
Halifax Place to the North intersection of Halifax
Avenue North and Halifax Place,
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in
the Construction Bulletin, the date of first publication not
less than ten days prior to the date for receipt of bids.
Said notice shall state that no bids will be considered unless
sealed and filed and accompanied by a cash deposit, bid bond,
cashier's check or certified check payable to the Clerk in the
amount of not less than five percent of the bid.
3. Bid date is set for March 10, 1959 at 2 o'clock p.m.
Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby that the
Village Council accept petition regarding be=v&&=w=rP the property at
5455 Fremont Avenue North and instruct the building inspector to see that r/
the property complies with our Village Ordinance. Motion carried.
Member Wayne Gageby introduced the following ordinance and moved
its adoption
AN ORDINANCE REGULATING THE INSTALLATION
OF WATER SOFTENING EQUIPMENT
VILLAGE OF BROOKLYN CENTER
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORD
1. The Village Ordinances are hereby amended by adding thereto the
following new section to be known as Section 3 -508:
" Section 3 -508 WATER SOFTENING AND FILTERING EQUIPMENT.
Notwithstanding the provisions of Section 3 -507, any person who is
engaged in the business of installing water softeners, even though
not licensed by the State Board of Health as a master plumber or
Journeyman plumber, and though not licensed by the Village as a
plumber, may connect water softening and water filtering equipment
to private residence water distribution system, provided provision
has previously been made therefor, and openings left for that
purpose or providing such connection may be made by use of cold
water connections to a domestic water heater where it is not
necessary to rearrange, make any extensions or alterations of,
or additions to any pipe, fixture or plumbing connected with the
water system except to connect the water softener. No such

connection or installation shall be made until a permit is first
secured for such installation from the building department of the
Village and the fee prescribed therefor has been paid.
The connections so made shall comply with the minimum standards
prescribed by this chapter, and all electrical work in connection
therewith shall comply with Sections 3 -807 and 3 -807.1 of this
chapter. The installations made pursuant to the provisions of
this section shall be subject to inspection according to all of the
regulations contained in this chapter.
The fee for the installation of water softeners shall be $3.50.
This section shall not be construed to require a permit or
inspection for service of a water softener commonly known as an
"exchange unit" where such exchange is designed to be made at
regular intervals."
2. This ordinance shall be effective from and after its publication*

Member Carl Carlson introduced the following ordinance and moved
its adoption:
AN ORDINANCE AMENDING SECTION 7 -303
OF THE VILLAGE ORDINANCES REGARDING
RATES FOR SANITARY SEWER. SERVICE
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN:
1. Section 7 -303 of the Village ordinances is hereby amended to
read as follows:
" Section 7 -303 SANITARY SEWER RATES. By resolution adopted from
time to time, the Village Council shall establish the rates to be
charged for sanitary sewer service against eacIt property connected
to the Village sanitary sewer system. The Village Engineer shall
periodically review the income, expenses and operation of the
sanitary sewer system and make recommendations to the Council
concerning the rates to be charged. In establishing said rates
the Council may consider the service charge imposed by the City
of Minneapolis, the expenses of administration, maintenance and
repair of the Village sanitary sewer system, anticipated necessary
improvements, and the various amounts and type of sewage discharged
by particular users. The Village Council may prescribe reasonable
penalties for late payment."
2. This ordinance shall be effective from and after its publication.
The motion for the adoption of the foregoing ordinance was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby, and Russ Jones; and the following voted against the same: None,
whereupon said ordinance was declared duly passed and adopted.
Member Wayne Gageby introduced the following ordinance and moved
its adoption:
AN ORDINANCE AMENDING THE BUILDING CODE
OF THE VILLAGE OF BROOKLYN CENTER
TO ESTABLISH SPACE REQUIR1MNIS FOR
DWELLINGS AND APARTMENTS
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS:

1. Section 3 -301 of Chapter 3 of the Village Ordinances is hereby
amended to read as follows:
Section 3 -301. SPECIFICATIONS. The provisions of the Uniform
Building Code, 1978 Edition, Second Printing, published by the Pacific Coast
Building Officials Conference, three copies of which are on file in the
village office, is hereby adopted as the official Building Code of the
Village of Brooklyn Center, and is hereby incorporated in and made a part
of Chapter 3 of the Village Ordinances as completely as if set out here in
! full. All construction in the Village of Brooklyn Center shall be according
to the provisions of said Buolding Code and any other provisions of this
ordinance.
A. Single and Two Family Dwellings Living units in single and two
family dwellings shall have a minimum first floor area of not less than 768
square feet for each unit containing two bedrooms or less if such dwellings
shall also have a full basement, and without a full basement shall have a
minimum first floor area of not less than 850 square feet for each unit
containing two bedrooms, or less. Living units in single and two family
dwellings containing three bedrooms shall have a minimum first floor area of
not less than 912 square feet, and when there are four bedrooms shall have a
minimum first floor area of not less than 1152 square feet.
B. AMtments Living units in buildings containing three or more such
units shall have the following minimum floor area per living unit:
Efficiency Apartments 400 square feet
1 Bedroom Apartments 600 square feet
2 Bedroom Apartments 720 square feet
Apartments with 3 or more bedrooms 120 square feet for each
additional bedroom over 2
The minimum area specified above for multiple living unit buildings shall
not include area occupied by stairs, halls, entryways and utility rooms,
and not more than 15% of said minimum area shall be occupied by closet
space.
No such multiple living unit building shall have a number of efficiency
apartment units exceeding 20% of the total number of units in said building.
2. This ordinance shall be effective from and after its passage and
publication.
The motion for the adoption of the foregoing ordinance was duly seconded by
member Russ Jones; and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby and Russ Jones; and the following voted against the same: None;
whereupon said ordinance was declared duly passed and adopted.

Motion by Wayne Gageby and seconded by Clifford Wellman that the
Village Council authorize Minder Engineering Co Inc. to draw plans and
specifications for the deepening of Shingle Creek through the Village of
Brooklyn Center, the amount not to exceed $2,000.00 in accordance with
the Engineer's proposal. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman that the
Village Council approve the sale of the South 135' of the North 755' of
Lots 34 and 35 in Auditor's Subdivision §216, to Mrs, Schmidt for a total
price of $3500.00, with $100 down, $400 on or before May 30, 1959, and
$3,000 on or before December 30, 1959• Motion carried.
Motion by Clifford Wellman and seconded by Wayne Gageby that
the council transfer $200 in the Richie Poland Memotal•Fund to the fire
department budget. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman that the
Village Council accept the final plat of Palmer Lake Terrace 4th Addition
subject to all restrictions of the platting ordinance and bond being posted.
Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that the Village
Council accept the final plat of Lynn Lee Addition subject to all
restrictions of the platting ordinance and bond being posted. Motion
carried.
Motion by Wayne Gageby and seconded by Carl Carlson that the
Village of Brooklyn Center agree to pay one half the cast of a Traffic
signal at the intersection of 57th Avenue and Highway #100 at a maximum
cost of $8500.00. Motion carried.
