The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gggeby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones to commit the Village of Brooklyn Center to make the following improvements in accordance with the resolution heretofore identified as Improvement Commitments for VA Loan Purposes. Said resolution shall have inserted in it the following: Property to be improved: Donnay's Brook Lyn Gardens, Fourth Addition and Registered Land Survey #755. Estimated Cost: $13,933.22 Date of completion: 12 months Improvements to be made: Street Surfacing and Graveling.. Boulevard sod, boulevard Elm Tree and Yard Tree, Street Signs Engineering Services Replacing Lot Irons and Screen Planting along Rear Lot Line in Block #1. Builder: Land & Properties, Inc, -2- The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby,end upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, Petrowske & Ross, have satisfactorily completed the following improvements: Sanitary Sewer Improvement No. 1958 -50 and Water Main Improvement No. 1958 -51 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; upon recommendation of the Village Administrator; the work completed is hereby accepted and approved. The motion for the adoption of the foregoing resolution was duly seconded by Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING A BANK ACCOUNT Liqueg STORE! The Village Council h�reby establishes a new accounting fund to be known as the Liquor Store Permanent #Und #2 into which shall be placed all of the receipts and from which disbursements may be made from time to time for Liquor Store purposes as approved by the Village Council and the drafts thereon shall be signed by the Mayor.. Member Carlson Carlson introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $140 000 MUNICIPAL BUILDING REVENUE CERTIFICATES . r�r WHEREAS the Village Council adopted a certain Resolution entitled "A Resolution Authorizing And Directing The Issuance And Sale Of $50,000 Liquor Store Revenue Certificates And Prescribing The Terms And Provisions And Providing Accounts For Their Payment" at a meeting of the Village Council duly called and held on August 5, 1953: and -3- WHEREAS Liquor Revenue Certificates in the total sum of $50,000+00 were issued and sold pursuant'to said Resolution of August 5, 1953, said Certificates all bearing date August 1, 1953, and maturing serially on the lot day of August in the years and amounts as follows: $6000 in 1955 to 1960, both inclusive, and $7000 in 1961 and 1962, and WHEREAS the principal of and interest upon said Liquor Revenue Certificates has been duly and promptly paid by the Village on or before the due dates so that there are presently outstanding from said issue of Liquor Revenue Certificates the following Certificates which will mature in the years and amounts as follows: $6000 August 1, 1959 $6000 August 1, 1960 $7000 August 1, 1961 $7000 August 1, 1962 and, WHEREAS, the Village Council has determined that it is necessary to issue and sell additional Revenue Certificates in the amount of $140,000 to provide money for land acquisition and improvement, and construction, furnishing, equipping and stocking a building to house a municipal liquor store, and WHEREAS the net earnings of the municipal liquor store, as defined in the said Resolution of August 5.. 1953., were $32,112139 for the calendar year 1958 and $37,695.22 for the calendar year 1957, and WHEREAS the Village Council has determined that $140,000 Municipal Building Revenue Certificates can be issued on a parity with the outstanding Liquor Revenue Certificates pursuant to the provisions of said Resolution of August 5, 1953, and particularly paragraph number 6. thereof, NOW, THEIWORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary to issue. and sell Municipal Building Revenue Certificates of the Village in the aggregate sum of $140,000 in order to provide money for the acquisition and improvement of land and for the construction, furnishing, equipping and stocking of a building for a municipal liquor store. 2. The Municipal Building Revenue Certificates shall be 140 in number and numbered 1 to 140, both inclusive, in the denomination of $1,000 each, shall bear date April 1, 1959, and shall bear interet payable January 1, 1960, and semiannually thereafter on January 1 and July 1 in each year. Said certificates shall mature serially on January 1 in the years and amounts as follows: $ 5,000 January 1 1961 $ 5,000 January 1, 1962 $ 5,000 January 11 1963 $13,000 January l., 1964 $13,000 January 1, 1965 $13,000 January 1, 1966 $11,000 January 1. 1967 $13,000 January 1, 1968 $15,000 January 1, 1969 $15,000 January 1, 1970 $15,000 January 1, 1971 $15,000 January 1, 1972 -4- All certificates maturing on January 1, 1969 and thereafter are subject to redemption in inverse numerical order on January 1, 1965, or any interest payment date thereafter upon payment as follows t (1) If redeemed prior to January 1, 1968, at par plus accrued interest, plus a premium of $30.00 for each certificate redeemed. (2) if redeemed on January 1, 1968, or thereafter, at par plus accrued interest. 3. Said Municipal Building Revenue Certificates shall be payable out of the Revenue Certificate Account of the Village Liquor Store Fund from the net revenues to be derived from the operations of the municipal liquor stores and shall be issued and sold subject to all the conditions, covenants, terms and provisions contained in paragraphs 4., 5 6., 7,, 8. and 94 of that certain Resolution adopted by the Village Council at a Council meeting duly called and held on August 5 1953, which Resolution is entitled "A Resolution Authorizing And Directing The Issuance And Sale Of $50,000 Liquor Store Revenue Certificates And Prescribing The Terms And Provisions And Providing Accounts For Their Payment." 44 The Village Council shall meet at the Village Hall in the Village on Tuesday., the 26th day of May., 19591 at eight o'clock P.M., for the purpose of receiving sealed bids for the purchase of said Munidpal Building Revenue Certificates and the Village Clerk is authorized and directed to cause notice'of the sale of said certificates to.be given by publication at least ten (lb) days in advance in Commercial West, a financial paper published in Minneapolis, Minnesota, anM Brooklyn Center Press a legal newspaper having general circulation in the Village. Said notice shall recite that the Village will furnish printed certificates and approving legal opinion of Messrs. Howard, Peterson, LeFevere, Lefler and Haertzen, Minneapolis, Minneso, both without expense to the purchaser, shall require that all bids be unconditional and accompanied by a good faith check in the amount of at least $3 and shall specify one or more interest rates in multiples of one -tenth or one- quarter of one percent. Said notice shall further provide that delivery of the certificates will be made by the Village within forty days after the date of sale at the office of the Village Clerk or, at.the option of the purchaser, at Minneapolis or Saint Paul, without expense to the purchaser. The motion for the adoption of the foregoing resolution Was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones,, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. WELL DRILLERS LICENSES Gilbert Mork 9025 -36th Ave. No. Dependable Well Co. 2527 E. 78th Street Motion carried, Motion by Clifford Wellman and seconded by Russ Jones that the Village Council accept the George Barton report on a major street plan for Brooklyn Center, which is to be taken under advisemt, Motion carried, Motion by Clifford Wellman and seconded by Wayne Gageby that the Village Council purchase the Willow Lane School Annex for $25,600, $500 to be paid on execution of the earnest money contract, and $14,500 to be paid on the date of possession which shall be not later than July lat. $10,600 to be paid on or before January 15, 1960. No portion of the purchase price is to be subject to interest payment, All special assess- ments due and payable in 1960 and in subsequent years to be paid by the Village. Legal description to be for that land East of Osseo Road owned by the Osseo Independent School District #279, described by street number as 7100 Osseo Road. The form of agreement is to be subject to the approval of respective school board and Brooklyn Center Village Council. Motion carried. Motion by Clifford Wellman and seconded by Wayne Gageby that the Village Attorney prepare the earnest money contract for the purchase of the Willow Lane School Annex and that upon the closing of the earnest money contract, the Village Attorney have the abstract to the property brought up to date and the title examined. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of April 28, 1959 ", were audited and ordered paid.
