The Village Council met in regular session and was called to order by
William N. Super, Mayor, at 6 :00 P.M.

Motion by Carl Carlson and seconded by Clifford Wellman that the Village
Council approve the minutes of the regular council meeting of April 28, 1959 as
recorded. Motion carried.
Member Carl Carlson introduced the following Ordinance and upon recommenda-
tion of the Planning Commission moved its adoption:
AN ORDINANCE AMENDING SECTION 35 -713 OF THE
VILLAGE ORDINANCES TO REZONE CERTAIN PROPERTY
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN:
1. Section 35 -713 of the Village ordinances is hereby
amended by adding the following thereto:
The North 96' of that portion of Government Lot
No. 3; bounded on the West by Trunk Highway No. 100,
on the North by 48th Ave. No. and on the East by
France Ave. No.
2. This ordinance shall be effective from and after its
publication.
The motion for the adoption of the foregoing Ordinance was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby
and Russ Jones; and the following voted against the same: None; whereupon said
Ordinance was declared duly passed and adopted.
Motion by Carl Carlson and seconded by Wayne Gageby that the Village
Council uphold the recommendation of the Plying Commission to approve the
construction of an office building on the above described property and grant a
variance that storage shall be allowed in the basement of said building, on the
condition that there shall be no outside storage of equipment or materials.
Motion carried.
Motion by Carl Carlson and seconded by Wayne Gageby that the building
inspector submit a proposal for architectural control on commercial and multiple
dwelling structures. Four voting yes and Clifford Wellman voting no. Motion
carried.
Notion by Clifford Wellman and seconded by Wayne Gageby that the Pearson
Brothers be allowed to amend their petition for the re- zoning of Lot 2, Block 10,
Northgate Addition together with more specific plans without an additional filing
fee. Motion carried.

Motion by Wayne Gageby and seconded by Russ Jones that the Village Council
uphold recommendation of the planning commission that a Special Use Permit be
granted Mrs. Beverly Jones, wife of the petitioner Kenneth Jones, to operate a
Beauty Parlor in her residence at 2331 Ericon Drive, and said permit be non -
transferrable, being granted to Mrs. Jones and not the residence at above
mentioned address. Motion carried.

Council uphold recommendation of the planning commission that a Special Use
Permit be granted Mr. K. 0. Sandum for the conversion of the present residence
at 6520 Osseo Road, to a duplex with the condition that the Council defers the
greating of said Permit until the Building Inspector has certified that the barn
in the rear has been converted to a one story garage and re -built in a satisfact-
ory manner and in accordance with the Village buil code. There shall be no
outside stairways on the duplex. Motion carried.
Motion by Wayne Gageby and seconded by Clifford Wellman that the Village
Council uphold recommendation omtnendation of the planning commission that a variance be
granted Mr. V. H. Edberg to re- divide his property at 520 - 55th Ave. No. as
shown on sketch filed with the planning commission, as re- division would be in
accordance with surrounding neighborhood. Motion carried.
Motion by Clifford Wellman and seconded by Wayne Gageby that the Village
Council uphold recommendation of the planning commission that a variance be
granted Mrs. Shirley Hueser to sell the north 60' of Lot 1, Block 2, Grandview
Manor provided, however, that a stipulation be made on future building permit
for the North 60' stating that a 35' yard setback on Fremont Avenue North and a
minimum of a 20' setback on 64th Avenue North must be maintained. Motion
.carried.
Motion by Carl Carlson and seconded by Wayne Gageby that the Village
CoVncil uphold recommendation of the planning commission that a variance be
granted Dr. Spake to convey the northerly 51' of Lot 9, Block 5, Brooklyn Manor
to Dr. Dudley as per Certificate of Survey filed with the Planning Commission,
said lot having 51' frontage on France Avenue North and extending Eastward 115'
from France Avenue North, as per plat. Super, Wellman, Carlson and Gageby
voting yes, Jones voted no. Motion carried.
Notion by Carl Carlson and seconded by Russ Jones that the Village Council
uphold recommendation of the planning commission that a variance be granted
Gerald Vickerman, 6+00 Humboldt Avenue North to build a garage on said property
with a 15' setback instead of the required 25' as said property was platted
under the old ordinance. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson that the Village 1,
Council allow an extension of the previously granted variance to Mr. Ronald
Gray, 807 - 73rd Avenue North, to live in his garage until August 7, 1959, to
November 1 5, 1959 Motion carried.
The mayor announced that the meeting was open for further consideration of
the proposed Sanitary Sewer Improvement No. 1959 -25, the hearing thereon having
been adjourned to this date at the meeting of May 5, 1959
The Mayor then called upon all property owners present to present further
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of said
improvement, member Carl Carlson introduced the following resolution and moved
its adoption:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, as follows:
The base bid of Dunkley Surfacing Co., Inc., in the amount
Of $1,885.00 for the furnishing of plant -mixed bituminous
surfacing as per specification is deemed to be the best bid
submitted by a responsible bidder for village purposes, and
said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman and upon vote being taken thereon the following yo;ted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Carl Carlson and seconded by Russ Jones that the Village Council
upon recommendation of SHIFFLET, BACKSTROM, HUTCHISON, & DICKEY, INC., in a
letter of May 7, 1959, approve the Change Order No. G-1 for the new Liquor
Store and Fire Station for the extra depth of foundation cost in the amount
Of $847.4+. Motion carried.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR SANITARY SEWER IMPROVEMENT N0. 1959 -17
AND DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for Sanitary Sewer
Improvement No. 1959 -17 prepared by Village Engineer are
hereby approved and ordered filed with the Clerk.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in the

1. It is hereby determined that it is necessary and
for the best interests of the village and the owners of property
specially benefited thereby that the following improvement shall
be constructed.
Sanitary Sewer on Osseo Road from 65th Avenue
North to approximately 62nd Avenue North and on
Halifax Drive from Osseo Road to Grimes Avenue
North and on France Avenue North from Halifax
Drive to 63rd Avenue North.
2. The plans and specifications for said improvement shall
be prepared by Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby
and Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION APPROVING PLANS AND SPECIFICATIONS

of not less than five per cent of the bid.
3. Bid date is set for June 23, 1959 at 2 o'clock p.m.
The Village Administrator and the Village Engineer are authorized
and directed to open said bids at 2:oo p.m. and to keep a record
of said bids and report the same to the meeting of the Village
Council to be held at 8:00 p.m. on said date.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson
and Russ Jones; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING BIDS FOR
PLANT MIXED BITUMINOUS SURFACING
WHEREAS, the Village Administrator and Village Engineer have reported
that on May 12, 1959, at 2 :00 o'clock p.m., they opened and tabulated
the bids received for plant -mixed bituminous surfacing, and said bids
were as follows:

Construction Bulletin, the date of first publication not less
than 10 days prior to the date for receipt of bids. Said

Council authorize the Village Administrator to employ another girl for the
Village Office. Motion carried.

Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED STREET INPROVE=T NO. 1959 -30
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Street surfacing on 65th Avenue and 66th Avenue from
Osseo Road to back lot line between Drew Avenue and
Chowen Avenue; and on Ewing Avenue and Drew Avenue
from 65th Avenue to the North line of Brooklane Addition
and France Avenue from Osseo Road to the North line of
Brooklane Addition.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be con-
structed at an estimated cost of $14,500.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the village on Tuesday, the 9th day of June,
1959 at 8 :00 o'clock P.M., and the clerk shall publish notice of
the time and place of hearing by two weeks' publication in the
official newspaper of the village.
3. The area proposed to be assessed for said improvement is
as follows:
All lots and parcels abutting thereon.
4. This proposed improvement shall be designated Street
Improvement No. 1959 -30.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl
Carlson and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Notion by Carl Carlson and seconded by Clifford Wellman that the
following resolution be adopted:
WHEREAS, Clarence Ludwig has been serving for many years as
executive secretary of the League of Minnesota Municipalities., and
WHEREAS, through his devoted efforts the League has become a
strong and effective organization for unproved municipal government
in Minnesota, and
WHEREAS, Clarence Ludwig is concluding his service with the League
because of retirement,
NOW, THEREFORE, the Village Council of the Village of Brooklyn
Center expresses its grateful appreciation as a participating member
of the League of Minnesota Municipalities for the outstanding service

of Clarence Ludwig as executive secretary thereof and publicly
acknowledges the great debt which the communities of Minnesota
their citizens owe to him for his vision, ability and dedicatfoas''to
strengthening municipal governments which lie closest to the people;
and we commend him as an outs di ng citizen,, scholar and servant
of our free institutions of government and for his distinguished
record of service to the University of Minnesota and to the people
of this state.

Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING WORK
WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Randall Brothers have satisfactorily
completed the following improvement in accordance with said contract:
Sanitary Sewer Improvement No. 1959 -5
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson
and Russ Jones; and the following voted against the same: None; whereupon
said resolution was duly passed and adopted.

adoption:
RESOLUTION ACCEPTING WORK
WHEREAS, pursuant to a written contract signed with the Village

Motion by Clifford Wellman and seconded by Carl Carlson that the claim
for expenses of the Justice of Peace, Ray Benson, to attend the traffic seminar
at the U. of M. and the membership fee of Hennepin County Suburban. Judges
Association be denied. Motion carried.

Motion by Wayne Gageby and seconded by Carl Carlson that the auditors
report prepared by Zimmerman and Moen for 195$ be accepted and published in
the Brooklyn Center Press. Motion carried.
Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION
BE IT RESOLVED that the Village of Brooklyn Center enter into
an agreement with the State of Minnesota, Department of Highways
for the following purposes, to -wit:
For the Construction of traffic control signals
at the intersection of Trunk Highway No. 100 and
57th Avenue North.
BE ST FURTHER RESOLVED that the Mayor and Clerk be and they hereby
are authorized to execute such agreement.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson
and Russ Jones; and the following voted against the same: None; whereupon
said resolution was duly passed and adopted.
The bills set forth on the schedule are attached to these minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting
of May 12, 1959 were audited and ordered paid.
