Super, Mayor, at 8 :00 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones were present. The Mayor announced that this was the time and place for receipt of bids for the purchase of $140,000 Municipal Building Revenue Certificates in accordance with the Resolution adopted April 28, 1959• The Clerk presented affidavits showing publication of the Notice of Sale in Commercial West a financial ' paper published in Minneapolis. Minnesota, and in the enter Press, the official village news- paper, which affidavits were examined, found satisfactory and ordered placed on file. The Clerk then presented the sealed bids which had been received, which were opened and examined and found to be as follows: Name of Bidder Interest Rate Amount of Bid I. Piper, Jaffray & Hopwood 4.50, on all certificates $140,000.00 maturing 111161 to 1/1/69, inclusive; 4.70% on all certificates maturing 1/1/70 to 1/1/72, inclusive; with additional interest of 1.30,6 on all certificates from 7/1/59 to 7/1/62, inclusive.. 3• Mannheimer -Egan, Inc. - 4.20% on all certificates $140,000.00 Harold E. Wood & Co. maturing 111161 to 1/1/63, inclusive; 4.40% on all certificates maturing 1/1/64 to 1/1/68, inclusive; 4.50, on all certificates maturing 111169 to 1/1/72, inclusive; with additional interest of 1,500 on all certificates from 7/l/59 to 1/1/63, inclusive. After due consideration of said bids, member Carl Carlson introduced the following Resolution and moved its adoption: RESOLUTION AUTHORIZING AND DIRECTING THE ISSUANCE AND SALE OF $140,000 MUNICIPAL BUILDING REVENUE CERTIFICATES AND ACCEPTING BID THEREFOR BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. The bid of Kalman & Co., Inc., Juran & Moody, Inc., E. J. Prescott & Co.asd Allison - Williams Co. to purchase $140,000 Municipal Building Revenue Certificates, bearing interest rate of 4.00% on all certificates maturing January 1, 1961 to January 1, 1965, inclusive and 4.25% on all certificates maturing January 1, 1966 to January 1, 19 72, inclusive, together with an additional coupon o f 1.750 on all certificates outstanding for the period of July 1, 1959 to January 1, 1962, and to pay therefor the sum of $140,000, is hereby found, determined and declared to be the most favorable bid and is hereby accepted. The Clerk is directed to retain the good faith check of said purchaser. 2. The Village shall forthwith issue its negotiable Municipal Building Revenue Certificates in the principal amount of $140,000, dated April 1, 1959 being 140 in number and numbered 1 to 140, both inclusive, in the denomination of $1,000 each, bearing interest at the rate of 4.00 Percent per annum on all certificates maturing January 1, 1961 to January 1, 1965, inclusive and 4.25 percent per annum on all certificates maturing January 1, 1966 to January 1, 1972, inclusive, plus additional interest at the rate of 1.75 percent per annum on all certificates out- standing for the period from July 1, 1959 to January 1, 1962 to be represented by a separate coupon, said certificates maturing serially in the years and amounts as follows: $ 5,000 on January 1 each year 1961 to 1963, inclusive; $13,000 on January 1 each year 196+ to 1968, inclusive; $15,000 on January 1 each year 1969 to 1972, inclusive; with a prepayment option as follows: All certificates maturing on January 1, 1969 and thereafter are subject to redemption in inverse numerical order on January 1, 1965, or any interest payment date thereafter upon payment as follows: (1) If redeemed prior to January 1, 1968, at par plus accrued interest „plus a premium of $30.00 for each certificate redeemed. (2) If redeemed on January 1, 1968, or thereafter, at par plus accrued interest. 3. Both principal and interest shall be payable at the main .office of Northwestern National Bank, Minneapolis, Minnesota, and the Village shall pay the reasonable charges of said bank for its services as paying agent. 4. The certificates and interest coupons to be thereto attached shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF HE RWIN VILLAGE OF BROOKLYN CENTER No. $1000 MUNICIPAL BUILDING REVENUE CERTIFICATE ✓ KNOW ALL MEN BY THESE PRESENTS That the Village of Brooklyn Center, Hennepin County., certifies that it is obligated to a to p Y, , � pay bearer out of the Revenue Certificate Account of its Liquor Store Fund from the net revenues to be hereafter derived from the operations of the municipal liquor stores, the principal sum of ONE THOUSAND DOLLARS on the lst day of January, 19 , and to pay interest thereon at the rate of percent ( %) per annum from date to July 1, 1959, percent ( %) per annum from July 1, 1959 to January 1, 1962 represented by separate sets of interest coupons at the coupon rate of percent ( %) and one and seventy - five hundredths percent (1.75)" respectively, and percent ( %) per annum after January 1, 1962, payable January 1, 1960 and semiannually thereafter on the 1st day of January and the lst day of July in each year in accordance with and upon presentation and surrender of the interest coupons hereto attached as they severally become due. Both principal and interest are payable at Northwestern National Bank of Minneapolis in the City of Minneapolis, Minnesota, in any coin or currency of the United States of America which at the time of payment is legal tender for public and private debts. All certificates of this issue maturing on January 1, 1969, and thereafter, upon thirty (30) days prior notice by mail to the bank where the certificates are payable and to the last known holder are subject to redemption in inverse numerical order on January 1, 1965, or any interest payment date thereafter, upon payment at par plus accrued interest plus a premium of $30.00 for each certificate redeemed if redeemed prior to January 1, 1968, and if redeemed on January 1, 1968, or thereafter, at par plus accrued interest. Holders desiring to receive such notice must register their names, addresses and certificate numbers with the Village Clerk. This certificate is one of an issue in the aggregate principal amount of $140,000, all certificates being of like date and tenor except as to maturity and redemption privilege, all issued for the purpose of providing money for the acquisition and improvement of land and for the construction, furnishing, equipping and stocking of a building constituting a municipal liquor store, pursuant to resolution of the village council, and is payable solely from the net revenues of the municipal liquor stores as defined in the authorizing resolution and the village shall not be liable to levy taxes or collect and use any money received from taxation for the payment of either principal hereof or interest hereon. IT IS HEREBY CERTIFIED AND RECITED That in and by the authorizing resolution the village council has covenanted and agreed that so far as permitted by law it will continue to operate the municipal liquor stores free from competition by other like stores in the village, that it will carry adequate insurance on the stores and contents, that it will keep suitable and adequate books of record and account to show all transactions in connection with said stores, that it has established and will maintain a Liquor Store Fund and has set up therein a Revenue Certificate Account into which it will pay monthly out of the net revenues of the municipal liquor stores a sum sufficient to provide money to pay principal hereof and interest hereon when due and that it will use and apply all of said net revenues as provided in the authorizing resolution.. IT IS FURTHER CERTIFIED AND RECITED That all conditions, acts and things required under the Constitution and Laws of the State of Minnesota to exist, to be done, to happen and to be performed in order to make this certificate a valid and binding special obligation of the village according to its terms, do exist, have been done, have happened and have been performed and that this certificate does not create an indebtedness of the village contrary to any constitutional or statutory limitation. IN WITNESS WHEREOF, the Village of Brooklyn Center, Hennepin County, Minnesota, by its Village Council has caused this certificate to be executed by the signature of the Mayor and attested by the Village Clerk and the corporate seal of said village to be hereunto affixed and the interest coupons to be executed and authenticated by the facsimile signatures of said officeas, all as of April 1, 1959. Mayor Village of Brooklyn Center, Minnesota Attest Village Clerk (Seal) (Form of Coupon) No. . $ • On the lst day of January (July), 19 , the Village of Brooklyn Center, Hennepin County, Minnesota, will pay to bearer at Northwestern National Bank of Minneapolis, Minneapolis, Minnesota, out of the Revenue Certificate Account of its Liquor Store Fund the sum of DOLLARS for interest then due on its Liquor Store Revenue Certificate dated April 1, 1959, No. Mayor Village Clerk 5. Said Municipal Building Revenue Certificates shall be payable out of the Revenue Certificate Account of the Village Liquor Store Fund from the net revenues to be derived from the operations of the municipal liquor stores, shall be issued and sold subject to all the conditions, covenants, terms and provisions contained in paragraphs 4., 5., 6., 7., 8. and 90 of that certain Resolution adopted by the Village Council at a Council meeting duly called and held on August 5, 1953, which Resolution is entitled "A Resolution Authorizing And Directing The Issuance And Sale of $50,000 Liquor Store Revenue Certificates And PVescribing The Terms And Provisions And Providing Accounts For Their Payment ", which paragraphs are hereby in- corporated by reference as if fully set forth herein, and shall share on a parity in the net earnings of the muncipal liquor stores with the outstanding Liquor Store Revenue Certificates. 6. The Clerk is hereby authorized and directed to deliver a certified copy of this resolution to the County Auditor of Hennepin County, together with such other information as the County Auditor may require, and to obtain his certificate that the issue has been entered upon his register. 7. The said certificates, when fully executed, shall be delivered by the Treasurer to the purchaser thereof upon receipt of the purchase price, and the said purchaser shall not be obligated to see to the proper application thereof. 8, The Clerk andTreasurer are authorized and directed to prepare and furnish to the purchaser and to the attorneys approving said issue, certified copies of all proceedings and records relating to the issuance of said certificates and to the right, power and authority of the Village and its officers to issue the same and said certified copies and certificates shall be deemed the representations of the Village as to all matters stated therein. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said Resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: p n RESOLUTION ACCEPTING BID WHEREAS, the Village Administrator and Administrative Assistant have reported that on May 26, 1959 at 2 o'clock P.M. they opened and tabulated the bids received for Sanitary Sewer Interceptor Improvement 1959 -19 A and that said bids were as follows: 1. Phelps -Drake Co., Inc. $180,134.05 NOW, TH12WORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the low bid of Nodlund Construction Co. as to the furnishing of labor and materials for the general construction as per specifications of Sanitary Sewer Interceptor Improvement 1959-19A in the amount of $132,226.75, is deemed to be the best bid submitted by a responsible bidder for village purposes and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None, on said resoluti was a u adopted. � p on declared duly passed and . p d Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID WHEREAS, the Village Administrator and Engineer have reported that on May 26, 1959, at 2 o'clock p.m, they opened and tabulated the bids received for Sanitary Sewer Interceptor Improvement 1959 -19B and the said bids were as follows: 1. Lametti & Sons, Inc. $134,030.04 29 Peter Lametti Const. Co. $1332556.17 3• Barbarossa & Sons, Inc. $140,184.00 4. Nodlund Construction Co. $187,141.00 5. Phelps -Drake Co.., Inc. $178,714.25 NOW., THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the low bid of Peter Lametti Construction Company, for the construction of Sanitary Sewer Interceptor Improvement No. 1959 -19B, as per specifications, in the amount of $133,556.17, is deemed to be the lowest bid submitted by a responsible bidder and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID WHEREAS, the Village Administrator and Engineer have repcited that on May 26, 1959 at 2 o'clock p.m. they opened and tabulated the bids received for Sanitary Sewer Improvement No. 1959 -24 and the said bids were as follows: 1. Shoppe Plumbing & Heating $16,122.00 2. Barbarossa & Sons, Inc. $11,681.00 3. Peter Lametti Construction Co. $ 8 4. Petrowske & Ross $11 2 829.75 5. Nodlund Construction Co. $11,763.50 NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, Minnesota, that the low bid of Peter Lametti Construction Co. for the construction of Sanitary Sewer Improvement No. 1959 -24 as per specifications in the amount of $8,807.69 is deemed tole the lowest bid submitted by a responsible bidder and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None;' whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID WHEREAS, the Village Administrator and Engineer have reported that on May 26, 1959 at 2 o'clock p.me they opened and tabulated the bids received for Deep Well Turbine Pump as part of Water Improvement 1959 -10 and that said bids were as follows: 1. McCarthy Well Co. $5,300.00 2. Fadden Pump Company $4 2 323.00 3. Max Renner $5,095•Q 4. Layne- Minnesota $4,990.00 5• Tri -State Drilling Company $4,840.00 a NOW.* THEREFORE,. BE IT RESOLVED, by the Village of Brooklyn Center, Minnesota, that the low bid of Fadden Pump Company for the furnishing and installation of a Deep Well Turbine Pump as a part of Water Improvement No. 1959-10 as per specifications in the amount of $4,323.00, providing that we receive a letter from Fadden Pump Co. that a completion date shall be prior to June 29, 1959, is deemed to be the lowest bid submitted by a responsible bidder and said bid is hereby accepted, The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Councilman Clifford Wellman left the meeting at this point. Motion by Carl Carlson, seconded by Wayne Gageby, that the Village Council reconsider their action of May 12, 1959 on the request of Mr. Ronald Gray, 807 73rd Avenue North, for an extension of time on the variance granted to him to live in his garage, and extend the time of the variance to July 1, 1960. Motion carried, Motion by Russ Jones and seconded by Carl Carlson that the Village Council authorize the temporary loan of $9500.00 from the general fund to the Park Bond Redemption fund until such a time as we receive tax money from the State. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby that the Village Council uphold recommendation of the planning commission that the petition of R. C. Ernst for a Special Use Permit to build two double bungalows on Block 3 1 Twin Lake Woods Addition be denied on the grounds that said structures would not conform to the surrounding area. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council uphold recommendation of the Planning Commission that the petition of R. C. Ernst for a Special Use Permit to construct three duplexes on Lot 4 and the West 25' of Lot 3, Block 5, Twin Lake Woods Addition, be denied on the grounds said structures would not conform to the surrounding area. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby that the Village Council uphold recommendation of the Planning Commission and that the petition of Fred W. Hey to build a one family dwelling on the West 85t, t ' 5 Lo 2 Gould 's Riverview Addition be granted,, providing however, 7, A n gr pr ng , that Mr. Hey grant to the Village an easement on the West 15' of said lot for utility purposes. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council uphold recommendation of the Planning Commission and that the petition of Leon Dubois for a variance to build a garage 1' from his south property line at 5725 Fremont Ave, No., be grand as said property line is the North line of the NSP Easement and is in accordsazce with previous building near this Easement. Motion carried. Motion by Carl Carlson ead seconded by Wayne Gageby that the -. VMAge Council uphold the recommendation of the Planning Commission that a petition for a variance of Robert Mallay to build a commercial building at 4300 -69th Ave. No., be approved subject to the following conditions-, % that the green strip on the east side of Lot be 10 the setback on the west side of lot be 5' and that the building be of one -story type as per plot plans filed with the petition, and that the building shall be brick faced on the South and East side, Motioncarried, Motion by Russ Jones and seconded by Wayne Gageby that the Village Council uphold recommendation of the planning commission and that the petition of Donald Mason, 5657 Logan Ave. No,, for a variance on off - street parking be approved, and that no green strip be required as per plat plan filed with the petition. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby that the Village Council uphold recommendation of the Planning Commission and that a variance be granted Mr. Richard Hipp to replat Lots 3, 4, 5, 6 and Z, Block 3, Palmer Lake Terrace 2nd Addition so as to provide adequate garage space for already erected dwellings and that Mr. Hipp provide the Village with a Registered Land Survey of the aforementioned lots as replatted, said survey to be filed with the Village along with the written consent of the affected property owners, affirming their approval. Motion carried. Member Carl�Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, Petrowske & Ross have satisfactorily completed the following improvements: Sanitary Sewer - Pro No. 1959 -14 Water Mains - Project No. 1959 -15 Storm Sewer - Project No. 1959 -29 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; the work completed is hereby accepted and approved, upon the recommendation of the Village Engineer and the Minder Engineering Company. The motion for the adoption of the foregoing resolution was duly seconded by Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION URGING EXPEDITIOUS CONSTRUCTION OP IWROVENtMS ON OSSEO ROAD WHEREAS, the Village Council has been advised of the increasing amount of traffic on Osseo Road through the Village of Brooklyn Center, and WHEREAS, said highway appears to be inadequate to handle the present and anticipated future traffic thereon, and WHEREAS, the Village Council has been advised that the State Highway Department is planning to improve said highway by construction of a four -lane divided highway and other improve- ments and additions, and WHEREAS, it is the opinion of the Village Council that said construction and improvements should be completed at the earliest possible time in order to permit adequate traffic flow both within and through the Village of Brooklyn Center, NOW, THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Minnesota State Highway Department is urged to expedite its project to improve Osseo Road in and through the Village of Brooklyn Center and if at all possible to cause said project to be constructed during the fiscal year 1961 rather than` the fiscal year 1962 -,s presently contemplated. IT IS FURTHER RESOLVED that a copy of this resolution be transmitted forthwith to the Commissioner of Highways, State of Minnesota. _A _ The motion for the adoption of the foregoing resolution was duly seconded by Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: William N, Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING ADVERTISEMENT FOR WATER METERS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. The Village Clerk shall advertise for bids for cold water meters, for village use under the specifications prepared by the Purchasing Agent. 2. Bid date is set for June 23, 1959 at 2 o'clock p.m. The motion for the adoption of the foregoing resolution was duly seconded by Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N, Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and - moved its adoption: RESOLUTION ORDERING ADVERTISEMEENT FOR PLANT MIXED BITUMINOUS SURFACING MATERIALS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows 1. The Village Clerk shall advertise for bids for plant -mixed bituminous surface material similar to Minnesota Highway Department Specifications 23+1. 2. Bid date is set for June 23, 1959 at 2 o'clock p.m. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof; William N. Super, Carl Carlson, Wayne Gageby and Russ Jone; and the following voted against the same None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Russ Jones that the Village Council approve the final plat of Northbrook Manor 4th Addition; subject to all requirements of the platting ordinance and a street bond of $18,363.00. Motion carried. Member Carl Carlson introduced the following Resolution and moved its adoption: RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Mayor and Clerk are hereby authorized and directed to execute,a petition requesting vacation of that portion of Northport Drive from the east right of way line of France Avenue to the east line of Cameron Manor, and the Clerk is directed to cause Notice of a public hearing thereon to be given as required by law. a � The motion for the adoption of the foregoing resolution was duly seconded by Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Russ Jones that Wayne Gageby be instructed to contact Mr. Russell Gilbertson about the condition of his property and that he instruct Mr. Gilbertson to clean it up.
