Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota, including all accounts audited
by said Council
June 9, 1959
The Village - Council met in regular session and was called to order
by William N. Super, Mayor, at 8 :00 p.m.
Roll Call: William N. Super, Clifford Wellman, Wayne Gageby, and
Russ Jones were present. Carl Carlson arrived late as hereinafter indicated.
Motion by Wayne Gageby and seconded by Clifford Wellman that the
Village Council approve the minutes of the special meeting of May 5, and the
regular meeting of May 12,, 1959 as recorded. Motion carried.
Member Carl Carlson arrived at this point of the meeting.
The Mayor announced that the meeting was open for the consideration of
proposed Street Improvement No. 1959-30•
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official
newspaper, the last publication being on June 4, 1959, which affidavit was
examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member Wayne Gageby introduced the following resolution and
moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF
STREET IMPROVIIMElff NO. 1959 -30 AND
ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and for
the best interests of the village and the owners of property
specially benefited thereby that the following improvement shall
be constructed:
Road Mix blade laid bituminous street surfacing on the
following streets:
65th Avenue and -66th Avenue from Osseo Road to
back lot line between Drew Avenue and Chowen Avenue.
Ewing Avenue from 65th Avenue to the North line of
Brooklane Addition.
France Avenue from Osseo. Road to the North line of
Brooklane Addition.
The eat* cost is $1.78 per assessable front foot.
2. The plans and specifications for said improvement shall
be prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,

Wayne Gageby and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and :adopted.
Motion by Carl Carlson and seconded by Wayne Gageby that the Village
Council uphold recommendation of the plarnning, commission that the petition
of Nordstrom -Odell to constru ^t a one family dwelling on Lot 2, Block 3,
Humboldt Addition, be approved under the following stipulations: that a deed
be granted to the owner of the residence on Lot 1, said block and addition,
of 5' from the foundation of that part of the residence now located on Lot 2
and also that no other buildings are to be constructed on Lot 2 within 15'
of the present dwelling on Lot 1, which encroaches on Lot 2, said block and
Addition. Motion carried.
Motion by Russ Jones and seconded by Wayne Gageby that the Village
Council uphold recommendation of the planning commission that the petition of
Mrs. Walter C. Nielsen to re -zone the North 300 feet of the South 312.53
feet of Lot 18, Aud. Sub. 25 from present R -1 to B -1 be denied on the grounds
that plans for ingress to and egress from the above mentioned property is not
in the best interests of the surrounding area nor the Village. Motion carried.
Member Carl Carlson, acting upon recommendation of the Planning
Commission, introduced the following ordinance and moved its adoption:
An Ordinance Amending the Zoning Ordinance
By Adding Additional Territory To The
Residence- Business District
The Village Council of the Village of Brooklyn Center do ordain
as follows:
Se ction 1 . Section 35 -713 of the Ordinances of the
Village of Brooklyn Center is hereby amended by adding at the
end of said section the following;
"The Westerly 160 feet of the North 307.6 feet
of Lot 40, Auditor's Subdivision No. 216"
Section 2. This ordinance shall be effective from and after
its passage and publication.
The motion for the adoption of the foregoing Ordinance was duly seconded by
member Russ Jones, and upon a vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Russ
Jones and Carl Carlson; and the following voted against the same: None;
whereupon said Ordinance was declared duly passed and adopted.
Motion by Carl Carlson and seconded by Russ Jones that the Village
Council uphold the recommendation of the Planning Commission and grant a
Special Permit for the construction of a Mortuary on the westerly 160 feet
of the south 153 feet of the North 307.6 feet of Lot 40, Auditor's
Subdivision No. 216, and a Variance so that that part of the said south
153 feet of the north 307.6 feet lying east of the westerly 160 feet
thereof may be used for off - street parking for said Mortuary, both being
based upon the plot plan heretofore submitted and on file with the Planning
Commission, and upon the condition that the property owners dedicate to
the Village a service road 30 feet in width lying parallel to Osseo Road
and in and through the south 153 feet of the above described property, the
exact location of said service road to be fixed at a later date. Motion
carried.
Motion by Wayne and seconded by Carl Carlson that the Village
enter into a purchase agreement with Mrs. Olga Madsen for the sum of $250,00
for the following described premises located in the Village of Brooklyn
Center:
South 30' of Lot Fifteen (15), Garcelon's Addition to
Minneapolis
Motion carried.

Member Clifford Wellman introduced the following resolution and
moved its adoption:

BE EXTENDED TO E4iH .A IID CSS_FO ROAD
WHEREAS, the population of the Village of Brooklyn Center
and particularly the Northwestern part of said Village has
been growing rapidly, and
WHEREAS, it is deemed in the public interest that public
traneportation facilities be provided for said expanding popula-
tion, and
WHEREAS, it is the opinion of the Village Cotu,.cil that an
extension of existing service is economically feasible at
this time,
NOW THEREFORE BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the Twin City Lines be requested
to extend its existing service on Osseo Road (Highway No. 152)
from its present terminus at 63rd Avenue North to the vicinity
of 69th Avenue North and said Osseo Road.
IT IS FURTHER RESOLVED that a copy hereof be forthwith
transmitted to the said Twin City Lines.
The motion for the adoption of the foregoing resolution was duly seconded
by Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted. .
Motion by Wayne Gageby and seconded by Carl Carlson that the Village
release the performance bond for the construction of water and sewer in
Garden City 7th Addition, based upon the racommendation of the Village
Administrator. Motion carried.
Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR PAYMENT OF
WATER MAIN nTROVEMENT NO. 1959 -22
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota as follows:
1. That Project No. 1959 -22 for construction of water
mains on 62nd Avenue North from Beard Avenue North
to Chowen Avenue North, and on Chowen Avenue North
from 62nd Avenue North to approximately 159' North of
62nd Avenue North be financed from the Revenue of the
Public Utilities.
2. All expenditures incurred by 1959 -A Fund Project No.
1955 -22 shall be reimbursed at the completion of the
project.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereoft William N. Super, Carl Carlson, Wayne Gageby,
Clifford Wellman and Russ Jones; and the following voted against the
same: None; whereupon said resolution was declared duly passed and
adopted.

Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION PROV]:D21G FOR PAMMMI'T OF
WATER MAIN - WROV104ENT NO. 1959 -23
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota as follows:
1. That Project No. 1959-23 for construction of
Water mains to connect Well #2 to the water main
on 63rd Avenue be financed from Revenue of the
Public Utilities,
2. All expenditures incurred by 1959 -a Fund for
Project No. 1959 -23 shall be reimbursed at the
completion of the project.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,
Wayne Gageby and Russ Jones, and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted.
Motion by Russ Jones and seconded by Carl Carlson that the Mayor and
Clerk be authorized to sign the agreement between the Park Board and the
Robbinsdale School District regarding the use and maintenance of school
properties and park properties for Park and Recreation purposes. Motion
carried.
Motion by Wayne Gageby and seconded by Carl Carlson that the Village
Council reject the claim of Thomas C. Knight for the sum of Seven Thousand
Five Hundred and no /100 dollars ($7,500) as compensation for his personal
injuries and special damages and the further sum of $300.00 as compensation
for the damage to his automobile which he is asking for as a result of an
accident May 6, 1959, involving a manhole on Palmer Lake Drive and 69th
Avenue North. Said claim shall be forwarded to the Iowa. Mutual Insurance
Company, 2440 Park Avenue, Minneapolis, Minnesota. Motion carried.
Motion by Russ Jones and seconded by Carl Carlson that the Village
Council accept the following petitions for sanitary sewer laterals:
Logan Ave.No. - 55th to N.S.P. easement (Project-#1959-31)
Logan Ave. No.- N.S.P. easement to Hwy. #100 (Project #1959-32)
Knox Ave. No. - N.S.P. easement to 59th (Project #1959 -33)
James Ave. No.- 55th Ave. No. to N.S.P. easement (Project #1959 -34)
Girard Ave. No. - 55th to N.S.P. easement (Project #1959-35)
Girard Ave. No. - N.S.P. easement to 59th (Project #1959 -36)
Dupont Ave. No. - N.S.P. easement to 59th (Project #1959 -37)
Motion carried.
The bills set forth on the schedule attached to these minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the
Meeting of June 9, 1959" were audited and ordered paid.
