June 23, 1959 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8 :00 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones were present. Wayne Gageby was absent. Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the minutes of the regular meeting of May 26, 1959 and a special meeting of June 2, 1959 as recorded. Motion carried. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there - of: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones; and the following voted against the same: None; wbe reupon said resolution was declared duly passed and adopted. S. McCrossan, Inc. as to the furnishing of plant -mixed bituminous material as per specifications is deemed to be the best bid submitted by a responsible bidder for Village purposes, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by Clifford Wellman, and upon vote being taken thereon: the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones; and the following voted against the same None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator, and the Village Engineer have reported that on June 23, 1959, at 2:00 P.M., they opened and • tabulated the bids received for Sanitary Sewer Improvement Nos. 1959 -17 and 1959-25 and that said bids were as follows: 19L9-17 1.959-2 No. 1 Nodland Construction Co., Inc. $2,230.00 $24,383.00 No. 2 Randall Bros. $2,472.50 $24,509.888 No. 3 Lametti & Sons, Inc. $3,436.00 $28,405.75 No. 4 Peter Lametti Construction Co. $2,265.96 $31,393- No. 5 ; Barbaxossa & Sans, Inc. $3, 448.00 $ 36 ,,781.50 NOW, THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota that the bid of Nodland Construction Co., Inc. in the amount of $26,613.00 as to the furnishing of all work, labor and material in connection with Sanitary Sewer Improvement Nos. 1959 -17 and 1959 -25 according to the plans and specifications therefore, now on file with the Village Clerk, is deemed to be the lowest and best bid submitted for said work by responsible bidders and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones; ' and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $100,000 PARK BONDS Y WHEREAS, the Village Council has been authorized to issue not exceeding $400,000 of Park Bonds pursuant to a vote of the electors held on the 3rd day of December, 1957, and WHEREAS, $200,000 of said authorized Park Bonds have been hereto- fore issued and a like amount is as yet unissued.. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the • Village a of Brooklyn Center Minnesota,, as follow s. i Member Clifford Wellman introduced the following Ordinance and moved its adoption: AN ORDINANCE CHANGING THE NAME OF 47th AVENUE NORTH TO LAKESIDE AVENUE THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS 1. A new section entitled Section 25 -409 is hereby added to the Village Ordinances to read as follows; Section 25 47th AVENUE NORTH - LAKESIDE AVENUE. 4 Avenue North lying within the Village of Brooklyn Center is hereby renamed, and shall hereafter be known as Lakeside Avenue. 2. Member Carl Carlson introduced the following resolution and moved its K adoption: RESOLUTION PROVIDING FOR PAYMENT OF WATER MAIN PROJECT NO. 1959 -26 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. That all expenditures incurred in construction of Water Main Project No. 1959 -26, Northport Manor 4th Addition shall be billed to Norm Chazin, contractor, who shall pay in full these costs when billed by the Village of Brooklyn Center at the completion of the Project. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption. RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Mayor and Clerk are hereby authorized and directed to execute a petition requesting vacation of that portion of Northport Drive from the east right of way line of France Avenue to the east line of Cameron Manor, and the Clerk is directed to cause Notice of a public hearing thereon to be given as required by law. The motion for the adoption of the foregoing resolution was duly seconded by Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman and Russ Jones; and • the following votes. against the Saxe: Nina, where up on said resolution was declared duly passed and adopted. 1. It is hereby determined to be necessary to issue an additional $100,000 Park Bonds of the $400,000 Park Bond authorized by a vote of the electors on the 3rd day of December, 1957. The money received from the sale of said bonds shall be used to acquire and improve parks and playgrounds. 2. The Park Bonds shall be 100 in number and numbered 1 to 100, both inclusive, in the denomination of $1,000 each, shall bear date July 1, 1959, shall bear interest payable July 1, 1960, and semiannually thereafter on January 1, and July 1 in each year. Said bonds shall mature serially on January 1 in the years and amounts as follows, all without option of prior payment: $5,000 January 1, 1962 $5,000 January 1 1963 $5,000 January 1, 1964 $5,000 January 1, 1965 $5,000 January 1, 1966 $5,000 January 1, 1967 $5,000 January 1, 1968 $5,000 January 1, 1969 $5,000 January 1, 1970 $5,000 January 1, 1971 $5,000 January 1, 1972 $5,000 January 1, 1973 $5,000 January 1, 1974 $5,000 January 1, 1975 $5,000 January 1 1976 $5,000 January 1, 1977 $5,000 January 1, 1978 $5,000 January 1, 1979 $5,000 January 1, 1980 $5,000 January 1, 1981 The full faith and credit of the Village will be pledged to payment of said Park Bonds. 3. The Village Council shall meet at the Village Hall in the Village on Tuesday, the 28th day of July, 1958, at eight o'clock P.M., for the purpose of receiving sealed bids for the purchase of said Park Bonds and the Village Clerk Is authorized and directed to cause notice of the sale of said bonds to be given by publication at least ten (10) days in advance in Commercial West a financial paper published in Minneapolis, Minnesota, and in Brooklyn Center Press a legal newspaper having general circulation in the Village. Said notice shall recite that the Village will furnish printed bonds and approving legal opinion of Messrs. Howard, Peterson, LeFevere, Lefler & Haertzen, Minneapolis, Minnesota, both without expense to the purchaser, shall require that all bids be unconditional and accompanied by a good faith check in the amount of at least $2,000 and shall specify one or more interest rates in multiples of one -tenth or one - quarter of one percent. Said notice shall further provide that delivery of the bonds will be made by the Village within forty days after the date of sale at the office of the Village Clerk, or, at the option of the purchaser, at Minneapolis or St. Paul without expense to the purchaser. The motion for the adoption of the foregoing resolution was seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the Mayor's appointment of Henry Davis as weed inspector for the Village of Brooklyn Center for the balance of 1959• Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR: A PUMP HOUSE ON WELL NO. 2 WHICH IS A PAR OF IMPROVEMENT NO. 1959 -10 AND DIRECTING ADVERTISEMENT FOR BIDS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for the following improvement, prepared by the Village Engineer are hereby approved and ordered filed with the clerk: Construction of the pump house on Well No. 2 and the furnishing of a chlorinator and necessary controls for the automatic operation of the pump. 2. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than 10 days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Bid date is set for July 14, 1959 at 2:00 o'clock P.M. 4. The Village Administrator and Village Engineer shall be authorized to open and tabulate the bids. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the Mayor's appointment of Mrs. Houser to the Recreation Commis - sion. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the `Final plat of the "Re- arrangement of Block 1, Elsen's City View Addition." Motion carried. The Bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of June 23, 1959" were audited and ordered paid.
