July 28, 1959 The Village Council met in regular session and was called to order by William 11, Super, Mayor, at 8:00 P.M. R011 Call: William I.I. Super, Wayne Gageby, Carl Carlson and Russ Jones were present. Clifford Wellman was absent until hereinafter indicated. Motion by Carl Carlson and seconded by Wayne Gageby that the minutes of the Regular meeting on June 9th and 23rd and the Board of Review meet of June , be approved as recorded ecorded with the correction that the word "accepted" in the motions relating to the receiving of petitions be deleted and the word "received" be inserted in the motions. lotion carried. Clifford Wellman arrived at this point of the meeting. adoptions Member Carl Carlson introduced the following resolution and moved its RESOLUTION VACATI10 A PORTION Of NORTHPORT ]RIVE SEAS, a petition has been duly filed with the Village Council of the Village of Brooklyn Center for the vacation of Northport Drive from the east right of way line of France Avenue to the east line of Cameron Manor and it appearing that t said Petition carries the names of a majority of all property owners abutting on said street, and WHEREAS, a notice of a public hearing on said proposed vacation to be held on July 28, 1959 was duly published on July 9, and July 16, 1959, in the Brooklyn Center Press, and three copies of said notice were posted on JulY 13, 1959, in conspicuous places within the village and WHEREAS, a hearing was held pursuant to said notice on July 28 , 1959, and all parties having been hard and no one appearing in opposition thereto: NOW, TBERFPORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. It is deemed to be in the best public interest to and the Village Council does hereby vacate Northport Drive from the east right of way line of France Avenue to the east line of Cameron Manor. the 2. The village clerk shall file a notice of completion of county Officials for ls as required in Section 117.19 of the Mi in nne es sota Statutes. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the fQtoving voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, .Carl Carlson and Russ Jones; and the following voted against the same: None, whreupon said resolu- tion was duly passed and adopted. After due consideration of said bids, member Wayne Gageby introduced the following resolution and moved its adoption: BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: Y 1. The bid of Vincent Newman & Co. and Fox, Reusch & Co. to purchase $100,000 Park Bonds, bearing interest at the rate of 4.30 percent per annum on all bonds maturing January 1, 1962 to January 1, 19$1, inclusive, together with an additional coupon of 1.00 percent on all bonds for the period from October 1, 1959 to January 1, 1961, and to pay therefor the sum of $100,000, is hereby found, determined and declared to be the most favorable bid and is hereby accepted. The Clerk is directed to retain the check of said purchaser. 2. The Village shall forthwith issue its negotiable park bonds in the principal amount of $100,000, dated July 1, 1959, being 100 in number and numbered 1 to 100, both inclusive, in the denomination of $1,000 each, bearing interest at the rate of 4 -3 0 t 8 maturing Januar 1 1 2 percent r annum, on all bonds u 3 96 3 � pe � y , to January 1, 1981, inclusive, plus additional interest at the rate of 1.00 percent for the period from October 1, 1959, to January 1, 1961, to be represented by a separate coupon, said bonds maturing serially in the years and amounts as follows, all without option of prior payment: $5,000 on January 1, each year 1962 to 1981, inclusive. 3. Both principal and interest shall be payable at the main office of a suitable bank to be hereafter designated in accordance with the purchaser's request, and the Village shall pay the reasonable charges of said bank for its services as paying agent. 4. The bonds and Interest coupons to be thereto attached shall be in substantially the following form: UNITED STATES OF AMERICA STATE OF MINNESOTA. COUNTY OF HE RWIN VILLAGE OF BROOKLYN CEWER Na. $lam PARK BOND OP 1959 KNOW ALL MEN BY THESE PRESEN'T'S That the Village of Brooklyn Center, Hennepin County, Minnesota, acknowledges itself to be indebted and for value received hereby promises to pay to bearer out of Park Bond Redemption Fund the sum of ONE THOUSAND DOLLARS on the lst day of January, 19 , and to pay interest thereon at the rate of four and thirty hundredths percent (4.300 per annum together with additional interest at the rate of one percent per annum for the period from October 1, 1959, to January 1, 1961, represented by separate coupons, all interest payable July 1, 1960 and semiannually thereafter on the lst day of January and the lst day of July in each year in accordance with and upon presentation and surrender of the attached interest coupons as they severally become due. Both principal of and interest on this bond are payable at the main office of , in any coin or currency of the United States of America which at the date of payment is legal tender for public and private debts, and for the prompt and full payment of such principal and interest as the same become due the full faith, credit and taxing powers of the Village have been and are hereby irrevocably pledged. This bond is one of an issue of bonds in the total principal amount of $100,000, all of like date and tenor except as to maturity, T all issued by the Village for the purpose of providing money to acquire and develop park land and recreational facilities, and is issued pursuant to authority conferred by more than the requisite -2- c majority vote of the qualified electors of the Village voting on the question of the issue at an election duly and regularly called and held and pursuant to and in full conformity with the Constitution and Laws of the State of Minnesota thereunto enabling. IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions and things required by the Constitution and Laws of the State of Minnesota to be done, to happen, and to be performed precedent to and in the issuance of this bond have been done, have happened and have been performed in regular and due form, time and manner as required by law; that prior to the issuance hereof a direct annual irrepealable ad valorem tax has been duly levied upon all of the taxable property in the Village in the years and amounts as required by law and additional taxes may be levied upon all of said property, if required to pay principal or interest, without limitation as to rate or amount; and that this bond together with all other indebtedness of the Village outstanding on the date hereof and the date of its actual issuance and delivery does not exceed any constitutional or statutory limitation thereon. TN WITNESS WMMMV, the Village of Brooklyn Center, Hennepin County, Minnesota, by its Village Council, has caused this bond to be signed by the Mayor and the Village Clerk and sealed with the corporate seal of the Village and the interest coupons here- to attached to be executed and authenticated by the facsimile signatures of said officers, all as of July 1, 1959. The Clerk is directed to cause said bonds to be prepared and the Clerk and Mayor are authorized and directed to execute the same and affix the village seal thereto and to cause the interest coupons to be executed and authenticated by the printed facsimile signatures of said officers. 6. The principal of and interest on said bonds shall be paid from the special fund heretofore created and designated as Park Bond Redemption Fund and the proceeds of the taxes herein levied shall be paid into said special fund; provided, however, that if any payment of principal or interest on said bonds shall become due when there is not sufficient money in said fund to pay the same, the Treasurer shall pay such principal, or interest -3- from the general fund of the Village and such fund shall be reimbursed for such advances out of the proceeds of taxes herein levied when collected. 7. The Clerk is hereby authorized and directed to deliver a certified copy of this resolution to the County Auditor of Hennepin County, together with such other information as the County Auditor may require, and to obtain his certificate that the issue has been entered upon his register and that a tax has been levied as required by law. 9. The tax levy herein provided shall be irrepealable until all of said bonds are paid, provided that the Clerk shall annually, prior to October 10, certify to said County Auditor any amount appropriated to the said park Bond Redemption Fund to pay principal and interest due during the ensuing year, and the County Auditor shall thereupon reduce the levy collectible during such year by the amount so certified. 10. The said bonds, when fully executed, shall be delivered by the Treasurer to the purchaser thereof upon receipt of the purchase price, and the said purchaser shall not be obligated to see to the proper application thereof. 11. The Clerk and Treasurer are authorized and directed to prepare and furnish to the purchaser and to the attorneys approving said issue, certified copies of all proceedings and records relating to the issuance of said bonds and to the right, power and authority of the Village and its officers to issue the same and said certified copies and certificates shall be deemed the representati of the Village as to all matters stated therein. Motion by Carl Carlson and seconded by Wayne Qageby to retain the 8tantion, Pittelkow & Bann and Associates to prepare position description and pay classification plan for the Village of Brooklyn Center at a maximum cost of $1400.00. Motion carried. -4- Motion by Carl Carlson and seconded by Wayne Gageby to instruct the Village Attorney to settle the mortgage on the R. G. Thompson property at 4101- 73rd Avenue North at 75% to 80% of the amount of the claim. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION TO REVISE A FINAL CONSTRUCTION COST FOR WORK COMMACTEA BY THE VILLAGE NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. That the original resolution accepting work completed on Improvement 110. 1958-13, contract with Randall Bros., be amended and approved with the amendment. 2. The work esstated in the revised Final Construction Cost is hereby accepted and approved. 3. The value of work performed exceeded the original contract by $1 of which $1,253.60 has been approved and accepted, the remaining balance of $676.50 exceeded original approval and acceptance because of 205' (feet) of extra pipe that was on the plans, but not included in the contract. This was overlooked by the Inspector and the contractor when the job was com- pleted in August of 1958. 4. The Village Officials are hereby directed to issue proper order for additional payment on said contract, taking the contractor's receipt in full. The total amount paid for said Improvement Project being $17,659.60. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Wayne Gageby, Clifford Wellman, Carl Carlson and Russ Jones; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZIIG STOP SIGUS BE IT RESOLVED by the Village of Brooklyn Center as follows: WHE MAS, the Village of Brooklyn Center Police Department has recommended that stop signs be erected on France Avenue at its intersection with 69th Avenue and on Palmer Lake Drive at its intersection with 69th Avenue, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The erection of the above enumerated stop signs is hereby approved. 2. The Board of County Commissioners of Hennepin County are urged to authorize said stop signs and cause the erection of the stop signs. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman., Carl Carlson, Wayne Gageby, and RusE Jones; and the following voted against the same: Bone; whereupon said resolution was declared duly passed and adopted. -5- Member Carl Carlson introduced the following amendment to the Village Ordinances and moved its adoption: ORDINANCE RELATING TO DRAINAGE EASEMENT AND AM WING SECTION 15-108, PARAGRAPH f OF THE VILLAGE CEDIRANCES The Village Council of the Village of Brooklyn Center ordains as follows: Section 1. Section 15 -108 of the Village Ordinances, paragraph (f) is hereby amended by adding the following new subparagraph (3): "(f) (3). When a drainage easement is provided and where proper drainage requires that such easement be brought to grade, such easement shall be graded in accordance with plans approved by the Village Engineer." Section 2. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there of: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones: and the following voted against the same: None; whereupon said o:rdinafte was declared duly passed and adopted. Motion by Wayne Gageby and seconded by Clifford Wellman to receive a petition for sanitary sewer lateral on Emerson Avenue from the Northern States Power Co. Easement to 59th Avenue. Date of public hearing to be set later. Engineer instructed to prepare an estimate. Said proposed improvement is desig- � Pr P nated Sanitary Sewer Improvement No. 1959 -45. Motion carried. Motion by Russ Jones and seconded by Clifford Wellman to receive a petition of sanitary sewer lateral on Colfax Avenue from Northern States Power Easement to 55th Avenue. Date of public hearing to be set later and engineer to prepare estimate. Said proposed improvement is designated Sanitary Sewer Improve- ment No. 1959 -46. Motion carried. Motion by Carl Carlson and seconded by Wayne Gageby to receive the petition for sanitary sewer lateral on Humboldt Avenue from 60th Avenue to Lilac Drive, and that the petition be filed. Motion carried. Motion by Russ Jones and seconded by Wayne Gageby that the Village Coun- cil receive petitions for sanitary sewer interceptor and storm sewer Interceptor ss ss that would serve the general area of Brooklyn Center between the Mississippi ipp i River and Palmer Lake and 73rd Avenue and 68th Avenue. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman that the drain- age bond in the amount of $1000 and the street bond in the amount of $1500 in Pearson's Northport 5th Addition be released, upon the recommendation of the Village Administrator. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING ADJUSTMENT OF 1959 BUDGET BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: WHEREAS, the labor expenditures of the Village of Brooklyn Center are operated on a job cost basis, (that is each department is charged for actual amount of labor used),and this has resulted in certain departments having a budgeted amount over and above their needs while other departments are short of budgeted funds, be tt resolved that the following adjustments be made: -6- Increase Labor Budget Assessors Department $ 175.00 General Gov't Buildings 680.00 Fire Protection 1585.00 Engineering 2112.00 Protective Inspections 884.00 Equipment Maint. Member Carl Carlson introduced the following resolution and moved its - adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHMIRAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lametti & Sons have satisfactorily completed the following improvement in accordance with said contract: Water Main Project No. 1959 -20 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed is less than the original contract amount by $298.05 because 4 services dropped 3. The Village Officials are hereby directed to issue proper order for final payment-on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $7985.95• The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed is less than the original contract amount by $323.00 because 4 services dropped 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $2436.00. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILUQE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lametti & Sons have satisfactorily completed the following improvement in accordance with said contract: Water Main Project No. 1959 -23 NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed exceeded the original contract amount by $363.41 because of change in design to provide a more adequate valve arrangement. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $2166.01. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lametti & Sons have satisfactorily -8- completed the following improvement in accordance with said contract: M Sanitary Sever Project No. 1959 -21 NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 29 The value of work performed is less than the original contract amount by $414,99 because 3 services less than estimate and part of pipe placed more shallow than anti- cipated. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $17,941.93• The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted In favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones, and the following voted against the same None; whereupon said resolution was duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoptions RESOLUTION ACCEPTIM WORK (CONnUkCTED BY VILLAGE) WHEREAS, pursuant to a written contract signed w* the Village of Brooklyn Center, Minnesota, Lametti & Sons have satisfactorily completed the following improvement in accordance with said contract: Water Main Pr oject No. 1959 -26 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed exceeded the original contract amount by $930.20 because of 12 additional services and a realignment of part of pipe due to engineering error. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement p being $17,695.60. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Wayne Gageby introduced the following amendment to the Village Ordinances and moved its adoption: AN ORDINANCE RELATING TO PUBLIC STREETS AM DRAINAGE WAYS AND AMENDING SECTION § -101 The Village Council of the Village of Brooklyn Center ordains as follows: Section 1. Section 25 -101 is amended to read as follows: " Section 25 -101 PUBLIC EASEMENTS AND RIGHT-OF-WAY PROTECTED. It Is� unlawful for any person "(a) to plow into or gouge with any tool or instrument or mar or deface in any manner any of the public streets, alleys, or highways within the Village of Brooklyn Center. "(b) to drive or cause to be driven any vehicle in a manner which destroys or damages curbs, gutters, boulevards, or any plants or improvements located on the public right of way. Owners or occupants of land, and builders or con - tractors thereon who authorize any vehicle to enter such land in a manner which causes any of the damage or destruc- tion aforesaid shall also be deemed in violation hereof. Persons in violation hereof shall repair or replace such damage to the original condition as approved by the Village Engineer, or at the election of the Village, such damage .or destruction may be repaired or replaced by the Village, and such person or persons responsible therefor shall promptly pay to the Village the cost thereof. The fore- going liability shall be in addition to the penalties prescribed herein. "(c) to alter the grade of any drainage easement unless a permit shall first be secured therefor from the Village, or to obstruct such drainage easement, and each day such obstruction or unauthorized alteration continues, shall be deemed a separate offense. "Section 2. This ordinance shall take effect from and after its publication. -9- F ` The motion for the adoption of the foregoing ordinance was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Qageby, and Russ Jones; and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson that the final plat of Ledin's Addition be approved upon recommendation of the Village Administratc and subject to the requirements to the platting ordinance. Wellman, and moved its adoption: PMOLUTION WHEREAS, Community Savings and Loan Association has operated in the City of Robbinsdale, an adjoining municipality, since receiving its authority to do business as a Savings and Loan Association from the Department of Commerce of the State of Minnesota, and WHEREAS, we as the governing body of this municipality recognize the need for additional services of this nature, and WHEREAS, the rapid growth of this community will increase the need for services rendered by this association and its growth is believed to be for the best interests of the community It serves, and WHEREAS, the men who are on the Board of Directors of thk association are recognized as leaders in these communities and as having the confidence of its people, and WHEREAS, the services of savings and loan associations in this area are limited and are rendered primarily by similar associations located in the downtown area of Minneapolis and some distance from our local residents and businesses, and WHEREAS, we recognize that Community Savings and Loan Association by reason of being a local organization can and will receive greater support from our people and can render greater service to our people, and WHEREAS, Community Savings and Loan Association is making an application to the Federal Home Loan Bank for insurance of its accounts, -10- NOW, THEREFORE, BE IT RESOLVIP that this Council, acting In its capacity as governing body of this municipality, go on record as favoring the granting of Community Savings and Loan Association's application for insurance of its accounts and as endorsing the need for additional services of a lending institu- tion of this nature in this area for home loan financing and as a depository of swings.
