Council of the Village of Brooklyn Center
in the County of H3nnepin and State of
Mirnesota, including all accounts audited
by said Council.
July 8, 1958
The Village Council met in regular session and was called to order by
William N. Super, Mayor, at 8:10 o'clock p.m.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gegeby, and Russ Jones were present.
Motion made by Carl Carlson and seconded by Clifford Wellman that the
Village Council approve the minutes of the Board of Review meeting of June 19,
1958 as recorded. Motion carried.
Motion made by Clifford Wellman and seconded by Russ Jones that the
Village Council approve the minutes of the special meeting of June 19, 1958
and the regular meeting of June 24, 1958. The minutes were approved as
recorded. Motion carried.
Member Wayne Gageby introduced the following resolution and moved its
adoption:

WHEREAS, the Village Engineer has reported that on July 8, 1958
at 2 o'clock p.m., he opened and tabulated the bids received for
Sanitary Sewer Improvement No. 1958 -18 and Sanitary Sewer Improvement
No. 1958 -24 and that said bids were as follows:

NOW, THMEFORE., BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, as follows:
The bid of Phelps -Drake Co., Inc., as to the furnishing of
all work, labor and materials in connection with Sanitary
Sewer Improvement Nos. 1958 - and 1958 -24, according to
the plans and specifications therefor now on file in the
Office of Village Clerk, is deemed to be the lowest and
best bid submitted for said work by a responsible bidder,
and said bid in the total amount of $45,255.14 is hereby
accepted,
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne
Gageby, and Russ Jones; and the following voted against the same: None.
Whereupon said resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING BID AND
Ap PROVTNG CONTRACT FORM
WHEREAS, the Village Engineer has reported that on July 8, 1958 at
2 o'clock p.m,, he opened and tabulated the bids received for Water
Main Extension No. 1957 -28 and that said bids were as follows:
No. 1. Randall Bros. $2,542.50
No. 2. Nodlund Const. Co. 4,940.00
No. 3. Lametti & Sons 3,235.00
No. 4, Phelps -Drake Co., Inc. 3,209.00
No. 5, Barbarossa & Sons 2,575.00
NOW, THEREFORE., BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, as follows:
The bid of Randall Bros., as to the furnishing of all work, labor and
. materials in connection with Water Main Extension No. 1}57-28,
according to the plans and specifications therefor now on file in
the Office of the Village Clerk is deemed to be the lowest and best
bid submitted for said work by a responsible bidder, and said bid in
the amount of $2,542.50 is hereby accepted.
Motion made by Russ Janes and seconded by Wayne Gageby that the Village
Council uphold the recommendation of the Planning Commission and grant Join
Horbal permission to use the property at 6901 Humboldt Avenue North for
storage, loading, fueling and maintenance of heavy equipment until May 15, 1959
subject to Mr. Horbal providing this council with a written statement waiving
and relinquishing any or all rights he may have acquired to use the land as
presently and heretofore used, not now in conformity with the ordinance
governing the use of property. Mr. Horbal's raquest will become effective
immediately upon receipt of said statement. Motion carried.

Motion made by Carl Carlson and seconded by Wayne Gageby that the
Village Council uphold the recommendation of the Planning Commission and allow
Martha Lahti a variance to build on the 50' lot, legally described as Lot 10,
Block 3, Humboldt Addition, as the adjacent lots are a similar width and the
type of house to be moved on this lot is in keeping with the neighborhood.
Upon vote being taken, the following voted in favor thereof; William N. Super,
Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the
same: Clifford Wellman. Motion carried.
Motion made by Clifford Wellman and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and allow
Howard Herman to sell the West 20 Lot 9, Block 2, Larsen's 3rd Addition to
Andrew Green, so that a house may be built on the Southeast corner of 61st and
Colfax Avenue North. Motion carried.
Motion made by Clifford Wellman and seconded by Carl Carlson that the
Village Council postpone action on the Jeanette Rudeen petition to raise
shetland ponies until further investigation has been made. Motion carried.
Motion made by Clifford Wellman and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and allow
Frank Casey a variance to build an addition to his present store at 57th and
Logan Avenue North but altering the recommendation from a 60 foot frontage
building to a 75' front; subject to the petitioner providing the council with
a plan for disposing of rubbish, in such a fashion that same will not extend
onto Logan Avenue North ov.57th Avenue North or be obnoxious to the surround -
ing community. Upon vote being taken, the following voted in favor thereof;
Carl Carlson, Clifford Wellman, and Russ Jones; and the following voted
against the same: William N. Super and Wayne Gageby. Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and
approve the proposed plat of Donnay's 3rd and 4th Additions; providing that
those lots along the West Village limits are not platted until the final plat
of the 4th Addition is submitted. Motion carried.
Motion made by Wayne Gage'gy and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and
approve the proposed plat of Frank Waite's 2nd Addition. Motion carried.
Frank Waite has agreed to sell the one foot outlot to the purchaser of
the property East of Waite's Addition for 1/2 of the price of grading and
surfacing Perry Avenue North from 61st Avenue North to 63rd Avenue North, plus
10% and the going rate of interest. .
Motion made by Carl Carlson and seconded by Wayne Gageby that the
Village Council uphold the recommendation of the Village Planning Commission
and allow Karl Gilles to construct 3 five unit apartment buildings on the
Southwest corner of France Avenue North and Highway #100, with the additional
requirement that the exterior of the buildings be brick faced. Motion carried.
Motion made by Russ Jones and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and deny
Lawrence, Inc,, permission - to install a 15' x 35' sign on the roof of Cook
Paint and Varnish Co. Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the
Village Council approve the proposed master plan submitted by Lyle Brandon of
the property East of Lyndale Avenue North between 70th Avenue North and 73rd
Avenue North. Motion carried.
Motion by Carl Carlson and seconded by Russ Jones that the Village
Council refer Richard Vana's appeal from the rulings of the Building Inspector,
regarding the location of the garage at 2919 Nash Road to the Planning
Commission. Motion carried.

Member Russ Jones introduced the following resolution and moved its
adoption.
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED SANITARY SEWER IMPROVEMENT NO. 1958 -30
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of sanitary sewer on 66th Avenue North
from France Avenue North to 3808 - 66th Avenue North.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed
at an estimated cost of $600.00,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows: -
1. The council proposes -to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953 as amended.
2. A public hearing on the proposed improvement shall be held at the
Village Hall in the village on Tuesday, the 12th day of August, 1958, at
8 :00 o'clock P.M., and the clerk shall publish notice of the time and place
of hearing by two weeks' publication in the official newspaper of the village.
3. The area proposed to be assessed for said improvement is as
follows:

4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1958 -30.
The potion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne
Gageby, and Russ Jones; and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion made by Russ Jones and seconded by Clifford Wellman that the
Village Council accept the justice report of John Wingard for part of April
and part of May, 1958 and the justice report of Raymond Benson's for part of
May and June, 1958 Motio carried.
Motion made by Russ Jones and seconded by Wayne Gageby that the
Village Council approve the addition to Randall Bros, contract for projects
1957 -39 an d 1957 -40, schedule for project No, 1958 -4 in the amount of
$4,147.50. Motion carried.
Motion made by Russ Jones and seconded by Carl Carlson that the
Village Council approve the addition to Randall Bros, contract for projects
1957 -39 and 1 957 -40, schedule for project No. 1958 -5 in the amount of
$2,890,30. Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the
Village Council authorize the Engineering Department to take any necessary
measures to insure village water to consumers during the 1958 sprinkling
season. Motion carried.

The bills set forth on the schedule attached to these minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the
Meeting of July 8 1958" were audited and ordered paid.
Motion made by Carl Carlson and seconded by Clifford Wellman to
adjourn. Motion carried.
