Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
August 5, 1958
The Village Council met in special session and was called to order by
William N. Super, Mayor, at 8 :05 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson,, Wayne Gageby�
and Russ Jones were present.
Motion by Wayne Gageby and seconded by Carl Carlson that the Village
Council allow a building permit to be issued for building a home on the front of
the lot at 531+0 Fremont Avenue North legally described as LOt 26, and all of
Lot 25, except the South 10 feet, Block 3, N. E, Perkin's Addition providing
that a performance bond is furnished to the Village in the amount of $100Q,00 to
assure the removal of the present small house which is on the back of the lot.
The removal of said building is to be done within one year frog this date*
Motion carried.
Member Clifford Wellman introduced an ordinance entitled:
AN ORDINANCE REGULATING THE MOVING OF HOUSES
AND PROVIDING LICENSES PERMITS AND FEES THEREFOR
which ordinance is attached to these minutes and made a part hereof., and moved
its adoption.
The motion for the adoption of the foregoing ordinance was duly seconded by
member Caul Carlson, and upon vote being taken thereon the following voted in
favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby,
and Russ Jones; and the following voted against the same: None; whereupon said
ordinance was duly passed and adopted.
Motion by Carl Carlson and seconded by Clifford Wellman to adjourn. Motion
carried.

AN ORDINANCE REGULATING THE MOVING OF HOUSES,
AND PROVIDING LICENSES, PE WTS AND FEES TH EREFOR
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS
• FOLLOWS:
1 There shall be added to the ordinance of the Village the follow-
ing new sections as hereafter designated:
Section 3 -1001, HOUSE MOVERS TO BE LICENSED. No person shall move
remoi e.. raises or hold up any.building within the limits of the Village
of Brooklyn. Center, unless such person shall be licensed by the Village
of Brooklyn Center to engage in such occupation,
Upon the filing of an application for such a license, the sane shall
be referred to the Building Inspector of said Village and he shall make
full investigation of the qualifications of the applicant to carry on the
work of moving, raising and holding up buildings and report his findings
thereon to the Village Council. Upon such report being filed with the
Village Council., and the execution of the bond as required herein and
its acceptance by the Village Council, such license may be granted or re-
fused., in the discretion of the Village Council. No such license shall
be granted to any person less than twenty -one (21) years of age,
The fee for each such license is Twenty -five Dollars ($p25.00) per
annum, which fee shall be paid into the Village treasury at the time of
the filing of the application for such license.
Section 3 -1002, INSURANCE AND BOND REQUIRED. No license shall be
issued unless and until the applicant shall first file with the Village.
Clerk a policy or policies of insurance insuring such applicant against
liability imposed by law on account of damage to or destruction of property
or injury to persons in the amount of at least $25,000 for a single in-
jury or claim of property damage and at least $50,000 maximum liability.
Such policy shall provide that it may not be cancelled by the insurer
except upon notice to the Village of Brooklyn Center. In case of can-
cellation of such insurance such license shall be suspended automatically
until such insurance has been replaced. No license shall be granted
until the party applying therefor shall also have given a bond in the
sum of Three Thousand Dollars 03,000.00) with good and sufficient
sureties, to be approved by the Village Council conditioned among
other things, that said party will pay any and all damage which may be
caused to any property., either public or private., within the Village of
Brooklyn Center, whether such damage or injury shall be inflicted by said

party or his agents, employees or workmen, and conch. 'tioned s also, that

Brooklyn Center against all liabilities judgments., costs and expenses

granting of such license,, including the cost to the Village for the
services of public utility maintenance men necessitated by the moving
of any building, and will in all things strictly comply with the pro-
visions of this ordinance and with the conditions of any and all permits
which may be issued to him thereunder.
Section 3- 10020 EXPIRATION OF LICENSE. Each such license shall
terminate the 30th day of April next succeeding the issuance of the
same., unless sooner revoked or forfeited., and shall not be transferable
or assignable.

Section 3 -1004* REVOCATION OF LICENSE. Upon presentation to the
Village Council of satisfactory proof that any such licensee has proven
incompetent to properly carry on such work of moving., raising or holding
up buildings or has proceeded with any such work in such a manner as to
endanger people or property or upon conviction for failure to comply with
this or related ordinances or for other good cause$ the Village Council
may revoke such license.
Section 3-100, PERMIT REQUIRED, Every licensed house mover shall
in eac and every instance, before raising holding up or moving any
building obtain a permit therefor from the Building Inspector*
An application for such permit shall designate the origin and
destination of such building the route over which it is to be moved
and shall state the time in which the moving of such building will be
completed.
No permit to move a building shall be issued unless and until the
following conditions are fully complied with and approved by the Build«
ing Inspector;
(a) The building to be moved must be worth at least 50% of the
cost of a similar new building as determined by the Building
Inspector.
(b) The Village Engineer must certify that all sewer charges
and water bills payable against the property from which the
building is to be moved have been paid and that all sewer and
water connections have been plugged or discontinued at the curb
line or at the main and that all taxes against said property
have been paid in full.
(c) The building to be moved must comply in all respects with
the Village Building Code and other applicable ordinances; pro-
vided, that the person proposing that said building be moved
may present to the Building Inspector complete and detailed plans
showing changes which will be made in order to attain compliance
with said ordinances. In the event that such changes are proposed
a permit authorizing the moving of said building shall not be
issued until the owner has agreed in writing to complete the
necessary changes within a period of one year the Building Inspector
has approved the plans the building permit fee has been paid and
the building permit issued,, and a performance bond guaranteeing
completion of said changes and equal to at least one and one -half
times the cost of said proposed work as estimated by the Building
Inspector has been posted with the Village.
(d) That upon compliance with sub-paragraphs (a) (b), and (c)
of this section, the Building Inspector licensee and applicant
shall personally submit the application to the Planning Commission
for approval and recommendation to the Village Council at the next
stated meeting of said commission. The Planning Commission shall
determine whether such application shall conform to the immediate
surrounding community. The Planning Commission in its discretion
shall call a public meeting of resident owners within a radius of

owners reviewal of the proposed application. In the event said
public meeting is held the Planning Commission will determine
the application on its merits and make its recommendation to
the Village Council.
Section 3 -3006 REMOVAL OF WIRES. In every case in which a permit
shall be issued, as herein provided for the removal of a building when
such removal required the displacement of any overhead electrical or
other wires it shall be the duty of the person association or corporation
owningp operating or controlling such wires to remove or displace the
same., so far as the same may be necessary to effect the removal of said
building to the point to which the removal +$ shall be authorized
by such permit.

Z o said builds and shall at the same time exhibit to said
person, association or corporation the properly issued permit authorizing
the removal of said building and it shall thereupon be the duty of
said person association or corporation, within twenty -four (24) hours
thereafter to remove or displace said wires sufficiently to allow the
passage of said building along the street over which said wires are
suspended.
Any expenses incurred or to be incurred in the moving removing
or displacing of such wires shall be paid for by the person who makes
application for said permit.
Section 3 - 1007. HOURS. No building shall be moved across my
railroad 1 ge unless the hour be specified and approved by the
company or governmental unit controlling such tracks or bridge.
Section 3 -100$, MOVING BUILDINGS INTO VILLAGE. Any person
association or corporation desiring to move any building to within the
limits of the Village of Brooklyn Center from outside of such limits
shall comply with the following additional requirements:
(a) Notify the Building Inspector of the Village of Brooklyn
Center during the process of construction of such building in
sufficient time so that the Building Inspector may make all
necessary inspections in order to determine whether such building
complies with the applicable ordinances of the Village of

(b) Pay to the Village of Brooklyn Center in addition to the
required fees for a building permits an additional fee of seven
cents (7¢) per mile to be traveled by the Inspectors in making
the inspection computed from the Village Hall in the Village
of Brooklyn Center to the site where the building is being
constructed,, together with a fee of three dollars ($3.00) per
hour for each Inspector for the time spent in connection with
such inspection within a radius of fifteen (15) miles from the
Village Hall of the Village of Brooklyn Center. The fee provided
in thib,section shall be paid at the time the application for
a permit to move a building is made and shall be retained by
the Village whether or not said permit is granted,
(c) The Building Inspector is hereby authorized and required
to make the inspections provided for herein upon compliance with
the foregoing requirements,
2. This ordinance shall be in full force and effect from and after
its regular publication.
