HomeMy WebLinkAbout1958 09-23 CCM Regular Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council. September 23, 1958 The Village Council met in regular session and was called to order by Wayne Gageby, acting Mayor, at 8 :10 p.m. Toll Call: Clifford Wellman, Wayne Gageby, and Russ Jones were present. William N. Super and Carl Carlson were absent. Motion by Russ Jones and seconded by Clifford Wellman that the Village Council dispense with the reading of the minutes of the preceding meeting, Motion carried. - The Acting Mayor announced that the meeting was open for the consideration of Storm Sewer Improvement No.' -33• The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement. After hearing and considering all objections, member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION DECLARING HEARING ON STORM SEWER IM?ROV N0, 1957 -33 FAVORABLE BUT DEFERRING ACTION THEREON BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The public hearing on Storm Sewer Improvement No. 1957 -33 is hereby declared to be favorable. 2. Action upon said improvement shall be deferred until September 30, 1958. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the follo�ving voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; aad the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Total: $14,480.00 No. 10 - Moore & Keller 1958 -38 $12,903.00 1958 -39 $10 2 122.00 Total $23,025.00 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, as follows: The bid of Sandstrom and Hafner as to the furnishing of all work labor, and materials in connection with Sanitary Sewer Improvement No. 1958 -38 and 1958-39, according to the plans and specifications therefore now on file in the Office of Village Clerk, is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid, in the amount of $7,748,00 for Sanitary Sewer Improvement No. 1958 -38 and $6,060.00 for Sanitary Sewer Improvement No. 1958 -39, is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following votea in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; and the fol.lowink voted against the same: None; whereupon said resolution was declared duly pasaeu and adopted.. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT NO. 1958 -46 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of sanitary sewer on 58th Avenue North from Northport Drive to a point 160' East of North- port Drive. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $900.00. NOWW, 'THEREFM. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 14th day of October 1958, at 8 :00 o'clock P.M., and the clerk shall publ3 h notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No, 1958 -46. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones and the follow - ing voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Russ Jones that the Village Council accept the final plat of Bergstrom's Lynside Manor 3rd Addition upon the recommendation of the Village Engineer; subject to all restrictions of the plat - ting ordinance and bond being posted. Motion carried. Motion by Clifford Wellman and seconded by Russ Jones that the Village Council accept the final plat of Donnay's Brook Lyn Gardens 3rd Addition upon the recommendation of the Village Eng sneer; subject to all restrictions of the plat- ting ordinance and bond being posted. MctJon carried, 4_ Motion by Clifford Wellman and seconded by Russ Jones that the Village Council accept the street deed from the Brooklyn Center Assemblies of God Chin. °ch and it is understood that the street deed is accepted without posting bond upon the assurance that the church will finish the street to the satis- faction of the Village Engineer within a reasonable time. Motion carried. The Acting Mayor announced that the Council was met to receive, open, and consider bids for village street department garage. An affidavit was presented showing publication of advertisement for bids in accordance with law and ordered placed on file. The sealed bids which had been received were then presented. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION TABLING FURTHER ACTION ON BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that further action on the bids received for the Street Department garage be tabled for further study by Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None, whereupon said resolution was declared duly passed Y P s and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION ACCEP WORK WHEPEAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Ruaaall Bros. have satizfactorily completed the following improvement is accord ace with said contract: _6_ Sanitary Sewer Improvement No. 1958 -4 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed is less than the original contract amount because the depth of the sewer was less than the original contract. 3. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $4,132.60, which is $1+.90 less than the original contract. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following ordinance and moved its adoption: AN ORDINANCE CHANGING THE NAME OF WOODBINE AVENUE NORTH TO WOODBINE LANE THE VILLAGE COUNCIL OF TO VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: 1. A new section entitled 25 -407 is hereby added to the village ordinances to read as follows: Section 25 -407 WOODBINE AVENUE NORTH - WOODBINE LANE. Woodbine Avenue North (lying in Northbrook Manor Addition and Northbrook Manor 2nd Addition) is hereby renamed and shall hereafter be known as Woodbine Lane. 2. This ordinance shall take effect from and after its publication. Passed by the Village Council this day of , 1958. Mayor Attest: Clerk (Seal) The motion for the adoption of the foregoing ordinance was duly seconded by Russ Jones, and upon vote being taken the.•wn, the following voted in favor thereof: Wayne Gageby, Clifford Wellman, aid Russ Jones; and the following voted against the same: None; whereupon: said ordnance i as ditty passed and adopted. -7- Motion by Russ Jones and seconded by Clifford Wellman that the Village Council authorize the Mayor and Clerk to sign a contract with Shifflet, Back- strom, Hutchison & Dickey, Inc. for architectural services for the new liquor store and fire station. Motion carried. Motion by Clifford Wellman to commit the Village of Brooklyn Center to make the following improvements in accordance with the resolution heretofore identified as Improvement Commitments for VA Loan Purposes. Said resolution s4all have inserted in it the following: Property to be improved: Donnay's Brook Lyn Gardens 3rd Addition Estimated Cost: $16,666.00 Date of Completion: 12 months Improvements to be made: Street surfacing, boulevard sod, planting of trees, erection of signs and irons in Donnay's Brook Lyn Gardens 3rd Addition Builder: Donnay Construction Co. The motion for the adoptions of the foregoing resolution was duly seconded by member Rtes Jones , and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution: REST BE IT RESOLVED, that the contract heretofore submitted, signed and executed by the Suburban Hennepin County Relief Board of the County of Hennepin for and during the year 1958 - 1959 for the administration and supervision of poor relief in the Village of Brooklyn Center be, and the same is hereby accepted, approved, renewed and extended for and during the year 1958 - 1959 with the same force and effect as though said original contract, above described, were redated and resigned and executed as of the date hereof. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
