September 30, 1958 The Village Council met in special session and was called to order by William N. Super, Mayor at 8 :10 p.m. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones. Motion made by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the minutes of the special meeting of September 2, 1958 and the regular meeting of September 9, 1958. The minutes were approved as recorded. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEMENT NO. 1957 -33 BE IT RESOLVED b the y Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interest of the village and the owners of property specially benefited thereby that the following improvements shall be constructed: Construction of storm Sewer Improvement No. 1957 -33 2. The foregoing work is approved to be'done with the proposed assessment area enlarged as set forth in the notice of hearing. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, The Mayor announced that the meeting was open for further consideration o- objections to any of the assessments for the following improvements: Sanitary Sewer Improvement Nos. 1957 -12, 1957 -38, 1957 -39, 1958 -1, 1958 -2, 1958 -3, 1958 -4, 1958 -6 1958 -8, 1958 -1o, 1958 -14, 1958 -18, 1958 -19, 1958 -22, 1958 -23, 1958 -24 1958 -30, and Water Improvement Nos. 1957 -40, 1958 -5, 1958 -7, 1958 -11 & 17, 1958 -12, 1958 -13, 1958 -20, and Public Utilities Water Nos. 1957 -3, 1957 -43, 1958 -25, 1958 -29 and storm Sewer Improvement Nos. 1957 -33, 1957 -36, 1958 -15 and Street Improvement Nos. 1958 -21, and Sewer Connections and Water Hookups. The Clerk produced an affidavit of publication of notice of hearing on the assessments showing one week's publication thereof in the official newspaper, the publication being on September 11, 1958, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present their objections to the above assessments. After all persons desiring to speak thereon had been heard, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING ASSESSMENTS FOR SANITARY SEWER IMPROVEMENT NOS. 1957 -12, 1957 -38, 1957 -39, 1958 -1, 1958 -2, 1958 -3, 1958 -4, 1958 -6 1958 -8, 1958 -io, 1958 -14, 1958 -18, 1958 -19, 1958 -220 1958 -23, 1958 -24, 1958 -30, AND WATER IMPROVEMENT NOS. 1957 -4o, 1958 -5, 1958 -71 1958 -11 & 17, 1958 -12, 1958 -13, 1958 -20, AND PUBLIC UTILITIES WATER NOS. 1957 -3, 1957 -43, 1958 -25, 1958 -29 AND STORM SEWER IMPROVEMENT NOS. 1957 -33, 1958 -15 AND STREET IMPROVEMENT NOS. 1958 -21 AND SEWER CONNECTIONS AND WATER HOOKUPS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Village Clerk has, with the assistance of the Engineer heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said Village against every assessable lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in special session on Tuesday, September 30, 1958 to pass on the proposed assessments. 3• Said proposed assessments have at all times been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments, or to any item thereof. 4. No changes in the proposed assessments are necessary. 5. This Council finds that each of the lots, pieces or. parcels of land enumerated in said proposed assessments was and is specially benefited by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece, or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 6. Such proposed assessments are affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lot, pieces or parcels of land respectively. 7. Said assessments so affirmed, adopted and confirmed shall be certifies to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessments for the payment of the above listed improvements. 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 6% per annum. 9. Such assessments shall be payable in equal installments beginning in the year 1959, payable on the 1st day of January in each year, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor, as follows: - 2 - A. Sanitary Sewer Improvement Nos. 1957 -12, 1957 -38, 1957-39, 1958 -1 1958 -2, 1958 -3, 1958 -41 1958 -6 1958 -8, 1958 -10, 1958 -14, 1958 -18, 1958 -19, 1958 -22, 1958 -23, 1958- 24,and 1958 -30, in twenty equal annual installments. Be Water Improvement Nos, 1957 -40, 1958 -5, 1958-7, 1958 -11 & 17, 1958 -12, 1958 -13, and 1958 -20 in twenty equal annual installments. C. Public Utilities Water Nos. 1957 -3, 1957 -43, 1958 --25, and 1958 -29 in twenty equal annual installments. D. Storm Sewer Improvement Nos. 1957 -33 and 1958 -15, in twenty equal annual installments. Be Street Improvement No. 1958 -21 in five equal annual install- ments. F. Sewer and Water Hookups, in twnety equal annual installments. 10. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the let day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None, where - upon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Wayne Gageby that the assessment hearing on Storm Sewer Improvement Porject No. 1957 -36 be continued to the meeting of October 7, 1958. Motion carried. Member Clifford Wellman introduced the following resolution and moved its adoption; RESOLUTION DIRECTING THAT BUILDING PERMITS NOT BE ISSUED IN CERTAIN AREAS WHEREAS the Minnesota Highway Department has submitted proposed plans for the construction of Interstate Route #94, a part of the Freeway system, in and through the Village of Brooklyn Center, and WHEREAS the Minnesota Highway Department proposes to acquire within the near future substantial areas of land within the Village now privately owned to complete construction of said Interstate Route #94, and WHEREAS the Minnesota Highway Department through its authorized representatives has requested that the Village refrain from issuing building permits in the area designated by said Minnesota Highway Department to be acquired in connection with said construction, and WHEREAS the Village Council has determined that it is in the best interests of the affected property owners, the public and the Village of Brooklyn Center that said request of the Minnesota Highway Department be honored, BE IT RESOLVED that the Building Inspector and all other officials and employees of the Village are hereby ordered to refuse to issue building permits for proposed constructioncf any and all kinds on and within the area designated to be acquired by the Minnesota Highway _3_ Department for the construction of Interstate Route #94 within the Village of Brooklyn Center, as shown on plans submitted to the Village as of this date by the said Minnesota Highway Department. The foregoing resolution was seconded by member Wayne Gageby and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the saxes Carl Carlson. Motion carried. Motion by Wayne Gageby and seconded by Russ Jones that the Village Council accept the petitions for sanitary sewer on Admiral Place from Admiral Lane to Commodore Drive and Pearson Drive from Admiral Lane to Commodore Drive and Commodore Drive from Pearson Drive to Admiral Place. Date of public hearing to be set later. Motion carried. Motion by Russ Jones and seconded by Wayne Gageby that the Village Council approve the following licenses: Cigarette License: Designware Industries 3721 - 50th Ave. No. Heating License: Wm. H. Klatke Plumbing 2656 Sheridan Ave.No. & Heating Electrical License: Electrical License: Electric Service 1609 Chicago Ave. So. Motion carried. Motion by Russ Jones and seconded by Carl Carlson that the Village Council approve the application for bingo permit to the Duoos Bros. American Legion Post #630 for the period from October 1, 1958 to December 17, 1958. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Council reject all bids on the Village garage. Motion carried.
