November 25, 1958 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 7:30 P.M. Roll Call: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones were present. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1958 -48. The Clerk produced an affidavit of publication of notice of hearing on the Proposed improvement showing two weeks' publication thereof in the offical news- paper., the last publication being on November 20, 1958, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1958 -48 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be con- structed: Sanitary Sewer Improvement Project No. 1958 -48 2. The plans and specifications for said improvement shall be prepared by William`E. Jensen, Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following o ing voted against the same: None; Carl Carlson abstained from voting; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SANITARY SEWER IWROVEMENT NO. 1958 -46 AND AUTHORIZING PERFORNANCE OF WORK BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Sanitary Sewer Improvement No. 1958 -46 prepared by William E. Jensen, Engineer, are hereby approved and ordered placed on file with the Clerk. 2. The construction for said improvement to be performed by Phelps Drake Co.,Inc. The Village is authorized to enter into a contract with Phelps Drake Co., Inc. for the performance of work. The construction is to be done at a total price of $855.40. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; where- upon said resolution was declared duly passed and adopted. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council request the Minnesota Highway Department's permission for the Little League to use the borrow pit adjacent to the ball park for parking purposes. The Village Council is also to request the Highway Department to install guard rails along Highway #100 in the vicinity of the ball park. Motion carried. Motion by Wayne Gageby and seconded by Clifford Wellman that the Village Council release the street bond on Donnay's Brook Lyn Garden, upon the recom- mendation of the Village Administrator. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Council deny the request of Don Stark to attend the Concrete Conference being held at the University. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEP=G WORK WEMMS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Nodland Construction Co. have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Improvement No. 1958 -47 NOW, THMUORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed is $105.90 less than the original contract amount because less 6" V.CP. was used than anticipated. 3. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement being $7,741.60. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council increase the salaries of James Fischbach and Truman Nelson 4% for th year 1959 upon the recommendation of the Village Administrator. Motion carried. Motion by Russ Jones and seconded by Carl Carlson that the following wage? scale be established for the following employees upon the recommendation of the Village Administrator: Frank Smith, Jr. $2.87 per hour Raymond Diver $2.47 per hour Eve Ripsin $1. per hour Motion carried. -3 _ I � The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of November 25, 1958 were audited and ordered paid. Motion by Russ Jones and seconded by Clifford Wellman to adjourn.
