Super, Mayer.. at 8:05 o'clock p.m. Roll Call: William N. Super, Clifford Wellman, and Carl Carlson were present. Russ Jones and Wayne Gageby were absent. In the E.k;,e=e tt Clerk Russ Jones, Dale Curry) Village Accountant, took the Couxicil meeting minutes. Notion by Carl Carlson and seconded by Clifford Wellman that the Village r Council uphold the recommendation of the Planning Commission and accept the proposed plat of Bobendrier's 3rd Addition, with the stipulation that a reinforced concrete sidewalk 10' wide be constructed by William Bobendrier between Lots 7 and 8 and 20 and 21, Block 1 and the Village Engineer has given his approval to the intersection of 71st Avenue North and Halifax Avenue North. Motion carried.j Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council uphold the reconvw- retation of the Planning Commission to grant F. W. Ames a special use permit to construct a multiple dwelling at 61st and Osseo Road providing the plans are approved by the Planning Commission. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Council uphold the recommendat -ion of the Planning Commission to grant a special use permit to construct multiple dwellings on that part of Lot 11, Auditor's L Subdivision #25, lying between Beard Avenue North and R.L.S. #6C3, and North of R.L.S. #607, providing improvements conform to the Zoning Ordinance. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Council uphold the recommendation of the Planning Commission and allow a variance to Mr. Claire Mattson to rebuild a garage recently destroyed by fire, as concrete slabs were salvaged from the fire which did not conform to the building code. Motion carried. Motion by ;Carl Carlson and seconded by Clifford Wellman that the Village Council uphold the recommendation of the Planning - Commission and deny Fred Liemers a variance to permit renting of the main floor of his home. The variance was denied on ground that said renting may have an adverse effect on the suwroimding residential neighborhood. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson that the Village Council uphold the recommendation of the Planning Commission and allow a variance for a non- conforming building setback, to Uzzell Construction Co. on th, sToM;ids that the plat was approved under the old platting ordinance, at 3318 Foe fiord.. Motion Carried. Motion by Carl Carlson and seconded by Clifford Wellman that the Village Council uphold - Vae recommendation of the Planning Commission and allow a variance to Mr. Malcolm to re- divide four 50' lots into three 67' lots for residential building purposes, the lobs being lots 6, 7, 8 and 9, Block 3 Linden Shores on Twin bakes. Motion carried. Motion by Carl Carlson that Donnay Paris property be referred to the Park Board. for their study. Motion was withdrawn for lack of a second. Wayne Gageby appeared at the meeting at this point and resumed his duties as Trustee, Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council recommend to the Park Board that they pay the costs on Donnay Park that would have otherwise been assessed for sanitary sewer lateral and street improve- ment. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING ADVPRTISDZNT FOR BIDS FOR POLICE CAR 1. The Village Clerk shall advertise for bids for Police car under the specifications prepared by the Village Administrator. 2. Bid date is set for December 29, 1958, at o'clock p.m. The motion for the adoption of the foregoing resolution was di:l.y seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. t Member Carl Carlson introduced the following resolution and moved its adoption: ' RESOLUTION ACCEPTING WORK WHEREAS, pursuant to a written contract Petrowske & Ross have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Improvement No. 1958 -42 and Water Improvement No. 1958 -43. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accept -ed and approved. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: FiRSOLUTION ACCEPTING WORK WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, 11 hel.ps- -Drake Co., Inc. have satisfactorily completed the following improvement in accordance with said contract: -2- Sanitary Sewer Improvement Fo. 1958 -24 NOW, THER &ORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed udder said contract is hereby eccepted and approved. 2. The value of work performed is $530.97 less than the original contract amount because of less services. 3. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $30,354.73 The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESO A CCEPTING WORK WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Phelps -Drake Co., Inc. have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Improvement No. 1958 -22 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved. 2. The of work performed exceeded the original contract mount by $351.10 because of additional 8" VCP. 3. The village officials are hereby directed to issue groper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $3,5 The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, e-ad Wayne Gageby; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: HESOUTTIE(?N ACCEPTING WORK WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Phelps -Drake Co., Inc. have -3- satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Improvement No. 1958 -18 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed exceeded the original contract amount by $203.17 because more VCP was used than anticipated. 3. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $14,,572.61. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Clifford Wellnmi-i introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WEKREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Randall Bros. have satisfactorily completed the following improvement in accordance with said contract: Water Main Improvement No. 1958-31 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved. 2. The value of work performed exceeded the original contract amount by $2,81.5.00 because additional main and services were added. 3. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full.. The total amount paid for said improvement project being $55,778.60. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: _4_ RESOLUTION ACCEPTING WORK WEEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Phelps -Drake Co., Inc. have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Improvement No. 1958 -46 NOW, THMWORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved. 2. The village officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement project being $855.40. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, and Wayne Gageby; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council release the following street bonds: Bond No. 37S -33554 Marvin Gordon Garden City 3rd Addition $ 500.00 Uzzell Const. Co. Garden City 3rd Addition $4,000.00 Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council accept the Palmer Lake Terrace 3rd Addition; subject to bond being posted and all restrictions of the platting ordinance. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council release the money in the Police Reserve Fund to each policeman in the form of cash which shall be applied to storm coats. The Police Chief shall so instruct the Police Department personnel. Motion carried. Motion by Wayne Gageby and seconded by Carl Carlson that the Village Council retain George Barton Association to furnish a major street plan for Brooklyn Center at a maximum cost of $1,800.00. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of December 9, 1958" were audited and ordered paid. Motion by Carl Carlson and seconded by Wayne Gageby to adjourn. Motion carried.
