February 11, 1958
The Village Council met in regular session and was called to order by
William N. Super, Mayor, at 8:10 P.M.
Roll Call: William N. Super, Clifford Wellman, Wayne Gageby, and Russ
Jones were present, and Carl Carlson was absent.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the
minutes of the regular meeting of January 14, 1958 and the minutes of the special
meeting of January 21, 1958 be approved as recorded. Motion carried.
The Mayor announced that the Council was met to receive, open and consider
bids for furnishing gasoline, fuel oil, and diesel fuel.
An affidavit was presented showing publication of advertisement for bids
in accordance with law and ordered placed on file.
The sealed bids which had been received were then presented. These were
opened, examined, and found to be as follows:

RESOLUTION TABLIM FURTHER ACTION ON BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that further action on the bids received for
furnishing gasoline, fuel oil, and diesel fuel be tabled for
further study.
The motion for the adoption of the foregoing resolutlon:.was duly seconded by member
Wayne Gageby, and upon vote being taken thereon, the following voted in favor there-
of: William N. Super, Clifford Wellman, Wayne aageby, and Ruse Jones; and the
following voted against the same: Norse. Whereupon said resolution was declared
duly passed and adopted.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the
Village Council uphold the recommendation of the Planning Commission and deny the
rezoning of Lot 8, Block ]., Sunset Manor Addition. to B -3 classification to Alfred
Kramer. Motion carried.

1. Section 35 -510 of the Zoning Ordinances is hereby
amended by changing paragraph no. 4 to the following
language:
(4) The petition shall be on the agenda of the
Planning Commission at its next regular meeting,
but not earlier than ten days. This meeting shall
serve as the nearing on the petition.
2. Section 35 -510 of the Zoning Ordinances is hereby
amended by changing paragraph no. 5 to the following
language:
(5) Not less than seven days prior to date of
the hearing, mailed notice of such hearing shall
be sent to the petitioner and to the property
owners within 250 feet of the property in question.
3. This ordinance shall take effect from and after its
publication.
The Motion for the adoption of the foregoing ordinance was duly seconded by member
Clifford Wellman and. upon vote being taken thereon, the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and
the following voted against the same: None. Whereupon said ordinance was duly
passed and adopted.

bounds description; subject to the village receiving a quit claim deed on Regent

Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED WATER ImmovEmm No. 1958 -9 AND
PROVIDING FOR REIMBURSEMENT OF UNASSERSED
COST OF WATER IMPROVEMENT N0. 1956 -19
WHEREAS, it is proposed that there be constructed an improve-
.
ment consisting of the following:
Construction of a water supply system including wells,
tanks, feeder mains and appurtenances to provide service
along the following described streets:
East Twin Lake Blvd. from 51st Avenue North to 53rd
Avenue North; Lake Side Place; Great View Avenue North;
53rd Avenue North from East Twin Lake Blvd. to Ewing
Avenue North; 52nd Avenue North from East Twin Lake
Blvd. to Ewing Avenue North; Oak Street from East Twin
Lake Blvd. to France Avenue North; France Avenue North
from 50th Avenue North to 53rd Avenue North; and Ewing
Avenue North from 50th Avenue North to 53rd Avenue North.
WHEREAS, the village engineer has made a preliminary report
advising that said proposed improvement is feasible and that
it can be constructed at an estimated cost of $78
NOW., TEEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed Improvement shall be
held at the Village Hall in the village on Tuesday, the 11th
day of March, 1958, at 8:00 o'clock P.M., and the clerk shall
publish notice of the time and place of hearing by two weeks'
publication in the official newspaper of the village.
3. The area proposed to be assessed for said improve -
ment is as follows:
All lots and parcels of land abutting thereon.
4. This proposed improvement shall be designated Water
Improvement No. 1958 -9.
BE IT FURTHER RESOLVED b the Village Council of the Village of
Brooklyn Center, Minnesota, that it is hereby determined that
the properties which will be served by Water Improvement No.
1958 -9 when said improvement is completed, will also be bene-
fited by Water Improvement No. 1956 -19, which properties were
not initially assessed for Water Improvement No. 1956 -19; and
that as to expenditures made for Water Improvement No. 1956-19
from general ad valorem tax levies or other sources and funds
in addition to special assessments heretofore made for said
improvement the Village shall be reimbursed therefor by adding
$30,960. to the assessments to be levied for Water Improve -
ment No. 1958-9, and the village clerk shall cause notice
that such additional amounts will be assessed to be included
in the notice of hearing in the making of said Water Improve-
ment No. 1958 -9.
The motion for the adoption of the foregoing resolution was duly seconded by member

WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of sanitary sewer on East Twin Lake Blvd.
from 51st Avenue North to 53rd Avenue North; Lake Side
Place; Greatview Avenue North; 53rd Avenue North from
East Twin Lake Blvd. to Ewing Avenue North;52nd Avenue
North from East Twin Lake Blvd. to Ewing Avenue Avenue
North; Oak Street North from East Twin Lake Blvd. to
France Avenue North; France Avenue North from 50th
Avenue North to 53rd Place; and Ewing Avenue North
from 50th Avenue North to 53rd Avenue North.
WHEREAS, the village engineer has made a preliminary report ad-
vising that said proposed improvement is feasible and that it
can be constructed at an estimated cost of $84,500.00,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall
be held at the Village Hall in the village on Tuesday.. the 4th
day of March, 1958, at 8:00 o'clock P.M., and the clerk shall
publish notice of the time and place of hearing by two weeks'
publication in the official newspaper of the village.
3. The area proposed to be assessed for said improvement
is as follows:
All lots and parcels of land abutting thereon.
4. This proposed improvement shall be designated Sanitary
Sewer Improvement No. 1958 -8.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the
following voted against the same None. Whereupon said resolution was declared
duly passed and adopted.

Motion made by Clifford Wellman and seconded by Wayne Gageby that the
Village Council accept the petition for sanitary sewer on 58th Avenue North from
Admiral Lane to Halifax Avenue North. Motion carried,
Member Clifford Wellman introduced the following resolution and moved its
adoption:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall
be held at the Village Hall in the village on Tuesday, the 4th
day of March, 1958, at 8:00 o'clock P.M., and the clerk shall
publish notice of the time and place of hearing by two weeks'
publication in the official newspaper of the village.
3. The area proposed to be assessed for said improvement
is as follows:
All lots and parcels of land abutting thereon.

Member Wayne Gageby introduced the following resolution and moved its
adoption:

PROPOSED WATER IMPROVEMENT NO. 1958 -7 AND
PROVIDING FOR REIMBURSEMENT OF UNASSE'SSED
COST OF WATER IMPROVEMENT NO. 1956 -19
WH MEAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of a water supply system including wells,
tanks, feeder mains and appurtenances to provide water
service along the following described streets
Winchester Lane from Noble Avenue North to Indiana
Avenue North; 66th Avenue North from Noble Avenue
North to State Highway 152; and Indiana Avenue
North from 65th Avenue North to 66th Avenue North.
WHEREAS, the village engineer has made a preliminary report
advising that said proposed improvement is feasible and that
it can be constructed at an estimated cost of $39,535.00,
NOW, THEREFCtRE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall
be held at the Village Hall in the village on Tuesday, the 4th
day of March, 1958, at 8:00 o'clock P.M., and the clerk shall
publish notice of the tiwe and place of hearing by two weeks'
publication in the official newspaper of the village.
3. The area proposed to be assessed for said improvement
is as follows:

4. This proposed improvement shall be designated Water
Improvement No. 1958 -7.
BE IT FURTHER RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, 81st it is hereby determined that the
properties which will be served by Water Improvement No. 1958 -7
when said improvement is completed, will also be benefited by
Water Improvement No. 1956 -19 1 , which properties were not ini-
tially assessed for Water Improvement No. 1956 -19; and that as
to expenditures made for Water Improvement No. 1956 -19 from
general ad valorem tax levies or other sources and funds in
addition to special assessments heretofore made for said improve -
ment the Village shall be reimbursed therefor by adding
$17,460. to the assessments to be levied for Water Improvement
No. 1958 -7, and the village clerk shall cause notice that such
additional amounts will be assessed to be included in the notice
of hearing in the making of said Water Improvement No. 19587 -
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the
following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.
Member Russ Jones introduced the following resolution and moved its adop-
tion:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED WATER IM MEMENT.' NO. 1957-28
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of elevated water tank located on 69th
Avenue North and France Avenue North.
WHEREAS, there was heretofore held a hearing on said improvement
based upon a proposed assessment only of land abutting water mains
within the area described in the notice for said earlier hearing;
and
WHEREAS, it appears that the benefit from the construction of
said tank may extend within the total area capable of being
served by the existing water system; and
MEWMS, the village engineer has made a preliminary report
advising that said proposed improvement is feasible and that it
can be constructed at an estimated cost of $140,000.,
NOW, THMEF0RE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority
granted by Chapter 398, Laws of Minnesota, 1953., as amended.
2. A public hearing on the proposed improvement shall be
held at the Village Hall in the village on Tuesday, the 4th
day of March, 1958, at 8 :00 o'clock P.M., and the clerk shall
publish notice of the time and place of hearing by two weeks'
publication in the official newspaper of the village.
3• The area proposed to be assessed for said improvement
is as follows:
Those lots and parcels of land within the following
described boundaries:
On the West, North and South by-the grillage limits..
and on the East by the West !dge of Palmer Lake and
Shingle Creek.

4. This proposed improvement shall be designated Water
Improvement No. 1957 -28.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and
the following voted against the same: None. Whereupon said resolution was
declared duly passed and adopted.
Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION APPROVING SPECIFICATIONS FOR SWEEPER,
TRUCK, TRACTOR SHOVEL, AND POLICE SQUAD CAR AND
DIRECTING ADVERTISMENT FOR BIDS.
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The specification for sweeper, truck, tractor
shovel, and police squad car prepared by A. J. Lee, Village
Administrator, are hereby approved and ordered filed with
the Clerk.
2. The Clerk shall advertise for bids for such equip -
ment by publication at least once in the official newspaper,
the dated first publication not less than three weeks prior
to the elate for receipt of bids. Said notice shall state
that no bids will be considered unless sealed and filed and
accompanied by a cash deposit, bid bond, cashier's check or
certified check payable to the Clerk in amount of not less
than five percent of the bid.
3. Bid date is set for March 11, 1958.
The motion for the adoption of the foregoing resolution was doily seconded by member
Wayne Gageby, and upon vote being taken thereon the following voted in favor there -
of: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the
following voted against the same: None. Whereupon said resolution wad declared
duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved its
adoption:
RESOLUTION APPROVING SPECIFICATIONS FOR STABILIZED
GRAVEL AND FINE AGGREGATE FOR SEAT COAT AM BITU-
MMUS KAMIAL AND DIRECTING ADVERTISEMENT FOR BIDS.
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The specifications, prepared by A. J. Lee, Village
Administrator, are hereby approved and ordered filed with the
Clerk.
2. The Clerk shall advertise for bids for such materials
by publication at least once in the official newspaper, the
date of first publication not less than three weeks prior to
the date for receipt of bids. Said notice shall state that
no bids will be considered unless sealed and filed and accom-
panied by a cash deposit, bid bond, cashier's check or certi-
fied check payable to the Clerk in amount of not less than
five percent of the bid.
3. Bid date is set for March 11, 1958.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor

following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.
Motion made by Russ Jones and seconded by Wayne Gageby that the Village
Council approve the following license applications:

Motion carried.
Motion made by Russ Jones and seconded by Clifford Wellman that the
Village Council accept the justice report of John Wingard for the month of January,
1958. Motion carried.
Motion made by Russ Jones and seconded by Wayne Gageby that the Village
Council accept the final plat of Garden City 4th Addition; subject to all restric-
tions of the platting ordinance and bond being posted. Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the
Village Council accept the final plat of Garden City 5th Addition; subject to all
restrictions of the platting ordinance and bond being posted. Motion carried.
Motion made by Clifford Wellman and seconded by Wayne Gageby that the
Village Council accept the final plat of Dale's Twin Lake Addition as approved by
the County Surveyor January 30, 1958; subject to all provisions of the platting
ordinance. Motion carried.
Member Clifford Wellman introduced the following ordinance and moved its
adoption:

1. There are hereby added to the Village ordinances the
following sections:
Section-19-501 DAMAGING VILLAGE PROPERTY. It is unlawful
for any person to knowingly or wilfully steal, destroy,
damage, mar, deface or otherwise injure or wrongfully
appropriate any property awned by the Village of Brooklyn
Center including any real or personal property, or any
utility installation or part thereof, whether owned by
the Village or any department or agency of the Village.
Section 1� 9 502 PENALTY. Any person violating the fore -
going section shall upon conviction therefor be sentenced
to not more than 90 days imprisonment or to pay a fine of
not more than $100.00.
2. This ordinance shall be in full force upon its
publication.
The motion for the adoption of the foregoing ordinance was duly seconded by member
Russ Jones; and the following voted in favor thereof: William N. Super, Clifford

THE VUA AGL COUNCIL OF THE VILIAGE OF BROOKLYN CEHM ORDAINS:
I. Section 35 -410 of the Zoning Ordinances is hereby amended
by adding at the end of said section after the words "within ninety
days of said date." the following language: "No fee shall be
required of persons applying for an occupancy permit for uses
existing at the time this ordinance was adopted."
2. This ordinance shall be in full force upon its
publication.
The motion for the adoption of the foregoing ordinance was duly seconded by member
Wayne Gageby; and the following voted in favor thereof: William N. Super, Clifford
Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same:
None. Whereupon said ordinance was declared duly passed and adopted.
The bills set forth on the schedule attached to 'these minutes and made a
part hereof entitled "The Bills Audited and Paid at the Meeting of February 11,
1958" and ordered paid.
