The Village Council met in regular gul.ar session and was called to .order by
William N. Super Mayor, at 8 :10 p.m.

Roll Call Wilm N. Super, Clifford Wellman, and Russ Jones were present.
Wayne Gageby and Carl Carlson were absent. (Carl Carlson arrived late as hereinafter
indicated.)
Motion made by Clifford Wellman and seconded by Russ Jones that the minutes
of the regular meeting of February ll, 1958 be approved as recorded. Motion carried.
The Mayor announced that the Council was met to receive, open and consider
bids for furnishing,all materials and labor to construct one new 500,000 gallon steel
elevated water tank, with necessary foundations.(Water Tank Improvement No. 1957 -28)
An affidavit was presented showing publication of advertisement for bids
in accordance with law and ordered placed on file.
The sealed bid which had been received were then presented. These were
opened, examined, and found to be as follows:

Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION TABLING FURTHER ACTION ON BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that further action on the bids received for
furnishing all materials and labor to construct one new 500,OU0
gallon steel elevated water tank, with necessary foundations,
be tabled for further study.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon, the following voted in favor
thereof: William N. Super, Clifford Wellman, and Russ Jones; and the following voted
against the same: None. Whereupon said resolution was declared duly passed and
adopted.

one four wheel tractor shovel, and one three ton dump truck.

Member Russ Jones introduced the following resolution and moved its adop-
tion:
RESOLUTION TABLING FURTHER ACTION ON BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that further action on the bids received for
furnishing stabilized gravel and fine aggregate for seal coat and
for furnishing bituminous material be tabled.
The motion for the adoption of the foregoing resolution was duly seconded by Clifford
Wellman, and upon vote being taken thereon, the following voted in favor thereof:
William N. Super, Clifford Wellman, and Russ Jones; and the following voted against
the same: None. Whereupon said resolution was declared duly passed and adopted.
Motion made by Russ Jones and seconded by Clifford Wellman that the Village
Council uphold the recommendation of the Planning Commission and deny Alfred Kremer's
request For rezoning of the lot back of the Pure Oil Station at 69th Avenue North
and Osseo Road. Motion carried.
Motion made by Russ Jones and seconded by Clifford Wellman that the Village
Council uphold the recommendation of the Planning Commission and that a variance be
granted for a three foot side lot, on the garage side of the house, be approved for
Lot 9, Block 9, Pearson's Northport 3rd Addition, and a one foot side lot on the
garage side of the house, be allowed on Lot 12, Block 9, Pearson's Northport 3rd
Addition; subject to the property line adjustment on Lots 8 through 13, Block 9,
Pearson's Northport 3rd Addition be completed, providing two letters are received
from home owners, adjacent to lots, agreeing to the variance. Motion carried.
Motion made by Russ Jones and seconded by Clifford Wellman that the Village-
Council uphold the recommendation of the Planning Commission and accept the proposed
}plat of Kenneth Bergstrom providing that a 50' easement for drainage purposes be
provided along the existing drainage ditch and that the lot line between.Lots 4 and
5, Block 2 be corrected to provide a better lot width for Lot 4 and 5. Motion
carried.
Motion made by Clifford Wellman and seconded by Russ Jones that the Village
Council allow a variance under the hardship provisions of the Zoning Ordinance and
allow `a building site on the South 51' of Lot 2, Block 2, Marston's Place. Motion
carried.
Carl Carlson arrived at the Councilmeeting at this point and resumed his
duties as trustee.

The Mayor announced that this was the time and place for receipt of bids
for the purchase of $530,000 Improvement Bonds and.$lOOiOOO Park Bonds in accordance
with the resolution adopted February 2 5, 1958•
The Clerk presented an affidavit showing publication of Notice of Sale in

a satisfactory affidavit of publication in the Brooklyn Center Press, the official
village Newspaper.
The Clerk then presented the sealed bid which had been received, which was
opened and examined and found to be as follows:

After due consideration of said bid, member Carl Carlson introduced the following
resolution and moved its adoption:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Centers Minnesota, that the bid of Kalman & Company, Inc. and John
Nuveen & Company, Inc. and Associates to purchase $530,000 Sewer
Improvement Bonds, bearing interest at the rate of 3.10 percent
per annum on all bonds maturing January 1, 1960 to January 1, 1966,
inclusive; 3.60 percent on all bonds maturing January 1, 1967 to
January 1, 1969; inclusive; 3.90 percent en all bonds maturing
January 1, 1970 to January 1, 1972, inclusive; 4.00 percent on
all bonds maturing January 1, 1973 to January 1, 1979, inclusive,
together with an additional coupon of 1.50 percent on all bonds
for the period from July 1, 1958 to January 1, 1960, and to pay
therefor the sum of $530,000, is hereby found, determined and
declared to be the most favorable bid and is hereby accepted.
The Clerk is directed to retain the check of said purchaser.
IT IS FURTHER RESOLVED that the bid of Kalman & Company, Inc.
and John Nuveen & Company, Inc. and Associates to purchase
$100,000 Park Bonds, bearing interest at the rate of 3.10 per-
cent per annum on all bonds maturing January 1, 1961 to January I,
1966, inclusive; 3.60 percent on all bonds maturing January 1, 1967
to January 1, 1969, inclusive; 3.90 percent on all bonds maturing
January 1, 1970 to January 1, 1972, inclusive; 4.00 percent on all
bonds maturing January. 1, 1973 to January 1, 1980, inclusive,
together with an additional coupon of 1.50 percent on all bonds
for the period from July 1, 1958 to January 1, 1960, and to pay

therefor the sum of $100,000, is hereby found, determined and
declared to be the most favorable bid and is hereby accepted.
The Clerk is directed to retain the check of said purchaser.,

Member Carl Carlson introduced ':,he following resolution and moved its
adoption:
BE IT RESOLVE) by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The Village shall forthwith issue its negotiable improve-
ment bonds in the principal amount of $530,000, dated April 1,
1958, being 530 in number and numbered 1 to 530, both inclusive,
in the denomination of $1,000 each, bearing interest at the rate
of 3.10 percent per annum on all bonds maturing Januaryyl, 1960
to January 1, 1966, inclusive; 3.60 percent on all bonds matur-
ing January 1, 1967 to January 1, 1969, inclusive; 3.90 percent
on all bonds maturing January 1, 1970 to January 1, 1972, in-
clusive; 4.00 percent on all bonds maturing January 1, 1973 to January 1.,
1979, inclusive, plus additional interest at the rate of 1.50
percent for the period from July 1, 1958 to January 1, 1960 to
be represented by a separate coupon, said bonds maturing serially
in the years and amounts as follows:

$30,000 on January 1 each year 1961 to 1964, inclusive,
$25,000 on January 1 each year 1965 to 1979, inclusive,
with a prepayment option as follows:
All bonds maturing on January 1, 1970 and thereafter "

2. Both principal and interest shall be payable at the

Both principal of and interest on this bond are payable at the
main office of Northwestern National Bank of Minneapolis,
Minneapolis, Minnesota, in any coin or currency of the United
States of America which at the date of payment is legal tender,
for public and private debts.
All bonds of this issue maturing on January 1, 1970, and
thereafter, upon thirty (30) days prior notice by mail to the
bank where the bonds are payable and to the last known holder
are subject to redemption in inverse numerical order on January 1,
1964, or any interest payment date thereafter, upon payment at
par plus accrued interest plus a premium of $30.00 for each bond
redeemed if redeemed prior to January 1, 1969, and if redeemed on
January 1, 1969, or thereafter, at par plus accrued interest plus
a premium of $10.00 for each bond redeemed. Holders desiring to
receive such notice must register their names, addresses and
bond numbers with the Village Clerk.
This bond is one of an issue of bonds in the total principal
amountcf $530,000, all of like date and tenor except as to inter-
est rates, maturity and redemption privilege, all issued pursuant
to and in full conformity with the Constitution and Laws of the
State of Minnesota, including Chapter 398, Laws of Minnesota 1953s
as amended, for the purpose of defraying the expenses incurred and to be
incurred in special improvements of the Village, and is payable primarily
from special assessments to be levied against property specially
benefited thereby but constitutes a general obligation of the
Village, and to provide moneys for the prompt and full payment of
said principal and interest as the same become due the full faith
and credit of the Village is hereby irrevocably pledged and the
Village will levy ad valorem taxes if required for such purpose
without limitation as to rate or amount.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of
Minnesota to be done, to happen,, and to be performed precedent to
and in the issuance of this bond have been done, have happened and
have been performed in regular and due form, time and manner as
required by law; and that this bond together with all other indebt-
edness of the Village outstanding on the date hereof and the date
of its actual issuance and delivery does not exceed any constitu-
tional or statutory limitation thereon.
IN WITNESS WHEREOF, the Village of Brooklyn Center, Hennepin
County, Minnesota, by its Village Council, has caused this bond to
be signed by the Mayor and the Village Clerk and sealed with the
corporate seal of the Village and the interest coupons hereto
attached to be executed and authenticated by the facsimile signa-
tures of said officers, all as of April 1, 1958-

On the 1st day of January (July), 19 , the Village of
Brooklyn Center, Hennepin County, Minnesota, will pay to bearer
out of Improvement No. 1958-A Fund at the main office of North-
western National Bank of Minneapolis, Minneapolis, Minnesota,
the sum of DOLLARS., being the
installment of interest then due on its Improvement Bond dated
April 1, 1958, No.

4. The Clerk is directed to cause said bonds to be prepared,
and the Clerk and Mayor are authorized and directed to execute the
same and affix the village seal thereto and to cause the interest
coupons to be executed and authenticated by the printed facsimile
signatures of said officers.
5. The bonds issued hereunder shall be payable from Improve-
ment'No. 1058 -A Fund, which special fund.is hereby created. The cost
of Storm Sewer Improvement No. 1957-33, Storm Sewer Improvement No.
1957 -36, Sanitary Sewer Improvement No. 1957 -38 and Sanitary Sewer
Improvement No. 1957-39 shall also be payable out of said special
fund, and the proceeds of the special assessments and taxes to be
levied for said improvements and the proceeds of said bonds shall
be credited to said Improvement No. 1958 -A Fund. If any payment
of principal or interest on said bonds shall become due when there"
is not sufficient money in said fund to pay the same, the Treasurer
shall pay such principal or interest from the general fund of the
Village and such fund shall be reimbursed for such advances out of
proceeds of assessments for said improvement when collected.
6. The estimated collection of special assessments and other
revenues pledged for the payment of said bonds will produce at
least five percent in excess of the amount needed to meet, when
due, the principal and interest payments on the bonds and no ad
valorem tax levy shall be made. The Clerk shall deliver a
certified copy of this resolution to the County Auditor of Henne-
pin County and obtain his certificate as required by Section
475.63, Minnesota Statutes.
7. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt of the
Inurchase price, and the said purchaser shall not be obligated to
see to the proper application thereof.
8. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys approv-
ing said issue certified copies of all proceedings and records
bonds and to the right, power

and authority of the Village and its officers to issue the same
and said certified copies and certificates shall be deemed the
representations of the Village as to all matters stated therein.
The motion for the adoptioncf the foregoing resolution was duly seconded by member
Clifford Wellman and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Carl Carlson, and H. R. ernes; and
the following voted against the same: None. Whereupon said resolution was de-
clared duly passed and adopted.

Member Carl Carlson introduced the following resolution and moved its
adoption
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows
1. The Village shall forthwith issue its negotiable park
bonds in the principal amount of $100,000, dated April 1, 1958,
being 100 in number and numbered 1 to 100, both inclusive, in
the denomination of $1,000 each, bearing interest -at the rate
of 3.10 percent per annum on all bonds maturing January 1, 1961
to January 1, 1966, inclusive; 3.60 percent on all bonds maturing

and in the issuance of this bond have been done, have happened and

irrepealable ad valorem tax has been duly levied upon all of the
taxable property in the Village in the years and amounts as required
by law and additional taxes may be levied upon all of said property,

7. The Clerk is hereby authorized and directed to deliver
a certified copy of this resolution to the County Auditor of
Hennepin County, together with such other information as the
County Auditor may require, and to obtain his certificate that
the issue has been entered upon his register and that a tax
has been levied as required by law.
8. The tax levy herein provided shall be irrepealable
until all of said bonds are paid, provided that the Clerk shall
annually, prior to October 10, certify to said County Auditor
any amount appropriated to the said Park Bond Redemption Fund to
pay principal and interest due during the ensuing year, and the
County Auditor shall thereupon reduce the levy collectible during
such year by the amount so certified.
9. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt of the

that said bond is now void and no longer in force and effect.

execute releases discharging the surety on said bond.
