HomeMy WebLinkAbout1958 03-25 CCM Regular Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council. March 25, 1958 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8:00 p.m. Roll Call: William N. Super, Carl Carlson, Wayne Gageby, Clifford WellmaL and Russ Jones. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village Council approve the council meeting minutes of the regular meeting of February 25, 1958 and the special meeting of March 4th, 1958. The minutes were approved as recorded. Motion carried. Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village Council readvertise the hearing on Water Improvement No. 1958 -12 because the first publication was inadequate, the new hearing date to be April 22, 2958. The following voted in favor of said motion: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same None. Whereupon said motion was declared duly adopted. Motion made by Wayne Gageby and seconded by Carl Carlson that the Village Council authorize the Mayor and Clerk to execute a lease leasing the property as follows: That part of Lot 63, Auditor's Subdivision 218, bounded on the Northwest by Highway 100„ on the East by Humboldt Avenue North and on the South by 59th Avenue North. This property is being leased from the University of Minnesota for park purposes. Motion carried. Motion made by Carl Carlson and seconded by Wayne Gageby that the Village Council instruct the Village Engineer to investigate the flow of traffic on Logan Avenue North from 53rd Avenue North and 57th Avenue North. 30 mile an hour speed limit signs are to be installed and the Police are to be instructed accordingly. Motion carried. Motion made by Carl Carlson and seconded by Wayne Gageby that the Village Council approve the application for an electrical license of Valley Electric, Inc., 740 Winnetka Avenue North, Minneapolis, Minnesota. Motion carried. Member Wayne Gageby introduced the following ordinance and moved its adop- tion: AN ORDINANCE ANlWING SECTION 3 -701 OF THE VILLAGES' ORDINANCES ARID INSERTING A NEW SECTION 3 -702 RELATING TO THE REGULATION OF SEWAGE DISPOSAL SYSTEMS THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS AS FOLLOWS: 1. Section 3 -701 of the Village ordinances is hereby amended to read as follows: Section 3 -701 LICENSE MUIRED. No person, firm, or corporation shall engage in the business of construct - ing, altering, maintaining, or repairing septic tanks or cesspools within the Village of Brooklyn Center, unless they shall be licensed by the Village Council which license shall be granted to any applicant there- for on compliance with the following: (a) The applicant shall pay a twenty-five ($25.00) dollar license Yee and fifteen ($15.00) dollars for renewal thereafter, and licenses shall run from May 1 to April 30 of the following year. (b) The applicant shall file a bond in the amount of One Thousand ($1000.00) dollars with the Village Clerk and shall be executed by the applicant and a surety company and shall be conditioned upon the faithful performance by the applicant of all things required by the opening of any street or alley or public ground by applicant or by any under said applicant's control or in applicant's employ or by the leav- ing of any of said applicant's equipment or material or any equipment or material used or to be used by him on the streets, alleys or other public grounds of said Village, and said bond shall be further conditioned so as to guarantee to said Village that said applicant will restore all streets, alleys or other public grounds excavated by said applicant to their former condition and for a year next thereafter said applicant will keep and maintain the streets and sidewalks in good condition, and said applicant will pay all fines and penalties which may be imposed upon said applicant for violation of this ordinance. The applicant shall indemnify and save harmless the Village from any liability of the village arising out of any defect in the street or sidewalk occasioned by the failure of the applicant to repair, restore, or maintain such street or sidewalk during said year as required herein. (c) Any person, firm or corporation may apply for a license authorizing the installation, construction, maintenance or repair of septic tanks or cesspools only. Said license shall be issued only to individuals or contractors who show a thorough understanding of the laws and regulations governing septic tank and cesspool installations and who demonstrate a sufficient knowledge, skill and training to enable them to carry on the work of installing or maintaining septic tanks and cesspools. (d) No license shall be issued unless and until the appli- cant shall first file with the Village Clerk a policy or policies of insurance insuring such applicant against liability imposed by law on account of damage to or destruction of property in the amount of $25,000. Any such policy shall provide that it may not be cancelled by the insurer except upon notice to the Village of Brooklyn Center. In case of cancellation of such insurance such license shall be suspended automatically until such insurance has been replaced. 2. A new section 3 -702 is hereby added to said ordinance to read as follows: Section 3 -702 PERMIT REQUIRED. Prior to the commencement oP work on any sewage disposal system or the alteration or repair of any sewage disposal system, a permit shall be obtained from the Village of Brooklyn Center stating the character and location of the proposed installation, altera- tions, or repair. 3. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones: and the following voted against the same: None. Whereupon said ordinance was declared duly pgssed and adopted. Member Russ Jones introduced the following ordinance and moved its adop- tion: AN ORDINANCE REPEALING SECTIONS 3 -501 THROUGH 3 -510 OF THE VILLAGE ORDINANCES AND SUBSTITUTING IN LIEU TMEOF NEW SECTIONS 3 -501 THROUGH 3 -507 INCLUSIVE RELATING TO REGULATION OF PLUMBING WITHIN THE VILLAGE OF BROOKLYN CENTER THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS AS FOLLOWS: 1. Section 3 -501 through Section 3 -510 of the Village ordinances are hereby repealed. 2. There is hereby adopted new sections 3 -501 through 3 -507 to the Village ordinances which shall read as follows: Secti 3 501. TITLE. Sections 3 -501 through 3-507 of this ordinance shall be known as "The Village of Brooklyn Center Plumbing Code ". Section 3 -502 SCOPE AND APPLICATION OF ORDINANCE. From and after the effective date of this ordinance no person shall construct, extend, alter or repair any Plumbing work within the Village of Brooklyn Center unless incompliance with the provisions of Sections 0 thr o Section - 0 of this ordinance ex 3 3 ugh 3 S 7 t p in buildings belonging to the United States or to the State of Minnesota. The regulations in this ordinance include and govern all work done and materials used (1) in insta;.ling plumbing fixtures which serve a special purpose, whether connected directly or indirectly to any waste line or stack; (2) in connecting or repair- ing any system or drainage whereby foul, waste or surplus water, sewage or other fluid is discharged or proposed to be discharged through a pipe or pipes from any building, premises, or establishment into any public or building sewer, drain, sump, cesspool, or other receptacle, or into any natural or artificial water- course flowing through public or private pro- perty; (3) in ventilating any building sewer, or any fixture or appurtenance connected therewith. Section 3 -503 ADOPTION OF PLUMBING ORDINANCE OF THE CITY OF MINNEAPOLIS. There is hereby adopted and incor- porated into this ordinance by reference thereto, by marking three copies thereof as "official copies" and filing them for reference and inspection in the office of the Village Clerk, all of that certain ordinance of the City of Minneapolis adopted by the City Council of said City, entitled "An Ordinance to regulate the con struction, extension, alteration and repairing of pli=bing work and repealing certain ordinance provisions ".. as amended, and now in effect, and containing Sections 1 through 25 inclusive, and designated in the City of Minneapolis Ordinance Compilation as 1:3 -1 through 1:3 -20; provided, however, that the following numbered sections of said ordinance are not hereby adopted or incorporated into this ordinance: Section 2; Subdivisions (4), (5) and (6) of Section 2.2; and Sections 3, 21, 24, and 25; and provided, further, that wherever the term "City of Minneapolis" t� y ne polls shall appear in sa�d ordinance it shall be construed to mean "Village of Brooklyn Center" wherever the terra "Department of Building" appears it shall, be construed to mean the "Department of Building of the Village of Brooklyn Center "; and wherever the term "Plumbing Inspector" is used it shall be construed to mean the "Plumbing Inspector of the Village of Brooklyn Center ", and the term "Minneapolis Plumbing Ordinance" as used therein shall be construed to mean "Village of Brooklyn Center Plumbing Code ". J S ection 3 -504 PLUMBING, WA'T'ER AND SEWER INSPECTOR. There is hereby created the office of Plumbing, Sewer and Water Inspector. The person chosen to fill the office of Plumbing, Sewer and Water Inspector shall be acquainted with the laws of Minnesota and the ordinances of the Village of Brooklyn Center and shall be familiar with the materials and workmanship required for the proper installation of plumbing, water and sewage facilities and shall also hold a State Journeyman or Master Plumber's License. The Plumbing, Sewer and Water Inspector is charged with the enforcement of this ordi- nance and of other applicable laws and to this end shall inspect all work performed on plumbing, sewer and water installations. Section-3-505 INSPECTION. The Inspector shall make a thorough inspection of the installation in buildings of the piping, traps, and fixtures of a plumbing system to insure compliance with all the requirements of this or- dinance. When any plumbing installation is found to be in violation of this ordinance, the Inspector shall notify the person, firm or corporation owning, using or installing the same, in writing. Any person, firm, or corporation failing or refusing to make the necessary repairs or changes and to have such work completed within 48 hours or any longer period which may be fixed by the Plumbing, Sewer and Water Inspector in such written notice after the receipt of such notice shall be deemed in violation of this ordinance. Section 3-50 CERTIFICATE OF INSPECTION. Upon the completion of any plumbing installation it shall be the duty of the person, firm, or corporation doing the same to notify the Inspector who shall inspect the Installa- tion within a reasonable time after such notice c is gives, and if the plumbing installation is found to be fully in compliance with this ordinance, he whall issue a certi- ficate of inspection. Section -507 LICENSE REQUIRED. No person, firm, or corporation shall engage in the business of installing, altering, extending, repairing, or maintaining any plumbing work or house drainage or connecting any plumb - ing installation within the Village of Brooklyn Center, unless they shall be licensed by the Village Council which license shall be granted to any applicant therefor on com- pliance with the following; (a) Licenses shall be issued only to individuals or contractors licensed as master plumbers by the Minnesota State Board of Health. Anyone not so licensed may do plumbing work which complies with the provisions of the minimum standards herein prescribed on premis s part of premises owned and actually occupied by is homestead if he shall file with the Inspector an affi- davit showing that he performed the actual work himself in such homestead. No journeyman shall install plumb- ing as herein defined unless he is authorized to do so under the State Plumbing Code. (b) The applicant shall pay a Twenty -five ($25.00) Dollar License fee and Fifteen ($15.00) Dollars for renewal thereafter, and the license shall run from May 1 to April 30 of the following year. (c) The applicant shall furnish a surety bond of $2,000.00 to the Village of Brooklyn Center covering applicant's work in connection with the Village water system; and a surety bond of $2,000.00 covering appli- cant's work in connection with the sewer system of the Village of Brooklyn Center. (d) No license shall be issued unless and until the applicant shall first file with the Village Clerk a policy or policies of insurance insuring such appli- cant against liability imposed by law on account of damage to or destruction of property in the amount of $25,000. Any such policy shall provide that it may not be cancelled by the insurer except upon notice to the Village of Brooklyn Center. In case of cancella- tion of such insurance such license shall be suspended automatically until such insurance has been replaced. 3. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there- ' of. William N. Super, Carl Carlson, Clifford Wellman,, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said ordinance was declared duly passed and adopted. Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council accept the petition for oil stabilizing on Morgan Avenue North from 69th Avenue North to the North line of Halek's Addition. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Villag Council accept the deed for street purposes for the following property: That part of the East 2 of the Northeast u of the Southeast ,- except that part thereof platted as Bergstrom's Lynside Manor, in Section 33, Township 119, Range 21, described as follows: All that part thereof lying Westerly of a line drawn parallel to and 30 feet Easterly of the West line thereof, and all that part thereof lying Northerly of a line drawn parallel to and 30 feet Southerly of the North line thereof. Motion carried. Motion made by Russ Jones and seconded by Clifford Wellman that the Villa& Council accept the petition submitted for water improvements on Wingard Lane. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED WATER EAPROV24MT NO. 1958 -17 AND PROVIDING FOR REIMBURSEMENT OF UNASSESSED COST OF WATER IMPROVEMENT NO. 1956 -19. WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of a water supply system including wells, tanks, feeder mains and appurtenances to provide service along the following described streets: Wingard Lane from Osseo Road to Noble Avenue North. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $5,000.00, NOW. THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Tuesday, the 22nd day of April 1958, at 8:00 o'clock P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improve- ment is as follows: All lots and parcels of land abutting thereon. 4. This proposed improvement shall be designated Water Improvement No. 1958 -17. BE IT FURTHER RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that it is hereby determined that the properties which will be served by Water Improvement No. 1958 -17 when said improvement is completed, will also be bene- fited by Water Improvement No. 1956 -19, which properties were not initially assessed for Water Improvement No. 1956 -19; and that as to expenditures made for Water Improvement No. 1956 -19 from general ad valorem tax levies or other sources and funds in addition to special assessments heretofore made for said improvement the Village shall be reimbursed therefor by adding $2,000,00 to the assessments to be levied for Water Improve- ment No. 1958 -17 and the Village Clerk shall cause notice that such additional amounts will be assessed to be included in the notice of hearing in the making of said Water Improvement No. 1958 -17. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Carl Carlson and seconded by Clifford Wellman that the Village Council accept the resignation of Elsworth Nelson from the Police Department effective June 1, 1958 with one week's paid vacation as of that date. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Village Council appoint Robert L. Leonard as police sergeant upon the recommendation of the Police Chief. Motion carried. Member Carl Carlson introduced the following resolution upon the recom- mendation of the Village Engineer: RESOLUTION RESTRICTING WEIGHT LIMITS ON VILLAGE STREETS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. There is hereby imposed a weight limit upon all Village streets of not to exceed four (4) tons weight per axle. 2. This limitation shall expire on May 15, 1958 unless sooner terminated by the Village Council. 3. The Village streets shall be posted in accordance with this resolution. Said resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION INCREASING VILLAGE BUDGET $5 MO BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: r The Budget heretofore established is hereby increased by the sum of $5,988.70, allocated as follows: Mayor, & Council $1,489.80 Village Clerk 1,121.85 Village Hall 441.52 Engineering Dept, 5.91 Police Department 328.54 Board of Prisoners 6.38 Fire Department 491.39 Civil Defense 46.77 Building Inspections 276.44 Dog Catcher 65.83 Street Department 1,608.27 Recreation 106.00 The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon, the following voted in favor there- of: William N. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR SANITARY SEWS@ IMpRoVEMENT N0. 1958 -8 AND DIRECTING ADVERTISEMENT FOR BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Sanitary Sewer Improvement No. 1958 -8 prepared by A. J. Lee, Village Engineer, are hereby approved and ordered filed with the Clerk, upon the recommendation of the Village Engineer. 2. The Clerk shall advertise for bids for such improve - ment by publication at least once in the official newspaper and in the Construction Bulletin.. the date of first publica- tion not less than ten days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Bid date is set for April 22, 1958. The motion for the adoption of the foregoing resolution was duly seconded by member Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declares duly passed and adopted. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of March 25. 1958" were audited and ordered paid.
