May 6, 1958
The Village Council met in special session and was called to order
by William N. Super, Mayor, at 8 :11 P.M.
Roll Call; William N. Super, Carl Carlson, Clifford Wellman, and
Wayne Gageby were present; Russ Jones was absent.
In absence of Clerk Russ Jones, proceedings were recorded by Village
Accountant, Dale F. Curry.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the
Village Council approve the minutes of the regular meeting of April 22, 1958.
The minutes were approved as recorded. Motion carried.
Motion made by Clifford Wellman and seconded by Wayne Gageby that
the Village Council accept theemergency petition for sanitary sewer on
Ewing Avenue North from 59th Avenue North to 61st Avenue North; 61st Avenue
North from Ewing Avenue North to June Avenue North; Osseo Road from Admiral
Lane to 61st Avenue North; Janet Lane from France Avenue North to 530' West;
and France Avenue North from 61st Avenue North to Janet Lane. Motion carried.
Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED SANITARY SEWER DWROVENENT NO. 1958 -24
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Construction of sanitary sewer on Ewing Avenue North
from 59th Avenue North to 61st Avenue North; 61st Avenue
North from Ewing Avenue North to June Avenue North;
Osseo Road from Admiral Lane to 6lst Avenue North;
Janet Lane from France Avenue North to 530 feet West;
and France Avenue North from 61st Avenue North to Janet
Lane.
WHEREAS, the village engineer has made a preliminary report
advising that said proposed improvement is feasible and that it
can be constructed at an estimated cost of $ 0.000
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted
by Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be
held at the Village Hall in the village on Tuesday, the 27th day
Of May, 1958, at 8:00 o'clock P.M., and the clerk shall publish
notice of the time and place of hearing by two weeks' publication
in the official newspaper of the village.
3. The area proposed to be assessed for said improvement is
as follows:
All lots and parcels of land abutting thereon.
4. This proposed improvement shall be designated Sanitary
Sewer Improvement No. 1958 -24.

The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof: William N. Super, Carl Carlson, Clifford Wellman
and Wayne Gageby; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion made by Wayne Gageby and seconded by Carl Carlson that the
Village Council uphold the recommendation of the Planning Commission and
grant a special permit to Donald Brandvold to build a double bungalow on
Lots 7 and 8, Block 3, Lake Breeze Addition. Motion carried.
Motion made by Carl Carlson and seconded by Clifford Wellman that
the Village Council uphold the recommendation of the.Planning Commission and
deny a special permit to Roy Swenson to construct a two family dwelling on
the West 1/2 of the North 75' of the South 150' of Lot 28, Garcelon's
Addition. Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the
Village Council authorize the adjustment of the special assessments on
Parcel 6500, Section 34, W. W. Boltser property at 3808 662 Avenue North
from a square foot town acreage basis for figuring assessments.
The correction to be calculated and the amount of the abatement to be spread
from 1959 to end of the assessment on the tax rolls:
Correction:
Levy #1918 Sewer Interceptor $151.46 to $134.25 less overpayment
for the years 1956, 1957 and 1958.
Levy #1939 Area Interceptor $195.98 to $146.26 less overpayment
for the years 1957 and 1958.
Levy #1941 Storm Sewer 56 -A2 $317.15 to $236.93 less overpayment
for the years 1957 and 1958.
Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that
the Village Council notify Mr. Earle Brown, University of Minnesota,
Dayton Co. & Winston Bros. about the proposed location of the freeway and
the re- location of Highway #100. The Village has given tentative approval
to the plan that has been presented. Final approval of the proposed
freeway plan and including the proposed re- location of Highway #100 will
be deferred until after the foregoing parties have had an opportunity to
review this proposal and to inform the Village Council of any criticisms
or comments they may have. Any suggested changes shall be submitted to
the Village Planner and shall thereafter be considered by the Planning
Commission and the Village Council. Comments should be submitted prior to
May 27, 1958. Said plan will be submitted to the Highway Department on or
about June 1, 1958. Motion carried.
Motion made by Carl Carlson and seconded by Clifford Wellman that
the Garden City Development Co. indemnity bond in the amount of $2,000 be
amended to the effect that the $2,000 expenditure to be measured by
prevailing prices for grading in the public recreational park instead of
trees and labor as bond now states. Motion carried.
Motion made by Carl Carlson and seconded by Wayne Gageby that the
Water Improvement Project No. 1958 -12 be extended from Beard Avenue North
from 64th Avenue North to Thurber Road. Motion carried.
Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM
WHEREAS, the Village Engineer has reported that on May 6, 1958,
at 2 o'clock p.m., he opened and tabulated the bids received for
Sanitary Sewer Improvement No. 1958 -10 and Water Main Improvement
No. 1958 -11 and that said bids were as follows:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, as follows:
The bid of Peter Lametti Construction Co. as to the furnishing of
all work, labor and material in connection with Sanitary Sewer
Improvement No. 1958 -10 and Water Main Improvement No. 1958 -11,
according to the plans and specifications therefor now on file in
the office of the Village Clerk, is deemed to be the lowest and
best bid submitted for said work by a responsible bidder, and
said bid is hereby acceptedo
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon the following voted
in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and
Carl Carlson; and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Motion made by Wayne Gageby and seconded by Clifford Wellman that
the Village Council accept the justice report of Raymond Benson and John
Wingard for the months of March and April, 1958. Motion carried.

Village Council approve the following licenses:

Motion carried.
Motion made by Clifford Wellman and seconded by Carl Carlson that
the Village Council set the date of June 19th, 8 o'clock p.m. as the date
for the meeting of the Board of Review. Motion carried.
Motion made by Carl Carlson and seconded by Wayne Gageby that all
petitions for improvement projects must be submitted on or before January lst
each year for the following year's work. Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the
Village Council accept the recommendation of the Village Attorney and take
no further steps against Howe, Inc. at this time. Motion carried.
Motion made by Clifford Wellman seconded by eyne Gageby to
adjourn. Motion carried. all
