The Village Council met in regular session and was called to order by
William N. Super, Mayor, at 8 :10 o'clock p.m.
Roll Call: Willaim N. Super, Clifford Wellman, and Russ Jones were pre-
sent. Wayne Gageby and Carl Carlson were absent.
The Mayor announced that the meeting was open for the consideration of
proposed Sanitary Sewer Improvement No. 1958 -18.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official news.
paper, the last publication being on May 8, 1958, which affidavit was examined and
found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present arguments
either for or against the proposed improvement. After hearing and considering all
objections, and the property owners appearing in favor of said improvement, member
Russ Jones introduced the following resolution and moved its adoption:

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:

ment No. 1958 -18 is hereby declared to be favorable.
2. Action upon said improvement shall be deferred until
a later time.
The motion fcr the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Russ Jones, and Clifford Wellman; and the following voted
against the same: None. Whereupon said resolution was declared duly passed and
adopted.

1. The public hearing on proposed Water Main Improvement
No. 1958 -20 is hereby declared to be favorable.
2. Action upon said improvement shall be deferred until

The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Russ Jones, and Clifford Wellman; and the following
voted against the same: None. Whereupon said resolution was declared duly passed
and adopted.

FAVORABLE BUT DEFERRING ACTION THEREON
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center.. Minnesota, as follows:
1. The public hearing on proposed Oil Stabilizing Improve-
ment No. 1958 -21 is hereby declared to be favorable.
2.' The description of the improvement is hereby changed
to the following
Perry Avenue North from 68th Avenue North to
69th Avenue North and on Morgan Avenue North
from 69th Avenue North to the North line of
Halek's Addition.

3. Actiou upon said improvement shall be deferred until
a later time.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Russ Jones, and Clifford Wellman; and the following
voted against the same: None. Whereupon said resolution was declared duly passed
and adopted.
Wayne Gageby appeared at the meeting at this point and resumed his duties
as Trustee.
The Mayor announced that the meeting was open for the consideration of
proposed Sanitary Sewer Improvement No. 1958 -22.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official ne-T3 --
paper, the last pablication being on May 8, 1958, which affidavit was examined and
found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present argu-
ments either for or against the proposed improvement. After hearing and considering
all objections, and the property oTmers appearing in favor of said improvement, mem-
ber Clifford Wellman introduced the following resolution and moved its adoption:

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and for
the best interests of the village and the owners of property
specially benefited thereby that the following improvement
shall be constructed:
Construction of Sanitary Sewer Improvement
No. 1958-22.
2. The plans and specifications for said improvement
shall be prepared by A. J. Lee, Vi3age Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by member
Wayne Gageby, and upon vote being taken thereon the following voted in favor there -
of: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the
:following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.

1. It is hereby determined that it Is necessary and for
the best interest of the Village and the owners of property

specially benefited thereby that the following improvement be
constructed:
Oil Stabilizing Improvement No. 1958 -21.
2. Said work will be undertaken by day labor and the
records of cost will be kept as provided by law and such
work is to be performed according to the specifications es-
tablished by the Engineering Department for such work.
The motion for the adoption of the foregoing resolution was duly seconded by member
Wayne Gageby, and upon vote being taken thereon the following voted in favor there-

following voted against the same: None. Whereupon said resolution was declared

RESOLUTION APPROVING PLAN AND SPECIFICATIONS
FOR SANITARY SEWER IMPROVEMENT NO. 1958 -23
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for Sanitary Sewer Improve-
ment No. 1958 -23 prepared by A. J. Lee, Village Engineer, are here-
by approved and ordered placed on file with the Clerk.
2. The construction for said improvement is to be added
to the existing contract with Petrowske and Ross for construct -
ion of Sanitary Sewer Improvement No's. 1958 -1, 1958 -2, 1958 -3,
and 1958 -6. Said work to be performed at the same unit prices
as now in force in said contract.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the
following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.

RESOLUTION
WHEREAS, the Village Council of the Village of Brooklyn Center,
Hennepin County, Minnesota, has received from the County Auditor
of Hennepin County, Minnesota, a list of lands in said village
which became the property of the State of Minnesota under the
provisions of law declartAg the forfeiture of lands to the
State for non - payment of taxes, which said list has been desig-
nated as Classification List "444 -C ", February 25, 1958; and
WHEREAS, each parcel of land described in said list has here-
tofore been classified by the Board of County Commissioners
of Hennepin County, Minnesota as non - conservation land and
the sale thereof has heretofore been authorized by said
Board of County Commissioners:
NOW, THEREFORE, BE IT RESOLVED, by said Village Council, act -
ing pursuant to Minnesota Statutes for 1949, Section 282.01,
Subdivision 1, that the said classification by said Board
of County Commissioners of each parcel of land described in
in said list as non- conservation land be and the same is
hereby approved and that the sale of each such parcel of
land be and the same is hereby approved.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Wayne Gageby, Clifford Wellman, and Russ Jones; and the
following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.
Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING WORK
AND ISSUING FINAL PAYMENT
WHEREAS, Pursuant to a written contract signed with the Village of
Brooklyn Center, Minnesota, on June 5, 1956, Layne- Minnesota
Company has completed the following improvement:
Municipal well, part of Water Improvement No.
1956 -19 -3.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, the work completed under said con-
tract is hereby accepted, upon the recommendation of Minder
Engineering Co., and
BE IT FURTHER RESOLVED that the Village officials are hereby
directed to issue a proper order for the final payment on said
contract, making the contractor's receipt in full. Final
payment is as follows:
Minder Engineering Estimate Dated April 15, 1958: $ 7,723.41

Motion made by Clifford Wellman and seconded by Russ Jones that the

be played which are to be reviewed by the Council not later than May 20th. Motion
carried.
The bills set forth on the schedule attached to these minutes and made a
