May 27, 1958 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8 :00 o'clock P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones were present. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village Council approve the minutes of the regular meeting of May 13, 1958. The minutes were approved as recorded. Upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None; and Carl Carlson abstained from voting. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1958 -24. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 22, 1958, which affidavit was examined and found satisfactory and ordered placed on file.. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT N0. 1958 -24 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota,..as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Construction of Sanitary Sewer No. 1958 -24 2. The plans and specifications for said improvement shall be prepared by A. J. Lee, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Carl Carlson that Lots 17, Block 1 and Lot 6, Block 6, Wangstad's Brooklyn Terrace be excluded from Sanitary Sewer Improvement Project 1958 -24 and the Village Engineer is author- ized to meet with the property owners on Lots 11, 12, 13, lalock 1 and Lots 11, 12, and 13, Block 2, Wangstad's Brooklyn Terrace to determine if these lots should be included or excluded in Improvement Project 1958 -24. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF $390,000 IMPROVEMENT BONDS AND $100,000 PARK BONDS WHEREAS, the Village Council has entered into contracts for the construction of Water Tank Improvement No. 1957 -28, Water Improvement Nos. 1957 -40, 1958 -5, 1958 -11, 1958 -12, 1958 -13 and 1958 -17, Sanitary Sewer Improvement Nos. 1958 -1, 1958 -2, 1958 -3, 1958 -4, 1958 -6, 1958 -8, 1958 -10 and 1958 -14, and Storm Sewer Improvement No. 1958 -15, all under the provisions of Chapter 398, Laws of Minnesota 1953, as amended, and WHERF,A.S, the Village Council has been authorized to issue not exceeding $400,000 of Park Bonds pursuant to a vote of the electors held on the 3rd day of December, 1957, of which $300,000 of Park Bonds has not as yet been issued, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that the total cost of each of the above described improvements heretofore commenced is as follows: For the construction of: Water Tank Improvement No. 1957 -28 $116,250.00 Watex Improvement No. 1957 -40 24,250.00 Water Improvement No. 1958 -5 3,150.00 Water Improvement No. 1958 -11 33,900.00 Wager Improvement No. 1958 -12 9,600.00 Water Improvement No. 1958 -13 17,850.00 Water Improvement No. 1958 -17 3,600.00 Sanitary Sewer Improvement No. 1958 -1 7,700,00 Sanitary Sewer Improvement No. 1958 -2 7,850.00 Sanitary Sewer Improvement No. 1958 -3 4,650.00 Sanitary Server Improvement No. 1958 -4 4,600.00 Sanitary Sewer Improvement No. 1958 -6 4 Sanitary Sewer Improvement No. 1958 -8 65,150.00 Sanitary Sewer Improvement No. 1958 -10 77,550.00 Sanitary Sewer Improvement No. 1958 -14 5,200.00 Storm Sewer Improvement No. 1958 -15 4,000.00 The aggregate cost thereof being determined to be approximately $390,000.00 2. It is hereby determined that the total cost of each of said improve- ments, except for Water Tank Improvement No. 1957 -28, shall be assess- ed upon property benefited by the improvement. The Clerk shall forth- with calculate the proper amount to be specially assessed for the improvements against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, based upon the benefits received. 3. It is hereby determined that twenty percent (20 %) of the total cost of Water Tank Improvement No. 1957 -28, or Wenty -three Thousand Two Hundred Fifty Dollars ($23,250.00), shall be assessed upon property benefited by the improvement. 4. It is hereby determined to finance the entire cost of said improve- ments by the issuance of improvement bonds. 5. There is hereby created a special fund to be designated as Improvement No. 1958 -B Fund, out of which shall be paid the cost of the said improvements and the principal and interest on the Improvement Bonds authorized hereunder and into which shall be paid all of the proceeds of the special assessments and taxes to be levied for said improve- -2- meets and the money received from the sale of said Improvement Bonds, 6. In anticipation of the collection of said special assessments and taxes, the Village shall forthwith issue and sell $390,000 Improve- ment Bonds. The full faith and credit of the Village shall be pledged for the payment of the principal and interest on the bonds when the monies on hand iu the Improvement No. 1958 -B Fund are insufficient for the purpose. 7. The Improvement Bonds shall be 390 in number and numbered 1 to 390, both inclusiv e, in the denomination of $1,000 each, shall bear date July 1, 1958, shall bear interest payable July 1, 1959, and semi- annually thereafter on January 1 and July 1 in each year. Said bonds shall mature serially on January 1 in the years and amounts as follows: $20,000 January 1, 1960 $20,000 January 1, 1961 $20,000 January 1, 1962 $20,000 January 1, 1963 $20,000 January 1, 1964 $20,000 January 1, 1965 $20,000 January 1, 1966 $20,000 January 1, 1967 $20,000 January 1, 1968 $20,000 January 1, 1969 $20,000 January 1, 1970 $20,000 January 1, 1971 $20,000 January 1, 1972 $20,000 January 1, 1973 $20,000 January 1, 1974 $20,000 January 1, 1975 $20,000 January 1, 1976 $20,000 January 1, 1977 $15,000 January 1, 1978 $15,000 January 1, 1979 All bonds maturing on January 1, 1970 and thereafter are subject to redemption in inverse numerical order on January 1, 1964, or any interest payment date thereafter upon payment as follows: (1) If redeemed prior to January 1, 1969, at par plus accrued interest, plus a premium of $30.00 for each bond redeemed. (2) If redeemed on January 1, 1969, or thereafter, at par plus accrued interest, plus a premium of $10.00 for each bond redeemed. The full faith and credit of the Village will be pledged to payment of the bonds. 8. It is hereby determined to be necessary to issue $100,000 Park Bonds of the $400,000 Park Bonds authorized by a vote of the electors on the 3rd day of December, 1957. The money received from the sale of said bonds shall be used to acquire and improve parks and playgrounds 9. The Park Bonds shall be 100 in number and numbered 1 to 100, both inclusive, in the denomination of $1,000 each, shall bear date July 1, 1958, shall bear interest payable July 1, 1959, and semi- annually thereafter on January 1 and July 1 in each year. The Village Council shall meet at the Village Hall in the Village on Tuesday, the 17th day of June, 1958, at eight o'clock P.M., for the purpose of receiving sealed bids for the purchase of said improve- ment Bonds and Park Bonds and the Village Clerk is authorized and directed to cause notice of the sale of said bonds to be ,given by publication ten (10) days in Com mercial West, a financial paper published in Minneapolis, Minnesota. Said notice shall recite that the Village will furnish printed bonds and approving legal opinion of Mssrs. Faegre & Benson, Minneapolis, Minnesota, both without expense to the purchaser, shall require that all bids be uncondition- al and accompanied by a good faith check in the amount of at least $8,000 for bids on the Improvement Bands and at least $2,000 for bids on the Park Bonds and shall specify one or more interest rates in multiples of one -tenth or one- quarter of one percent. Said notice shall further provide that delivery of the bonds will be made by the Village within forty days after the date of sale at the office of the Village Clerk or, at the option of the purchaser, at Minneapolis or Saint Paul, without expense to the purchaser. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted aginst the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council approve the following electrician's licenses: F. N. Hurd & Co. - 2520 Lyndale Ave. So. Pls., Minn. St. Louis Park Electric- 63258 Cambridge - Mpls., Minn. Hoffman Electric - Anoka, Minnesota Motion carried. Member Clifford Wellman introduced the following resolution and moved its adoption: AN ORDINANCE CHANGIM THE NAME OF PART OF 6 ?ND AVENUE NORTH TO 61ST AVENUE NORTH THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: 1. A new section entitled 25 -406 is hereby added to the village ordinances to read as follows: -4- Secti 25 -406 62ND AVENUE NORTH - 61ST AVE= NORTH. 2nd Avenue North (lying between Perry Avenue North and I` Regent Avenue North) is hereby renamed and shall hereafter be known as 61st Avenue North. 2. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of May 27 1958" were audited and ordered paid. Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village Council adjourn.
