The Village Council met in special session and was called to
order by William N. Super, Mayor, at 8:00 o'clock pm.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson, and
Russ Jones were present and Wayne Gageby was absent. (Wayne Gageby arrived
late as hereinafter indicated).
The Mayor announced that this was the time and place for receipt
of bids for the purchase of $390,000 Improvement Bonds and $100,000 Park
Bonds in accordance with the resolution adopted May 27, 1958-

The Clerk presented an affidavit showing publication of Notice of
Sale in Commercial. West, a financial paper published in Minneapolis..
Minnesota, which affidavit was examined and found satisfactory and ordered
placed on file, together with a satisfactory affidavit of publication in
the Brooklyn Center Press, the official village newspaper.
The Clerk then presented the sealed bicb which had been received,
which were opened and examined and found to be as follows:

Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION TABLING FURTHER ACTION ON BIDS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that further action on the bids received of
$390,000.00 Improvement Bonds and $100,000.00 Park Bonds be
tabled for further study.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote bein g taken thereon, the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson,
, and the following voted against the same: None; where-
Upon said resolution was declared duly passed and adopted.
Motion made by Clifford Wellman and seconded by Carl Carlson that
the Village Council release the certified check, in the amount of $900.00,
Which is street improvement escrow of Dr. Isabell Cameron for CameronL p -ter',
Motion carried.
After due consideration o bid for $390,000.00 Improvement Bonds,
member Russ Jones introduced the following resolution:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that the bid of B. a pan Ingen & Co., Inc
Barcus, Kindred & Co., to purchase $390,000.00 6F7ger and Water -
Improvement Bonds, bearing interest rate of 3.0frf on all bonds
maturing 1/i/60 to January 1, 1.968, Inclusive; j.20 percent on
all bonds maturing January 1, 1969 to Jannax- 1, 1971, inclusive;
3.50 percent on all bonds mati=ing January 1, 1972 to January 1,
1974, inclusive; 3.60 percent on all bonds maturing January 1 1975`

to January 1, 1979, inclusive, together with an additional
coupon of 1,40 percent on all bonds for the period of from
August 1, 1958 to July 1, 1959, and to pay therefor the sum
of $390,000.00, is hereby found, determined and declared to
be the most favorable bid and is hereby accepted. The Clerk
Is directed to retain the check of said purchaser.

Member Russ Jones introduced the following resolution and moved
its adoption:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The Village shall forthwith issue its negotiable improve-
ment bonds in the principal amount of $390,000 dated July 1,
1958, being 390 in number and numbered 1 to 390, b oth inclusive,
in the denomination of $1 ..000 each, bearing interest at the rate
of 3.00 percent per annum on all bonds maturing January 1, 1960
to January 1 , 1968, inclusive; 3.20 percent on all bonds maturing
January 1, 1969 to January 1, 1971, inclusive; 3.50 percent on
all bonds maturing January 1, 1972 to January 1, 1971, inclusive;
3.60 percent on all bonds maturing January 1, 1975 to January 1,
1979, inclusive, plus additional interest at the rate of 1 *40
percent for the period from August 1,- 1958 to July 1, 1959 to
be represented by a separate coupon, said bonds maturing serially
in the years and amounts as follows:
$20 on January 1.each year 1960 to 1977, inclusive,
$15,000 on January 1 each year 1978 to 1979 inclusive,
with a prepayment option as follows:
All bonds maturing on January 1, 1970 and thereafter
subject to redemption in inverse numerical order on
January 1, 1961+, or any interest payment date there-

accrued interest plus a premium of $30.00 for each
bond redeemed,
(2) If redeemed on January 1, 1969, or thereafter, at

2. Both principal and interest shall be payable at the main

Indebted and for value received hereby promises to pay to bearer
out of Improvement No. 1958 -B Fund the sum of ONE THOUSAND
DOLLARS on the lst day of January, 19 , and to pay interest
thereon at the rate of percent ( %) per annum
from date to August 1, 1958, percent ( %) per annum
from August 1, 1958 to July 1, 1959 represented by separate
sets of interest coupons at the coupon rate of percent
( %) and one and forty-obunftedths percent (1.40%), respectively,
and percent ( %) per annum after July 1,
1959, payable July 1, 1959 and semiannually thereafter on the
lst day of January and the lst day of July in each year in
accordance with and upon presentation and surrender of the
attached interest coupons as they severally become due. Both
principal of and interest on this bond are payable at the main

in any coin or currency of the United States of America which at
the date of payment is legal tender for public and private debts.
All bonds of this issue maturing on January 1, 1970, and
thereafter, upon thirty (30) days prior notice by mail to the
bank where the bonds are payable and to the last known holder
are subject to redemption in inverse numerical order on January 1,
1964, or any interest payment date thereafter, upon payment at
par plus accrued interest plus a premium of $30.00 for each bond
redeemed if redeemed prior to January 1, 1969, and if redeemed on
January 1, 1969, or thereafter, at par plus accrued interest plus
a premium of $10.00 for each bond redeemed. Holders desiring to
receive such notice must register their names, addresses and
bond numbers with the Village Clerk.
This bond is one of an issue of bonds in the total principal
amount of $390,000, all of like date and tenor except as to inter-
est rates, maturity and redemption privilege, all issued pursuant
to and in full conformity with the Constitution and Laws of the
State of Minnesota, including Chapter 398, Laws of Minnesota 1953,
as amended, for the purpose of defraying the expenses incurred and
to be incurred in special improvements of the Village, and is
payable primarily from special assessments to be levied against
property specially benefited thereby but constitutes a general
obligation of the Village, and to provide moneys for the prompt
and full payment of said principal and interest as the sauce become
due the full faith and credit of the Village is hereby irrevocably
pledged and the Village will levy ad valorem taxes if required for
such purpose without limitation as to rate or amount.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of
Minnesota to be done, to happen, and to be performed precedent to
and in the issuance f this bond have been done have happened and

required by law; and that this bond together with all other indebt-
edness of the Village outstanding on the date hereof and the date
of its actual issuance and delivery does not exceed any constitu-
tional or statutory limitation thereon.

4. The Clerk is directed to cause said bonds to be prepared
and the Clerk and Mayor are authorized and directed to execute the
same and affix the village seal thereto and to cause the interest
coupons to be executed and authenticated by the printed facsimile
signatures of said officers.
5. Tte bonds issued hereunder shall be payable from Improvement
No. 1958 - - B Fund, which special fund is hereby created. If any
payment of principal or interest on said bonds shall become due
when Hera is not sufficient money in said fund to pay the same,
the Trer.surer shall pay such principal or interest from the general
fund of the Village and such fund shall be reimbursed for such
advances out of proceeds of assessments for said improvement when
collected.
6. It is hereby determined that of the total cost of Water
Improvemeant No. 1957 -28 which is $116,500, 200 thereof, or the sum
of $23,250 shall be assessed against property benefited thereby
and the balance shall be paid from general ad valorem taxes. For
the pu.pose - cif providing money for the portion of payment of
principal and interest on the bonds not payable from special
assessments, there is hereby levied upon all of the taxable
property in the village a direct ad valorem tax in the years and
amounts as follows:

7. The estimated collection of special assessments together

8. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt of the
purchase price, and the said purchaser shall not be obligated to
see to the proper application thereof.
9. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys approving
said issue certified copies of all proceedings and records relating
to the issuance of said bonds and to the right, power and authority
of the Village and its officers to issue the >3amo end said certified
copies and certificates shall be deemed the representations of the
Village as to all matters stated therein.

After due consideration of bids for $100,000.00 Park Bonds,
member Carl Carlson introduced the following resolution:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that the bid of Kalman & Company, Inc. &
Associates to purchase $100,000.00 Perk Bonds, bearing interest
rate of 2.70 percent on all bonds maturing January 1, 1961 to
January 1, 1967 inclusive; 3.10 percent on all bonds maturing
January 1, 1968 to January 1, 1969, inclusive 3.50 percent on
all bonds maturing January 1, 1970 to January 1, 1972, inclusive;
3.60 percent on all bonds maturing January 1, 1973 to January 1,
1980 together with additional interest of 1.40 percent on all
bonds from January 1, 1959 to January 1, 1960, and to pay there
for the sum of $100,000.00, is hereby found, determined and
declared to be the most favorable bid and is hereby accepted.
The Clerk is directed to retain the check of said purchaser.

its adoption.
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows;
1. The Village shall forthwith issue its negotiable park
bonds in the principal amount of $100,000, dated July 1, 1958,
being 100 in number and numbered l to 100, both inclusive, in
the denomination of $1,000 each, bearing interest at the rate
of 2.70 percent per annum on all bonds maturing January 1, 1961
to January 1, 1967, inclusive; 3,10 percent on all bonds maturing
January 1, 1968 to January 1, 1969, inclusive; 3.50 percent on
all bonds maturing January 1, 1970 to January 1, 1972, inclusivA;
3.60 percent on all bonds maturing January 1, 1973 to Januar;r 1,
1980, inclusive, plus additional interest at the rate of 1.40
Percent for the period from January 1, 1959 to January 1 1960 tc
be represented by a separate coupon, said bonds maturing serially
in the years and amounts as follows, all without option of prior
payment;

purpose of providing money to acquire and develop park land and
recreational facilities, and is issued pursuant to authority
conferred by more than the requisite majority vote of the
qualified electors of the Village voting on the question of the
issue at an election duly and regularly called and held and
pursuant to and in full conformity with the Constitution and Laws
of the State of Minnesota thereunto enabling.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the-State of
Minnesota to be done, to happen, and to be performed precedent to
and in the issuance of this bond have been done, have happend and
have been performed in regular and due form, time and reanner as
required by law; that prior to the issuance hereof a direct
annual irrepealable ad valorem tax has been duly levied upon all
Of the taxable property in the Village in the years and amounts
as required bylaw and additional taxes may be levied upon all of
said property, if required to pay principal or interest, without
limitation as to rate or amount; and that this bond together with
all other indebtedness of the Village outstanding on the date
hereof and the date of its actual issuance and delivery does not

5. There shall be paid out of the Park Bond Redemption Fund
the principal of and interest on said bonds and into which shall
be paid the proceeds of the.taxes herein levied; provided, however,
that if any payment of principal or interest on said bonds shall
become due when there is not sufficient money in said fund to pay
the same, the Treasurer shall pay such principal or interest from
the general fund of the Village and such fund shall be reimbursed
for such advances out of the proceeds of taxes herein levied when
collected.
6. For the purpose of paying the principal of and interest
on said bonds, there is hereby levied upon all of the taxable
property in the Village a direct ad valorem tax which shall be
spread upon the tax rolls and collected with and as part of
other general taxes of the Village, and shall be paid into the
Park Bond Redemption Fund above provided, which tax is in the

7. The Clerk is hereby authorized and directed to deliver
a certified copy of this resolution to the County Auditor of
Hennepin County, together with such other information as the
County Auditor may require,.and to obtain his certificate that
the issue has been entered upon his register and that a tax
has been levied as required by law.
8. The tax levy herein provided shall be irrepealable
until all of said bonds are paid, provided that the Clerk shall
annually, prior to October 10, certify to said County Auditor
any amo,,mt appropriated to the said Park Bond Redemption fund to
pay principal and interest due during the ensuing year, and the
County Auditor shall thereupon reduce the levy collectible during
such year by the amount so certified
9. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt of the
purchase price, and the said purchaser shall not be obligated to
see to the proper application thereof.
10. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys approv-
ing said issue, certified copies of all proceedings and records
relating to the issuance of said bonds and to the right, potter
and authority of the Village and its officers to issue the same
and said certified copies and certificates shall be deemed the
representations of the Village as to all matters stated therein.

Member Carl Carlson introduced the following resolution upon the
recommendation of the Village Attorney and Park Board and moved its
adoption.
RESOLMION DIRECTING CONDEMNATION
OF CER TAIN P_VTFM.cYrS IN LAND
WHEREAS, it is necessary and advisable and in the public
interests of the Villa.gs of Brooklyn Center to acquire
certain land for park purposes as hereinafter described,
and
WHEREAS, the Park Board has been unab ?_e to acquire such
interests through negotiation and has by resolution
determined that it has become necessary to procure such
lands by right of eminent domain;
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
Brooklyn Center, as follows:
1. The Village Attorney is instructed and directed to
file the necessary petitions to acquire the interests in
land as herein ter described and to prosecute such action
to a successful conclusion or until it is abandoned,
dismissed, or terminated by the court.
2, The Village Attorney and the Village officers shall
do all things necessary to be done in the commencement,

prosecution, and successful termination of such
action.
3. The interests to be acquired in such proceedings
are as follows:
(a) Fee simple interest for park purposes:
That part of the East li acres of the West 4 acres
of the Northwest u of the Southeast -1 of the North -
east u lying North of the South 140 feet thereof.

AND DIRECTING ADVERTISEMENT FOR BIDS
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
I. The plans and specifications for Sanitary Sewer
Improvement No. 1958 -18 prepared by A• J. Lee, Village
Engineer, are hereby approved and ordered filed with the
Clerk.
2. The Clerk shall advertise for bids for such improvement
by publication at least once in the official newspaper and in
the Construction Bulletin, the date of fitst publication not
less than ten days prior to the date for receipt of bids,
Said notice shall state that no bids will be considered unless
sealed and filed and accompanied by a dash deposit, bid bond,
cashier's check or certified check payable to the Clerk in the
amount of not less than five percent of the bid.
3. Bid date is set for July 8, 1958, 2 O'clock p:m.
The motion for the adoption of the foregoing resolution was duly seconded
by member Russ Jones, and upon vote being taken thereon the following
