Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota, including all accounts audited
by said Council
July 23, 1957
The Village Council met in regular session and was called to order by William N.
Super, Mayor, at 8 :05 P.M.
Roll Call: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and
Russ Jones were present.
Motion made by Wayne Gageby and seconded by Carl Carlson to approve the minutes
of the regular meeting of July 9, 1957 and the special meeting of July 16, 1957.
Minutes were approved as recorded. Motion carried.
Motion made by Clifford Wellman and seconded by Russ Jones that the Village Coun-
cil approve the plans of the Shell Oil Company. Building plans approved were M7185 -2.
Building to be erected at the corner of 63rd Avenue North and Osseo Road. Motion
carried.
The Mayor announced that the meeting was open for the consideration of proposed
Storm Sewer Improvement No. 1957 -36•
The Clerk produced an affidavit of publication of notice of hearing on the pro -
posed improvement showing two week's publication thereof in the official newspaper,
the last publication being on July 11, 1957, which affidavit was examined and found
satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present arguments
either for or against the proposed improvement. After hearing and considering all
arguments for and against the said improvement, member Clifford Wellman introduced
the following resolution and moved its adoption:
RESOLUTION CONTINUING PUBLIC HEARING
ON STORM SEWER IMPROVEMENT NO. 1957 -36
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows:
1. That the.,Village Council continue the public hearing on Storm
Sewer Improvement 1957 -36 to August 1.6, 1957, 8 :00 o'clock p.m. Hearing
to be held at the Village Hall, to permit further study of the proposed
improvement.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor then
of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones;
and the following voted against the same: None; whereupon said resolution was de-
clared duly passed and adopted.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village
Council approve the final plat of Pearson's Northport 5th Addition; subject to all
restrictions of the platting ordinance and bond to be posted. Motion carried.
Motion made by Russ Jones and seconded by Carl Carlson that the Village Council
accept the petition for oil stabilizing on France Avenue North from 53rd Avenue
North to a line half way between 54th Avenue North and 55th Avenue North. Moticd
carried.
Member Russ Jones introduced the following resolution and moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED OIL STABILIZING IMPROVEMOT NO. 1957 -37
WHEREAS, it is proposed that there be constructed an improvement
sio listing of the following:

Oil stabilizing on France Avenue North from 53rd Avenue North to
a line half way between 54th Avenue North and 55th Avenue North.
WHEREAS, the Village'Eingineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed
at an estimated cost of $1300.00,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
I. The council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at the
Village Hall in the village on Tuesday, the 13th day of August, 1957, at
7 :30 o'clock P.M., and the clerk shall publish notice of the time and
place of hearing by two weeks' publication in the official newspaper of
the village.
3. The area proposed to be assessed for said improvement is as follows:
All lots and parcels of land abutting thereon.
4. This proposed improvement shall be designated Oil Stabilizing
Improvement No. 1957 -37-
The motion for the adoption of the foregoing resolution was duly seconded by member

Carl Carlson, and upon vote being taken thereon the following voted in favor thereof:
William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and
the following voted against the same: None; whereupon said resolution Vas declared
duly passed and adopted.
Motion made by Carl Carlson and seconded by Clifford Wellman that the Village
Council accept the petition for water main on Orchard Avenue North from 68th Avenue
North to 67th Avenue North. Village Engineer to draw up estimates and date of hear-
ing to be set later. Motion carried.
Member Russ Jones introduced the following resolution and moved its adoption:
RESOLUTION ACCEPTING WORD
WHEREAS, pursuant to a written contract signed with the Village of Brooklyn
Center, Minnesota, Phelps -Drake Co., Inc., has satisfactorily completed the
following improvement; in accordance with said contract:
Water Main Improvement No. 1956 -19 -2
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center: The work completed under said contract is hereby accepted
and approved based upon the recommendation of the Village Engineer.
BE IT FURTHER RESOLVED that the Village Officials are hereby directed to
issue a proper order for the final payment on such contract, taking the
contractor's receipt in full.
The motion for the adoption of the foregoing resolution was duly seconded bW
member Wayne Gageby, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ
Jones; and the following voted against the same: None; whereupon said r"olution was
declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved its afttfon:

WHEREAS, pursuant to a written contract signed with the Village of Brooklyn
Center, Minnesota, on March 28, 1957, Phelps -Drake Co. has satisfactorily
completed the following improvement; in accordance with said contract:

Member Wayne Gageby introduced the following resolution and moved its adoption:
RESOLUTION ACCEPTING WORK
WHEREAS, pursuant to a written contract signed with the Village of Brooklyn
Center, Minnesota, on March 28, 1957, Phelps -Drake Co. has satisfactorily
completed the following improvement, in accordance with said contract:
Sanitary Sewer Improvement No. 1957-4
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center: The work completed under said contract is hereby accepted
and approved, based upon the recommendation of the Village Engineer.
BE IT FURTHER RESOLVED that the Village Officials are hereby directed to
issue a proper order for the payment on such contract, and retaining
$1,124.74 to insure completion of clean -up work on this project.
The motion for the adoption of the foregoing resolution was duly seconded by
member Wayne Gageby, and upon vote being taken thereon, the following voted in favor

Jones; and the following voted against the awe: None; whereupon said resolution
was declared duly passed and adopted.
Member Wayne Gageby introduced the following resolution and moved its adoption:

WHEREAS, pursuant to a written contract signed with the Village of Brooklyn
Center, Minnesota, on March 28, 1957, Phelps -Drake Co., Inc., has satisfact-
orily completed the following improvement, in accordance with said contract:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center: The work completed under said contract is hereby accepted

BE, IT FURTHER RESOLVED that the Village Officials are hereby directed to
issue a proper order for the payment on such contract, and retaining $1,OUO
to insure completion of clean -up on this project.

Member Wayne Gageby introduced the following resolution and moved its adopticn:

Center, Minnesota on March 28, 1957, Phelps -Drake Co. has sattsfactorily
completed the following improvement, in accordance with said contract:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center: The work completed under said contract is hereby accepted
and approved, based upon the recommendation of the Village Engineer, and

issue a proper order for the final payment on such contract, taking the
contractor's receipt in full.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ
Jones; and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
Motion made by Carl Carlson and seconded by Clifford Wellman that the Village
Council hire Kermit Kallberg as Chief Accountant at the sum of $ per month.
Motion carried.
Motion made by Wayne Gageby and seconded by Russ Jones that the Village Council
approve the following license applications:

Motion carried.
Notion made by Clifford Wellman and seconded by WayM Gogeby that the Village
Council accept and pay the claim of Gordon Sandahl for work done at 689.3 Drew Avenue
North in the amount of $95.60. Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village
Council accept the deed from M. C. Balfany for the following property:
Commencing at the Northeast corner of Block Three (3),,Balfany's Northport
2nd Addition thence East along the North line of Register Land Survey #409,
a distance of 235 feet thence South 111.98 feet; thence at an angle to the
left of 26 degrees, 23 minutes to the most Northerly corner of Sailor Lane
as platted in Balfany's Northport 2nd Addition; thence Westerly along Northerly
line of Block 1 said Addition, to Northwest corner of said Block One (1);
thence North to Southwest corner of Block Three (3); thence North to beginning,
Tract B, Registered Land Survey #409.
The above stated property is to be for Village use, Motion carried.
Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council
postpone the hearing on zoning ordinance and map to August 13, 1957• Special notices
to be given owners where there is a substantial change in land classification. Sum -
mary of ordinance and maps to be published in the Brooklyn Center Press. Motion
carried.
Member Wayne Gageby introduced the following resolution and moved its adoption:
RESOLUTION ACCEPTING BIDS

The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ
Jones; and the following voted against the same: None; whereupona said resolution
was declared duly passed and adopted.
Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village
of Brooklyn Center participate with Robbinsdale and Crystal in special police pat
roling of Twin Lake as set out in a schedule by the City of Robbinsdale. Motion
carried.
The Mayor announced that the meeting was open for the consideration of pro-
posed Oil Stabilizing Improvement No. 1957 -16.
The Clerk produced an affidavit of publication of notice of hearing on the
proposed improvement showing two weeks' publication thereof in the official news-
paper, the last publication being on July 11, 1957, which affidavit was examined
and found satisfactory and ordered placed on file.

objections, and the property owners appearing in favor of said improvement, member
Russ Jones introduced the following resolution and moved its adoption:
RESOLUTION ORDERING WORK
DONE BY DAY LABOR
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is in the best interests of the
Village and the property owners that Oil Stabilizing Improvement No. 1957 -16
be undertaken as proposed.
2. Said work will beundertaken by day labor and the records of cost
will e kept e t as provided b law and such work is to be performed in the
p p y pe
manner heretofore according to the specifications established by the
Engineering Department for such work.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ
Jones; and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
Member Carl Carlson introduced the following ordinance, 'based upon the recommen-
dations of the Village Plumbing Inspector, Clarence Canfield:
AN ORDINANCE AMENDING THE BUILDING CODE
OF THE VILLAGE OF BROOKLYN CENTER -BY PROVIDING
FOR THE LICENSING OF GAS FITTERS AM PROVIDING
STANDARDS FOR THE INSTALLATION OF W TEMS
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO O$DAIN:
Sect i r on 1. Sections 3- 811, 3 -813, 3 -814 and 3 -815 of the Ordinances
of the Village of Brooklyn Center are hereby repealed.

Section 2. In place of the numbered sections which are hereby
repealed, there shall be added the new sections which shall to entitled
and shall read as follows:
"Section 3 -811. PERMIT REQUIRID.
No person, firm or corporation shall hereafter install, alter,
maintain or repair any system for the use of illuminating or
fuel gas or installing, altering, repairing, or servicing any
gas burning device connected thereto in or for any building or
structure in the Village of Brooklyn Center without first ob-
taining -a permit therefor."
" Section 3 -813 LICENSING
No person, firm or corporation shall engage in the business of
installing, altering or repairing any system for the use of
illuminating or fuel gas or in the installation, altering, or
repairing of any gas burning device connected thereto without
first having procured a license therefor as herein provided,
except that a person, firm or corporation duly licensed as a
plumber by the Village of Brooklyn Center shall not require any
further license to engage in such Fork. Licenses shall be
issued only to individuals or contractors who show a thorough
understanding of the laws and regulations governing the instal -
lation of illuminating or fuel gas systems and gas burning de-
vices and who demonstrate sufficient knowledge, skill and train-
ing to enable them to carry on the work of installing, maintaining,
and altering illuminating or fuel gas systems and gas burning
devices. Application for licenses shall be made to the Village
Council and such license shall be granted by a majority vote *
therefor and upon filing a bond in the amount of $2,000.00 (Two
Thousand and no /100) conditioned upou compliance with the pro -
visions of the Village ordinances. Any person, firm or corp-
oration holding a Class B gas fitters license from the City of
Minneapolis shall be deemed prima facie qualified to obtain a
license from the Village of Brooklyn Center. The annual fee for
such license to engage in such business shall be $25:00 (Twenty-
five and no /100), and $15.00 (Fifteen and no /100) for renewal
thereafter, which license shall expire on April 30 next follow -
ing the date of its issuance. A person, firm or corporation en-
gaged in the business of installing or repairing , heating : plants
who is duly licensed for such purposes by the Village shall not
require a license under this section to install such heating
systems involving the use of gas."
" Section 3 -814 CONSTRUCTION REQUIR 2 , WTS
Every installation, repair or alteration of any gas system
for illuminating or fuel purposes, and every installation,
repair or alteration of any gas burning device connected
thereto shall be made in conformity with the provisions of
the Minneapolis ordinance relating to the installation of
gas systems and gas burning devices as set forth in the
publication entitled 'PLUMBING AND GAS PIPING ORDINANCES
AND EXCRRPTS FROM OTHER ORDERS AND REGULATIONS' as published
by the Department of Buildings of the city of Minneapolis in
1949 and as amended by the ordinances published March 14, 1950"
which ordinances insofar as they relate to construction require -
ments are hereby adopted by reference and three copies of which
shall be kept on file in the office of the Village Clerk. All
installations shall also conform to all rules and regulations
of the state fire marshal."
"Section 3 -815. CORRECTION OF UNSAFE CONDITIONS
The buil ing inspector and the Village fire marshal are hereby
empowered to cause any illuminating or fuel gas system or any
gas burning device connected thereto to be shut off whenever
they shall find that such system or device does not comply
with the requirements of the Village ordinances or whenever
the system for any reason presents an immediate hazard to life

or property. They may attach a warning tag to such system
which states that such system is in violation of the Village
ordinances or constitute an immediate hazard. It shall be
unlawful for any person to cause such system to be placed in
use thereafter until it shall be approved by the building in-
spector in writing."
Section 3 . This ordinance shall be effective from and after its
passage and publication.
Passed by the Village Council of the Village of Brooklyn Center
this 23rd day of July, 1957.

Wayne Gageby, and upon vote being taken thereon the following voted in favor there -

and the following voted against the same: None; whereupon said ordinance was de-
clared duly passed and adopted.
The bills set forth on the schedule attached to these minutes and made a part
hereof entitled "The Bills Audited and Ordered Paid at the Meeting of July 23, 1957"
were audited and ordered paid.
Motion made by Clifford Wellman and seconded by Wayne Gageby to adjourn. Motion
carried.
