Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accountq audited by said Council August 6, 1957 The Village Council met in special session and was called to order by William N. Super, Mayor, at 8:10 p.m. Roll Call: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby, and Russ Jones were present. Motion made by Wayne Gageby and seconded by Carl Carlson to approve the minutes of the special meeting of July 22, 1957 and the regular meeting of July 23, 1957• Minutes were approved as recorded. Motion carried. The Mayor announced that the meeting was open for further consideration of proposed Storm Sewer Improvement No. 1957 -36• The Mayor then called upon all property owners present to present argu- ments either for or against the proposed improvement. After hearing and consider- ing all objections, and the property owners appearing in favor of said improvement, member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SMM IMPROVEMENT No. 1957 -36 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Storm Sewer Improvement No. 1957 -36 2. The plans and specifications for said improvement shall be prepared by Minder Engineering.Co., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson., Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village uphold the recommendation of the Planning Commission and grant Glen Luther permission to build en addition to his present building at 3607 50th Avenue North. Motion carried.' Motion made by Russ Jones and seconded by Carl Carlson that the Village Council uphold the recommendation of the Planning Commission and deny Pearson Brother's request to approve the house at 5520 Halifax Avenue Forth to extend beyond the established building line of Ekberg Drive. Motion carried. Motion made by Wayne Gageby and seconded by Clifford Wellman that the Village Council uphold the recommendation of the Planning Commission and approve the proposed plat of Hjelvik's 2nd Addition, in view of the plat being adjacent to 40 feet of Minneapolis lots and there are other 66 foot lots to the North and East. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby that the Village turn the Fordson tractor and attachments over to the Park Board. Motion carried. �I Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council accept the petition for sanitary sewer on Upton Avenue North from 135' South" of 59th Avenue North to 255' North o f 59t Avenue North. Motion carried. Motion carried. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it .2- can be constructed at an estimated cost of $ -k/so, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minmesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. WHEREAS.. the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $ 31, W19 p° , NOW.. TMHWORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1951. as amended. 2. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota that the Twin City Rapid Transit Co be re- quested to make an extension of the North Fremont bus line extend - ing on the Osseo Road from 47th Avenue North to 63rd Avenue North. '1 Motion for the adoption_ of the foregoing resolution was duly seconded by member Wk Gageby, and upon vote being taken thereon the following voted in favor there- of: 'William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; aftd,tla following voted against the same: None; whereupon said resolution was decIftet duly passed and adopted. Motion made by Carl Carlson and seconded by Clifford Wellman that the Village Council release the bond of Garden City Development Co. on Garden City 3rd Addition in lieu of bond posted by Marvin W. Gordon. Motion carried. Motion made by Wayne Gageby and seconded by Russ Jones that the Village Council approve the fclowing applications for licenses: Electrical Licenses: Jensen Electrical Contractor - 5241 Knox Avenue North- Minneapolis, Minneso8 Plumbing License Axel Newman Heating & Plumbing — 1608 Como Avenue - St. Paul It Minnesota= Well Drilling License Dependable Well Co. - 2527 East 78th Street - Minneapolis, Minnesota Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota on March 28, 1957, Lyon's Construct - ion Co. has satisfactorily completed the following improvement; in accordance with said contract, upon recommendation of the Village Engineer. SAnitary Sewer Improvement No. 1957 -6, Drew Avenue North from 58th Avenue North to 59th Avenue North. NOW,, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota. The work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seedbded by member' Wayne Gageby, and upon vote being taken thereon the following voted to favor thereof, William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and fuss Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. _4_ Metaber Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, Pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota on March 28, 1957, Lyon's Construct - ion Co. has satisfactorily completed the following improvement; in accordance with said contract; upon recommendation of the Village Engineer. Sanitary Sewer Improvement No. 1957-7, Drew Avenue North from 65th Avenue North to the North line of Brooklane Addition. NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; The work completed under said contract is hereby accepted and approved and., BE IT FURTHER RESOLVED that the Village Officials are here - by directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. NOW, THERWORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; The work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are here- by directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by mem- ber Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; The work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by mem- ber Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, Pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota on March 28, 1957, Lyon's Construc- tion Co. has satisfactorily completed the following improvement; in accordance with said contract; upon recommendation of the Village Engineer. Sanitary Sewer Improvement No. 1957 -25, 410' of Kyle Avenue North North of 61st Avenue North. NOW.. THE WORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; The work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. -6- The motion for the adoption of the foregoing resolution was duly seconded by mem- ber Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Carl Carlson that the Village Council accept the July justice report of Raymond Benson. Motion carried. Motion made by Wayne Gageby to adopt the following resolution: RESOLUTION ESTABLISEM 1957 -B IMPROVEMENT FUND BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. There is hereby created a new fund to be known as the 1957 -B Fund. 2. This fund shall be used to finance those improvements within the Village which will be paid for out of the second bond issuetb be sold this year. 3. The officers of the Village are authorized to transfer to the 1957 -B Fund from any funds available for the purpose such monies as from time to time are needed to meet the payments due on the contracts for such improvements. The amounts so trans ferred. shall be reimbursed upon sale and delivery of the bonds. The foregoing resolution was duly seconded by member Clifford Wellman and upon voted being taken thereon, the following voted in favor thereof: William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Clifford Wellman that the Village Council adopt the form entitled 'Undertaking by Developer or CBntractor - Brooklyn Center ". This form of agreement shall be required from the developers in order to implement the platting ordinance. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Village Council increase the plumbing inspector's salary to $398.67 a month as of July 29, 1957• Motion carried. The bills set forth on the schedule attached to these minutes and Made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of August 6, 1957 ", were audited and ordered paid. Motion made by Clifford Wellman and seconded by Carl Carlson to adjourn.
