August 27, 1957
The Village Council met in regular session and was called to order by
William N. Super,, Mayor, at 8:05 P.M.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne
Gageby, and Russ Jones were present.
Motion made by Wayne Gageby and seconded by Carl Carlson to approve the
minutes of the special meeting of July 29 and the regular meeting of August 13,
1957. The Minutes were approved as recorded. The minutes of the August 6, 1957,
special meeting were approved except for the correction of the resolution proT4idj,
for public hearing on proposed sanitary sewer improvement No. 1957 the descr
tion should read as follows:
59th Avenue North from Washburn Avenue North to Upton Avenue North,
Vincent Avenue North from 140 feet South of 59th Avenue North to
150 feet North of 60th Avenue North and Upton Avenue North from
140 feet South of 59th Avenue North to 265' North of 59th Avenue
North.
Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the Village
Council authorize the Village Engineer to negotiate for easement on the Dave
Magnusson property, the amount not to exceed $499.00. Motion carried.
Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION ACCEPTING BID
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that the bid of Lametti & Sons as to the furnishing
of all work, labor, and materials in connection with the following
improvement, according to plans and specifications therefor now on
file in the Office of'the Village Clerk is deemed to be the lowest
and best bid submitted for said work by a responsible bidder, and
said bid is hereby accepted:

The motion for the adoption of the foregoing resolution was duly seconded by mez A�
Clifford Wellman and upon vote being taken thereon, the following voted in favor

Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION ACCENTING BID
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, -that the bid of Northern Contracting Co., Inc.
as to the furnishing of all work, labor, and materials in connection
with the following improvement, according to plans and specifications
therefor now on file in the Office of the Village Clerk is deemed to
be the lowest and best bid submitted for said work by a responsible
bidder, and said bid is hereby accepted:

The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman and upon vote being taken thereon, the following voted in favor
thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ
Jones; and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
Motion made by Russ Jones and seconded by Clifford Wellman that the
Village Council authorize the Village Attorney to write a letter notifying Duane
G. Livingston that they are in violation of the Village Ordinance and are to vacate
same within 30 days. Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the

Village Council accept the final plat of Cameron Manor; subjec t to 1 l restrictions
of the platting ordinance and receipt of bond or certified check. Motion carried.
Member Russ Jones introduced the following resolution and moved its
adoption:
A RESOLUTION ESTABLISHING VOTING DISTRICTS
FOR THE VILLAGE OF BROOKLYN CENTER
Be it resolved by the Village Council of the Village of Brooklyn
Center:
Section 29 -101. The resolutions establishing voting districts
passed on the 9th day of August, 1950, and on the 27th day of April,
1155, are hereby rescinded and in lieu thereof there shall be estab-
lished nine voting districts in the Village of Brooklyn Center, each
district to be numbered and described as follows:
DISTRICT ONE: Bounded by S3rd Avenue North on the South,
Shingle Creek on the West, Highway 1#100 on the North, and
James Avenue North on the East.
DISTRICT TWO: Bounded by the Mississippi River on the East,
53rd Avenue North on the South, James Avenue North on the West,
and on the North by a line beginning at 55th Avenue North ead
James Avenue North extended Easterly to Camden Avenue North
thence Northerly to 56th Avenue North; thence Easterly to the
Mississippi River.
DISTRICT THREE: Bounded on the South by a line beginning at
55th Avenue North and James Avenue North extended Easterly
to Camden Avenue North; thence Northerly to 56th Avenue North;
thence East to the Mississippi River, on the East by the
Mississippi River, on the North by a line beginning at 59th
Avenue North extended and the Mississippi River extending
Westerly to Humboldt Avenue North; thence Southerly to 57th
Avenue North; thence Westerly to James Avenue North, and on
the West by James Avenue North.
DISTRICT FOUR: Bounded on the East by the Mississippi River;

on the South by Highway 100; on the West by Shingle Creek;
and on the North by 73rd Avenue North.
DISTRICT SIX: Bounded on the East by Shingle Creek; on the
South by 57th Avenue North; on the West by Osseo Road; and
on the North by 69th Avenue North.
DISTRICT SEVEN: Bounded on the North by 73rd Avenue North;

61st Avenue North, on the East by a line beginning at 61st
Avenue North and Osseo Road extending Northerly to 69Th
Avenue North; thence Easterly to Shingle Creek; thence
Northerly to 73rd Avenue North.

on the West ay the West Village limits; on the South by a
line beginning at 57th Avenue North and the West Village limits
extending Easterly to Major Avenue North; thence North. to 58th

to France Place; thence Easterly to France Avenue North; thence

Section 29 -102. The new voting districts shall be in full force and
effect sixty days after posted notice taereof as prescribed by law.
The motion for the adoption of the foregoing resolution was duly seconded by member
Wayne Gageby and upon vote being taken thereon, the following voted in favor thereof:
William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and
the following voted against the same: None; whereupon said resolution was declared
duly passed and adopted.
Motion made by Wayne Gageby and seconded by Carl Carlson that the Village
Council approve the following application for licenses:

Motion made by Carl Carlson and seconded by Wayne Gageby that the Village
Council accept the petition for sanitary sewer on Zenith Avenue North between 59th
Ave.aue North and 60th Avenue North. Date of hearing to be set later. Motion

Village Council accept the deed from the University of Minnesota for park purposes

Motion made by Clifford Wellman and seconded by Carl. Carlson that tiic
Village Council authorize the Village Engineer a Village Attorney to negot3ntc w

u.obinsdale for water for fire protection for the Cook Paint Company property. Coa-
cfIuction cost to be borne by the Cook Paint and Varnish Co. The Village of Brook
lya Center will re -bill Cook Paint and Varnish Co. for the use of the water. M ?t.on

Member Wayne Gageby introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE
OF $350,000 IMPROVEMEBT BONDS
WIMM, the Village Council has entered into contracts for the
construction of Storm Sewer Improvement No. 1957 -34, Sanitary
Sewer Improvement Nos. 1957 -20, 1957 -21, 1957 - 1957 -25,
1957 -26, 1957 -27, 1957 -29 and 1957 -32, Water Main Improvement
Nos. 1956 -42, 1956 -50, 1957 -22, 1957- 2k,and 1957{-31, and
Oiling Improvement Nos. 1957 -35 and 1957 -37, all under the
provisions of Chapter 398, Laws of Minnesota 1953, as
amended,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. It is hereby determined that the total cost of
each of the improvements heretofore commenced is as follows:
For the construction of:

the aggregate cost thereof being determined to
be approximately $350,000.00
2. It is hereby determined that the total cost of each
of said improvements shall be assessed upon property
benefited by the improvement. The Clerk shall forthwith
calculate the proper amount to be specially assessed for
the improvements against every assessable lot, piece or
parcel of land within the district affected, without regard
to cash valuation, based upon the benefits received.

3. It is hereby deternized to finance the entire cost
of said improvements by the isouance of improvement bonds.
4. There is hereby created a special fund to be desig-
nated as Improvement No. 1957 Fund out o f w hich shall be
paid the cost of the said improvements and the principal
and interest on the Improvement Bonds authorized hereunder
and into which shall be paid all of the proceeds of the
special assessments and taxes to be levied for said
improvement and the moneys received from the sale of Improve
ment Bonds.
5. In anticipation of the collection of said special
assessments and taxes, the village shall forthwith issue and
sell $350,000 Improvement Bonds. The full faith and credit
of the village shall be pledged for the payment of the prin-
cipal and interest on the bonds when the moneys on hand in
the Improvement No. 1957 -B Fund are insufficient for the
purpose.
b. The Improvement Bonds shall be 350 in number and
numbered 1 to 350, both inclusive, in the denomination of
$1,000 each, shall bear date October 1, 1957, shall bear
Interest payable July 1, 1958, and semiannually thereafter on
January 1 and July 1 in each year. Said bonds shall mature
serially on January 1 in the years and amounts as follows:

Motion made by Carl Carlson and seconded by Clifford Wellman that th-
Tillage Council release the street bond on Homedale lst Addition in the amount of
$5,416.48, upon the recommendation of the Village Engineer. Motion carried.
Motion made by Wayne Gageby and seconded by Clifford Wellman that the V ?a
C allow Pioneer Realty to erect a sign on the Southeast corner of 63rd any
Osseo Road for the period of one year. Motion carried.
Motion made by Clifford Wellman and seconded by Wayne Gageby to accept the
petition for the vacation of a portion of 57th Avenue North described as follows:
57th Avenue North from State Highway No. 152 (Osseo
Road) to a point 2666.81 feet East of the intersection
of the centerline of said 57th Avenue North and the
Westerly right -of -way line of said State Highway No. 152.
Pr ?bl c hearing was set for September 24, 1957, and the Village Attorney was instructec
to publish the same. Motion carried.
Motion made by Russ Jones and seconded By Wayne Gageby that the Village
Council authorize the Village Engineer to negotiate for the plumbing and piping on
the new pump house, due to the emergency involved, such as the lateness of the year.
The amount not to exceed $5,000.00. Motion carried.
Mr. H. R, Jones introduced the following resolution and moved its adoption:
RESOLUTION RELATING TO PARTICIPATING IN RURAL
RM EPIN COUNTY NURSING DISTRICT.
WHEREAS, pursuant to Minnesota Statutes, Sections 145.08 and 145.12 provi-
sion has been made for a public health nursing district in that portion of Hennepin
County outside the City of Minneapolis, and
WHEREAS, pursuant to such authority such a public health nursing district
has been organized and has been in operation for several years, and
WHEREAS, it is deemed necessary to continue the operation of such nursinU
district and to provide it with adequate funds for its proper operation.
NOW, THEREFORE, BE IT RESOLVED by the governing body of
Village of Brooklyn Center that this political subdivision
continue to be included in the public health nursing dis-
trict of rural Hennepin County, organized on January 4,
1952; that it participate in the benefits thereof; and
that it agrees to support on an apportionment basis its
pro rata share of the cost of the administration of such
district provided, however, that for the period January 1,
1958 to December 31, 1960, this cost shall not exceed in
any one year $.47 per capita on the basis of the official
1950 Federal Census.
BE IT FURTHER RESOLVED, that this resolution shall be
deemed an agreement to continue to participate in such
nursing district on the basis hereinbefore specified

with all other political subdivisions adopting similar
resolutions.
The motion for adoption of the foregoing resolution was seconded by Clifford Wellman.
