HomeMy WebLinkAbout1957 09-10 CCM Regular Session 1 of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council September 10, 1957 The Village Council met in regular session and was called to order by William N. Super, Mayor, at 8:00 p.m. r Roll Call: William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones were present. Motion made by Clifford Wellman and seconded by Wayne Gageby to approve the council meeting minutes of the regular session of August 27, 1957 Minutes, . were approved as recorded. Motion carried. The Mayor announced that the Council was met to receive, open and consider bidsfor village pump house. An affidavit was presented showing publication of advertisement for bid.:; in accordance with law and ordered placed on file. The sealed bids which had been received were then presented. These were opened, examined, and found to be as follows: D. W. Harsted Co., Inc. 6870 Channel Road N.E. $` 5,890. 00 Mork- Campion, Inc. 6418 Bass Lake Road 8,875.00 Great Western Construction Co. 2115 Chicago Avenue 8,823.00 Olof Pearson 2812 Pleasant Ave 7,335.00 Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bid of D. W. Harstad Co., Inc., 6870 Channel Road N.E., Minneapolis, Minnesota, for constructing a - village pump house, as to specifications, is hereby found, determined, and declar to be the lowest and best bid submitted by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby and on g Y upon vote being taken thereon the following voted in favor thereof William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the eame None; whereupon said resolution was declared duly passed and adopted. The Clerk produced an affidavit of pu�l.icati.on of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the Last publication being on August 29, 1957, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member C;.ifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMMOVEMENT NO. 1957-38 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RE'SQVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: I. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary sewer on Upton Avenue North from 135' South of 59th Avenue North to 255' North of 59th Avenue North and 135' South of 59th Avenue North on Vincent Avenue North to 135' North of 60th Avenue North. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof. William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed: Sanitary sewer on O'Henry Road from Beard Avenue North to Xerxes Avenue North, 64th Avenue from Beard Avenue North to Xerxes Avenue forth and Poe Road from Beard Avenue North to O'Henry Road. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Co., Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereop the following voted is -2- favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: Done; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1957 -44D. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the'last publication being on August 29, 1957, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. Motion made by Wayne Gageby and seconded by Clifford Wellman to uphold the recommendation of the Planning Commission to accept the proposed plat of \ Donny Construction Co,- subject to all restrictions of the platting ordinance and signed agreement of L, Donnay, which reads as follows:' "The undersigned, L. A. Donna hereby agrees that Y, Y gr ha he will donate to the Public, for park purposes, the area shown on the master plan of the proposed 'Donnays Brook Lyn Gardens' as 'Park' provided � that the freeway does not take more than the north 330 feet thereof and provided further that the Village assumes the proportion of the special assessments that would otherwise have been assessed against k the 'Pam# area." Donnay Construction Co. is also allowed to construct two model houses at 63rd Avenue North and Berry Avenue North. Motbn carried Motion made by Russ Jones and seconded by Qarl Carlson to uphold the recommendation of the Planning Commission and allow George Macko to divide hi property into four parcels by Registered Land Survey. Motion carried. Motion made by Carl Carlson and seconded by Clifford Wellman to uphold the recendation of the Planning Commission and allow Mary Balfany to construct a home at 3600 55th Avenue North within 112 feet of Sailor Lane. Motion carried. Enkers to divide Lots 7 and 8, Block 1, Homedale Addition into two lots facing on 63rd Avenue North. Motion carried. Motion made by Wayne Gageby and seconded by Carl Carlson to uphold the recommendation of the Planning Commission and deny Don Anderson's request to,build a garage extending 7 feet in front of his house. Motion carried. Motion made by Clifford Wellman and seconded by Carl Carlson to uphold the recommendation of the Planning Commission and allow the Faegre Co...3615 50th Avenue North, to use box car for storage for the period of one year; subject to cleaning up the premises by September 16, 1957, 8 o'clock p.m. An inspection is to be made by the Fire Marshal and Building Inspector and a written report made to the Village Council by September 16th. If the inspections are not satisfacto-y, the permit for one year will be automatically cancelled and the building will have to be removed Wthin 30 days. Motion carried. Nation made by Wayne Gageby and seconded by Russ Jones to authorise the Village Engineer to hire a test drilling rig to make ,a survey of the water tW.)I.e in the distress area between Highway #100 and 60th Avenue North. Motion carried. Motion made by Wayne Gageby and seconded by Carl Carlson that the Village Council accept the petition for storm sewer on 5th Avenue North and Camden Avenue North, North of 65th Avenue North. Motion carried. Motion made by Russ Jones, and seconded by Clifford Wellman that the Village Council accept the petition for sanitary sewer on Abbott Avenue North from 59th Avenue North to 60th Avenue North. Motion carried. Member Russ Jones introduced the following resolution and-moved its adoption: RESSOLUTION FOR HEARING ON PROPOSED ASSESSMENT BE IT RESOLVED BY THE VILLAGE COUNCIL of the Village of Brooklyn Center, Minnesota, as follows: 1. A hearing shall be held on the 8th day of October, 1957 in the Village Hall at 8 o'clock . to ass on proposed assess- g 1 P m P uP P P ments of improvements and at such time and place all persons owning property affected by such improvement will be given an opportunity to be.heard with reference to such assessment. 2. The Village Clerk is hereby directed to cause a notice , of the hearing on the proposed assessments to be published once in the official newspaper at least two weeks prior to the hearing, and he shall state in the notice the total cost of the improvement. 3. Said notice shall include the following improvements: Sanitary Sewer Improvement Nos. 1957 -4, 1957 -5, 1957 -61 1957 -7, 1957-8, 1957 -10, 1957 -14, 1957 -17, 1957 -20, 1957 -21, 1957 -23, 1957 -25, 1957 -26, 1957 -27, 1957 -29, 1957 -32; Storm Sewer Improvement Nos. 1956 -57, 1956 -58, 1957 -9; Water Main :improvement Nos. 1957 -1, 1957 -2, 1957 -3, 1957 -11, 1957 -15, 1957 - 22, 1957 -24, 1957 -31; and Oil Stabilizing Improvement Nos 1957 -16, 1957 -35, 1957 -37; and sanitary sewer connections w2lch have heretofore been made. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof: William N. Motion carried. -4- Motion made by Russ Jones and seconded by Carl Carlson that the Village hire Hanley, Zimmerman, and Moen to make an'annual audit of the Liquor Store, Public Utilities and Village accounts. Motion carried. Member Russ Jones introduced the following resolution and moved its adoption: A RESOLUTION DESIGNATING POLLING PLACES FOR SPECIFIC DISTRICTS WITHIN THE VILLAGE OF BROOKLYN CENTER BE IT RESOLVED by the Village Council of the Village of Brooklyn Center That the following polling places be designated for each i lk district as provided in Section 29 -101 of the Village Ordinances:. DISTRICT ONE: Church of Triune God 5827 Humboldt Avenue North DISTRICT TWO: Harron Church 55th & Dupont Avenue North DISTRICT THREE: Brooklyn Center Baptist Church 5840 Humboldt Avenue North DISTRICT FOUR: Earle Brown School 5900 Humboldt Avenue North DISTRICT FIVE: Village Hall 6445 Lyndale Avenue North DISTRICT SIX: Garden City Office 6300 Osseo Road DISTRICT SEVEN: Willow Lane School 7020 Perry Avenue North DISTRICT EIGHT: Northport School 5421 Oseeo Road DISTRICT NIM: Brookdale Covenant Church 5139 Osseo Road The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the fol.lowitg voted in favor thereof: William N. Motion made by Russ Jones and seconded by Carl Carlson that the Village Council accept the August justice report of Ray Benson. Motion carried. Motion made by Carl Carlson and seconded by Clifford Wellman that the Village Council approve the electrical license of Plymouth Electric Co., 1938 Glenwood Parkway, Minneapolis, Minnesota. Motion carried. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Lametti & Sons, Inc., has satisfactorily completed the following improvement in accordance with said contract, upon the recommendation of the Village Eingineer: Storm Sewer Improvement No. 1956 -57 _5_ NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center The work completed under said contract is hereby accepted and approved and, a- BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by rnmber Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION SUBSTITUTING EM MIT KALLEBERG IN PLACE OF DALE CURRY FOR PURPOSES OF HANDLING INVESTMENT SECUR TIES BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. The resolutions heretofore adopted by the Village Council on January ll, 19556, authorizing Dale Curry as Village Accountant to carry out the instructions of the Mayor and Clerk with respect to the sale, exchange, delivery or other disposition of securities which may be purchased from time to time and deposited with the Northwestern National Bank of Minneapolis, such resolutions further authorizing Dale Curry as Village Accountant to be the agent of the committee consisting of the Mayor, Clerk and Village Accountant, are hereby supplemented and amended so as to strike the name of Dale Curry and insert in lieu thereof the name of Kermit Kalleberg in his capacity as the new accountant for the Village of Brooklyn Center. 2. A copy of this resolution may be certified to the Northwestern National Bank of Minneapolis if necessary. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR STORM SEWER IMPROVEMENT NO 1957.33 AND DIRECTING ADVERTISEMENT FOR BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Storm Sewer Improvement No. 1957 -33 prepared by Minder Engineering Co., Engineer, are hereby approved and ordered filed with the Clerk. 2. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than three weeks prior to the date for receipt of bids_ Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. -6- 3. Bid date is set for October 15, 1957• The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Weliman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereupon said -resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS } FOR STORM SEWER IMPROVEMENT NO. 1957 -36 AND DIRECTING ADVERTISEMENT FOR BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for Storm Sewer Improvement No. 1957 -36, prepared by Minder Engineering Co., Engineer, are hereby approved and ordered filed with the Clerk. 2. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not Less than three weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Bid date is set for October 15, 1957• The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, and Carl Carlson; and the following voted against the same: Russ Jones; whereupon said resolution was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village engage the planning services of Carl L. Gardner and Associates and Thorshov and Cerny, Inc., for an additional six months and for a cost of $1,200. This is to cover necessary planning work in connection with the interstate freeway program, assistance in putting the new zoning ordinance into operation, and routine consult- ant services with respect to subdivisions, rezoning requests, and other planning questions that come before the Planning Commission. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of September 10, 1957" were audited and ordered paid.
