HomeMy WebLinkAbout1957 10-29 CCM Special Session Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota October 29, 1957 The Village Council met in special session and was called to order by William N. Super, Mayor, at 8:05 P.M. Roll Call: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson and Russ Jones were present. Member Russ Jones introduced the following resolution and moved its ' adoption: ESfl RESOLUTION ACCEPTING BID BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, thatfoe bid of Lametti & Sons as to the fur- nishing of all work, labor, and materials in connection with the following improvement, according to plans and specifications therefor now on file in the Office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a re- sponsible bidder, and said bid is hereby accepted: 195T -38 $22,525.00 The motion for the adoption of the foregoing resolution was duly seconded by amembw Wayne Gageby and upon vote being taken, thereon, the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution vas declared duly passed and adopted. Member Wayne Gageby introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING SID BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the bid of Randall Brothers as to the furnishing of all work, labor, and materials in connection with the following improvements according to plans and specifications therefor now on file in the Office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a res- ponsi'61e bidder, and said bid is hereby accepted: 1957 -39 $13,288.75 1957 -40 21,842.60 The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted in favor there-. of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. - _Whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR STEEL GARAGE BUILDING AND DIRECTING ADVERTISEMENT FOR BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for a rigid steel garage building, prepared by Village Engineer, are hereby approved and ordered filed with the Village Clerk. 2. The Clerk shall advertise for bids for such a build- ing by publication at least once in the official newspaper and in the Construction Bulletin, the date of the first publica- tion not less than ten days prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposits bid bond, cashier's check or certified check payable to the Village Clerk in the amount of not less than five per cent of the bid. 3. Bid date is set for November 12, 1957• The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Clifford Wellman that the Villag. Council approve the following license application: Plumbing License: Jarnig Plumbing & Heating Co. - Anoka, Minnesota Motion carried. Motion made by Clifford Wellman and seconded by Wayne Gageby approving the appointment as judges and clerks for the village election to be held December 3 1957 of those persons whose names are set forth on the attached list, marked q exhibit A, which list is made a part of these minutes. The judges and clerks are to be paid $1.00 per hour, and the Polls shall be open from 7 o'clock A.M. to 8:00 o'clock P.M. Motion carried. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOUMON ACCEPT730 WORK WHEREAS, Pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota on September 1, 1957, Northern Contracting Co. has satisfactorily completed =the following improvement; in accordance with said contract; based upon the recommendation of the Village Engineer and Consulting Engineer. Sanitary Sewer Improvement No. 1957 -32 N0W.. THMMORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; the work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption: s MOUITION ACCEPTING WORK WHEREAS., Pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota on September 3, 1957, Northern Contracting Co. has satisfactorily completed the following Im- provement; in accordance with said contract; based upez the recommendation of the Village Engineer and Consulting Engineer. Water Main Improvement No. 1957 -31 -2- NOW, 'THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: The work completed under said contract is hereby accepted and approved and, BE IT FURTHER RESOLVED that the Village Officials are hereby directed to issue a proper order for the final payment on such contract, taking the contractor's receipt in full. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Carl Carlson and seconded by Clifford Wellman that the Village Council release $1151.00 cash escrow of M. C. Balfany for improvements in Balfany's Northport 2nd Addition. Balance to be retained in escrow by the Village. Motion carried. Motion made by Carl Carlson and seconded by Russ Jones to pass the follow- ing resolution: RESOLUTION AUTHORIZING SETTS WITH CRO19STR 6 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as Follows: 1. It appears from the files in the village office that a number of heating installations have been made by Cronstroms Heating & Sheet Metal, Inc. from time to time which in some cases occurred without the securing of a permit as required by ordinance. 2. This matter has been discussed at length between the representatives of dronstrom; and the officials of the village and their legal counsel, and it is determined that in order to settle the dispute with Cronstroms as to the amounts owing fox those installations for which permits have not been taken, that permits may be issued upon payment of the following fees: (a) For those installations commenced prior to April 11, 1955 a permit fee shall be issued upon payment of $5.00 for each such installation, said fee being the amount then required under the ordin- ance and it appearing that in good faith Cronstroms Heating &Sheet Metal, Inc. may not have been aware of the requirement for permits prior to such time. (b) For those installations commenced between April,ll, 1955 and April 18, 1957 a double fee shall be charged in the amount of $10.00, it appearing that during this interval Cronstroms was aware of the re- quirement for licenses and permits and no valid excuse exists for their failure to secure the same, the date of April 18, 1957 being the date of the publication of an ordinance establishing new Pees for such installations. (c) For those installations commenced between April 18, 1957 and August 29, 1957, a tee of $13.25 shall be charged for each permit or such other amount as is required by the ordinance published on April 18, 1957, but no double permit shall be required in con - nection therewith, it appearing that a number of per - mits were held up by Cronstroms Heating & Sheet Metal, Inc. under the belief that the Village might reconsider the ordinance adopted April 18, 1957 which established a higher fee schedule. -3- (d) For those installationa commencing after August 29, 1957 for which no permit was taken out as required by ordinance, a double fee shall be charged for all such permits based upon the- prevail- ing schedule under the amendment to the ordinance published April 18, 1957, it appearing that Cron- stroms had no valid excuse or reason justifying their failure to take out permits after said date, there having been a conference with Cronstroms on said date in which Cronstroms was informed that no change in the higher fee schedule was contemplated'. 3. The foregoing is regarded as a policy established to achieve a settlement with Cronstroms Heating & Sheet Metal, Inc. to which it has agreed. In the event that Cronstroms fails to secure all of the permits for all installations made since the village ordinance was originally adopted requiring permits for heating installations, then and in that event the village shall, not be bound by this resolution and may elect to pursue such l remedies as it has under the ordinance and laws of this state ` without reference to this resolution. Motion carried. Motion made by Russ Jones to commit the Village of Brooklyn Center to make the 'following improvements in accordance with the resolution heretofore identi- fied as Improvement Commitments for VA Loan Purposes. Said resolution shall have inserted in it the following :, Property to be improved: Lang's Addition Estimated cost: $1,580.00 Date of Completion: 12 months Improvements to be made: Road building of 154' of Perry Avenue North and 600' of 71st Avenue North, within Lang's Addition, Brooklyn Center, Minnesota. Builder: R. F. Lang Construction Co. The foregoes motion was duly seconded by member Wayne Oageby, and upon -vote being taken there.: the following voted in favor thereof: William N. Super, Clifford Wellman, Waym Gageby, and Russ Jones; and the following voted against the same: None. Wheren said resolution was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Carl Carlson to adjourn. Motion carried.
