Minutes of the proceeding of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota, including all accounts audited
by said Council.
November 26, 1957
The Village Council met in regular session and was called to order by
William N. super, Mayor, at 8:05 p.m.
Roll Call: William N. Super, Clifford Wellman, Carl Carlson, and Russ
Jones were present. Wayne Gageby came to the meeting at 10 :30 p.m.
Motion made by Clifford Wellman and seconded by Carl Carlson that the
following minutes be approved as recorded: Regular meeting of October 8th, special
meeting of October 15th, regular meeting of October 22nd, special meeting of October
29th,special meeting of November 5th, regular meeting of November 12th, and special
meeting of November 14th. Motion carried.
Member Wayne Gageby introduced the following resolution and moved its adoption
RESOLUTION ACCEPTING BID
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, that the bid of Wallace & Tiernan, Inc., as
to the furnishing of a mechanical diaphragm solution feed chlo-
rinator, as to specifications, for $1724.00 is deemed to be the
best bid submitted by a responsible bidder for village purposes,
and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by member
Carl Carlson, and upon vote being taken thereon the following voted in favor thereof:
William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones; and
the following voted against the same: None; whereupon said resolution was declared
duly passed and adopted.
Member Russ Jones introduced the following resolution and moved its
adoption:
RESOLUTION ESTABLISHING WORKING CONDITIONS, WAGES,
AND HOURS FOR PUBLIC WORKS DEPARTMENT EMPLOYEES.
WHEREAS the Village Council feels that it is for the best interest
of the Village of Brooklyn Center, the Public Works Department
Employees, and their designated bargaining representative, Local
No. 49, International Union of Operating Engineers, AFL -CIO, for
the purpose of establishing conditions of employment of the em-
ployees of the Public Works Department, and to insure a friendly
spirit of cooperation between the Village, its employees, and
their designated bargaining representative, and to avoid disruption
In the service and operation of the Public Works Department and to
secure the benefits intended to be derived by the Village, its
employees, and their designated bargaining representative to adopt
the hereinafter set out rules and regulations governing the employ-
ment and working conditions of the employees of the Public Works
Department,
Now, THBdt WM.. be it hereby resolved by the - VillageCouncil, that
the following rules and regulations covering the employment of the
employees of the Public Works Department be adopted and placed in
effect as follows; to wit:
.ARTICLE I
Recognition
The Village agrees to recognize Local 49, International Union of
Operating Engineers, AFL -CIO, as the bargaining representatives
of all employees employed in the Public Works Department.
ARTICLE II
Wages
CLASSIFICATIONS ,Tanuary., 1958
Street Department
Foreman $2•95 per hour.
Mechanic 2.70 per hour
Heavy Equipment Operator 2.70 per hour
Light Equipment Operator 2.37 per hour
Public Works Maintenance Man (Laborer) 2.17 per hour
Utilities Department
Supervisor of Utilities $2.80 per hour
Water and Sewer Maintenance Man 2.42 per hour
Provided, however, that the employee hired as temporary laborer in either
of the Departments will receive $2.10 per hour for the first sixty (60)
days of employment. Thereafter, he shall receive the above specified
rate for Public Works Maintenance Man.
Personnel operating the following equipment shall be classified as heavy
equipment operators: Patrol, rubber tired loader (over 30 horsepower),
sweeper, crawler tractor, self - propelled seaman mixer.
Personnel operating the following equipment shall be classified as light
equipment operators: Trucks, tractor mowers, self - propelled rollers
compressor and attachments, rubber tired loader (under 30 horsepower,
distributer, broom.
Personnel employed as Public Works Maintenance Man shall not operate any
trucks or power driven equipment other than a pick up truck or sewer
cleaning equipment.
ARTICLE III
Seniority
A policy of seniority shall be formulated that will give employees with
longer periods of service an opportunity for promotion and also give all
employees a feeling of security.
In the event of lay off due to lack of work in either of the depart-
ments, employees with the least seniority in that department shall be
the first to be laid off, and in the event of rehire, the last employee
laid off shall be the first to be rehired.
In the event of a job opening within a department, the job should be
announced by bulletin and the oldest employee in that department should
be given opportunity to step up for promotion.
Employees in both departments shall not be reduced in pay scale when
assigned work of a lower classification. Employees performing work of
a higher pay classification shall receive the wage scale prevailing
for the higher classification.
No employee shall be laid off out of turn on the seniority list.
In the event of discharge, the employee or his representative shall be
entitled to a hearing before the VillageCouncil. If it is determined
that the employee has been unjustly discharged, he shall be reinstated
at once and all Wages and other benefits lost during his time off shall
be credited to him.
ARTICLE IV
Hours
1. The regular work day for employees shall be eight (8) hours.

2. The minimum work week for employees shall be Forty hours.
3. The average work month for employees for purposes of computing
vacations., sick leave and fractions of a month's work shall be
one hundred seventy -three (173) hours.
ARTICLE V
Overtime
1. Overtime shall be allowed and paid to any employee on the basis of
one and one -half times the regular rate of pay computed on an hourly
basis when overtime employment is directed by a responsible super-
visor.
2. Overtime for an employee is defined as work beyond eight (8) hours
in any one day, forty (40) hours in any one week and for work
performed on Saturdays Sundays, and legal holidays or days
observed as legal holidays.
3. Overtime for all employees shall be paid as it is earned.
4. An employee called back to work after he has completed his regular
work day or called out on his day off shall receive a minimum of
two hours '
pay at the overtime rate.
ARTICLE vI
Amendment
Amendment may be made at any time to this resolution by the Village
Council.
ARTICLE VII
Effective Date
This resolution shall be considered to have been in full force and effect as
of January 1, 1958.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super Carl Carlson.. Wayne Gageby Clifford Wellman, and Russ
Jones; and the following voted against the same: None. Whereupon said resolution
was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION
WHEREAS., The Board of County Commissioners of Hennepin County
pursuant to Chapter 943., Laws Minnesota 1957, did, on November 19,
1957, adopt a resolution rescinding the dedgnation of all state
aid roads theretofore designated as such within the County of
Hennepin; Pi s and
WHEREAS, the said Board of County Commissioners did, on the dame
date, adopt a resolution designating certain roads and streets
lying within the County of Hennepin as County State Aid Highways;
and
WHEREAS., attached hereto and made a part hereof is a 25 page list
containing descriptions of County State Aid Highways numbered 1

and 156 as designated by the Board of County Commissioners of
Hennepin County; and
WHEREAS, portions of the state aid roads whose designation as

such was rescinded and portions of the roads and streets desig -,
nated as County State Aid Highways as aforesaid lie within the
corporate limits of the Village of Brooklyn Center.
NOW, THERE'F`ORE, Be it resolved by the Village Council of the
Village of Brooklyn Center that the resolutions of the Board
of County Commissioners of Hennepin County rescinding the
designation as such of all state aid roads within the County
of Hennepin and designating certain roads and streets within
the County of Hennepin as County State Aid Highways, portions
of which streets and roads and state aid roads lie within the
corporate limits of the Village of Brooklyn Center, and such
rescission as state aid roads and designation as County State

The motion for the adoption of the foregoing resolution was duly seconded by member
Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof
William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones; and
the following voted against the same: None. Whereupon said resolution was declared
duly passed and adopted.
Motion made by Clifford Wellman and seconded by Wayne Gageby that the
Village Council allow Norman Chazin to construct two model homes on Noble Avenue
North at approximately 72nd Avenue North. Motion carried.
Motion made by Wayne Gageby and seconded by Carl Carlson that the Village
Council reduce the street bond requirements of Robert Hanson from $2960 to $1000,
upon the recommendations of the Village Engineer. Motion carried.
Motion made by Clifford Wellman and seconded by Wayne Gageby that the
Village Council accept Vern Donnay's final plat entitled "Donnay's Brook Lyn
Gardens "; subject to posting a street bond and provisions of Platting Ordinance.
Motion carried.
Member Russ Jones introduced the following resolution and moved its adop-
tion:
RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE
OF . $200,000 WATER IMPROVEMENT REF WING BOND.

WHEREAS, the Village Council has heretofore sold, issued,
and delivered improvement Bonds of 1956 dated July 1, 1956 in
the amount of $525,000.00 said bonds bearing interest at the
rate of 4% per annum, said interest being payable on January 1
and July 1, 1957 and January 1, 1958, all of said bonds being
payable on January 1, 1958, and
WHEREAS, said bonds were issued at said time in antici-
pation of substantial prepayments on the special. assessments
which were spread against the properties benefited by Water
Improvement No. 1956 -19, and
WHEREAS, there has been paid into the 1956-B Improvement
Fund sufficient monies which, in addition to meeting the interest
payments recited above, will enable the payment of $125,000 of
the principal amount of said bonds, and
WHEREAS, there are sufficient monies on hand in the
Investment Trust Fund of the Village to purchase $200,000of
said Improvement Bonds to be held after maturity by said
investment trust fund at the stated interest rates, and
WHEREAS, in accordance with the prior intention of the
Village Council, the Village Council now proposes to meet the
balance of the principal due on January 1, 1958 in the amount
of $200,000 by the issuance of refunding bonds,
NOW, THEREFORE., BE IT RESOLVED by the Village Council
of the Village of Brooklyn Center, as follows:
A.
1. To provide monbs for the payment of the balance thereof
due on January 1, 1958, the Village Council hereby deter*
mines to finance the payment of said balance by the
Issuance of refunding bonds.
2. The refunding bonds shall be 200 in number and numbered
1 to 200, both inclusive, in the denomination of $1000
each, shall bear date Janury 1, 1958, shall bear inter-
est payable July 1, 1958 and semi - annually thereafter on
Juanuary 1 and July 1 in each year to maturity. Said
bonds shall mature serially on January 1 in the years
and amounts as follows:
$50,000 January 1, 1959
50,000 January 1, 1960
50,000 January 1, 1961
$50,000 January 1, 1962
The full with and credit of the Village will be pledged
to payment of the bonds.
3. The Village Council shall meet at the Village Hall in the
Village on Tuesday, the 10th day of December, 1957, at
8:00 p.m., for the purpose of receiving sealed bids for
the purchase of said bonds and the village clerk is
authorized and directed to cause notice of the sale of
said bonds to be given by publication ten days in Com-
mercial West, a financial paper published in Minneapo-
lis, Minnesota. Said notice shall recite that the village
will furnish printed bonds and approving legal opinion of
Messrs. Faegre & Benson, Minneapolis, Minnesota, both
without expense to the purchaser, shall require that all
bids be unconditional and accompanied by a good faith
check in the amount of at least $4,000.00 and shall spe-
cify one or more interest rates in multiples of one-
tenth or one- quarter of one percent. Said notice shall fur-
ther provide that delivery of the bonds will be made by the
village within thirty days after the date of sale at the
office of the village clerk or, at the option of the pur-
chaser, at Minneapolis or St. Paul without expense to the
purchaser.
The motion for the adoption of the foregoing resolution was duly seconded by member
Clifford Wellman, and upon vote being taken thereon the following voted in favor
thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ
Jones; and the following voted against the same: None. Whereupon said resolution
was declared duly passed and adopted.

Motion made by Clifford Wellman and seconded by Carl Carlson that the Village
Council accept the sewer and water petitions for Chowen Avenue North and Beard
Avenue North from 63rd Avenue North to the North line of Lawnridge Addition.
Motion carried.
