Super, Mayor, at 8:00 P.M. Roll Call: William N. Super, Carl Carlson, Wayne Gageby, Clifford Wellman, and Russ Jones were present. Motion made by Clifford Wellman and seconded by Wayne Gageby that the Village Council, approve the regular council meeting minutes of November 26, 1 957 a s recorded. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council refer the Kenneth Krogh petition to bd1d a garage extending four Peet in front of his house at 5918 Pearson Drive back to�the Planning Commission for further consideration. Motion carried. The Mayor announced that this was the time and place for receipt of bids for the purchase of $200,000 Water Improvement Refunding Bonds in accordance with the resolution adopted November 26 1957• The Clerk presented an affidavit showing publication of Notice of Sale in Onmercial West, a financial paper published in Minneapolis, Minnesota, which affidavit was examined and found satisfactory and ordered placed on o th 3 ntheNr vt public w a sfactor affidavit of file t with sat s g Y Hennepin Post. The Clerk then presented the sealed bids which had been received, which were opened and examined and found to be as follows: Name of Bidder Interest Rate Amount of Bid 1. John Nuv & Co. 3.6% on all bonds maturing $200,006.00 & Associates 1/1159 to 1/1162 inclusive; plus 1% From the period from 2/1/58 to 1/1/59 After due consideation of all of said bids and upon the recommendation of the Village Attorney, member Carl Carlson introduced the following resolution and moved its adoption: BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnowta, that the bid of Kalman and Compimy, Inc. and Ates to purchase $200,000 Water Improvement Refund fonds bearing interest at the rate of 3.30% per annum 1L11 bonds moturing January 1, 1959 to January 1, 1962 inclusive togetbor with an additional coupon of 1.20% on all bonds for tho period from February 1, .'1958 to January 1, 1959, and to pay therefor the sum of $200,000.00 is breby found, determined and declared to be the most favorable bid and is he eby accepted. The Clerk.is directed to retain the check of sa1d purchase and return all other checks to the unsuccessful bidders forthwith. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor thereof William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereuponsaid resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: j BE IT RESOLVED by the Village Council of the Village.of Brooklyn ` Center, Minnesota, as follows: 1. The village shall forthwith issue its negotiable Refunding Bonds in the principal amount of $200,000 dated January 1, 1958 being 200 in number and numbered 1 to 200, both inclusive, in the denomination of $1000 each bearing interest at the rate of 3. per annum for all bonds for the period from January 1, 1958 to February 1, 195$, 4.50% for the period from February 1, 1958 to January 1, 1959 to be repre- sented by separate coupons in the amount of 3.30% and 1.20°, and 3.30% thereafter, said bonds maturing serially in the years and amounts as follows: $50,000 on January 1 each year 1959 to 196 inclusive, with no prepayment option., 2. Both principal and interest shall be payable at the main office of the Northwestern National Bank of Minneapolis, Minneapolis, and the village shall pay the reasonable charges of said bank for its services as paying agent. 3. The bonds and interest coupons to be thereto attached shall be in substantially the following forms No. $1000. UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF HENNEPIN VILLAGE OF BROOKLYN CENTER WATER IMPROVEMENT.' REFUNDING BOND OF 1958 KNOW ALL MEN By THESE PRESENTS that the Village 'of Brooklyn Center, Hennepin County, Minnesota, acknowledges itself to be indebted and for value received hereby promises to pay to bearer out of Improvement No. 1956 -B Fund the sum Of ONE THOUSAND DOLLARS on the lst day of January, 19 , and to pay interest thereon at the rate of three and thirty hundredths per cent (3.30 %) per annum from date to February 1, 1958 and four and fifty hundredths per cent (4.50°0 from February 1, 1958 to January 1, 1959 represented by separate sets of interest coupons at the coupon rate of three and thirty hundredths per cent (3 .300 and one and twenty hundredths per cent 1.20% respectively, and three and thirty hundredths per cent (3.3% per annum after January 1, 1959, payable July 1, on the 1st da 1958, and semiannually thereafter Y of January and the on _u and h l.st day of July in each year in accordance with p n3 as the attached interest cou o Y de of the at F presentation and surrender severally become clue. Both principal of and interest on this bond are payable at the main office of Northwestern National Bank of Minneapolis, Minneapolis, Minnesota, �� any coin or currency of the United States of America which at the'de of Payment is legal tender for public and private debts. THIS BOND is one of an issue of bonds in the total principal amount of $200,000, all of like date and tenor except as to maturity, all issued pursuant to and in full conformity with the Constitution and Laws of the State of Minnesota, including Chapter 429,, Minnesota Statutes, as amended, for the purpose of refunding a part of an -2- issue of bonds dated July 1, 1956 entitled Water Improvement Bond of 1956 which bonds were issued for the purpose of defraying the expenses incurred and to be incurred in special improvements of the village, and is payable primarily from special assessments to be levied against property specially benefitted by said improvements but constitutes a general obligation of the village, and to provide moneys for the prompt and full payment of said principal and interest as the same become due the full faith and credit of the village is hereby irrevocably pledged and the village will levy ad valorem taxes if required for such purpose without limitation as to rate or amount. IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions; and things required by the Constitution and Laws of the State of Minnesota to be done, to happen, and to be performed precedent to and in the issuance of this bond have been done, have happened and have been performed in regular and due form, time and manner as required by law; and that this bond together with all other indebtedness of the village outstanding on the date hereof and the date of its actual issuance and delivery does not exceed any constitutional or statutory limitation thereon. IN WITNESS WHEREOF, the Village of Brooklyn Center, Hennepin County, Minnesota, by its Village Council, has 'caused this bond to be signed by the Mayor and the Village Clerk and sealed with the corporate seal of the village and the interest coupons hereto attached to be executed and authenticated by the facsimile signatures of said officers, all as of January 1, 1958• Mayor Village Clerk (.Seal) (Form of Coupon) No. $ On the lst day of January (July), 19 , The Village of Brooklyn Center, Hennepin County, Minnesota, will pay to bearer out of Improvement 1956 -B Fund at the main office of Northwestern National Bank of Minneapolis, Minneapolis, Minnesota, the sum of DOLLARS, being the installment of interest then due on its Water Improvement Refunding Bonds of 1958, dated January 1, 1958, No: Mayor Clerk 4. The Clerk is directed to cause said bonds to be prepared, and the Clerk and Mayor are authorized and directed to execute the same and affix the village seal thereto and to cause the interest coupons to be executed and authenticated by the printed facsimile signatures of said officers. 5. The bonds issued herecqlder shall be ;dyable from Improvement No. 1956 -B Fund heretofore cre0e4, provided t t if any payment of Principal or interest shall become due when theme is not sufficient money in said fund to pay the same, the treasUM shall pay such principal or interest from the general fund of tie village and such fund shall be reimbursed for suet advances out of proceeds of assessments for said improvement when col eted. The estimated collection of special assessments and other revenues pledged for the payment of said bonds will produce at least five percent in excess of the amount needed to meet, when due, the principal and interest payments on the bonds and no ad valorem tax levy shall be made. The Clerk shall deliver a certified copy of this resolution to the County Auditor of Hennepin County and obtain his certificate as required by Section 475.63, Minnesota Statutes. 7• The said bonds when fully executed shall be delivered by the Treasurer to the purchaser thereof upon receipt of the purchase price, and the said purchaser shall not be obligated to see to the proper `application thereof. 8 The Clerk and Treasurer are authorized and directed to preraze and furnish to the purchaser and to the attorneys approving said is>>ae, certified copies of all proceedings and records relating to the ;.ssl.4ance of said bonds and to the right, power and authority of the village and its officers to issue the same and said certified copies and certificates shall be deemed the representations of the village as to all matters stated therein. The motion for the adoption of the foregoing resolution was duly seconded by Member Wayne Gageby, and upon vote being taken thereon the followinEZ voted in favor thereof William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and A. R. Jones, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Carl Carlson that the following licenses be approved upon the recommendation of the Building Tnspector and E. C. Peterson: Heating License Mill City Heating & Air Conditioning Co. 13005 County Road 6, Mpls., Min.;., Scavenger License AAA Scavenger Co. 8100 Pillsbury Ave. So., Mpls , Minn. Motion carried. Motion made by Russ Jones and seconded by Wayne Gageby that the Village Council accept the November Justice Report of Raymond Benson. Motion carried. Motion made by Russ Jones and seconded by Clifford Wellman that the Village Council accept the final plat of Joe Miller entitled "Northbrook Manor "; subject to all restrictions of the platting ordinance and bond to be posted. Motion carried. Motion made by Wayne Gageby and seconded by Carl Carlson that the Village Council: purchase the property for the Village Well site frcd Garden City Development Co. in the amount of Motion carried. Motion made by Carl Carlson and second�edAy Clifford Well.man'that the Village Council enter into a lease with the University of Minnesota for the property located at 59th Avenue North and Humbq t for skating rink site. Motion carried. Upon the recommendation} of the Village Engineer, motion was made Wayne Gageby and seconded by Clifford Wellman that the Village accept the following deeds for street purposes: property of Industrial Center, 3bc., - Tracts "F" and "a ", Registered Land Survey No. 546; and the property of Justin V. Smith - that part of Tract "q," Registered Land Survey No. 546 lying, Northerly -of the extension of the Southerly line of Tract "B ". Motion carried. Motion made by Clifford Wellman and seconded by Carl Carlson to authorize the Village Attorney to preparo an ordinance relative to unclaimed ..4- _ocperty coming into possession of the Village. Motion carried. Upon the reccmmendation of the Village Engineer, motion was made by Clifford Wellman and seconded by Carl Carlson to release the street bonds on Sandahl's Addition and Oak Hill 3rd Addition. Motion carried. Motion made by Clifford Wellman and seconded by Russ Jones that the Village Council authorize the Village Attorney to attend the hearing before the Coumssioner of Taxation, Friday, December 13, 1957 and submit the information presently known to the Council relative to the petition to declare as exempt from taxes part of the Earle Brown farm. Motion carried. Motion made by Carl Carlson and seconded by Wayne Gageby that the Village Council hire David Lindgren as police officer as of January 1, 1958 or as soon thereafter as the transfer can be made. The salary for this position is $325. a month. Motion carried. The bills set forth on the schedule attached to these minutes and made a part hereof entitled "The Bills Audited and Paid at the Meeting of December 10, 1957'' were audited and ordered paid.
