HomeMy WebLinkAbout1957 12-30 CCM Special Session > Minutes of the proceeding of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota, including all accounts audited by said Council December 30, 1957 The Village Council met in special session and was called to order by William N. Super, Mayor, at 8:30 P.M. Roll Call: William N. Super, Carl Carlson, Clifford Wellman, Wayne Gageby and Russ Jones were present. Motion made by Wayne Gageby and seconded by Carl Carlson that the follow- ing minutes be approved as recorded: Special meeting of December 4, 1957, Canvass Board Meeting of December 4, 1957, and special meeting of December 17, 1957• The regular meeting of December 10, 1957 was approved as corrected. Motion carried. The Mayor announced that the Council was met to receive, open and con- sider bids for communication type monitoring receivers. An affidavit was presented showing publication of advertisement for bids in accordance with law and ordered placed on file. The sealed bids which had been received were than presented. These were opened, examined, and found to be as follows National Electronics Co. 40 receivers $2,254.00 Electronic Communications Service Co.40 receivers $2,540.00 Lew Bonn Co. 40 receivers $2,548.00 General Electric Co. 40 receivers $4,384.00 Alternate Bid General Electric Co. 40 receivers $3,820.00 Member Russ Jones introduced the following resolution and moved its adop- tion: RESOLUTION TABLING FURTHER ACTION ON BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Centers Minnesota, that further action on the bids received for communication type monitoring receivers be tabled for further study. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Wayne Gageby and seconded by Carl Carlson that the Village Council authorize the Civil Defense to erect a portable boat house to house the Sheriff's trailer, boat and motor. Money is to come from the Liquor Store. Donald Fraser is to draw up the proper agreement. Motion carried. Motion made by Clifford Wellman and seconded by Carl Carlson that the Village AAdministrator, Harold Hannay, and the Fire Chief check into the possibility of obtaining rescue equipment and report to the Village Council. Motion carried. Motion made by Russ Jones and seconded by Clifford Wellman that the Villag< Council accept the justice report of John Wingard for the month of November. Motion. carried. Member Russ Jones introduced the following resolution and moved its adoption: RESOLUTION SUBSTITUTING DALE CURRY IN PLACE OF KERMIT KALLEBERG FOR PURPOSES OF HANDLING INVESTMENT SECURITIES BE IT RESOLVED BY VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER AS FOLLOWS: 1. The resolutions heretofore adopted by the Village Council on September 10, 1957 authorizing Kermit Kalleberg as Village Accountant to carry out the in- structions of the Mayor and Clerk with respect to the sale, exchange, delivery or other disposition of securi- ties which may be purchased from time to time and deposi- ted with the Northwestern National Bank of Minneapolis, such resolutions further authorizing Kermit Kalleberg as Village Accountant to be the agent of the committee consisting of the Mayor.. Clerk and Village Accountant, are hereby supplemented and amended so as to re- instate the tame of Dale Curry and to strike the name of Kermit Kalleberg in his capacity as the new accountant for the Village of Brooklyn Center. 2. A copy of this resolution may be certified to the Northwestern National Bank of Minneapolis if necessary. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted,in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted agains the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Carl Carlson and seconded by Wayne Gageby that the Village Council appoint Walter Johnson as Assistant Building Inspector at the salary of $425.00 per month. Motion carried. Member Russ Jones introduced the following ordinance and moved its adop- tion: AN ORDINANCE APMING SECTION 7 -102 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS: 1. Section 7 -102 of the Village Ordinances is hereby amended to read as follows: Section 7 -102 THE CARE OF GARBAGE AND RUBBISH. It shall be the duty of every householder or occupant of any dwelling house, boarding house, restaurant or any place of business to provide for the disposal of all garbage or rubbish accumulated upon property owned or occupied by him or them in a sanitary manner approved b the Local rd of Health b burni : Boa � Y �f pP Y burial, feeding, or providing for its removal; provided, however, that it shall be unlawful to burn garbage or other organic material except within-a dwelling or other building. Persons desiring to make use of the services of a licensed garbage and rubbish collector for the purposes of removing such garbage and rubbish may do so by notifying such col - lector, paying the fee provided for herein, and providing himself or themselves with one or more tight metal cans sufficient to receive all garbage which may accumulate between the times of collection. All persons making use of the services of the licensed garbage and rubbish collector shall place all garbage and rubbish accumulated upon property owned or occupied by him or them in said cans, each of which shall be provided with a bail or handles and a tight fitting cover. All such cans shall, be so placed as to be readily accessible forxamoving and emptying the garbage and rubbish therefrom by the collectors, and where they will not be a public nuisance or in any manner or degree offensive. Each con - tainer shall be kept as clean as is reasonably possible at all times. The Local Board of Health shall be the judge of the sufficiency and location of said garbage and rubbish cans or receptacles. 2. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Wayne Gageby, and upon vote being taken thereon the following voted in favor there - of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Member Wayne Gageby introduced the following ordinance and moved its adoption: AN ORDINANCE AMENDING SECTION 3 -807 AS AMENDED OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS: 1, Section 3 -807 of the Village Ordinances as amended by an ordinance adopted February 28, 1956, is further amended to read as follows: -3- Sections 807 CONSTRUCTION RBQUI Wom. No certificate of construction shall be issued unless the electric light, power and heating installations are in strict conformity with the Provisions of this ordinance, the statutes of the State of Minne. sota and the rules and regulations issued by the Railroad and Warehouse Commission of Minnesota under authority of the state statutes, and unless they are in conformity with the most approved methods of construction for safety to life and property. The code for electrical construction which is entitled "ELECTRICAL ORDINANCE CITY OF MINNEAPOLIS 1955 "as published and promulgated in pam- phlet form is hereby adopted together with all amendments there - to duly adopted and published by the City of Minneapolis as of December 30, 1957 insofar as the same relates to the construction requirements which are set forth therein, three copies of which shall be kept on file in the office of the Village Clerk. All electrical construction performed in the village shall, in addi- tion to the foregoing requirements, comply with the provisions of said code. 2. This ordinance shall take effect from and after its publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl. Carlson, and upon vote being taken thereon the following voted in favor there- of: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Russ Jones and seconded by Clifford Wellman that the Vi11ag Council delegate the record keeping of the Village payroll to the Village Account- ant subject to the control and supervision of the Village Treasurer. Motion carried Member Carl Carlson introduced the following ordinance and moved its adoption: AN ORDINANCE PROVIDING FOR THE DISPOSAL OF ABANDONED PROPERTY HELD BY THE VILLAGE THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDA: 1. A new chapter shall be added to the ordinances of the village to read as follows: Section 2 -101. DISPOSAL OF PROPERTY. Any personal pro- i perty other than animals or perishable property in the custody or possession of the Village of Brooklyn Center which has been abandoned by the owner thereof or for which no owner has been found may be disposed of after said property has been so held by the Village for a period of at least six months as herein- after provided. Sedlon 2 -102. NOTICE OF SALE. After the expiration of said six month period, a notice for the sale of said property at public auction shall be published at leasttwice in the official newspaper of the village, the last publication being made not less than four days before the time of the proposed sale. Said notice shall state the time and place of said proposed sale, shall list the property to be sold and shall state that said property will be sold to the highest bidder. Section 103 CONDUCT OF SALE. Said sale may be. conducted by the clerk or by any other authorized employee of the village but no property shall be delivered to the highest bidder until a payment in cash has been received therefor or If payment is made by check, until such check has been paid In full by the bank upon which it is drawn. All monies re- ceived from such sale shall be deposited in the general fund but shall be held for a period of six months from the date of such sale subject to the right of the former owner to receive payment of the sale price upon application and satis- factory proof of ownership within the six Month period follorf- ing said sale. 1 _h_ z r. a Section 2 -104 TERMS OF SALE. The village shall not be liable in any manner for the condition of any such pro- perty which is sold, and no warranty, express or implied, is authorized in connection with any such sale, 2. This ordinance shall take effect from and after its publication. 1 The motion for the adoption of the foregoing ordinance was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones; and the following voted against the same: None. Whereupon said resolution was declared duly passed and adopted. Motion made by Clifford Wellman and seconded by Carl Carlson that the Village Council accept the deed from Garden City Land Company for wen site in the vicinity of 63rd Avenue North and Osseo Road; subject to review of the Village Attorney. Payment for this transfer in the sum, of $1500 to Garden City Land Com- pany is authorized in accordance with the prior agreement to purchase said property Motion carried. The bills set forth on the schedule attached to these minutes and made a 1 part hereof entitled "The Bills Audited and Ordered Paid at the meeting of December 10, 1957" were audited and ordered paid. Motion made by Clifford Wellman and seconded by Wayne Gageby to adjourn.
