SUBJECT: Brutger Amendment
One of the requirements we (the City) placed upon the Brutger Company
relative to the condominium building was the right of first refusal on the pa rt
of the Association to purchase any units being sold. At that time, I indicated
to you that a problem might arise with our ability to get FHA /GI approval of the
building because such clauses are in conflict with their policies.
It was our intent to allow the residents of Brookwood the opportunity
to ensure the continuity of the project as an elderly project. The burden was still
placed upon the resident to enforce the 55 and older rule. However, without FHA /GI
approval, the units would be almost impossible to sell now or in the future. This
would not be in the interest of any of the parties involved.
The Association can adopt a 55 and older policy and review sales under
their own adopted rules and regulations. With permanent signage indicating a project
dedicated to the elderly and such rules adopted by the Association, I believe we
achieve the same result.
I strongly recommend the HRA pass the resolution amending the Brutger
Contract. Such action would allow the removal of the right of first refusal from
the Association documents filed with the title.
