-The HPA convened the public hearing on February 28, 1983 and continued the
hearing to this evening.

6. Approval of Contract for Administrative Services between the Metropolitan
Council and the Brooklyn Center Housing and Redevelopment Authority
-Under this agreement the Metropolitan Council would provide administrative
services for the City's Housing Rehabilitation Program.
7. Resolution Approving One Housing Rehabilitation Grant

SUBJECT: HRA and Council Resolutions related to Senior Housing
The Council (HRA) has five (5) resolutions carried over from their last
meeting. Since the resolutions are directly related to establishing a
tax increment district and because they set for the transfer of land to
the Brutger Company, I am recommending that they again be tabled until
the meeting of March 28. I feel that it is improtant that the Council
have before them the developers agreement and that the whole thing be
handled at one time.
At this time, there is but one (1) item to be clarified in the contract
and hopefully it will be resolved by our next meeting.

RE: HRA Grant Application
The following grant application is recommended for HRA approval. The information
contained in this memo is private and not available to the general public.
A. Eric & Mary Johnson, 5434 Camden Avenue. The following work is
recommended:
1. Repair front door frame and weatherstrip.
2. Repair rear door frame. Replace rear door, and weatherstrip.
(Owner to perform his own painting or finishing door).
3. Replace bathroom window and frame. (Reuse existing aluminum
storm and screen) (Owner to paint or finish new window).
4. Repair and adjust all windows to operate properly. Replace
balance waights and ropes as needed.
5. Replace all broken window panes and reglaze all windows
as needed.
6. Install hand rails to 2nd floor.
7. Repair bathroom wall around tub. Install vinyl tub surround.
S. Patch and repair all cracked and loose plaster on walls
and ceilings, both floors. (Owner to repaint or finish
all walls and ceilings)..
9. Insulate rim joist.
10. insulate walls (blown in cellulose, fibre glass, or mineral
wool for best application).
11. Reroof dwelling. Remove all existing shingles. Replace any
rotting roof boards (sheathing) as needed. Replace roof
jacks on vent stacks and flask as needed to prevent leaking.
12. Install 3 roof vents.

13. Replace gravity furnace with forced air type. Re -duct as
needed or as practical proper performance.
14. Repair plumbing leak in bathroom sink and correct plumbing
waste vents to code.
Alternates: #1 - Ceramic tile full height around tub in lieu of vinyl surround.
#2 - Additional cost to reroof detached garage.
#3 - Additional cost to insulate roof. This cost can only be
determined at time of reroofing dwelling when rafters are
accessible for viewing.

WHEREAS, the Authority desires to establish a housing development project
pursuant to ?Minnesota Statutes, Section 462.466 having boundaries generally
described as follows:

Authority pursuant to the Minnesota Municipal Housuig and

Commissioners "the governing body ") of the Authority of the housing development
plan for the project area involved in such undertaking is required by the local
governing body before it will consider for approval said housing development plan;
and
WHEREAS, there was presented to this meeting of the governing body of the
authority for its consideration and approval, a copy of a housing. development plan _
for said project area dated February 28, 1983 which plan is entitled Brooklyn
Center Housing Development Project Plan; and
WHEREAS, the said Brooklyn Center Housing and Development Project Plan
dated February Y
is 28 1983 has been duly transmitted by this Authority on February
17, 1983 to the planning agency of the municipality in which tt`le areas t o be
developed are situated; namely, the City Planning Commission of the City of
Brooklyn Center for its study, and request was made by said Authority to said
Planning Commission for its written opinion of the said Plan, and said Planning
Commission at a regular meeting subsequent to the public hearing will give the

Authority its written opinion of said Plnn and its findings as to compliance with the
General Plan of the City of Brooklyn Center.
NOW, THEREFORE, 13E IT RESOLVED by the governing body of the Housing
and Redevelopment Authority in and for the City of Brooklyn Center:
I. That the housing development project area described in said Brooklyn
Center Housing Development Project Plan dated February 28, 1983 will provide
housing for persons of moderate income and their families- as defined in the
Minnesota Municipal Housing and Redevelopment Act, Minnesota Statutes Section
462.421, Subdivision 25, and requires public assistance in order to provide, decent,
safe, and sanitary urban dwellings, apartments, or other living accommodations for
persons of low income as defined in Minnesota Statutes Section 462.421,
Subdivision 12 and the U.S. Housing Act of 1949.
2. The said Housing Development Plan and Project will carry out the
purpose and policy of the Municipal Housing and Redevelopment Act of the State
of Minnesota, M innesota Statutes Section 462.415 to 462.711 as set forth in
Section 462.415 and in the Congressional Declaration of National Housing Policy
contained in the Act of 1949 as amended.
3. The said Housing and Development Plan is hereby in all respects
approved and the Secretary is hereby directed to file said Housing and
Redevelopment Plan with the Minutes of this meeting.'
4. Application is hereby made to the City Council of the City of
Brooklyn Center, the governing body of the municipality in which said project- i!z
located, for the approval of Said Plan and project area, and the staff of this
Authority to transmit said Plan to said City Council, together with a copy. of this
Resolution, a plan for financing the project and to take such other action as he, the
Said staff may deem necessary and advisable in order to secure from said City
Council its approval of said Plan and projects. Said City Council is hereby
requested to hold a public hearing on said Brooklyn Center Housing Development
Plan after giving published notice of the date, time, place and purpose of such
hearing in a newspaper of general circulation in the City of Brooklyn Center, such
notice to be published at least ten days and no more than 30 days prior to the date
of the hearing.
Said City Council is hereby requested to approve said Plan and projects and
to find by Resolution that: (1) the land in the project area would not be made
available for redevelopment without the financial aid to be sought; (2) the housing
development plan for the housing development project area in the locality will
afford maximum opportunity, consistent with the sound needs of the locality as a
whole, for the development of such areas by private enterprise; and (3) the housing
development plan conforms to a general plan for the development of the locality as
a whole, and further to find by resolution that (i) the said Plan will afford
maximum opportunity, consistent with sound needs of the locality as a whole, for
redevelopment by private enterprise; and (ii) the Housing Development Plan
conforms to a general plan for the locality as a whole.
Said staff is hereby authorized and directed to transmit to the State
Department of Energy Planning and Development Office of Local Government

certified copies of this Resolution, of said PIan, and other papers and documents
described or referred to in Minnesota Statutes Section 462.445, Subdivision 8 of
said Municipal Housing and Redevelopment Act.

A RESOLUTION APPROVING TIIE DISPOSITION OF
PROPERTY BY TIIE BROOKLYN CENTER HOUSING
AND REDEVELOPMENT AUTHORITY.
WHEREAS, the Brooklyn Center housing and Redevelopment Authority (the
"Authority ") owns land it acquired with the approval of the governing body of the
City of Brooklyn Center, Minnesota (the "City Council ") in accordance with
Minnesota. Statutes Section 462.466; and
WHEREAS, the Authority desires to dispose of this property to private
enterprise in order to facilitate the establishment and creation of a housing
development project; and
WHEREAS, the Authority has published a notice on February 17, 1983 of the
public hearing in a newspaper of local circulation for the purpose of disposing of
said property in accordance with Minnesota Statutes Section 462.525; and
WHEREAS, the property to be disposed of by the Authority is described as
follows:
Beginning at a point formed by the intersection of the easterly right -
of -way line of Humboldt Avenue and the southerly right -of -way line
of North Lilac Drive; thence northeasterly along said southerly right -
of -way line of North Lilac Drive, to its intersection with the easterly
right -of -way line of Fremont Avenue; thence northerly along said
easterly right -of -way line of Fremont Avenue to its intersection with
the southerly right -oi -way line of North Lilac- Drive and continuing
northeasterly along said southerly right -of -way line of North Lilac
Drive to its intersection with the westerly right -of -way line of
Dupont Avenue; thence North along said westerly right -of -way line of.
Dupont Avenue to its intersection with the southerly right -of -way of
U.S. Interstate 94; thence westerly along said southerly right -of -way

and Redevelopment Authority in and for the City of Brooklyn Center:
That the property generally described in this resolution and legally described
in the Authority Tax Increment Financing Plan for the Brutger Proposal, dated
February 28, 1983, be disposed of to the Brutger Companies Inc., a private
enterprise, in order to facilitate the establishment and creation of a housing and
development project as defi,ied in Minnesota Statutes Section 462.466 and help to
alleviate a shortage of decent, safe and sanitary housing for persons of low and
moderate income.
Adopted by the Board of Commissioners of the Authority this 28th day of
February, 1983.

BETWEEN THE METROPOLITAN COUNCIL AND THE
BROOKLYN CENTER HOUSING AND REDEVELOPMENT AUTHORITY

THIS AGREEMENT is made and entered into as of this lst day of
January, 1933, by and between the Metropolitan Council, herein
called the "Council ", and the City of Brooklyn Center Housing and
Redevelopment Authority, herein called the "City ".
WITNESSETH:
WHEREAS, the City desires to assist low and moderate income
homeowners in making repairs to their homes for the purpose of
correcting defects directly affecting the safety, habitability,
energy usage, or accessibility of the property;

WHEREAS, the City has received a certain Community Development
Block Grant, herein called the "HUD Home Improvement Grant ", from
the United States Department of Housing and Urban Development;
WHEREAS, the Council has been duly organized pursuant to Minn.
Stat., Section 473.123 and has all the power and duties of a
housing and redevelopment authority pursuant to Minn. Stat.,
Section 473.193 under the provisions of the Municipal Housing and
Redevelopment Act, Minn. Stat., Sections 462.411 to 462.711; and
WHEREAS, the City desires to purchase certain necessary administrative
services from the Council in connection with the implementation
and administration of the HUD Horne Improvement Grant:
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the parties agree as follows:
I. SCOPE OF SERVICES.
The City hereby agrees to engage tha Council, and the Council
hereby agrees to do, perform, and carry out in a satisfactory and
proper manner, on behalf of the City in connection with the
administration of the HUD Home Improvement Grant, those certain
administrative services detailed in Appendix A, which is attached
hereto and.made a part hereof.
II. COMPENSATION.
2.01 The City shall compensate the Council for services performed
by the Council under this contract.
2.02 Method of Payment
A. Beginning March 31, 1983, and within ten days following
the end of each three month period of performance of
this contract thereafter, the Council shall submit to
the City a quarteriy progress report describing and
discussing the contract work completed to date.
B. On the City's verification and acceptance of the progress
report, the City shall pay the Council $480.00 per
grant. The City agrees to make such payments quarterly.
III. GENERAL PROVISIONS
3.01 Term of Agreement
The services to be purchased and furnished under this contract
shall commence on January 1,.1983, and shall continue through
December 31, 1983.
3.02 Termination of Contract
The Council and the City shall each have the right to terminate
this contract at any time and for any reason by submitting
written notice of termination to the other party at least
ten (10) days prior to the specified effective date of such
termination. If the contract is terminated or cancelled
pursuant to this provision, the City shall provide payment
to thee Council for all expenses incurred and services performed_
to the date of germination.
3.03 Amendments
The terms of the contract may be amended, changed or modified
by mutual agreement of the parties hereto. Such amendments,
changes or.modifications shall be effective only on the
execution of written amendment(s) signed by the Council and
the City.
3.04 Audits and Inspection {
The Council agrees to:
(1) keep and maintain during the performance of this contract,
and for a period of three _years following, records and
files relating to
(a) the final financial aspects of this contract
including payrolls, time records, invoices, receipts,

vouchers, and
(b) the services performed hereunder; and
(2) allow City or other authorized personnel to enter on
the Council's premises and to inspect, audit,'and copy
the above records and files

3.05 Assignability

The Council shall neither assign nor transfer any rights or
obligations under this contract without the prior written
consent of the City.
3.06 Equal Employment Opportunity: Affirmative Action
The Council agrees not to discriminate against any employee
or applicant for employment because of race, color, religion,
sex, or national origin, and to take affirmative action to

assure that applicants and employees are t reat equally

with respect to the following: employment, upgrading,

transfer, recruitment, la ,

of Fay, and other forms of compersation and selection for
training. The Council further agrees to comply with any and
federal, state, local laws � all f regarding equal employment g

3.07 Construction and Severability of Contract Provisions
The City and the Council agree that no provision of or
performance under this contract shall be interpreted or
applied in a manner which violates applicable federal or
state statutes, rules, or regulations, including without
limitation these provisions governing the implementation and
administration of the HUD Home Improvement Grant. If any
'term or provision of this contract is determined to be
invalid, the remaining terms and provisions shall remain in
full force and effect and they shall be interpreted, performed,
and enforced as if said invalid provision did not appear
herein..
IN WITNESS WHEREOF, the parties hereto have caused this contract
to be executed by their duly authorized representatives effective

APPENDIX A ,
The administrative services to be performed by the Metropolitan
Council HPA staff for the Brooklyn Center HFtA Home Rehabilitation
Grant Program are as follows: r
1. Initial Screening of Applicants
a. Answer telephone and in- person inquiries from
residents as to eligibility for the program;
b. Assist applicants in filling out required forms
and verify information as' necessary with outside
sources to determine eligibility.
2. Selection of Applicants f
a. Coordinate inspection of property with City inspec-
tion department to determine repairs needed and
record information on proper forms.
b. Assist City staff in determining initial ranking
of applicants for approval by City,
c:. Inform applicants of approval or disapproval.
3. Coordination of Rehabilitation ,
a. Assist selected homeowners to obtain a minimum of
two bids for the approved repairs and to obtain
contractor warranties, and to ,obtain from selected
homeowners a signed repayment agreement from home-
owner.
b. Notify homeowner and selected contractor(s), after
• review of bids and authorization from City staff
to' proceed working.
c. Prepare amendments to scope of work as necessary
during the process and request authorization from
City staff before notifying homeowner and contractor
of changes to scope of work.
d. Notify City staff as contractor completes rehabili-
tation (either partial or final) and recommend pay-
ment for work completed.
e. Record repayment agreement with County Recorder
after work completed.
f Maintain complete files or required documents for
City from initial application through completion
of rehabilitation on all applicants.
