Super, Mayor, at 8:08 P.M. Roll Call: William N. Super, Clifford Wellman, Carl Carlson, Wayne Gageby, and Russ Jones were present. Motion made by Wayne Gageby and seconded by Carl Carlson to approve the minutes of the special meeting of June 4 and regular meeting of June 11, 1957. Minutes were approved as recorded. Motion carried. The Mayor announced that the Council was met to receive, open, and consider bids for Water Main and Sanitary Sewer Improvement Projects No.'s 1957 -21, 1957-22, 1957 -23, 1957.24, 1957 -26, 1957 -27, and 1957-29• An affidavit was presented showing publication of advertisement for bids in accordance with law and ordered placed on file. The sealed bids which had been received were then presented. The motion for the adoption of the foregoing resolution was duly seconded by member --- .Russ Jones, and upon vote being taken thereon, the following voted in favor thereof: - William N. The motion for the adoption of the foregoing resolution was duly seconded by member Wayne Gageby and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. T MMME, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. This proposed improvement shall be designated Storm Sewer Improvement No. 1957 -36• The motion for the adoption of the foregoing resolution was duly seconded by !ember Russ Jones, and upon vote being taken thereon the following voted in favor thereof: William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of pro- posed ail Stabilizing Improvement No. 1957 -35• The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official news - paper, the last publication being on June 13th, 1957, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Wayne Gageby introduced the following resolution and moved its adoption: RESOU)TION ORDERING WORK DONE BY DAY LABOR BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. Said work will be undertaken by day labor and the records of cost will be kept as Pro Y pro vided b law and such wor k is to be pe r- formed according to the specifications heretofore established by the Engineering Department for such work. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof.* William N. Super, Clifford Wellman, Wayne Gageby, Carl Carlson, and Russ Jones; and the following voted against the same; None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Wayne Gageby that the Village Council accept the petition of Mrs. G.E. Morfitt recognizing the distraction of the property-located at 5254 wing Avenue North. The Village Attorney was authorized to check into the matter. Mot *4 carried. Motion by Wayne GWIW and seconded by Clifford Wellman that the Village Council issue a bowling alley license to Russell Gilbertson for Beacon Bowl until eptenber 15, 1957, contingent upon post;it performance bond in the amount of $500 to complete the following requisites of the Village Council: A. Complete parkin bumper from East end cf bowling alley to proposed 5th Street on the South line of Tract-W. _5.. B. Registered Land Survey to be filed immediately with the County Register of Deeds. C. Revise plan on Tract "A" to designate exact parking area and plan of car parking on the working building plans, and same to be delivered to Village office. D. Have Tract "A" free and clear of all materials and obstacles by September 15, 1957• E. Subject to final inspection of the bowling alley building Immediately and.an inspection of the premises on September 151. 1957 to see if all the foregoing requisites have been fulfilled, and if not, the $5o0 bond will be automatically forfeited an d license revoked. The Village of Brooklyn Center shall forthwith issue its negotiable coupon Certificates of Indebtedness in the principal amount of $22,000, said certificates of indebtedness to be dated July 1, 1957) to be 22 in number and numbered l to 22 both Inclusive, in the denomination of $1000 each, all bearing interest at the rate of 3.75% per annum., payable July 1, 1958, and semiannually thereafter on the lst day of January and the lst day of July in each year, which certificates of indebtedness shall mature serially: in order of serial numbers, on January let in the years and amounts as follows, all with- out option of prior payment: $3000 in the year 1959 $4000 in the Year 1960, $5000 in each of the years 1961, 1962 and 1963. 2. This certificate of indebtedness is one of an issue in the total principal amount of $22,000, all of like date and tenor ex- cept as to maturity, issued by the village pursuant ta the Constitu- tion and Laws of the State of Minnesota, including Section 412.301, Minnesota Statutes, for the purpose of financing the purchase of certain street construction, maintenance, fire and police equipment. IT is HEREBY CERTIFIEm AND RECITED That all acts, conditions and things required by the Constitution and Laws of the State of Minnesota to be done, to happen, to exist, and to be performed pre - cedent to and in the issuance of this certificate of indebtedness f have been done, have happened, do exist and have been performed in regular and due form, time and manner as required by law and that this certificate of indebtedness together with all other indebted- ness of the village outstanding on the date hereof and the date of its actual issuance and delivery does not exceed any constitutional or statutory limitation thereon. The certificates of indebtedness shall be prepared under the direction of the village clerk and shall be executed on behalf -8- of the village by the signature of the mayor and attested by the village clerk and the corporate seal of said village shall be affixed to each thereof, and the interest coupons shall be execU- ted and authenticated by the facsimile signature of said officers. When said certificates of indebtedness have been so executed tbay shall be delivered by the village treasurer to the purchaser there- of upon receipt of the purchase price heretofore agreed upon and the purchaser shall not be obligated to see to the proper application thereof. 5. There shall be paid into the certificate of indebtedness sinking fund all monies for said certificates of indebtedness which shall be held by the village treasurer and used for no other pur- pose than to pay principal of and interest on said certificates of indebtedness, provided that if any payment of principal or interest shall become due when there is riot sufficient money in said fund to pay the same, the treasurer shall pay such principal or interest from the general fund of the village and said general fund shall be reimbursed for such advances out of the proceeds of taxes levied pursuant hereto or other monies appropriated by the village council for such purpose. Into said sinking fund shall be paid all proceeds of the taxes levied pursuant to this resolution and such other monies as may be received by the village for the purpose of or appropriated to the payment of said certificates of indebtedness and interest. 6. There is hereby levied upon all the taxable property in the village a direct annual ad valorem tax which shall be spread upon the tax rolls and collected with and as a part of other gen- eral taxes of the village, which tax is to be for the years and in amounts as follows: Year v 1957 $4400. 1958 4900. 1959 5800. 196 500. Each of said levies shall be irrepealable, provided that the village reserves the right to reduce said levies in the manner and to the extent permitted by law. 7. The village clerk is hereby authorized and directed to file with the County Auditor of Hennepin County, Minnesota, a certified copy of this resolution together with such other in- formation as the County Auditor may require, and to obtain from the County Auditor a certificate that such tax has been levied and the certificates of indebtedness entered upon his bond register. f 8.
